MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON May 24, 2021 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 24th day of May, 2021. Mayor Conley called the meeting to order at 7:00 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 7, 2021. Mr. Hoover seconded the motion, which passed with a unanimous voice call vote recorded GREETINGS TO PUBLIC Mayor Conley presented the following proclamations: PAGE 2 OF 24 Regular Meeting Minutes – May 24, 2021 Pride Month June 2021Proclamation Proclamation of the B o r o u g h o f M a d i s on Proclaiming Pride Month June 2021 WHEREAS, our nation was founded on the principle of equal rights for all people and some of the most inspiring moments in our history have arisen from the various civil rights movements that have brought one group after another from the margins to the mainstream of American society; and WHEREAS, in the movement toward equal rights for lesbian, gay, bisexual, transgender and queer (LGBTQ) people, an historic turning point occurred 52 years ago on June 28, 1969, in New York City, with the onset of the Stonewall Riots. During these riots, LGBTQ citizens rose up and fought against the discriminatory criminal laws that have since been declared unconstitutional; and WHEREAS, all human beings are born free and equal in dignity and rights and LGBTQ individuals and their allies have had immeasurable impact to the cultural, civic and economic success of our country; and WHEREAS, the Borough of Madison is committed to supporting visibility, dignity and equality for LGBTQ people in our diverse community; and WHEREAS, while society at large increasingly supports LGBTQ equality, it is essential to acknowledge that the need for education and awareness remains vital; and WHEREAS, celebrating Pride Month brings awareness and provides support and advocacy for Madison’s LGBTQ community and is an opportunity to take action and engage in dialogue to strengthen alliances, build acceptance and advance equal rights; and WHEREAS, it is imperative that young people in our community, regardless of sexual orientation, gender identity, and expression, feel valued, safe, empowered, and supported by their peers and community leaders; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby proclaim the month of June 2021 as Pride Month in the Borough of Madison in support of the LGBTQ community and to recognize all LGBTQ residents whose influential and lasting contributions to our neighborhoods make Madison a vibrant community in which to live, work and visit. ______________________________________ Robert H. Conley, Mayor May 24, 2021 PAGE 3 OF 24 Regular Meeting Minutes – May 24, 2021 National Gun Violence Awareness Day June 4, 2021 Proclamation of the B o r o u g h o f M a d i s on Proclaiming National Gun Violence Awareness Day June 4, 2021 WHEREAS, gun suicide claims the lives of over 23,000 people in the United States each year and more than 14,000 people die in gun homicides; and WHEREAS, Americans are 25 times more likely to be killed with guns than people in other developed countries; and WHEREAS, protecting public safety in the communities they serve is a mayor’s highest responsibility; and WHEREAS, support for the Second Amendment rights of law-abiding citizens goes hand-in-hand with keeping guns away from dangerous people; and WHEREAS, firearms are the leading cause of death for children and teens in the United States. WHEREAS, in January 2013, Hadiya Pendleton, a teenager who marched in President Obama’s second inaugural parade and was tragically shot and killed just weeks later, should be now celebrating her 23rd birthday; and WHEREAS, to help honor Hadiya – and the 100 Americans whose lives are cut short and the countless survivors who are injured by shootings every day – a national coalition of organizations has designated June 4,2021, the first Friday in June as the sixth National Gun Violence Awareness Day; and WHEREAS, the idea was inspired by a group of Hadiya’s friends, who asked their classmates to commemorate her life by wearing orange; they chose this color because hunters wear orange to announce themselves to other hunters when out in the woods and orange is a color that symbolizes the value of human life; and WHEREAS, anyone can join this campaign by pledging to Wear Orange on June 4th, the first Friday in June 2021, to help raise awareness about gun violence and honor the lives of gun violence victims and survivors; and WHEREAS, we renew our commitment to reduce gun violence and pledge to do all we can to keep firearms out of the wrong hands and encourage responsible gun ownership to help keep our children safe; NOW, THEREFORE, I, Robert H. Conley, Mayor May 24, 2021 REPORTS OF COMMITTEES Public Safety Ms. Byrne, Chair of the Committee, made the following comments: On May 14th, our 1921 Ahrens-Fox firetruck, “Geraldine” turned 100 years old. It was on this date that Mrs. Geraldine Rockefeller Dodge officially presented the Ahrens-Fox firetruck to the Borough of Madison. A parade was held followed by a town wide celebration and pumping demonstration. This was the first of three fire engines that Mrs. Dodge purchased and gave to Madison over the years. The other 2 fire engines that were presented were a 1949 and 1953 Mack. Geraldine still runs and pumps today and is housed at Fire Department. On May 23rd, the Madison Fire Department celebrated 140 years of protecting Madison citizens, business and property from the ravages of fire. It was on May 23, 1881, in Obrien’s Hall, which was located on Waverly Place that the “Hook & Ladder Co #1” was formally created. One of the founding members of the Fire Department was Fred Bardon. Fred served as president of the fire department from 1889-1912. He created the Madison Eagle which was the Madison Eye Opener first in 1877. Fred was also instrumental in encouraging the incorporation of the Borough of Madison in 1889 through his editorials in the Madison Eagle. Fred also served as the president of the Madison Board of Education as well as the 1st tax collector for Madison. Bardon Street in Madison is named after him. Fred passed away at the young age of 58 on March 17, 1916. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: The Administration and Finance Department continue to monitor the impact of the pandemic on revenues, reporting that tax collection rates are good, but fees collected remain low. Some good news is that the recycling markets have improved. In the past the Borough received more than $60,000 annually for curbside recyclables. The last few years the Borough has had to pay to dispose of recycling. With market improvements, the Borough received some income for recycling but continues to pay for garbage tipping fees. The Utility Billing Department encourages residents and businesses to pay their utility bills on line. Ms. Baillie announced that the Borough is working on several grants including trail improvements at Memorial Park and playground equipment for Dodge Field that will be handicapped accessible. Public Works and Engineering Mr. Hoover, Chair of the Committee, made the following comments: Denville Line Striping completed all Mill & Overlay roads and crosswalks last week. Cifelli & Son started tree removal work at Anthony Drive and Wayne Blvd and expects drainage work to start next week. Hartley Dodge Memorial Plaza restoration general contractor Merrill & Garaguso of Swedesboro, NJ is preparing a construction schedule. Several interesting public hearings have been scheduled by the Madison Land Use Boards. Please stay tuned via the website. The Department of Public Works is working on a Pilot program with neighboring communities. The Senior Citizen Van will once again start daily services on a limited basis. The Shade Tree Management Board planted 90 new trees in and will PAGE 5 OF 24 Regular Meeting Minutes – May 24, 2021 continue to plant in the fall. The Madison community is invited to participate in a walkable, self-guided Environmental Scavenger Hunt sponsored by the Madison Environmental Commission (MEC) with the support of Madison High School volunteers. Starting on June 3rd, residents can search for environmental items, such as a butterfly garden or recycling bin. The scavenger hunt is designed to take 30-60 minutes and all 10 clues can be found within and around the downtown district. Community Affairs Ms. Coen, Chair of the Committee, made the following comments: The next meeting of the Downtown Development Commission is scheduled for June 17, 2021, via Zoom. Residents are reminded that the Farmers’ Market is open each Thursday through November. The Taste of Madison will be held soon with a restaurant passport and raffles. The Chamber of Commerce is accepting nomination for the Extra Mile Award, for outstanding customer service. The Spring Ahead into the Arts programs continues. And on June 5th, Hidden Figures program will be held at the AME Bethel Church. Utilities Ms. Ehrlich, Chair of the Committee, made the following comments: The Electric Department replaced the donated Christmas tree from St. Vincent’s with a beautiful 8-foot Blue Spruce purchased from Coviellos. The Department set a new pole at 322 Main Street for underground electric service for the two new condominiums. The Department also replaced an old utility pole in front of 18 Madison Avenue and transferred our lines and equipment. American Electrical Testing is replacing the Relays in our James Park substation with our assistance. The Electric Department started utility service work for the 4 Community Place redevelopment and is reviewing plans for future work on Lincoln Place and the Cook Avenue Parking Lot renovation. The Water Department excavated and replaced an older model fire hydrant on Ashland Road. The Department also installed a drain at the dog park to try and dry the area around the fountain. The department reminds us to please refrain from watering lawns during sunlight hours, when 50% of the water used is lost due to evaporation. Health Mr. Landrigan, Chair of the Committee, made the following comments: Mr. Landrigan noted State issued updates to mask guidelines and capacities, both indoor and out, noting masks are still require in schools, and on public transportation. In Madison there are a total of 868 confirmed cases of COVID-19 reported, with no new cases this week. Residents age 12 and up can now receive vaccines, with same day appointments available. Eric Range; Belleau Avenue, offered his support of Resolution 156-2021, noting the resolution addresses needs of the University and the Borough of Madison. Kathleen Caccavale; Central Avenue, raised concern regarding the purchase of benches, asking that green products be purchased. Lydia Chambers; Harding Township, co-chair of the Garden Club of Madison, endorsed approval of Resolution 156-2021, supporting conservation at Drew University. Chris Coultas; Longhill Road, asked Council to continue preservation of the Drew Forest. Gene Cracovia; Barnesdale Road, Chair of the Shade Tree Management Board, offer support for Resolution 156-2021, and asked Council to continue to partner with Drew University. Claire Whitcomb; Fairwood Road, encouraged Council to approve Resolution R 156-2021, supporting conservation at Drew University. Judy Kroll; Laurel Way, offered support of Resolution R 156-2021, supporting conservation at Drew University. Bridget Dailey; Keep Street, encouraged Council to approve Resolution R 156- 2021, supporting conservation at Drew University. Inquired about the energy efficiency of vehicle purchased for the Department of Public Works. Tom Haralampoudis; Pomeroy Road, inquired about discussion with Drew University regarding the Drew Forest and steps to attain funds. Chris Schorr; Shady Lawn Drive, President of Friends of Madison Shade Trees, noted the oldest trees in Madison are in the Drew Forest. AGENDA DISCUSSIONS 05/24/2021-1 MADISON HIDDEN FIGURES PRESENTATION Ms. Coen introduced a program that grew out of conversations in the community beginning last summer and culminating with a weekend of event to discover the Hidden Figures in the Borough of Madison. Kenesha Tucker started by thanking Ms. Coen and Mayor Conley for continuing the Community Conversation and the committee members working on the Madison Hidden Figures program. A Welcoming reception will be held June 4th with events through June 6th and a Closing Breakfast at the Nautilus Diner on June 6th. Program highlights include projects purpose is to educate the Madison community about the history of Black residents and their contribution to the Madison and Morris County. Teachers will provided research for students to discover the history and impact of these residents. If residents are interested in helping out, there is an Amazon wish list of supplies needed for the project. 05/24/2021-2 MARIJUANA LEGISLATION UPDATE Mr. Codey provide explanation of proposed legislation regarding legalization of marijuana, noting classes of State issued licenses, local tax rates and lack of State regulation regarding types of activities, times, locations, etc. Mr. Codey explained that by opting out at this time, the Borough can at any time opt–in when guidelines are set by the State. Mayor Conley suggested introduction of an ordinance in July. ADVERTISED HEARINGS The Clerk made the following statement: The ordinance scheduled for hearing tonight was submitted in writing at a Regular meeting of the Mayor and Council held on May 10, 2021, was introduced by title and passed on first reading, was published in the Madison Eagle and made available to members of the general public requesting same. Mayor Conley called up Ordinance 20-2021 for second reading and asked the Clerk to read said ordinances by title: ORDINANCE 20-2021 ORDINANCE OF THE BOROUGH OF MADISON APPROPRIATING $60,000.00 FROM THE GENERAL CAPITAL IMPROVEMENT FUND FOR THE PURCHASE OF SNOW THROWER AND ACCESSORIES FOR THE DEPARTMENT OF PUBLIC WORKS WHEREAS, the Director of Public Works has recommended that the Borough appropriate $60,000.00 from the General Capital Improvement Fund for the purchase of a snow thrower, vehicles and accessories for use by the Public Works Department; and PAGE 8 OF 24 Regular Meeting Minutes – May 24, 2021 WHEREAS, the Chief Financial Officer has attested to the availability of the funds in the General Capital Improvement Fund in an amount not to exceed $60,000.00 for this purpose; and WHEREAS, the Borough Council has determined that the Borough should appropriate $60,000.00 from the General Capital Improvement Fund for the purchase of a snow thrower and accessories. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: The amount of $60,000.00 is hereby appropriated from the General Capital Improvement Fund for the purchase of a snow thrower and accessories. R 149-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXECUTION OF AN AGREEMENT WITH THE MORRIS COUNTY COOPERATIVE PRICING COUNCIL TO RENEW MEMBERSHIP THEREIN FOR THE PERIOD OF OCTOBER 1, 2021 THROUGH SEPTEMBER 30, 2026 WHEREAS, the Morris County Cooperative Pricing Council (“MCCPC”) was created in 1974 to conduct a voluntary cooperative pricing system with municipalities, boards of education, and other public bodies located in the County of Morris and adjoining counties; and WHEREAS, the purpose of the MCCPC is to provide substantial savings on various goods and services to its members through the cooperative public bidding process; and WHEREAS, the Borough of Madison desires to enter into an Agreement with the MCCPC, which is administered by Randolph Township as Lead Agency to renew its membership in the MCCPC for the period of October 1, 2021 through September 30, 2026. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. R 152-2021 RESOLUTION OF THE BOROUGH OF MADISON ACCEPTING AN AMENDED SPENDING PLAN FOR THE AFFORDABLE HOUSING TRUST FUND WHEREAS, on July 8, 2015, the Borough of Madison (“Borough”) filed a declaratory judgment action with the New Jersey Superior Court, Morris County seeking to declare its HEFSP as being constitutionally compliant and seeking protection and repose against exclusionary zoning litigation for a ten (10) year period; and WHEREAS, on August 10, 2020 the Borough executed a Settlement Agreement with Fair Share Housing Center that identified the Borough’s affordable housing obligation, compliance mechanisms, and other terms intended to promote the production of affordable housing; and WHEREAS, the Borough of Madison currently has an approved development fee ordinance and affordable housing trust fund in place which includes development fees, payments from developers in lieu of constructing affordable units on-site, barrier free escrow funds, and other funds collected in connection with the Borough’s affordable housing program; and WHEREAS, the Borough requires approval of an amended spending plan in order to utilize funds within its affordable housing trust fund in accordance with its Settlement Agreement with Fair Share Housing Center (FSHC); and WHEREAS, N.J.A.C. 5:93-8-9. requires a municipality with an affordable housing trust fund to receive approval of a spending plan from COAH or Superior Court prior to spending any of the funds in its housing trust fund; and WHEREAS, N.J.A.C. 5:93-5.1(c) requires a spending plan to include the following: 1. A projection of revenues anticipated from imposing fees on development, based on pending, approved and anticipated developments and historic development activity; 2. A projection of revenues anticipated from other sources, including payments in lieu of constructing affordable units on sites zoned for affordable housing, funds from the sale of units with extinguished controls, proceeds from the sale of affordable units, rental income, repayments from affordable housing program loans, and interest earned; PAGE 19 OF 24 Regular Meeting Minutes – May 24, 2021 3. A description of the administrative mechanism that the municipality will use to collect and distribute revenues; 4. A description of the anticipated use of all affordable housing trust funds pursuant to N.J.A.C. 5:93-8.16; 5. A schedule for the expenditure of all affordable housing trust funds; 6. If applicable, a schedule for the creation or rehabilitation of housing units; 7. A pro-forma statement of the anticipated costs and revenues associated with the development if the municipality envisions supporting or sponsoring public sector or non-profit construction of housing; and 8. A plan to spend the trust fund balance as of July 17, 2008 within four years of the Council’s approval of the spending plan, or in accordance with an implementation schedule approved by the Council; 9. A plan to spend and/or contractually commit all development fees and any payments in lieu of construction within three years of the end of the calendar year in which funds are collected, but no later than the end of third round substantive certification period; 10. The manner through which the municipality will address any expected or unexpected shortfall if the anticipated revenues from development fees are not sufficient to implement the plan; and 11. A description of the anticipated use of excess affordable housing trust funds, in the event more funds than anticipated are collected, or projected funds exceed the amount necessary for satisfying the municipal affordable housing obligation. WHEREAS, the Borough of Madison has prepared a Spending Plan consistent with P.L. 2008, c. 46, COAH regulations, and the Settlement Agreement with FSHC. NOW THEREFORE BE IT RESOLVED that the Governing Body of the Borough of Madison, Morris County requests that Superior Court review and approve Madison’s spending plan. R 153-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING CANCELLATION OF $595.68 IN LATE FEES FOR REAL PROPERTY TAX PAYMENT WHEREAS, the Borough Administrator and Tax collector have recommended approval of a request to cancel $595.68 in late fees due to extraordinary circumstances for delinquent payment of second quarter 2021 taxes on property at 17-33 Madison Avenue, Block 1301, Lot 15; and WHEREAS, the Borough Council has determined to cancel said late fees and interest thereon. There was no Council discussion and the motion passed with the following roll call vote recorded: Yeas: Ms. Baillie, Ms. Byrne, Mr. Hoover, Ms. Ehrlich, Mr. Landrigan Abstain: Ms. Coen Nays: None R 156-2021 RESOLUTION OF THE BOROUGH OF MADISON SUPPORTING ENVIRONMENTAL CONSERVATION POTENTIAL OF THE DREW FOREST WHEREAS, consistent with the goals of the 2020 Open Space and Recreation Plan, as adopted as an Element of the Borough’s Master Plan, to preserve and protect the Borough’s unique cultural and historic sites in order to strengthen community assets; preserve natural systems and environmentally sensitive areas for the community and the wildlife it supports; protect the Buried Valley Aquifer; and create opportunities for additional resource-based recreation while fostering the growth and sustainability of the Borough’s urban forest; and WHEREAS, the Open Space Recreation and Historic Preservation Committee voted to recognize the importance of Drew University to the Borough of Madison; and WHEREAS, the Open Space Recreation and Historic Preservation Committee recognized the importance of the Drew Forest as a significant element of the Drew University campus and education; and WHEREAS, the Borough Council of the Borough of Madison also recognizes the significance of the Drew Forest to the Borough of Madison, Morris County and the Drew University community for the following reasons: The Forest provides biodiversity, groundwater recharge and carbon storage; The Forest is a living classroom for teaching and research for Drew students and the wider community; For the past 12 years, 22 acres of the 45 forested acres known as the Zuck Arboretum and the Hepburn Woods have been restored through the Drew Forest Restoration Project; In 2012, Drew University received the Governor’s Environmental Excellence for Healthy Ecosystems for this work; Native trees and plants, and habitats for pollinators, birds and other wildlife have been restored; PAGE 23 OF 24 Regular Meeting Minutes – May 24, 2021 A portion of the Forest lies in the Great Swamp Watershed; The Forest provides recharge and filtering of Madison’s water supply and the Buried Valley Aquifer and reduces flooding and soil erosion by controlling run-off; and The Forest serves as a major cooling zone to offset the urban heat island effect for the Borough. NOW THEREFORE BE RESOLVED, that the Borough Council of the Borough of Madison supports the concept of working with Drew University to maximize the conservation potential of the Drew Forest and minimize development in environmentally sensitive areas of the Drew Forest.
