MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON April 24,2017 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 24th day of April, 2017. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 5, 2017. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence for recently deceased resident Joseph Chiarolanzio. APPROVAL OF MINUTES Ms. Baillie moved approval of the Executive Minutes of April 12, 2017. M. Kirby Children’s Center and Alison Kentos of the Northwest Chapter of the New Jersey Association for the Education of Young Children. Proclamation of the B o r o u g h o f M a d i s on Proclaiming Week of the Young Child™ April 24 – 28, 2017 WHEREAS, the Week of the Young Child™ was first established in 1971, recognizing that the early childhood years lay the foundation for children’s success in school and later life; and WHEREAS, the purpose of the Week of the Young Child™ is to focus public attention on the needs of young children and their families and to recognize the early childhood programs and services that meet those needs; and WHEREAS, the F.M. Kirby Children’s Center, the Northwest Chapter of the New Jersey Association for the Education of Young Children and other local organizations, in conjunction with the National Association for the Education of Young Children, are celebrating the Week of the Young Child™ April 24-28, 2017; and WHEREAS, these organizations are working to improve early learning opportunities, including early literacy programs, that can provide a foundation of learning for young children; and WHEREAS, teachers and others who make a difference in the lives of young children in the Borough of Madison deserve thanks and recognition; and WHEREAS, public policies that support early learning for all young children are crucial to young children’s futures; PAGE 2 OF 17 Regular Meeting Minutes – April 24, 2017 NOW, THEREFORE, I, Robert H. Conley, Mayor April 24, 2017 MAY DAY TEE SHIRT DESIGN CONTEST WINNER Mayor Conley recognized this year’s May Day tee-shirt artist, Owen Armstrong, a third grader at Torey J. Sabatini School. Master Armstrong was presented with a framed original of his drawing. REPORTS OF COMMITTEES Public Works and Engineering Mrs. Vitale, Chair of the Committee, made the following comments: The Public Works Department has stared the annual spring planting of 105 street trees. They continue maintenance on Borough vehicles and field maintenance. Drew University and the Borough of Madison are co-sponsoring free tree seedlings under the NJ State tree recovery campaign. The DPW has been busy replacing and resetting as many as 70 manhole covers on roads in preparation for resurfacing. The Mill and Overlay program includes Fairwood Road, Kings Road, Maple Avenue, Redmond Drive, Oxford Lane, Prospect Place, Trail Place, Lorraine Avenue (1/2), Linden Lane, West End Avenue (1/2), Brittin Street, and Dean Street. Public Safety Mr. Landrigan, Chair of the Committee, made the following comments: During the month of March the Fire Department responded to twenty six General Alarms, 17 Still Alarms, 18 Investigations and 39 Medical calls for a total of 100 calls for assistance in March. Total Calls for January through March is 308. On Friday, March 31st, four Madison Firefighters along with Firefighters from Picatinny FD, Morris Plains FD and training staff at the Morris County Fire County Fire Academy, worked and trained with the manufacturer of the “Live Burn” building to better understand how it works and to learn how to train more safely and effectively within the building. On Easter Sunday, April 16th, the Madison FD was dispatch to assist the Florham Park VFD at the scene of a residential structure fire at 21 Parker Court. No one was home at the time of the fire and there were no injuries. Damage was confined to the garage. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: In anticipation of the June 6th Primary Election, the Clerk’s office will remain open for Late Night Voter Registration on May 16, 2017 until 8:00 p.m. Applications for Vote by Mail ballots and voter registration forms are available in the Borough Clerk’s Office or online at morriselections.org. Ms. Baillie noted that 2nd quarter tax bills are due May 1st, and a tax sale is scheduled for September 12, 2017. The first step is working with the Utility Billing Department to make sure all 2016 utility account balances are paid. New biometric time clocks will be installed this week in Borough buildings. Utilities Mr. Wolkowitz, Chair of the Committee, made the following comments: Rapid Pump and Meter Co. attended a preconstruction meeting on February 22nd but has requested a contractual time extension due to submittal timing. The Water PAGE 3 OF 17 Regular Meeting Minutes – April 24, 2017 Department completed 43 mark outs for projects and the Electric Department installed new pole, down-guys and anchors, transferred all primary voltage and secondary voltage cables for poles which were damaged by a truck at Rosedale Avenue. Health Mr. Rowe, Chair of the Committee, made the following comments: This week is National Infant Immunization Week (NIIW), an annual event to promote the benefits of immunizations and improve the health of children two years or younger. Additional information and resources are on Rosenet.org on the Health Department pages. Women’s Health screening is scheduled for Monday May 22nd. Appointments are necessary and can be made by calling the Health Department. Community Affairs Ms. Byrne, Chair of the Committee, made the following comments: Rides for Seniors, the grant-funded senior transportation project, is growing. As of April 17, 106 Tri-town residents have registered and 65 rides had been taken. The April 19th Spring Luncheon drew 50 people, gathered to honor the 10 volunteer tax counselors who completed and filed federal and state returns for 141 area residents. The Seniors Center will once again participate in Madison High School’s Day of Service on May 19, 2017. The Senior Center is enlisting student help with making and decorating T-Caps for donation to the Carol Simon Cancer Center. The Helping Hands project has been resurrected and residents are already signing up for student help with yard work, window cleaning and other spring projects. The Chamber of Commerce has announced a ‘Thursday Ladies Night Out’ to be held on May 11th and volunteers are still needed to help with May Day, scheduled for Saturday, May 6th. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: E-mail received April 21, 2017 from Alison Spatola, of Rose Avenue, regarding the Welcoming Community resolution. E-mail received April 21, 2017 from Gwen Packard, of Berkeley Heights, regarding the parking along Main Street. INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. Since no member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 04/24/2017-1 2017 FARMERS’ MARKET Ms. Byrne announced the details of the 2017 Farmer’s Market season, to be held on Central Avenue between Main Street and Cook Avenue on Thursdays, June 1, 2017 to October 26, 2017. Resolution 140-2017 is listed on the Consent Agenda. He/she shall limit his/her statement to three (3) minutes or less. Jessie Esposito; Community Place, asked for restricted parking on Community Place, noting Housing Authority employees park all day. Kathy Doherty; Community Place, asked about parking restrictions on Community Place noting cars often block driveways. Tom Abruzzo; Maple Avenue, noted his frustration with the process in adopting Resolution 57-2017, and raised concern that Madison be named a Sanctuary City. Judy Campbell; Sampson Avenue, noted her support of Resolution 57-2017, expressing Madison’s commitment to remain a Welcoming Community. Denise Katz; Parkside Avenue, thanked the Mayor for his leadership, and noted that residents who attended a Special Meeting, held April 3rd, where generally in support of a Welcoming Community. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of May 8, 2017 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title. Mrs. Vitale moved that the following Ordinances 18-2017 through 27-2017 be adopted. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Mr. Landrigan, Mrs. Vitale, Ms. Baillie, Mr. Wolkowitz, Mr. Rowe, Ms. Byrne Nays: None ORDINANCE 18-2017 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $75,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR ARCHITECTURAL SERVICES FOR REPLACEMENT OF THE ROOF AT THE MADISON PUBLIC LIBRARY WHEREAS, the Library Director has recommended that the Borough appropriate $75,000.00 from the General Capital Improvement Fund for PAGE 5 OF 17 Regular Meeting Minutes – April 24, 2017 architectural services to replace the Library roof at the Madison Free Public Library; and WHEREAS, the approved 2017 Capital Budget recognizes this expenditure; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $75,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $75,000.00 from the General Capital Improvement Fund for architectural services to replace the Library roof at the Madison Free Public Library. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $75,000.00 is hereby appropriated from the General Capital Improvement Fund for architectural services to replace the Library roof at the Madison Free Public Library. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. PAGE 13 OF 17 Regular Meeting Minutes – April 24, 2017 R 140-2017 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE FARMERS' MARKET FOR 2017 WHEREAS, the Downtown Development Commission has recommended to the Borough Council that the Farmers' Market be continued in the Borough of Madison to be held on Central Avenue between Main Street and Cook Avenue from Thursday, June 1, 2017 to October 26, 2017; and WHEREAS, the Borough Council recognizes that the Farmers' Market has been a welcome addition to the Borough in that it creates another community event which has been successfully run in the past; WHEREAS, the Borough Council finds that it is a benefit to the Borough of Madison and its citizens to allow the continued operation of the Farmers' Market. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison County of Morris, State of New Jersey, as follows: 1. A Farmers' Market is authorized to be conducted on Central Avenue between Main Street and Cook Avenue from Thursday, June 1, 2017 to October 26, 2017. 2. The Farmers' Market shall be conducted in accordance with the 1993 "Guidelines for Madison's Farmers' Market", as amended, as well as the Madison Farmers’ Market Regulations and By Laws, subject to the dates and times and other conditions set forth in this resolution. Farmers shall be allowed to sell agricultural products that are produced and sold on their farms, including eggs, pork, wheat flour and baked goods and the sale of field-grown and cut field flowers; however, the sale of potted plants, shrubbery or other landscaping products shall not be permitted. 4. The requirements of the Peddling and Soliciting Ordinance (Chapter 139 of the Madison Borough Code) shall not apply to the Farmers' Market as authorized by Chapter 139-13(c). 5. The requirements of the Sign Ordinance (Chapter 195 of the Madison Borough Code) shall not apply to the extent that the Farmers' Market shall be permitted to have signs as utilized in previous years; 6. The requirements of the Parking Ordinance (Chapter 195 of the Madison Borough Code) shall not apply to the extent that there shall be two (2) hour parking during market hours in areas denoted as one hour parking; 7. TO HOLD A 5K RUN AT GIRALDA FARMS ON SUNDAY, JUNE 4, 2017 WHEREAS, Good Grief, Inc. has requested permission to use portions of Laurel Way, Woodland Road, Treadwell Avenue, and Madison Avenue in connection with a benefit 5k run at Giralda Farms; and WHEREAS, the Police Chief recommends approval of this request; and WHEREAS, Good Grief, Inc. has agreed to reimburse the Madison Police Department for all expenses incurred in connection with the monitoring of said race; and WHEREAS, the Borough Council has reviewed said request and determined that it should be granted. R 143-2017 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING A DONATION OF THE LOJACK STOLEN VEHICLE RECOVERY SYSTEM PAGE 15 OF 17 Regular Meeting Minutes – April 24, 2017 WHEREAS, the LoJack Corporation has generously offered to donate equipment and services to the Madison Police Department for participation in the LoJack Stolen Vehicle Recovery System, currently in operation in twenty-eight states; and WHEREAS, the Madison Police Chief recommends participation in the LoJack Stolen Vehicle Recovery Network to help combat vehicle theft; and WHEREAS, the Council concurs with this recommendation. R 144-2017 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING SARA KEFFER TO THE POSITION OF SENIOR CITIZEN DIRECTOR IN THE SENIOR CITIZEN DEPARTMENT WHEREAS, the position of Senior Citizen Director in the Senior Citizen Department will be vacated due to a retirement; and WHEREAS, the QPA/ Personnel Director recommends the appointment of Sara Keffer to fill the position of Senior Citizen Director on or about May 1, 2017; and WHEREAS, the Council concurs with this recommendation.
