MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON October 24, 2022 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 24th day of October, 2022. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 6, 2022. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Pappas Dr. Joseph Fennelly, MD Alfred Garibay APPROVAL OF MINUTES Ms. Coen moved approval of the Executive Minutes of October 12, 2022. Ms. Ehrlich seconded the motion, which passed with a unanimous voice call vote recorded. GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley noted the ten year anniversary of Super storm Sandy and how well the Borough of Madison responded. Mayor Conley thanked the staff and volunteers REPORTS OF COMMITTEES Utilities Mr. Landrigan, Chair of the Committee, made the following comments: The American Electrical Testing contactors are completing their second year of the three (3) year Preventative Maintenance contract for inspecting and testing our two (2) substations, Kings Road Substation and James Park Substation. The Department set a new pole for underground service at 56 Samson Avenue. The crews removed all of the temporary electric service set-up for the Bottle Hill Day festivities. The Electric Department cut down the lines, pulled the electric meters, and removed the utility pole at 28 Walnut Street, in preparation for demolition. The Department is in the process of ordering a new pad mount Transformer to supply power to the new buildings to be constructed on Central Avenue. The Electric Department is working with Tanya Van Order from the Housing Authority to relocate a transformer to “higher ground” in the Chateau Thierry Senior Housing rear parking area. The Department continues to complete solar tie-ins, house services, mark outs, and trouble calls. PAGE 2 OF 19 Regular Meeting Minutes – October 24, 2022 Public Safety Ms. Byrne, Chair of the Committee, made the following comments: The Fire Department visited classes Pre-K thru 8th grade students to teach fire safety. Progress continues on our Municipal Trunked radio system. Antennas and coax cables at both radio transmission sites have been installed. Both sites have been made ready for equipment to be installed by our in-house electrical contractor. We are still anticipating going live on the new radio system by January or February of next year. Firefighters have been mounting equipment on and training with the new Rescue/Pumper. We are targeting the first week of November to put her "in service". On Tuesday morning on October 18th the Fire Department responded into the town of Morristown to assist the Morristown Fire Department at near fatal fire. Volunteer Firefighters are needed. Anyone wishing to join as a Volunteer Firefighter can go to www.MadisonFD.com for more details on how to join and what is required. The Police Department reports that last week, both School Resource Officers conducted safety talks at all elementary schools. The safety talks consisted of topics like Halloween safety, pedestrian and traffic safety, stranger danger, and internet safety. The talks will conclude this week and include Kings Road School, Central Avenue School, and Torey J School. On Saturday October 29th, Madison Police Department will be accepting old medication as part of “D.E.A. Medication Turn-In Day” which will be held 10:00 a.m. to 2:00 p.m. at police headquarters located at 62 Kings Road, Madison, NJ. Community Affairs Mr. Hoover, Chair of the Committee, made the following comments: The next meeting of the Downtown Development Commission will be held on Thursday, October 20th, at 7:15 pm in the Committee Room, 2nd Floor, Hartley Dodge Memorial Building. The Madison Farmers Market season continues through Thursday, November 17th. Madison’s annual fall festival, Bottle Hill Day, which had to be rescheduled due to Hurricane Ian, was again a success. The 6th Annual Trunk or Treat and Pumpkin Illumination will be held on Friday, October 28, beginning at 5:00 pm. Prizes will be given to the top three decorated cars or trucks. Proceeds will benefit the Madison Volunteer Ambulance Corps. Look for registration information on the I Love Madison, NJ, Facebook page. The Madison Chamber of Commerce will display Cornstalks & Scarecrows decorated by chamber businesses will be up on Waverly Place from October 18th through November 1st. The Halloween Parade & Magic Show is scheduled for Saturday, October 29th. Madison Community Arts Center announces that on October 18th, the first gallery show will begin with new Gallery Systems hardware: Madison-affiliated artist Maria Lupo. The show will be on the walls until December 4, 2022. Gallery hours will be posted on the website. The Center will host a TEDx talk on October 25th, including Madison resident Andy Breckman. From November 28th through December 3rd, the Center will host a week- long Festival of Dance featuring a number of dance forms, including Carolyn Dorfman. The festival's final day will be a Benefit for the People of Ukraine, featuring Ukrainian Folk Dancers and the Ukrainian modern dancer Oksana Horban. A small exhibit of art from students in Ukraine will be on the walls. On February 21, a complete show of the Ukrainian student art will be displayed until April 4th in partnership with the Center for Holocaust and Genocide Education at Saint Elizabeth University. We will be hosting several events in concert with this program and are speaking to several partners now. Finance and Borough Clerk Ms. Coen, Chair of the Committee, made the following comments: Ms. Coen thanked all that participated in the Wellness Walk, held Sunday, October 23, 2022, and noted how important mental health care is during the holiday season. PAGE 3 OF 19 Regular Meeting Minutes – October 24, 2022 In anticipation of the November 8th General Election, the County of Morris will hold Early Voting in several locations throughout the County, including the Court Room of the Hartley Dodge Memorial. Early voting will take place from Saturday, October 29th to Sunday, November 6th. Polls will be open from 10:00 am to 8 pm Monday to Saturday and 10:00 am to 6:00 pm on Sunday. On Election Day, polls will be open from 6:00 am to 8:00 p.m. Vote by mail application must be received by the Morris County Clerk before Monday, November 1st. Residents are remaindered that the Electric Utility Rebate program ends December 1st. Forms are available in the Clerk’s Office and the Borough website. Public Works and Engineering Ms. Ehrlich, Chair of the Committee, made the following comments: The Engineering Department reports that construction on the Trails at the Madison Recreation Center is complete. The Department of Public Works is in the process of replacing the broken sidewalk under the Prospect Street rail bridge. They have moved some of the plantings from the Civic Center and replaced at the Train Station. This was done with the help and advice from resident Jocelyn Colquhoun. Thank you to Lisa Ellis for her help with Bottle Hill day. The Sewer Department continues sewer cleaning on a quarterly basis and a huge thank you to Michael Pellessier for getting the word out and keeping residents informed. Leaf season is upon us and pick up will start in some of the heavier area's first. Health Mr. Range, Chair of the Committee, made the following comments: Morris County community level has increased due to increases in hospitalization. Residents are reminded to get COVID boosters available at the Madison Health Department and most pharmacies. Influenza vaccine clinics will be held October 25th for residents at Senior Housing, Chateau Thierry and October 27th for the general public at the Hartley Dodge Memorial. The annual rabies clinic will be held Saturday, December 3rd. COMMUNICATIONS AND PETITIONS The Borough Clerk announced receipt of the following communications: Email dated October 18, 2022, from Lisa Moro, Michele Dabal, and Sharon Streit, pickle ball instructors, thanking the staff of the Department of Public Works for preparing Dodge Field basketball courts for pickle ball lessons. He/she shall limit his/her statement to three (3) minutes or less. Matthew Van Natten; Ridgedale Avenue, suggested funds for the Green Avenue bump outs be spent on pedestrian safety improvements. Thomas Haralampoudis; Pomeroy Road, inquired about funds for streetlights and asked where the lights will be placed. Mr. Haralampoudis also inquired about the safety of street bump outs. AGENDA DISCUSSIONS 10/24/2022-1 HARTLEY DODGE MEMORIAL LIGHTING PROJECT UPDATE John Forte, Hartley Dodge Memorial Trustee, presented a proposed lighting project for the exterior of the HDM building noting that the purpose is to highlight the architectural features of the building and help the building remain relevant. Marcus Dolittle of the firm For Visual Interaction, provided concept plans for the project. ADVERTISED HEARINGS – None Ordinance 46-2022 has a hearing scheduled for November 14, 2022. Lenora Clark; Seven Oak Circle, referring to an article recently published in the Madison Eagle suggested public safety be the top priority of the Borough Council. Suzanne Schreiber; Greenwich Court, raised concern regarding replacement energies, noting there is much we don’t know. Peter Tashima; Britten Street, noted a sign on a pickup truck at the corner of Central Avenue and Main Street and asked that residents think about the impact on the children of Madison. Thomas Haralampoudis; Pomeroy Road, suggested that the Borough electric utility take advantage of recent subsidies and work on new ideas for cleaner energy. Dennis Schreiber; Greenwich Court, noted that it’s a two way street in this town, and hopes that everyone will work together. Denise Katz; Parkside Avenue, stated she is grateful to the Mayor and Council for making decisions regarding cleaner energy for the future. Chris Schorr; Shadylawn Drive, noted how encouraged she is that the Borough is working to find alternatives and working together. Leah Wells; Birch Drive, Vernon, NJ, noted how important bats are to the ecosystem and community and thanked the Mayor and Council for their efforts to save the Drew Forest. WHEREAS, the Borough entered into a contract for a five year term with Suburban Disposal, Inc., to collect and dispose of solid waste within the Borough; and WHEREAS, the contract awarded by Resolution 323-2019 for a three year term provided an option to renew the contract for an additional two-year term; and WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Suburban Disposal, Inc. for an additional two-year term through December 31, 2024, in an amount not to exceed $1,071,000.00, contingent on the availability of funds in the 2023 and 2024 municipal budgets. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The Mayor and Borough Clerk are authorized to execute an extension of the contract for solid waste collection and disposal with Suburban Disposal, Inc. for a two-year term through December 31, 2024. 2. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. R 270-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXTENSION OF THE CONTRACT FOR PREVENTATIVE MAINTENANCE/REPAIR OF SEWER PUMP STATION EQUIPMENT WITH RAPID PUMP & METER SERVICE CO., INC. PAGE 6 OF 19 Regular Meeting Minutes – October 24, 2022 WHEREAS, the Borough entered into a contract for a one year term with Rapid Pump & Meter Service Co., Inc., for Preventative Maintenance/Repair of Sewer Pump Station Equipment; and WHEREAS, the contract awarded by Resolution 306-2021 for a one year term provided an option to renew the contract for two additional one-year terms; and WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Rapid Pump & Meter Service Co., Inc. for an additional one-year term through December 31, 2023, contingent on the availability of funds in the 2023 municipal budget. Pricing to remain the same per the terms of the contract. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The Mayor and Borough Clerk are authorized to execute an extension of the contract for Preventative Maintenance/Repair of Sewer Pump Station Equipment with Rapid Pump & Meter Service Co., Inc. for a one-year term through December 31, 2023. 2. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. R 271-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXTENSION OF THE CONTRACT FOR YARD WASTE COLLECTION AND DISPOSAL SERVICES WITH WASTE INDUSTRIES, INC. WHEREAS, the Borough entered into a contract for a one year term with Waste Industries, Inc., for collection and disposal of yard waste within the Borough; and WHEREAS, the contract awarded by Resolution 341-2019 for a one-year term provided an option to renew the contract for two additional two-year terms. The first two-year extension was authorized by Resolution 273-2020; and WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Waste Industries, Inc. for an additional two-year term through December 31, 2024, in an amount not to exceed $432,000.00, contingent on the availability of funds in the 2023 and 2024 municipal budgets. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. R 272-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXTENSION OF THE CONTRACT FOR COLLECTION AND DISPOSAL OF RECYCLABLE MATERIALS SERVICES WITH SUBURBAN DISPOSAL, INC. WHEREAS, the Borough entered into a contract for a one year term with Suburban Disposal, Inc., for collection and disposal of recyclable materials within the Borough; and WHEREAS, the contract awarded by Resolution 360-2019 for a one-year term provided an option to renew the contract for two additional two year terms two- year term. The first two-year extension was authorized by Resolution 294-2020; and WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Suburban Disposal, Inc. for an additional two-year term through December 31, 2024, in an amount not to exceed $793,000.00, contingent on the availability of funds in the 2023 and 2024 municipal budgets. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The Mayor and Borough Clerk are authorized to execute an extension of the contract for collection and disposal of recyclable materials with Suburban Disposal, Inc. for a two-year term through December 31, 2024. 2. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. R 273-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXTENSION OF THE CONTRACT FOR TREE PRUNING AND TREE REMOVAL SERVICES WITH HONOR TREE SERVICE WHEREAS, the Borough entered into a contract for a one year term with Honor Tree Service, for tree pruning and tree removal services within the Borough; and WHEREAS, the contract awarded by Resolution 63-2022 for a one-year term provided an option to renew the contract for two additional one year terms; and PAGE 8 OF 19 Regular Meeting Minutes – October 24, 2022 WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Honor Tree Service for an additional one-year term through December 31, 2023, contingent on the availability of funds in the 2023 municipal budget. Pricing to remain the same per the terms of the contract. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The Mayor and Borough Clerk are authorized to execute an extension of the contract for tree pruning and tree removal services with Honor Tree Service for a one-year term through December 31, 2023. 2. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. R 274-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING EXTENSION OF THE CONTRACT FOR REMOVAL AND PROPER RECYCLE OF LEAVES WITH NORTHEAST PRODUCTS OF NJ, LLC WHEREAS, the Borough entered into a contract for a three-year term with Northeast Products of NJ, LLC, for removal and proper recycle of leaves within the Borough; and WHEREAS, the contract was awarded by Resolution 302-2020 for a three- year term provided an option to renew the contract for one additional two-year term; and WHEREAS, the Director of Public Works and the Qualified Purchasing Agent have recommended that the Council authorize an extension of the contract with Northeast Products of NJ, LLC for an additional two-year term through January 31, 2025, contingent on the availability of funds in the 2023 and 2024 municipal budgets, in an amount not to exceed $164,780.00. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison in the County of Morris and State of New Jersey as follows: 1. The Mayor and Borough Clerk are authorized to execute an extension of the contract for removal and proper recycle of leaves with Northeast Products of NJ, LLC for a two-year term through January 31, 2025. 2. The terms and conditions of the contract and any other legal documents necessary shall be approved by the Borough Attorney. PAGE 9 OF 19 Regular Meeting Minutes – October 24, 2022 R 275-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A COLLECTIVE BARGAINING AGREEMENT WITH THE FIREFIGHTERS MUTUAL BENEVOLENT ASSOCIATION 911 TELE-COMMUNICATIONS LOCAL NO. 474 WHEREAS, the Borough of Madison (“Borough”) commenced collective negotiations with the Borough of Madison Firefighters Mutual Benevolent Association 911 Tele-Communications Local No. 474 (“FMBA”); and WHEREAS, the Borough was able to successfully negotiate a new collective bargaining agreement with the FMBA for the period January 1, 2022 to December 31, 2025; and WHEREAS, the Mayor and Council have considered the specific terms and conditions contained in the collective bargaining agreement for the above noted bargaining unit. NOW THEREFORE BE IT RESOLVED as follows: 1. The Mayor and Council approve the attached Collective Bargaining Agreement for the above-bargaining unit and the terms and conditions specifically set forth in the agreement; and 2. The Mayor and Council hereby authorize the Borough Administrator, Mayor and Borough Clerk to execute the collective bargaining agreement; and 4. The Mayor and Council authorize the Borough Administrator and CFO to effectuate the collective bargaining agreement. R 276-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING A FEE FOR RECORDING OF BOROUGH COUNCIL MEETINGS BE IT RESOLVED by the Borough Council of the Borough of Madison that Michael Pellessier is hereby approved for a pensionable fee of $1,000.00 per month for the recording and posting of various virtual evening meetings, retroactive to January 1, 2022. R 277-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING MEDICAL AND PRESCRIPTION DRUG PLAN OFFERINGS UNDER THE STATE HEALTH BENEFIT PROGRAM OF THE STATE OF NEW JERSEY WHEREAS, Chapter 78, P.L. 2011 requires a Local Government employer participating in the New Jersey State Health Benefits Plan to offer employees a minimum of three (3) coverage levels options plus a high deductible health plan; and WHEREAS, the Borough of Madison is choosing to satisfy the Chapter 78, P.L. 2011 prescribed minimum by offering the following six (6) plans for the Plan Year 2023 to its eligible employees/eligible dependents. PAGE 10 OF 19 Regular Meeting Minutes – October 24, 2022  NJ Direct 15  NJ Direct 15/25  NJ Direct 20/30  NJ Direct 20/35  Horizon OMNIA  Horizon HD4000 NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1) The Borough shall offer the above referenced six (6) New Jersey State Health Benefit Plans offerings to eligible employees and their dependents. 2) The above referenced six (6) New Jersey State Health Benefit Plan offerings will be the sole offerings for the 2023 Plan Year with these plan offerings to remain fixed and in effect until the earlier of the following: a. Change in the New Jersey State Health Benefit Plan offerings b. Change in premiums such that the offerings that are in addition to the NJ Direct 15 Plan carry with them materially higher premiums than the NJ Direct 15 plan. c. Borough of Madison withdrawal from the New Jersey State Health Benefit Plan program d. Such other changes as may be mutually agreed through the collective bargaining process. R 278-2022 RESOLUTION OF THE BOROUGH OF MADISON AWARDING A CONTRACT FOR THE PURCHASE OF PENN GLOBE LED ALUMINUM LAMPPOSTS TO FACILITIES SOLUTIONS GROUP (FGS) WHEREAS, the Borough of Madison desires to award a contract for the purchase of Penn Globe LED Aluminum lampposts to an authorized vendor under Facilities Solutions Group (FSG); and WHEREAS, the purchase of goods and services by a local contracting unit is authorized by the Local Public Contracts Law, N.J.S.A. 40A:11-10, et seq.; and WHEREAS, Facilities Solutions Group (FSG) has been awarded contract #21060101; and WHEREAS, the Qualified Purchasing Agent has recommended that the Borough Council utilize this contract for the purchase of Penn Globe LED Aluminum lampposts in the amount of $146,840.91; and WHEREAS, funds are available in the Electric Capital Account E-08-55-637- 602, and the availability of funds has been certified by the Chief Financial Officer. R 282-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING 5K RUN/FUN WALK IN MADISON ON SATURDAY, NOVEMBER 19, 2022, SPONSORED BY TOREY J SABATINI SCHOOL PTO WHEREAS, the Torey J. Sabatini PTO has requested permission to hold a 5K run/fun walk in Madison on Saturday, November 19, 2022; and WHEREAS, the walk will begin at 9:00 a.m., on Glenwild Road and continue on Loantaka Road, Woodland Road and Green Village Road on the route approved by the Madison Borough Police Chief, said route being approximately 3.1 miles long; and WHEREAS, Police Chief Miscia recommends approval of this request. R 283-2022 RESOLUTION OF THE BOROUGH OF MADISON APPROVING TEMPORARY SIGNS FOR FAMILY PROMISE OF MORRIS COUNTY WHEREAS, Family Promise of Morris County has requested permission to put up temporary signs advertising the Homebound Hustle 5k & 1 Mile Walk on November 5, 2022, at Central Park of Morris County; and WHEREAS, up to ten (10) signs would be located at various intersections and in the Borough right-of way, commencing on October 25, 2022 and removed by November 8, 2022; and WHEREAS, the Zoning Officer has recommended that a temporary sign permit be issued. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that the request of Family Promise of Morris County to put up temporary signs as described herein from October 25, 2022 and removed by November 8, 2022, is approved. R 284-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING USE OF COMPETITIVE CONTRACTING FOR RETAINING A CONSULTANT TO PERFORM HOME ENERGY AUDITS PAGE 14 OF 19 Regular Meeting Minutes – October 24, 2022 WHEREAS, the Borough of Madison (“Borough”) wishes to retain a qualified consultant to perform home energy audits in Madison with the cost of such audits being borne by the residents; and WHEREAS, the Borough, pursuant to N.J.S.A. 40A:11-4.3, wishes to authorize the use of competitive contracting to procure these services. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey authorizes the Borough’s Qualified Purchasing Agent to issue a Request for Proposal in accordance with the requirements of competitive contracting for retaining the services of a qualified consultant to perform home energy audits in Madison. R 285-2022 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING THE INTENT TO ISSUE A NEW LICENSE PURSUANT TO N.J.S.A. 22:1-19.1 ET SEQ FOR THE ISSUANCE A NEW THEATER EXCEPTION PLENARY RETAIL CONSUMPTION LIQUOR LICENSE PURSUANT TO N.J.S.A. 33:1-12.2 WHEREAS, N.J.S.A. 33:1-19.1 and 19.2 provide that a new liquor license may be issued to a theater with no less than 50 seats without regard to any other restriction on the number of such licenses in any municipality; and WHEREAS, N.J.S.A. 33:1-19.1 et seq. provides that, whenever a municipality is authorized to issue one or more new or additional plenary retail consumption, seasonal retail consumption or plenary retail distribution licenses or a plenary retail consumption license and the governing body by resolution determines to permit the issuance thereof, the governing body shall cause to be published a notice of the proposed issuance of such a license and that applications therefore will be accepted by the governing body; and WHEREAS, the Borough Council is advised that the owner of a theater seeks the issuance of a new theater exception plenary retail consumption license; and WHEREAS, the Borough Council has determined that it wishes to issue same. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey based upon the foregoing, that it will accept applications pursuant to the aforesaid statute for the issuance of a theater exception plenary retail consumption license (#37); and BE IT FURTHER RESOLVED, that the Borough Clerk be and is hereby authorized and directed to cause a notice to be published in the newspaper circulated generally in the municipality be not less than two insertions, one week PAGE 15 OF 19 Regular Meeting Minutes – October 24, 2022 apart, the second of which shall be published not less than thirty days prior to the time and date specified in the notice, after which no further applications will be accepted; and BE IT FURTHER RESOLVED, that in order for an applicant to qualify, it must operate a theater facility in compliance with all applicable laws, ordinances, rules and regulations. The governing body reserves the right to reject all applications; and BE IT FURTHER RESOLVED, that upon receipt of applications, the governing body shall approve the issuance of a theater exception plenary retail license to qualified applicants, therefore upon payment of license fees; and BE IT FURTHER RESOLVED, that the Borough Clerk be and is hereby authorized to undertake all administrative acts required and to resolve any issues not specifically governed by the forgoing, in accordance with the law. R 286-2022 RESOLUTION OF THE BOROUGH OF MADISON AWARDING A CONTRACT TO RIVERVIEW PACING, INC. FOR THE GREEN AVENUE PEDESTRIAN SAFETY PROJECT IN THE AMOUNT OF $295,557.50 WHEREAS, the Borough of Madison publicly advertised for the Green Avenue Pedestrian Safety Project (the “Contract”) in accordance with the Local Public Contracts Law, N.J.S.A. 40A:11-1, et seq.; and WHEREAS, the Borough received three (3) bids; and WHEREAS, the lowest qualified bid was submitted by Riverview Paving, Inc., Hackettstown, NJ, in the amount of $295,557.50; and WHEREAS, the Qualified Purchasing Agent and Assistant Borough Engineer have recommended that the Borough Council award the contract to Riverview Paving, Inc., of Hackettstown, NJ, in the total amount not to exceed $295,557.50 for the Green Avenue Pedestrian Safety Project, conditioned upon the Borough Legal Department approval and concurrence by the New Jersey Department of Transportation; and WHEREAS, the Chief Financial Officer has attested that funds will be available for this purpose in Ordinance 41-2022. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. The contract for the Green Avenue Pedestrian Safety Project is hereby awarded to by Riverview Paving, Inc., Hackettstown, NJ, based upon its bid in the amount of $295,557.50, conditioned upon the Borough Legal Department approval and concurrence by the New Jersey Department of Transportation. R 287-2022 RESOLUTION OF THE BOROUGH OF MADISON REQUESTING THE DIRECTOR OF LOCAL GOVERNMENT SERVICES TO APPROVE THE INSERTION OF AN ITEM OF REVENUE IN THE BUDGET OF THE YEAR 2022 WHEREAS, N.J.S.A. 40A:87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any County or Municipality when such items shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget; and WHEREAS, said Director may also approve the insertion of any item of appropriation for equal amount; and WHEREAS, the Borough of Madison will receive $3,900.00 from the Morris County Alliance Against Alcoholism and Drug Abuse Supplemental Grant and wishes to amend its 2022 Budget to include this amount as revenue.
