MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON February 9, 2015 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 9th day of February, 2015. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 8, 2015. APPROVAL OF MINUTES- None GREETINGS TO PUBLIC Mayor Conley made the following comments: EMPLOYEE OF THE MONTH: The Employee of the Month for February is James Blair of the Madison Fire Department. Firefighter Blair assisted a resident whose home was flooded when a hot water valve broke, flooding both the kitchen and basement. His assistance in shutting off the water as well as completing the clean up was greatly appreciated. Mayor Conley asked for a motion regarding the resolutions to appoint of new Police Officers. Mr. Catalanello moved adoption of the Resolution R 62-2015 through R 66-2015, listed below. Ms. Baillie seconded the motion. MORALES, TO THE POSITION OF POLICE OFFICER WHEREAS, the Madison Borough Chief of Police Darren Dachisen has recommended that Julian A. Morales be appointed to the position of Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Julian A. Morales to the position of Police Officer in the Madison Police Department; and WHEREAS, the Chief Financial Officer has certified that adequate funds for this purpose are contained in the 2015 temporary budget for the Police Department (Account 240). R 63-2015 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING JOSEPH DIROCCO, TO THE POSITION OF POLICE OFFICER WHEREAS, the Madison Borough Chief of Police Darren Dachisen has recommended that Joseph DiRocco be appointed to the position of Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Joseph DiRocco to the position of Police Officer in the Madison Police Department; and WHEREAS, the Chief Financial Officer has certified that adequate funds for this purpose are contained in the 2015 temporary budget for the Police Department (Account 240). R 64-2016 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING, KEVIN MARHEFKA, TO THE POSITION OF POLICE OFFICER WHEREAS, the Madison Borough Chief of Police Darren Dachisen has recommended that Kevin Marhefka be appointed to the position of Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Kevin Marhefka to the position of Police Officer in the Madison Police Department; and WHEREAS, the Chief Financial Officer has certified that adequate funds for this purpose are contained in the 2015 temporary budget for the Police Department (Account 240). R 65-2015 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING SPIRO MILONAS TO THE POSITION OF POLICE OFFICER WHEREAS, the Madison Borough Chief of Police Darren Dachisen has recommended that Spiro Milonas be appointed to the position of Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Spiro Milonas to the position of Police Officer in the Madison Police Department; and WHEREAS, the Chief Financial Officer has certified that adequate funds for this purpose are contained in the 2015 temporary budget for the Police Department (Account 240). NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Spiro Milonas is hereby appointed to the position of Police Officer in the Madison Police Department effective immediately, to be compensated in accordance with the Police Benevolent Association Collective Bargaining Agreement. R 66-2015 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING PATRICK STRAFACI TO THE POSITION OF POLICE OFFICER WHEREAS, the Madison Borough Chief of Police Darren Dachisen has recommended that Patrick Strafaci be appointed to the position of Police Officer in the Madison Police Department; and WHEREAS, the Madison Borough Council, after due consideration, has determined to appoint Patrick Strafaci to the position of Police Officer in the Madison Police Department; and WHEREAS, the Chief Financial Officer has certified that adequate funds for this purpose are contained in the 2015 temporary budget for the Police Department (Account 240). NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Patrick Strafaci is hereby appointed to the position of Police Officer in the Madison Police Department effective immediately, to be compensated in accordance with the Police Benevolent Association Collective Bargaining Agreement. REPORTS OF COMMITTEES Community Affairs Ms. Baillie, Chair of the Committee, made the following comments: The Downtown Development Commission and the Madison Area YMCA are teaming up to host the First Annual Madison Downtown Scavenger Hunt on Saturday, March 21, 2015. The event will support Downtown Madison and benefit the Madison Area YMCA’s Community Mental Health Initiative. The Taste of Madison will be held Monday, March 30, 2015, in partnership with the Chamber of Commerce and the Rotary Club of Madison. Tickets are available at Gary’s Wine and Market Place. Ms. Baillie noted a new fitness class at the Senior Center, to promote senior health, “Not Your Daughter’s Yoga”. Public Safety Mr. Catalanello, Chair of the Committee, made the following comments: Mr. Catalanello congratulated the five recently appointed police officers and reminded resident to clear snow from fire hydrants adjacent to their property, asking residents to ‘adopt’ a hydrant. Utilities Mrs. Vitale, Chair of the Committee, made the following comments: The Water Department reports shutoff of service for customers with frozen pipes, continued water sample analysis, repaired of a 6” main break at 50 Shadylawn Drive, and radio telemetry for the Madison Avenue tank is ordered. The staff also offered assistance to the Road Department with snow plowing and snow removal. Finance and Borough Clerk Mr. Landrigan, Chair of the Committee, made the following comments: Mr. Landrigan noted that the 2015 budget process begins tonight with a proposed budget that includes a 1.5% increase in the municipal tax rate, and meets guidelines from the Strategic Planning Committees. An additional budget hearing is scheduled for February 18th, at 7:00 p.m. Health Mr. Wolkowitz of the Committee made the following comments: Due to the recent measles outbreak, the Health Department encourages residents to speak to their doctor and do their part to help prevent sickness by updating their personal vaccination status. Mr. Wolkowitz noted that the Council and Staff are wearing Red this evening for Women’s’ Heart Health Awareness. Public Works and Engineering Mr. Rowe, Chair of the Committee, made the following comments: Plans and specifications for the Ridgedale Avenue Reconstruction project will be submitted to NJDOT for review this week. The project has received a state grant and is anticipated to be bid this spring for summer construction work. The Mill and Overlay Road Maintenance program is subject to capital funding. It may include repaving of Morris, Danforth, Sherwood, Longview, Court, Parkside, Candlewood, FoxChase or Union. Funding will be discussed for contract work related to signage, striping, curb, sidewalk, potholes and crack sealing. The 2015 capital improvement budget proposals are being assembled and are generally consistent with the five PAGE 5 OF 15 Regular Meeting Minutes – February 9, 2015 year and twenty year plans. A grant funding application will be submitted to the County of Morris for historic preservation of the unoccupied portion of the East Wing of Hartley Dodge Memorial. COMMUNICATIONS AND PETITIONS- None INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Mike Soriano; Woodland Road, stated that the proposed capital spending from the 2015 preliminary capital budget showed $415,000 for the Electric Utility and $315,000 for the Water Utility. These amounts are about the same as the straight line method presented by the Utility Committee. But it is much less than the remaining useful life method which has $1.6 million in annual capital spending for the Electric Utility and $3.2 million in annual capital spending for the Water Utility. Mr. Soriano suggested a process where issues are explicitly addressed and answered. AGENDA DISCUSSIONS 02/09/2015-1 LETTER OF INTENT FOR HDM GRANT APPLICATION TO THE MORRIS COUNTY HISTORIC PRESERVATION TRUST FUND There was no objection to Ms. Baillie’s recommendation for approval of a letter of intent to apply to the Morris County Historic Preservation Trust Fund 2015 Grant Program in connection with renovations to the Hartley Dodge Memorial building. Resolution R 69-2015 listed on Consent Agenda. 02/09/2015-2 OAK COURT PARKING RESTRICTIONS Police Chief Darren Dachisen and Borough Engineer Robert Vogel provided background information regarding a proposed ordinance to regulate parking on a portion of Oak Court, in response to resident concerns regarding the narrow roadway. There was no objection to listing an ordinance for introduction. Ordinance 7-2015 is listed for Introduction. 02/09/2015-3 2015 MUNICIPAL BUDGET DISCUSSION Mayor Conley noted guidelines for tonight’s budget presentation asking each Department head to present 2014 accomplishments and 2015 goals in a short presentation. Mr. Landrigan noted that the proposed budget maintains Borough services and calls for a modest 1.5% increase in municipal taxes. Police Chief Darren Dachisen presented recommendations for a proposed budget for the Police Department noting newly sworn in Police Officers. Chief Dachisen requests two new police vehicles, part-time dispatchers and an increase in the hourly rate for school crossing guards, tied to attendance. Fire Chief Louie DeRosa presented recommendations for the proposed budget for the Fire Department, noting a request for an additional fire fighter, upgrades to turnout gear and replacement of a staff vehicle. Chief DeRosa noted additional volunteer firefighters in 2014. Public Works Superintendent David Maines presented recommendations for the Public Works and PAGE 6 OF 15 Regular Meeting Minutes – February 9, 2015 Water Department, noting additional funds requested for confined space training the purchase of an additional pickup truck, and an asphalt hot box. Borough Engineer Robert Vogel presented a proposed budget for Land Use Services, noting a request for upgrades to software for a resident web portal. Lisa Gulla, Director of the Health Department noted staff turnover in the Health Department and the receipt of a mentoring grant in the amount of $35,000.00. Mrs. Gulla also noted renewal of contracts for health services with Chatham Borough, Chatham Township and Springfield Township. Mayor Conley noted a scheduled budget hearing for Wednesday February 18th at 7:00 p.m. ADVERTISED HEARINGS - None INVITATION FOR DISCUSSION (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. INTRODUCTION OF ORDINANCES The Clerk made the following statement: The ordinance scheduled for introduction and first reading tonight will have a hearing during the meeting of February 23, 2015 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinance 7-2015 for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 7-2015 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 185-29 OF THE BOROUGH CODE ENTITLED ‘VEHICLES AND TRAFFIC’ TO PROHIBIT PARKING ON OAK COURT WHEREAS, upon the recommendation of the Chief of Police, the Borough Council has determined that Chapter 185 of the Madison Borough Code entitled "Vehicles and Traffic" should be amended in order to implement these changes. R 69-2015 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SIGNATURE ON DECLARATION OF INTENT TO APPLY FOR 2015 MORRIS COUNTY HISTORIC PRESERVATION TRUST FUND GRANT WHEREAS, the Borough Administrator has recommended that the Borough authorize the Mayor to submit a Declaration of Intent to apply to the Morris County Historic Preservation Trust Fund 2015 Grant Program in connection with renovations to the Hartley Dodge Memorial building (deadline for submittal of Declaration of Intent is February 27, 2015); and WHEREAS, the Borough Council has determined it is appropriate to authorize the Mayor to sign a Declaration of Intent to the Morris County Historic Preservation Trust Fund 2015 Grant Program in connection with renovations to the Hartley Dodge Memorial building. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris in the State of New Jersey that the Mayor is authorized to sign a Declaration of Intent to submit a Grant Application to the Morris County Historic Preservation Trust Fund 2015 Grant Program in connection with renovations to the Hartley Dodge Memorial building (deadline February 27, 2015). PAGE 10 OF 15 Regular Meeting Minutes – February 9, 2015 R 70-2015 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EDISON ELECTRIC (EEI) MASTER CONTRACT BETWEEN BOROUGH OF MADISON AND BP ENERGY COMPANY WHEREAS, pursuant to prior Council resolution(s) the Borough of Madison entered into Master Power Purchase and Sale Agreements with the following suppliers on the dates indicated: Exelon Generation Company LLC (October 4, 2011) PPL EnergyPlus LLC (October 4, 2011) NextEra Energy Power Marketing, Inc. (October 4, 2011) PSEG Energy Resources & Trade LLC (October 28, 2011) Noble Americas Gas & Power Corp. (October 20, 2011) DTE Energy Trading, Inc. (October 4, 2011) WHEREAS, the Assistant Borough Administrator/Utility Finance Director has recommended that the Council enter into a Master Power Purchase and Sale Agreement with BP Energy Company, and WHEREAS, the Borough desires to extend to its authorized representatives the duty and obligation to execute Transaction Confirmations that secure specific quantities of energy for delivery to the Borough for specific delivery periods at a fixed price, and WHEREAS, pursuant to prior Council authorization, and to facilitate the purchase of wholesale electricity, the Borough entered into the Membership Agreement with PJM Interconnection, LLC and the Master Energy Supply Agreement with American PowerNet Management, Inc. NOW THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris, that the Borough Administrator/Assistant Administrator/Utility Finance Director are authorized to execute a Master Power Purchase and Sale Agreement with BP Electric Company, and to enter into various other Master Power Purchase and Sale Agreements as may be prepared and approved by Betts & Holt LLP, special counsel to the Borough of Madison; and BE IT FURTHER RESOLVED THAT the Council affirms the above- described Master Power Purchase and Sale Agreements with Exelon Generation Company, LLC; PPL EnergyPlus LLC; NextEra Energy Power Marketing, Inc.; PSEG Energy Resources & Trade LLC; Noble Americas Gas & Power Corp.; DTE Energy Trading, Inc.; the Membership Agreement with PJM Interconnection, LLC; and the Master Energy Supply Agreement with American PowerNet and authorizes the continuation of these agreements; and BE IT FURTHER RESOLVED THAT the Council authorizes the Borough Administrator/Assistant Administrator/ Utility Finance Director to enter into binding Transaction Confirmations securing specific blocks of energy at specific delivery periods and prices pursuant to the Master Power Purchase and Sale Agreements. R 71-2015 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CONTRACT EXTENSION FOR THE PREVENTATIVE MAINTENANCE/REPAIR OF HVAC EQUIPMENT BID TO RAMAS CLIMATE & REFRIGERATION, LLC OF LIVINGSTON, NEW JERSEY PAGE 11 OF 15 Regular Meeting Minutes – February 9, 2015 WHEREAS, a contract for electrical services was awarded by Resolution 81- 2014 to Ramas Climate & Refrigeration, LLC, of Livingston, N. J., as a result of public bidding, which contract expires on March 31, 2015; and WHEREAS, the bid specifications allowed for a one-year extension of the contract at the request of the Borough; and WHEREAS, the Qualified Purchasing Agent has recommended that the Borough award an extension for of the contract for preventative maintenance/repair services for an additional one year. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey that a one-year contract extension is hereby authorized to be entered into with Ramas Climate & Refrigeration, LLC, of Livingston, New Jersey, commencing on April 1, 2015 through March 31, 2016, and the Mayor and Borough Clerk are authorized to sign such extension of contract, to be in a form approved by the Borough Attorney. R 72-2015 RESOLUTION OF THE BOROUGH OF MADISON APPROVING TEMPORARY SIGNS FOR BERNARDO SOCCER CAMP WHEREAS, the Bernardo Soccer Camp has requested permission to put up temporary signs advertising a 2015 soccer program sponsored by the Recreation Department ; and WHEREAS, the signs would be located at various intersections approved in advance by the Recreation Director and Zoning Officer, for a maximum of 45 days; and WHEREAS, the Zoning Officer has recommended that a temporary sign permit be issued; and WHEREAS, the Bernardo Soccer Camp will pay rental fees for use of the Borough recreational facilities and provide a discount to Madison youngsters attending the camp. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the request of the Bernard Soccer Camp to put up temporary signs as described herein, is approved. R 73-2015 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING SANDRA EMMERICH TO THE POSITION OF CONFIDENTIAL ASSISTANT II IN THE FINANCE DEPARTMENT WHEREAS, the position of Confidential Assistant II in the Finance Department will be vacated due to a retirement; and PAGE 12 OF 15 Regular Meeting Minutes – February 9, 2015 WHEREAS, the Chief Financial Officer recommends the appointment of Sandra Emmerich to fill the position of Confidential Assistant II in the Finance Department effective February 10, 2015; and WHEREAS, the Council concurs with this recommendation. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey, that Sandra Emmerich is hereby appointed to the position of Confidential Assistant II in the Finance Department effective February 10, 2015; and BE IT FURTHER RESOLVED, that Ms. Emmerich be compensated at the annual salary of $50,000.00. R 74-2015 RESOLUTION OF THE BOROUGH OF MADISON RECOGNIZING THE GOVERNOR’S COUNCIL ON ALCOHOLISM AND DRUG ABUSE FISCAL GRANT CYCLE JULY 2014 TO JUNE 2019 WHEREAS, the Governor’s Council on Alcoholism and Drug Abuse established the Municipal Alliances for the Prevention of Alcoholism and Drug Abuse in 1989 to educate and engage residents, local government and law enforcement officials, schools, nonprofit organizations, the faith community, parents, youth and other allies in efforts to prevent alcoholism and drug abuse in communities throughout New Jersey. WHEREAS, The Borough Council of the Borough of Madison, County of Morris, State of New Jersey recognizes that the abuse of alcohol and drugs is a serious problem in our society amongst persons of all ages; and therefore has an established Municipal Alliance Committee; and, WHEREAS, the Madison Council further recognizes that it is incumbent upon not only public officials but upon the entire community to take action to prevent such abuses in our community; and, WHEREAS, the Madison Council has applied for funding to the Governor’s Council on Alcoholism and Drug Abuse through the County of Morris; NOW, THEREFORE, BE IT RESOLVED by the Borough of Madison, County of Morris, State of New Jersey hereby recognizes the following: 1. The Borough Council does hereby authorize submission of a strategic plan for the Madison Municipal Alliance grant for fiscal year 2015 in the amount of: DEDR $12,419.00 Cash Match $ 3,104.00 In-Kind $ 9,314.00 2. The Borough Council acknowledges the terms and conditions for administering the Municipal Alliance grant, including the administrative compliance and audit requirements. PAGE 13 OF 15 Regular Meeting Minutes – February 9, 2015 R 75-2015 RESOLUTION OF THE BOROUGH OF MADISON REJECTING BID FOR YARD WASTE COLLECTION AND DISPOSAL WHEREAS, the Borough of Madison publicly advertised for bids for Yard Waste Collection and Disposal in accordance with Local Public Contracts Law N.J.S.A. 40A:11-1 et seq.; and WHEREAS, one (1) bid was received and the Borough Attorney determined that the sole bidder was non-responsive; and WHEREAS, the Purchasing Officer has recommended that the bid be rejected since the bid contains a non waivable defect and is hereby authorized pursuant to N.J.S.A.:11-5(3) to negotiate an agreement with a responsible contractor. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the sole bid received on February 4, 2015 for Yard Waste Collection and Disposal is hereby rejected for the reasons set forth herein.
