MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON March 23, 2015 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 23rd day of March, 2015. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 8, 2015. The Pledge of Allegiance was recited by all. APPROVAL OF MINUTES None GREETINGS TO PUBLIC Mayor Conley asked for a moment of silence for the passing of former Chief of the Madison Fire Department, Thomas Kiernan. Chief Kiernan was 81 years old and a lifelong Madison resident. He was a part of the Madison Fire Department family since joining as a Volunteer in December of 1961, when he was discharged from the United States Marine Corp. Chief Kiernan was hired as a career firefighter in June of 1963, promoted to Lieutenant in 1986 and then promoted to Chief of the Fire Department in 1989. He retired in 1991. Mayor Conley announced a Latino Town Hall Meeting scheduled for Saturday, April 11, 2015 at 9:00 a.m., as well as the fund raising event ‘Bowling for Campers’ scheduled for Thursday, March 25th at Plaza Lanes. PROCLAMATIONS: Mayor Conley presented the following Proclamation to resident Jamie Conroy: Proclamation of the B o r o u g h o f M a d i s on Proclaiming AUTISM AWARENESS MONTH APRIL 2015 WHEREAS, autism is a pervasive developmental disorder affecting the social, communication and behavioral skills of those affected by it; and WHEREAS, as more health professionals become proficient in diagnosing autism, more children are being diagnosed on the autism spectrum, resulting in rates as high as 1 in 68 children nationally and 1 in 45 children in New Jersey; and WHEREAS, while there is no cure for autism, it is well documented that if individuals with autism receive treatment early in their lives, it often is possible for those individuals to lead significantly improved lives; and PAGE 2 OF 22 Regular Meeting Minutes – March 23, 2015 WHEREAS, individuals with autism often require a lifetime of specialized and community support services to ensure their health and safety and to support families’ resilience as they manage the psychological and financial burdens autism presents; and WHEREAS, Autism New Jersey, is spearheading an awareness effort in order to educate parents, professionals and the general public about autism and its effects; and WHEREAS, to promote Autism Awareness in the Borough of Madison, the “Light It Up Blue” campaign will decorate Waverly Place in blue lights and Tons of Toys will host a “Puzzle Piece” campaign throughout the month of April; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim April 2015 as National Autism Awareness Month and urge all residents to become better educated on the subject of autism spectrum disorders. _____________________________________ Robert H. Conley, Mayor March 23, 2015 Mayor Conley presented the following Proclamation to Tanya Van Order and Lou Riccio from the Madison Housing Authority: Proclamation of the B o r o u g h o f M a d i s on In Recognition of the th 50 Anniversary of NORWESCAP WHEREAS, since 1965, Northwest NJ Community Action Partnership, Inc. (NORWESCAP) has been providing invaluable and outstanding service to the citizens; and WHEREAS, the quality and character of life in the communities across northwestern New Jersey are reflective of the concerned and dedicated efforts of this organization and individuals who are devoted to the welfare of the community and its citizenry; and WHEREAS, NORWESCAP is one of 23 Community Action Agencies in the state of New Jersey and one of over 1,000 nationwide founded on the common purpose to support low-income households as they develop their abilities to be self-supporting and develop family and community relationships that will sustain self-reliance; and WHEREAS, Community Action was born out of the Equal Opportunity Act of 1964 that was initiated by President John F. Kennedy and brought to fruition by President Lyndon B. Conley, Mayor March 23, 2015 PRESENTATION OF CERTIFICATES: Mayor Conley presented certificates of Achievement to the Madison High School Boys Ice Hockey Team for their historic season, including the Haas Cup Champions, Codey Winter Tournament Champions, most wins in school history and 2nd most wins in state history. Mayor Conley also, recognized: Grace Nittolo, Team Manager, Emily Pruzick and Alyssa DeBiasse. REPORTS OF COMMITTEES Community Affairs Ms. Baillie, Chair of the Committee, made the following comments: A team from the Senior Citizen Advisory Committee, led by Councilwoman Carmela Vitale won 3rd place in the YMCA Scavenger Hunt, held Saturday, March 21, 2015. Monica Hansen, Registered Dietician from Chatham Shop Rite continues to draw a lot of interest at her monthly nutrition classes. The March 19th class, “”Beans: Blending, Buying and…Bingo!” had 18 residents in attendance. Monica reviewed the nutritional aspect of various dishes, prepared a recipe and the audience sampled the results. On Tuesday, March 31st a full bus will be traveling to the Bethwood in Totowa to see, and participate in, “Ira and Isabella’s Jewish Italian Comedy Wedding.” Among other items on the menu are Matzo Ball Soup and Italian Salad, and the guests will be dancing both the Tarantella and the Hora. The Chamber of Commerce will host an Easter Fun Fest in the downtown area on Friday, April 3rd, and the Taste of Madison is scheduled for Monday, March 30th. On Saturday, April 25th, the Chamber of Commerce will hold the first Home Expo, highlighting local contractors, at the Madison Community House. Public Safety PAGE 5 OF 22 Regular Meeting Minutes – March 23, 2015 Mr. Catalanello, Chair of the Committee, made the following comments: The American Red Cross launched a nationwide campaign in January to reduce injuries and fatalities in home fires. The Madison Fire Department has reached out to the American Red Cross and through Capt. Ed Nunn, has secured new smoke detectors that will last for up to ten years. The Fire Department plans to relaunch their install program in early April. Utilities Mrs. Vitale, Chair of the Committee, made the following comments: The Electric Utility Department reports installation of wildlife protection at the substations on Samson and Ridgedale Avenues, as well as cut out box replacements on Ridgedale Avenue and Woodland Road. They also completed a repair to a speed limit sign on Rosedale Avenue. The Water Department reports continued service upgrades and mark outs. Finance and Borough Clerk Mr. Landrigan, Chair of the Committee, made the following comments: The Tax Department has issued 853 revised tax bills reflecting credits for the Homestead Rebate program, and the public hearing regarding the 2015 municipal budget will be held on April 13, 2015. Health Mr. Wolkowitz of the Committee made the following comments: The recent outbreak of measles has brought attention to the number of children not vaccinated. New Jersey has a very liberal policy regarding religious exemptions and the number of exemptions has increase greatly since 2007. There is proposed legislation to tighten the requirements for a religious exemption regarding inoculations. The Madison Health Department will continue to following with interest. Public Works and Engineering Mr. Rowe, Chair of the Committee, made the following comments: The Department of Public Works road crew continues to patch potholes. Mayor Conley and Mr. Rowe had an opportunity to observe the team in action last Friday. The staff is also starting to work on the playing fields in anticipation of the opening of the spring seasons across a variety of sports. From the Engineering Department, the Ridgedale Avenue plans and specs will be finalized and the bid advertisement will be sent to the newspapers this week. The Waverly Place parking lot plans and bid documents are almost complete, with advertisement of bids in April. Field survey work in preparation for the 2015 Road Reconstruction projects will begin next week. Residents may notice surveyors on Loantaka Terrace, Crescent Avenue, Kinney Street, West Street, Cross Street, and Cottage Place. The contracts for EnTech have been received and a preconstruction meeting will be scheduled with the contractor this week. Sewer lining work will begin in April. The project affects easement areas at Shadylawn Drive, Danforth Road, Rose and Park Avenues. Contractor and material vendor quotes are being assembled for the drainage and turf replacement work on the Memorial Park sports field and skating rink. This evening Council will be voting on the introduction of an ordinance to provide funding for the project from the Open Space Trust fund. The bid for the HVAC system replacement, ceiling and lighting repairs at the Public Library was advertised on March 12th, and a pre-bid meeting will take place on Tuesday, April 7th in the Chase Room. COMMUNICATIONS AND PETITIONS None PAGE 6 OF 22 Regular Meeting Minutes – March 23, 2015 INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Dave Luber; Lawrence Road on behalf of the Madison Historical Society, expressed interest in partnering with the Borough to relocate the Historical Society in the East Wing of the Hartley Dodge Memorial. Susan Simon; Spring Garden Drive noted the many artifacts in the Historical Society’s collection that can be displayed at the Hartley Dodge Memorial East Wing. Thomas Haralampoudis; Pomeroy Road thanked Mayor and Council recognizing the Madison High School Boys Ice Hockey Team and for appropriating funds to resurface and repair the skating rink and playing fields at Memorial Park. AGENDA DISCUSSIONS 03/23/2015-1 APPROPRIATION OF $10,000.00 FOR PROFESSIONAL SERVICES FOR RESTORATION AND RENOVATION OF THE EAST WING OF THE HDM Ms. Baillie stated that the Open Space Advisory Committee approved the Borough’s application for $10,000.00 from the Open Space Trust Fund for professional services to plan a restoration of the East Wing of the Hartley Dodge Memorial. Mr. Vogel has submitted an application to the Morris County Historic Trust Fund Committee to provide additional dollars for this project. Ordinance 13-2015 is listed for introduction. 03/23/2015-2 APPROPRIATION OF $75,000.00 FOR RESURFACING AND REPAIR OF SKATING RINK AND PLAYING FIELDS AT MEMORIAL PARK Ms. Baillie noted a proposed ordinance for approval for resurfacing and repairs to the skating rink and playing fields at Memorial Park. There was no objection to listing the proposed ordinance for introduction. Ordinance 14-2015 is listed for introduction. 03/23/2015-3 AMEND CHAPTER 166 OF THE BOROUGH CODE REGARDING SIDEWALK REIMBURSEMENT Borough Engineer Robert Vogel explained a recommendation to increase the sidewalk reimbursement program funds, noting that the current reimbursement amount dates back to 1988. There was agreement to list an ordinance for introduction. Ordinance 16-2015 is listed for introduction. 03/23/2015-4 APPROPRIATION OF $150,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR 2015 SEWER LINING IMPROVEMENTS Mr. Vogel explained that the appropriation for continuation of the sewer lining project includes three new easements. There was no objection to listing Ordinance 17-2015 for introduction. PAGE 7 OF 22 Regular Meeting Minutes – March 23, 2015 03/23/2015-5 APPROPRIATION OF $663,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE 2015 MILLING AND OVERLAY PROJECTS Mr. Vogel provided information regarding the 2015 roadway milling and overlay program and recommended moving forward with an appropriation ordinance to fund needed improvements. Ordinance 18-2015 is listed for introduction. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on March 9, 2015, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 9-2015 CALENDAR YEAR 2015 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) WHEREAS, the Local Government Cap Law, N.J.S.A. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 1.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS, the Borough Council of the Borough of Madison in the County of Morris finds it advisable and necessary to increase its CY 2015 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS, the Borough Council hereby determines that a 2.0 % increase in the budget for said year, amounting to $365,207.76 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and, WHEREAS the Borough Council hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED, by the Borough Council of the Borough of Madison, in the County of Morris, a majority of the full authorized PAGE 8 OF 22 Regular Meeting Minutes – March 23, 2015 membership of this governing body affirmatively concurring, that, in the CY 2015 budget year, the final appropriations of the Borough of Madison shall, in accordance with this ordinance and N.J.S.A. 40A: 4-45.14, be increased by 3.5%, amounting to $639,224 and that the CY 2015 municipal budget for the Borough of Madison be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED, that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption. Mayor Conley opened up the public hearing on Ordinance 9-2015. Since no member of the public wished to be heard, the public hearing was closed. Mr. Landrigan moved that Ordinance 9-2015, which was read by title, be finally adopted. Mr. Wolkowitz seconded the motion. ORDINANCE 10-2015 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $110,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR RESTORATION AND REPAIR OF THE JAMES LIBRARY BUILDING WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to continue the restoration and repair of the James Library Building, as requested by the Museum of Early Trades & Crafts; and WHEREAS, the Open Space Advisory Committee has recommended the full funding of this request; and WHEREAS, the METC will be utilizing these funds to satisfy the match requirement of a Morris County Historical Preservation Trust Fund grant application to further support the restoration work; and WHEREAS, the Borough Council has determined that the Borough should appropriate $110,000.00 from the Open Space Trust Fund for the restoration and repair of the James Library Building; and PAGE 9 OF 22 Regular Meeting Minutes – March 23, 2015 WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $110,000.00 for this purpose in the Open Space Trust fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $110,000.00 is hereby appropriated from the Open Space Trust Fund for the restoration and repair of the James Library Building, as requested by the Museum of Early Trades & Crafts. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 10-2015. Since no member of the public wished to be heard, the public hearing was closed. Ms. Baillie moved that Ordinance 10-2015, which was read by title, be finally adopted. ORDINANCE 11-2015 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $12,000.00 FROM THE MUNICIPAL OPEN SPACE TRUST FUND FOR REFORESTATION AT THE MADISON RECREATION COMPLEX WHEREAS, the Borough Council has determined that it is in the best interest of the Borough to reforest certain areas of the Madison Recreation Center; and WHEREAS, the Open Space Advisory Committee has recommended the full funding of the request; and WHEREAS, the Borough Council has determined that the Borough should appropriate $12,000.00 from the Municipal Open Space Trust Fund for reforestation; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount not to exceed $12,000.00 for this purpose in the Municipal Open Space Trust fund. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $12,000.00 is hereby appropriated from the Municipal Open Space Trust Fund for reforestation at the Madison Recreation Complex. Construction of sidewalks; municipal partial reimbursement program. A. .... D. The reimbursement shall be $25 per square yard. The reimbursement shall apply to sidewalk installation only and shall not apply to ancillary work such as landscaping, lawn sprinklers and electronic dog fences. The property owner shall submit to the Borough Engineer all bills associated with the project as well as evidence of payment to the contractor. The Borough Council shall appropriate an amount annually for this program, and the reimbursements will be paid up to the annual limit to those who file first in time. SECTION 2: All other provisions of the Ordinance not inconsistent herewith shall remain the same. SECTION 3: This Ordinance shall take effect as provided by law.
