MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON September 9, 2019 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 9th day of September, 2019. Mayor Conley called the meeting to order at 7:00 p.m. in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2019. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Mrs. Vitale seconded the motion, which passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Rowe, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley announced that the Borough of Madison has been recognized by New Jersey Monthly as the top community on their 2019 List of Best Places to Live in New Jersey. Mayor Conley thanked the Council members and staff, volunteers, teacher and merchants for their contributions to making Madison #1. Mayor Conley asked for a moment of silence for the victims of the terrorist attacked on September 11, 2001, noting that the horn at the Hartley Dodge Memorial will sound on Wednesday morning to commemorate these events. Mayor Conley noted that September is Suicide Prevention month, and a walk in support is scheduled at Cougar Field, September 21st at 5:30 p.m. EMPLOYEE OF THE MONTH FOR SEPTEMBER: The Employee of the Month for September is Kris MacDougall of the Department of Public Works for his dedication and commitment in designing and fabricating innovative tools for the Water Department making it easier and safer to operate valves and saving the department time and money. Joseph Longo of the Madison Police Department – 20th Anniversary on September 7, 2019 Donna Carey of Water & Light Billing – 20th Anniversary on September 13, 2019 LONG-TIME VOLUNTEER FIREFIGHTER RECOGNITION: Mayor Conley recognized the following volunteer firefighters: Ed Nunn, Sr. (18 years) Vito Terranova (33 years) Neil Simonelli (44 years) Tony Giannone (47 years) Carl Weisgerber (50 years) Jay Hagerich (53 years) TEAM RECOGNITION: Mayor Conley recognized coaches and members of the Madison Little League 11u All-Star Team under the direction of Ken Wear, for their win at State Finals. REPORTS OF COMMITTEES Public Safety Ms. Baillie, Chair of the Committee, made the following comments: Madison Police Lt. Joseph Longo reports extra patrols with the start of the new school year. Mayor Conley aided in the detention of an alleged hit and run driver on Madison Avenue. The Fire Department reports mutual response to a fire on Speedwell Avenue in Morristown. Finance and Borough Clerk Mrs. Vitale, Chair of the Committee, made the following comments: The Finance Department continues cross training employees in payroll and accounts payable. The 2020 municipal budget process has begun with Administrator meeting with Department Heads and the annual update of assets information will be completed and submitted this week. Utilities Mr. Rowe, Chair of the Committee, made the following comments: The Electric Department has been helping the Public Works Department and the Police Department with trimming overgrown branches and bushes obstructing School and Crosswalk signs throughout the town. As a reminder, if you have trees or shrubs adjacent to a public sidewalk, please make sure the sidewalk is 100% clear at all times. In late August the crew responded to two power outages, one near Shunpike Road and Noe Avenue, the other on Lathrop Road. The Water Department will start its state mandated hydrant flushing in the next two weeks. The work is expected to continue through the end of October. It helps to ensure that all of our 600+ fire hydrants are in good working order. Areas of high traffic will be done overnight. The rest of the system will be flushed during the day. When a nearby hydrant is flushed residents may notice low pressure, discoloration of the water or bubbles. This is a temporary condition, and the best way to alleviate the above is to run an outside faucet, or a laundry sink, i.e., someplace outside your kitchen or bathrooms. Public Works and Engineering Ms. Byrne, Chair of the Committee, made the following comments: PAGE 3 OF 18 Regular Meeting Minutes – September 9, 2019 The Public Works Department continues to service and repair Borough vehicles, watered flower baskets and various plantings and clean DPW Yard for recycling center. The Engineering Department reports that Cifelli &Son Contracting will start the water main replacement and drainage improvements on Community Place in the next week. TilconNY has been given notice to proceed with resurfacing Wisteria, Lynwood and part of Crestview, Lawrence, Laurel, Nordling and Delbarton and the NJDOT reimbursement requests for both phases of Greenwood Avenue were submitted based on the approved pavement testing results. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The Senior Citizen Advisory Committee will hold their next meeting September 11th. Restaurant Week is being planned for Saturday, October 5 - Sunday, October 11 in partnership with the Madison Area Chamber of Commerce. This event will feature a contest for diners. Diners who submit five receipts dated between October 6 - 11, by October 19 will be eligible to win a $100.00 Madison Gift Check. Bottle Hill Day is Saturday, October 5th. There is still time to participate. Sponsorship and Application packets are available on rosenet. Please visit the Madison Farmers Market located on Central Avenue, between Cook Avenue and Main Street, from 2: 00 to 7:00 pm every Thursday through October 24th. In addition to the great lineup of vendors the Market features weekly live musical performances. The Council is invited to the Chamber of Commerce networking event at The Park Avenue Club on Wednesday, September 25. The Madison Car Show is Saturday, October 5. The main sponsor is Madison Tire & Auto Repair. The Museum of Early trades & Crafts will hold their annual benefit dinner at the Park Avenue Club on Friday, September 27, 2019. The Mayor’s Fitness Crawl will take place on Sunday, September 15th from 9:00 A.M. to 2:00 P.M. Health Ms. Coen, Chair of the Committee, made the following comments: Influenza Vaccine clinic dates have been scheduled for Wednesday October 1st and Monday October 21st from 9 – 11 am at the Civic Center. No appointments are necessary. Please bring Medicare cards (if applicable). The vaccine is regular dose, not high dose. The public is reminded that any type of food distribution or sale in the borough may require a temporary food license, inspection and approval from the Health Department. Please call for further information. The next regular Board of Health meeting is Tuesday, September 17, 2019 at 7:30 pm in the Health Department Office at 28 Walnut Street. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated August 13, 2019 from John Larkin, 33 Elm Street regarding cable franchise abuse. INVITATION FOR DISCUSSION (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Chair, the person shall proceed to the lectern and give his/her name and address in an audible tone of voice, and print the same on the sheet provided for the record. He/she shall limit his/her statement to three (3) minutes or less. PAGE 4 OF 18 Regular Meeting Minutes – September 9, 2019 Thomas Haralampoudis; Pomeroy Road, provided comment on proposed Ordinance 46-2019, regarding the ban of plastic bags in the Borough, noting improvement to the Borough’s recycling center. Rachel Ehrlich; Kings Road, noted her appreciation for the efforts of Borough Crossing Guards. Kathy Dailey; West End Avenue, noted her support for Resolution 266-2019, license plate recognition hardware. Susan Petracco; Lorraine Road, stated her absence at the Scoping Hearing regarding the Borough’s Affordable Housing plan, noting affordable housing in the Central Avenue area. AGENDA DISCUSSIONS 09/09/2019-1 MADISON BRANDING AND LOGO PRESENTATION Kris Pfeifer and Vicky Vitarelli presented a new branding for Madison explaining that Madison leaders have identified that now is the time to unify the voice of Madison as a way to keep the town flourishing, attract new businesses and residents, encourage more dining and shopping downtown, all while striving to meet the needs of existing residents, businesses and organizations. People come to Madison for the character of its history and stay for the promise of their future. Following presentation of branding examples, Ms. Baillie suggested Department heads have the opportunity for input. Mrs. Vitale agreed the next step should be to consult Departments. Mr. Rowe suggested signs be kept simple to read and changes be implemented over time. Mayor Conley noted the next step would be to come back to Council with a resolution outlining the plan and timeline for the roll out of a new brand. 09/09/2019-2 MADISON COMMUNITY ARTS CENTER Eric Hafen, Director of Arts and Events at the Madison Community Arts Center provided a presentation on the space at Kings Road to be used as the Borough’s Community Arts Center, noting that this 3,000 sq. ft. facility on the ground floor of Building 'A' fronting on Kings Road is equipped with restrooms, dressing rooms, a ticket booth area and a large performance space, which opens out to a large patio area with an outdoor stage. ADVERTISED HEARINGS The Clerk made the following statement: Ordinances scheduled for hearing tonight were submitted in writing at a Regular meeting of the Mayor and Council held on August 12, 2019, were introduced by title and passed on first reading, were published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinances for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 42-2019 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CHAPTER 56, ENTITLED “ALCOHOLIC BEVERAGES” TO AMEND THE HOURS FOR SALE OF ALCOHOLIC BEVERAGES FOR ON-PREMISES CONSUMPTION PAGE 5 OF 18 Regular Meeting Minutes – September 9, 2019 WHEREAS, the Borough Council has determined that Chapter 56 entitled “Alcoholic Beverages” of the Madison Borough Code should be amended to increase the hours for sale of alcoholic beverages for on-premises consumption on Sundays; and WHEREAS, the Borough Council has determined to amend hours for such sale on Sundays between 2:00 a.m. and 10:00 a.m., except as otherwise provided herein; and NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: Section 56-6 entitled “Hours and Days of Sales” shall be amended and replaced with the following: §56-6: Hours and Days of Sales (A) Sale of alcoholic beverages for on-premises consumption and sale of wine and malt beverages for off-premises consumption. No licensee or any agent, servant or employee of any licensee shall sell, serve, distribute or deliver or allow, permit or suffer the sale, service, distribution or delivery of any alcoholic beverage for consumption on any licensed premises: (1) On Sunday between 2:00 a.m. and 12:00 noon, 10:00 a.m. except as otherwise provided herein. SECTION 2: This Ordinance shall take effect as provided by law. Mayor Conley opened up the public hearing on Ordinance 42-2019. Since no member of the public wished to be heard, the public hearing was closed. Mrs. Vitale moved that Ordinance 42-2019, which was read by title, be finally adopted. Ms. Byrne seconded the motion. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Rowe, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None Mayor Conley declared Ordinance 42-2019 adopted and finally passed and ordered the Clerk to publish the notice thereof in the newspaper and to record the ordinance as required by law. ORDINANCE 43-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $15,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR EMERGENCY REPLACEMENT OF FIRE ENGINE ONE TRANSMISSION Mayor Conley opened up the public hearing on Ordinance 43-2019. Since no member of the public wished to be heard, the public hearing was closed. PAGE 6 OF 18 Regular Meeting Minutes – September 9, 2019 WHEREAS, the Madison Fire Chief has recommended that the Borough appropriate $15,000.00 from the General Capital Improvement Fund for emergency replacement of Fire Engine One transmission; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $15,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $15,000.00 from the General Capital Improvement Fund for emergency replacement of Fire Engine One transmission. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $15,000.00 is hereby appropriated from the General Capital Improvement Fund for emergency replacement of Fire Engine One transmission. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Ms. Baillie moved that Ordinance 43-2019, which was read by title, be finally adopted. Mr. Rowe seconded the motion. PAGE 7 OF 18 Regular Meeting Minutes – September 9, 2019 INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of September 23, 2019 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 44-2019 ORDINANCE OF THE BOROUGH OF MADISON AMENDING CH. 185 OF THE BOROUGH CODE ENTITLED “VEHICLES AND TRAFFIC” TO DELETE VALLEY ROAD AS A THROUGH STREET WHEREAS, the Borough Administrator has recommended that Chapter 185- 35 of the Borough Code, entitled "Vehicles and Traffic", be amended to delete Valley Road as a through street to allow the Engineering and Police Departments to pursue enhanced traffic calming measures; and WHEREAS, the Borough Council has determined that Valley Road should be deleted from Ch. 185-35 as a through street to allow for additional traffic calming measures. NOW, THEREFORE, BE IT ORDAINED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey as follows: SECTION 1: Chapter 185-35 of the Borough Code is amended to delete Valley Road as a through street SECTION 3: This Ordinance shall take effect as provided by law. There was no Council discussion, and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Rowe, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None ORDINANCE 45-2019 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $65,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR EMERGENCY STORM SEWER LINING REPAIR BETWEEN LOVELAND STREET AND ANTHONY DRIVE WHEREAS, the Borough Engineer has advised the Council that a storm sewer is in imminent danger of failure and collapse between Loveland Street and Anthony PAGE 8 OF 18 Regular Meeting Minutes – September 9, 2019 Drive requiring emergency replacement in order to protect the health and welfare of the public; and WHEREAS, the Borough Engineer has requested that the Borough appropriate $65,000.00 from the General Capital Improvement Fund to pay for these emergency repairs; and WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $65,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $65,000.00 from the General Capital Improvement Fund for the emergency repair of the storm sewer between Loveland Street and Anthony Drive. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $65,000.00 is hereby appropriated from the General Capital Improvement Fund for the emergency repair of the storm sewer between Loveland Street and Anthony Drive. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $100,000.00 is hereby appropriated from the General Capital Improvement Fund for the Department of Public Works Recycling Center project. SECTION 2: The budget of the Borough is hereby amended to conform with the provisions of this Ordinance. SECTION 3: This Ordinance shall take effect as provided by law. Ms. Byrne moved that Ordinance 46-2019, which the Borough Clerk read by title, be adopted. Mr. Hoover seconded the motion. Ms. Baillie abstained from voting on Resolution 263- 2019.There was no further Council discussion and the motion passed with the following roll call vote recorded: Yeas: Mrs. Vitale, Ms. Baillie, Mr. Rowe, Ms. Byrne, Mr. Hoover, Ms. Coen Nays: None R 253-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SUBMISSION OF AN APPLICATION FOR DIVERSION TO THE MORRIS COUNTY OPEN SPACE, FARMLAND, FLOODPLAIN PROTECTION AND HISTORIC PRESERVATION TRUST FUND WHEREAS, Greener by Design, LLC has prepared an application (hereinafter “application”) for diversion of an approximately 2 +/- acre portion of the PAGE 10 OF 18 Regular Meeting Minutes – September 9, 2019 preserved open space known as the Madison Recreation Complex (MRC) Block 601, Lot 1; and WHEREAS, the application area of the MRC that is being requested for diversion has contaminated soils needing to be remediated; and WHEREAS, the application area is currently not being utilized for any recreational purposes; and WHEREAS, the Borough of Madison has entered into a Memorandum of Understanding with Fair Share Housing Center; and WHEREAS, the application includes an alternatives analysis that shows the Borough has no other reasonable alternatives for addressing the affordable housing needs as agreed upon in its Memorandum of Understanding with Fair Share Housing Center. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Borough of Madison agrees to submit the application for diversion to the County of Morris for the aforementioned diversion. No. 274-5-33795 B.A. No. 74 OCTOBER 10, 2019 R 256-2019 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING DONATED LANDSCAPING MAINTENANCE FOR CONDURSO WAY PARK WHEREAS, the Davis & Sons Landscaping of Madison, NJ has generously offered to maintain the landscaping at Condurso Way Park; and WHEREAS, the Borough Council has concluded that it would be in the best interest of the Borough to accept the donated plantings, materials and volunteer labor; and WHEREAS, Davis & Sons Landscaping od Madison, NJ will consult with Borough Administration, the Parks Advisory Committee and the Patriotic Celebrations Committee on all significant landscaping decisions; and WHEREAS, Davis & Sons Landscaping od Madison, NJ will provide proof of adequate insurance coverage annually to the Finance Department. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris in the State of New Jersey that the Borough accepts the donation by Davis & Sons Landscaping od Madison, NJ of new plantings, materials and volunteer labor. R 257-2019 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING SCHOOL CROSSING GUARDS FOR THE 2019-2020 SCHOOL YEAR WHEREAS, N.J.S.A. 40A:9-154.1 provides that municipalities may appoint school crossing guards for terms not exceeding one year. GATTI AGNES YULIANO R 258-2019 RESOLUTION OF THE BOROUGH OF MADISON APPROVING THE MADISON SENIOR CENTER GENERAL POLICIES AND STANDARDS OF CONDUCT POLICY WHEREAS, the Coordinator of the Senior Center has recommended that the Borough Council approve the General Policies and Standard of Conduct Policy for the Senior Center; and WHEREAS, a copy of such policies is attached hereto that have been reviewed and approved by the Borough Attorney; and WHEREAS, the Council has determined to approve such policies which are in conformity with the requirements of the New Jersey statutes. R 259-2019 RESOLUTION OF THE BOROUGH OF MADISON APPROVING CONFINED SPACE RESCUE AGREEMENT WITH BOROUGH OF FLORHAM PARK WHEREAS, the Fire Chief has recommended that the Borough enter into an agreement with the Borough of Florham Park to provide Confined Space Rescue Services to Borough of Florham Park at a cost of $3,000.00 per year plus any costs incurred for each time the Borough Fire Department is called; and PAGE 13 OF 18 Regular Meeting Minutes – September 9, 2019 WHEREAS, the Borough Council has determined that the execution of said Agreement on behalf of the Borough should be authorized and approved. NOW, THEREFORE BE IT RESOLVED, by the Council of the Borough of Madison in the County of Morris and State of New Jersey that the Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to execute an Agreement with Borough of Florham Park to provide Confined Space Rescue Services to Borough of Florham Park at a cost of $3,000.00 per year plus any costs incurred for each time the Borough Fire Department is called, in a form acceptable to the Borough Attorney. R 260-2019 RESOLUTION OF THE BOROUGH OF MADISON CONFIRMING CHANGE ORDER #2 TO MBT CONTRACTING, LLC FOR THE MADISON ELECTRIC STORAGE BUILDING PROJECT WHEREAS, the Assistant Borough Engineer has advised the Council that changes in design to include one additional steel frame and associated piers/footings on the Madison Electric Storage Building project; and WHEREAS, the Assistant Borough Engineer has recommended that based on said change order, the base contract with MBT Contracting, LLC. shall be increased by $12,931.60 (3.84%) which results in no additional appropriation being needed; and WHEREAS, the Council wishes to authorize disbursement of Change Order #2 in the cumulative amount of $12,931.60. WHEREAS, the Chief Financial Officer has confirmed that adequate funds for this purpose are contained in Ordinances 1-2019 and 6-2019. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that payment in the amount of $12,931.60 to the MBT Contracting, LLC. contract for the Madison Electric Storage Building project is approved. R 261-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING RENEWAL OF AN AGREEMENT FOR AN EMPLOYEE ASSISTANCE PROGRAM WITH ATLANTIC HEALTH SYSTEM WHEREAS, the Borough of Madison wishes to renew the contract with Atlantic Health System for an Employee Assistance Program (EAP) as hereinafter set forth, in consideration of payment as hereinafter provided; and PAGE 14 OF 18 Regular Meeting Minutes – September 9, 2019 WHEREAS, the Borough Council has determined to approve the renewal of an agreement with Atlantic Health System for an Employee Assistance Program (EAP); and NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison County of Morris, State of New Jersey, that the Mayor and Borough Clerk are hereby authorized to execute a renewal of the contract for an Employee Assistance Program (EAP) with Atlantic Health System, in a form approved by the Borough Attorney. R 262-2019 RESOLUTION OF THE BOROUGH OF MADISON AWARDING CONTRACT TO PERFORMANCE TRAILERS, INC. OF FLANDERS, NJ IN THE AMOUNT OF $34,911.00 WHEREAS, the Fire Chief has recommend awarding a contract to Performance Trailer, Inc. of Flanders, NJ for the purchase of a trailer and accessories for the Fire Department in the amount of $34,911.00; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $34,911.00 for this purpose which funds were appropriated by Ordinance 25-2019. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract is hereby awarded to Performance Trailer, Inc. of Flanders, NJ for the purchase of a trailer and accessories in the amount of $34,911.00. 2. R 263-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MADISON AREA YMCA 5K RUN AT GIRALDA FARMS ON SUNDAY, OCTOBER 20, 2019 WHEREAS, Madison Area YMCA has requested to hold a “5K run” in Madison on Sunday, October 20, 2019, for the benefit of Project Community Pride; and WHEREAS, the run will begin at 8:30 a.m., on the grounds of Giralda Farms; and PAGE 15 OF 18 Regular Meeting Minutes – September 9, 2019 WHEREAS, Giralda Farms property owners have requested a Hold Harmless agreement and a Certificate of Liability Insurance regarding such use of the property; and WHEREAS, Police Chief Dachisen recommends approval of this request. R 264-2019 RESOLUTION OF THE BOROUGH OF MADISON SUPPORTING THE MADISON ENVIRONMENTAL COMMISSION BIRDS & BREAKFAST WALK WHEREAS, the Madison Environmental Commission wishes to hold a Bird & Breakfast Walk on Saturday, September 28, 2019 with Terry Caruthers, NJ Audubon Associate Naturalist; and WHEREAS, the Bird & Breakfast Walk will consist of a free bird walk followed by a light breakfast at a Zero Energy house in Madison. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the Borough of Madison supports the Madison Environmental Commission’s Bird & Breakfast Walk. R 265-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A SPECIAL EVENT PERMIT TO ALLOW THE USE OF PUBLIC PARKING LOT NUMBER ONE BY THE ROTARY CLUB OF MADISON FOR A PUBLIC SHREDDING EVENT ON OCTOBER 12, 2019 WHEREAS, the Rotary Club of Madison has requested permission to use public parking lot number one on Saturday, October 12, 2019, between the hours of 9:00 a.m. and 12:00 p.m. for a public shredding event; and WHEREAS, the Borough Administrator has recommended that such permission be granted; and WHEREAS, the Rotary Club has submitted a Special Event Permit Application to the Borough as well as a Certificate of Liability Insurance naming the Borough of Madison as an additional insured; and WHEREAS, the Borough Council agrees with this recommendation. R 266-2019 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING AWARD OF CONTRACT TO VIGILANT SOLUTIONS, LLC FOR THE PURCHASE OF LICENSE PLATE RECOGNITION HARDWARE, INSTALLATION AND SETUP WHEREAS, the Borough of Madison received quotes for license plate recognition hardware, installation and setup (the “Contract”) in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the Qualified Purchasing Agent/Personnel Officer has recommended that the Borough Council award the contract to Vigilant Solutions, LLC in the amount of $21,522.00; and WHEREAS, the Chief Financial Officer has attested that funds are available in an amount not to exceed $21,522.00 for this purpose in the Police Outside Duty Trust Account. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for license plate recognition hardware, installation and setup is hereby awarded to Vigilant Solutions, LLC based upon its proposal in the amount of $21,522.00, contingent upon proof of business registration and statutory requirements. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into the contract with Vigilant Solutions, LLC in a form acceptable to the Borough Attorney.
