MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON June 14, 2021 – 6:30 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 14th day of June, 2021. Mayor Conley called the meeting to order at 6:30 p.m. via Teleconference in the Council Chamber of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 10, 2021. APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: EMPLOYEES OF THE MONTH FOR JUNE: Magdalena Martorana, from the Utility Billing Department, has been selected as Employee of the Month for June. For several weeks, Magdalena single-handedly managed the operations of the Utility Billing Department. Along with the usual daily tasks of processing payments, billing and customer service, Magdalena stepped up and took on additional responsibilities while her supervisor was on medical leave. ANNIVERSARY: Bob Vogel, Borough Engineer – will celebrate his 20-year anniversary on June 18. Proclamation Recognizing Juneteenth, Saturday June 19, 2021 Proclamation of the B o r o u g h o f M a d i s on Recognizing PAGE 2 OF 26 Regular Meeting Minutes – June 14, 2021 SATURDAY, JUNE 19, 2021 AS JUNETEENTH WHEREAS, on June 19, 1865, two and a half years after President Lincoln issued the Emancipation Proclamation, Union Soldiers, led by Major General Gordon Granger, arrived at Galveston, Texas with news that the Civil War was over and that enslaved people were now free; and WHEREAS, with its origin in Texas in 1866, Juneteenth is the oldest nationally celebrated commemoration of the ending of slavery in the United States. Since then, Juneteenth has been celebrated in communities across the United States, providing an opportunity to mark the emancipation of enslaved people; and WHEREAS, Juneteenth continues to be the most recognized African American holiday observance, also known as Emancipation Day, Emancipation Celebration, Freedom Day and Jun-Jun; and WHEREAS, Juneteenth symbolizes for many African Americans what the Fourth of July does for all Americans – liberty, freedom and justice for all; and WHEREAS, Juneteenth is a day for us to reflect on the suffering caused by slavery and commit to being allies of our African American friends, family and neighbors; and WHEREAS, Juneteenth commemorates the strength and resolve of African Americans throughout our history and serves as an opportunity to celebrate the rich and numerous contributions of African Americans; and WHEREAS, Juneteenth is an opportunity for Madison residents of all races, nationalities and religions to acknowledge the painful history and lasting, systemic impact of slavery and racial injustice in the United States; NOW, THEREFORE, I, Robert H. Conley, Mayor of the Borough of Madison, on behalf of the governing body, do hereby recognize Saturday, June 19, 2021 as Juneteenth to acknowledge the historical significance of the day and recommit to working toward the dismantling of institutionalized racism. _____________________________________ Robert H. Conley, Mayor June 14, 2021 REPORTS OF COMMITTEES Public Safety Ms. Byrne, Chair of the Committee, made the following comments: Madison, Morristown and Cedar Knolls Firefighters recently completed four days of trench rescue training. Firefighters worked in an 8-foot deep trench utilizing specialized equipment and technical skills to secure the trench walls to safely remove a mannequin. This training was made possible with assistance from the PAGE 3 OF 26 Regular Meeting Minutes – June 14, 2021 Madison Police Dept., DPW, Water Dept., and the Hanover Township Sewer Dept. who provided a Vacuum truck for the class. On Tuesday afternoon, June 8th, a lightning storm came through Madison effecting five properties in town. Three residential properties that were struck, each requiring Madison to receive mutual aid assistance from Chatham Borough and Green Village Fire Departments. All three homes sustained electrical surges damaging appliances and electronics within the houses. The two municipal properties that were struck sustained damage to the radio communications system, electronic equipment used to maintain the water levels in the municipal water tanks and some security cameras. All damaged equipment has been repaired and/or replaced. Finance and Borough Clerk Ms. Baillie, Chair of the Committee, made the following comments: Ms. Baillie noted that the 2020 municipal audit is now complete and will be presented at the next Council meeting. Madison will receive funding from a finalized American Rescue Plan in the amount of $1,847,818.66. Funds will be distributed half this year and half next year. The Borough Administration will come to Council with suggestions on how and where to use funds. Public Works and Engineering Mr. Hoover, Chair of the Committee, made the following comments: Restoration of the Hartley Dodge Memorial Plaza began with the removal of granite plaza block on Monday June 7th. Several meetings were held with the general contractor and architect and reasonable progress is being made. Please note all general public access to the municipal building is via the west wing courtroom ramp for the duration of this six month project. Tree removal work has been completed at Anthony Drive and Wayne Blvd and curb and driveway replacement, topsoil and seed on the north side of the roads has also been completed. A weekly status report is available on the Rosenet website for those who are interested. If there are specific concerns about the construction work please contact either the Madison Police or the Engineer. Crack sealing work on Noe Avenue, Union Avenue, Essex Place, Union Hill Road, Kings Road and Winding Way was complete this week. A snow loader purchased from the Town of Kearny will be delivered this week. The Public Works Department assisted with the Fire Department trench training this week. The 2021 tree planting program is also completed. This is the final week of the Recreation Department spring sports schedule, with summer sports beginning the week of June 21st. A draft fall schedule should be ready by July 1st. The Madison Environmental Commission reports a successful milkweed giveaway and a Friends of the Drew Forest group is support the proposed resolution. The Shade Tree Management Board will meet Thursday, June 17th. Community Affairs Ms. Coen, Chair of the Committee, made the following comments: Ms. Coen noted the Hidden Figures program this past weekend and thanked the committee for their efforts, as well as the Madison Board of Education and Borough for their support. The Downtown Development Commission will once again hold Bottle Hill Day this fall, on Saturday, October 2nd. The Farmers’ Market will hold raffles for both a 50/50 and tricky tray on June 17th. The Taste of Madison is ongoing with passports available at Gary’s Wine and Marketplace and a Ladies Night Out is planned for September. PAGE 4 OF 26 Regular Meeting Minutes – June 14, 2021 Utilities Ms. Ehrlich, Chair of the Committee, made the following comments: American Electrical Testing has completed the first phase of upgrades to the electric system. On June 3rd, the Electric Department repaired a broken utility pole on Morris Place. A June 9th power outage, caused by a squirrel, was quickly repaired. The 2021 Water Quality Report has been mailed to all resident. Residents are reminded to use rain sensor with sprinkler systems and remember no watering between 8:00 a.m. and 8:00 p.m. Health Mr. Landrigan, Chair of the Committee, made the following comments: Reporting for the Health Department, COVID 19 case numbers in NJ are some of the lowest in the nation. Madison reports a total of 874 cases with no new cases reported. Vaccination efforts in Morris County are above 70%, with most location providing vaccine on the same day or as walk-in appointments. Email dated June 4, 2021 from Tony Mezzacca of Main Street, regarding the handicapped parking spaces on Lincoln Place. Email dated June 10, 2021 from David Steketee of Ferndale Road, regarding outside opposition at planning board meetings. Email dated June 11, 2021 from David Steketee of Ferndale Road, regarding a Facebook post by Corporal Stephanie Aquino. AGENDA DISCUSSIONS 06/14/2021-1 NJ DEPARTMENT OF ENVIRONMENTAL PROTECTION GREEN ACRES URBAN PARKS INITIATIVE PROGRAM – DODGE FIELD PLAYGROUND PAGE 5 OF 26 Regular Meeting Minutes – June 14, 2021 Ms. Baillie provided information regarding a proposed grant application noting that the one playground in the Borough of Madison, located at Dodge Field, is old, tired and not handicapped accessible. The Borough has an opportunity to apply for a $500,000 Green Acres Urban Parks Initiative grant through the NJ Department of Environmental Protection. Ms. Coen noted that the playground will benefit all children with special needs. Mayor Conley opened the public hearing on Urban Parks Initiative grant. He/she shall limit his/her statement to three (3) minutes or less. Craig Erezuma; Albright Circle, thanked the staff of the Borough, especially, Capt. Joseph Longo and Sgt. Stephanie Aquino, members of the Public Works Department and others for their assistance with a boy scouting event. Clair Whitcomb; Fairwood Road, inquired about the proposed basketball/pickleball court at the Community Pool, asking if the court will be open to all residents. Kathleen Caccavale; Central Avenue, referring to Ordinance 29-2021, asked if there was a green needs assessment conducted for this project. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of June 28, 2021 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Madison Eagle, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. PAGE 16 OF 26 Regular Meeting Minutes – June 14, 2021 R 162-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING REVISED CONTRACT WITH LAND CONSERVANCY OF NJ FOR OPEN SPACE SERVICES WHEREAS, The Land Conservancy has previously been engaged to assist the Borough Council and Open Space , Recreation and Historic Preservation Committee with a variety of Open Space Services; and WHEREAS, the Borough Council has agreed to revise the contract with the Land Conservancy of New Jersey (“Land Conservancy”) for such services to increase the base contract from not to exceed $5,000.00 to not to exceed $7,000.00 and added a lump sum payment of $12,000.00 for professional services to assist in the preservation of a portion of the Drew University campus as Open Space; and WHEREAS, funds are available in the Open Space, Recreation and Historic Preservation Trust Fund. R 163-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING SUBMISSION OF GRANT APPLICATION TO STATE OF NEW JERSEY GREEN ACRES PROGRAM FOR THE DODGE FIELD PLAYGROUND WHEREAS, the New Jersey Department of Environmental Protection, Green Acres Program (“State”), is providing grants through the Urban Parks initiative; and WHEREAS, the Borough of Madison desires to further the public interest by obtaining grant funding in the amount of $500,000.00 from the State to fund the following project: To build a new handicap accessible playground at Dodge Field at a cost of $500,000.00. NOW, THEREFORE, the governing body resolves that the Mayor Robert H. R 175-2021 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2021 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $40,000.00 from the State of New Jersey Department of Environmental Protection and wishes to amend its 2021 Budget to include a $10,000.00 increase in grant funds as revenue. PAGE 24 OF 26 Regular Meeting Minutes – June 14, 2021 R 177-2021 RESOLUTION OF THE BOROUGH OF MADISON AWARDING BID FOR THE PURCHASE OF NEW UNUSED CABLE TO FRANKLIN GRIFFITH WHEREAS, the Borough of Madison publicly advertised for bids for the purchase of new, unused cable in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the apparent low bidder, Turtle & Hughes, was determined to have submitted a defective bid due to mathematical errors and therefore rejected; and WHEREAS, the next lowest responsive bid was submitted by Franklin Griffith, of Trenton, NJ, in an amount not to exceed $63,000.00; and WHEREAS, the Acting Qualified Purchasing Agent, the Borough Attorney and Borough Electric Utility Superintendent have recommended that the Borough Council award the contract to Franklin Griffith in an amount not to exceed $63,000.00; and WHEREAS, the Chief Financial Officer has attested that funds will be available in an amount not to exceed $63,000.00 for this purpose, in Ordinance 31- 2020. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for the purchase of new, unused cable is hereby awarded to Franklin Griffith, of Trenton, NJ, based upon its bid not to exceed $63,000.00. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into the contract with Franklin Grifith in a form acceptable to the Borough Attorney. R 178-2021 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEMBERSHIP IN THE 2021-2022 EMPLOYEE WELLNESS PROGRAM THROUGH THE MADISON YMCA WHEREAS, the Personnel Director recommends that the Borough continue to offer employees and volunteers opportunities for wellness including assistance to become healthier and more productive employees; and WHEREAS, the Borough of Madison desires to contract with the Madison YMCA for a partially subsidized employee wellness program, to offer the benefit of a discounted membership to employees. Participating employees would pay a portion PAGE 25 OF 26 Regular Meeting Minutes – June 14, 2021 of the membership fees. The Borough contributions would not exceed $500 per employee/family and not exceed a total of $25,000 in any calendar year; and WHEREAS, it is anticipated that a healthier work force will increase productivity, improve employee morale and reduce future insurance premiums; and WHEREAS, the Chief Financial Officer has certified that funds are available in Account 229, subaccount 528 for this purpose. This agreement is contingent upon adequate funding therefore in the 2020 Municipal Budget. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that the Mayor and Borough Clerk are hereby authorized to execute an agreement for subsidized employee and volunteer membership with the Madison YMCA. UNFINISHED BUSINESS - None APPROVAL OF VOUCHERS On motion by Ms. Baillie, seconded by Ms. Byrne and carried, the following vouchers of the Borough of Madison were approved for payment, and the supporting documentation of said vouchers was made part of the Supplemental Minute Book.
