MINUTES OF A REGULAR MEETING OF THE MAYOR AND COUNCIL OF THE BOROUGH OF MADISON November 25, 2024 - 7 p.m. CALL TO ORDER The Regular Meeting of the Mayor and Council of the Borough of Madison was held on the 25th day of November, 2024. Mayor Conley called the meeting to order at 7:00 p.m., in the Committee Room of the Hartley Dodge Memorial, Kings Road, in the Borough of Madison. STATEMENT IN COMPLIANCE WITH THE OPEN PUBLIC MEETINGS ACT The Borough Clerk read the statement pursuant to the Open Public Meetings Act: “In compliance with the Open Public Meetings Act, adequate notice of this meeting of the Council was provided by transmitting a copy of the meeting notice to the Madison Eagle and Morris County Daily Record, posting a copy on the bulletin board at the main entrance of the Hartley Dodge Memorial, and filing a copy in the office of the Clerk, all on January 12, 2024. This Notice was made available to members of the general public.” ROLL CALL The Borough Clerk called the roll and the following acknowledged their presence: Mayor Robert H. Seconded: Ms. Ehrlich Vote: Approved by voice vote RECONVENE IN COUNCIL CHAMBER Mayor Conley reconvened the Regular Meeting at 8 p.m. in the Council Chamber with all members present. The Pledge of Allegiance was recited by all. Mayor Conley asked for a moment of silence for the passing of Madison residents Jake Mocko and Andrew Cobb, III. APPROVAL OF MINUTES - None GREETINGS TO PUBLIC Mayor Conley made the following comments: Mayor Conley welcomed all present at tonight’s Council meeting and those joining virtually. Mayor Conley noted his participation at the New Jersey League of Municipalities Annual Conference held in Atlantic City, last week. Mayor Conley thanked Police Chief John Miscia and Capt. Joseph Longo for their presentation of the ARRIVE program presented at a roundtable in Atlantic City. Mayor Conley noted a recent grant award from Morris County for the preservation of the Drew Forest in the amount of $1,087,766.00. REPORTS OF COMMITTEES Public Safety Mr. Range, Chair of the Committee, made the following comments: The Police Department has been planning for Friday’s Christmas Parade for the past several weeks. The department will have a full complement of our officers present on scene and safety measures will be in place to ensure that everyone will feel safe and secure. The planning committee has also worked with federal, state, and county partners to ensure a safe event. There will be additional barriers up to line Main Street so there are no safety issues with visitors crossing the street during the parade or children running to get candy in the roadway. Last week, Chief Miscia and Captain Longo attended the NJ League of Municipalities Conference in Atlantic City, NJ as part of Mayor Conley’s roundtable to discuss the ARRIVE Together program and the benefits to residents, visitors, and officers. The ARRIVE program, is a program where a counselor is partnered with a police officer to handle calls where individuals are in mental crisis. Madison was one of the first towns in Morris County to adopt and take part of this program. For more information on ARRIVE, log on the Rosenet.org and in the search tab enter “Arrive Together Program”. The Fire Department notes that the outdoor fire ban has been lifted, but reminds everyone to be careful. As we are moving into the holiday season, it is important to make sure residents don’t use any worn or damaged holiday lights and electrical cords. Always make sure that any electric cord or electric decoration has the UL label on the cord. It is especially important to take care with any candles. Captain Blair and Lieutenant PAGE 2 OF 17 Regular Meeting Minutes – November 25, 2024 Webb both completed the 101-hour fire/arson investigation course. Next week the Fire Department will be doing confined space rescue training with the Picatinny Arsenal, Cedar Knolls Fire Department at Madison Fire Headquarters. Finance and Borough Clerk Ms. Ehrlich, Chair of the Committee, made the following comments: Ms. Ehrlich reported that the NJ Anchor tax relief program filing has been extended and refunds are paid by direct deposit or check to the requestor. Budget season has arrived with tonight’s presentation on the 5-yr Capital Budget. No Action is required this evening but an opportunity for the residents to see the proposed plan. The budget schedule is similar to past years with presentation from Department Heads and utility budgets. Introduction is scheduled for March 24th with a hearing and final adoption planned for April 28, 2025. Public Works and Engineering Mr. Landrigan, Chair of the Committee, made the following comments: While crews are out and working extra hours, it takes almost three weeks for the DPW to make it around the Borough picking up leaves. The DPW thanks the residents for their patience. Crews have completed the third time around the Borough with the leaf vacuums, with a transition to claws during the rain; will now start the fourth trip around. Pumpkins can be recycled at the DPW Garage. They can be dropped off at any time in the truck marked pumpkin recycling. Repair work is continuing on the DPW roof trusses. Storm drains and swales were cleaned in preparation of the recent, much needed, rainfall. Utilities Mr. Haralampoudis, Chair of the Committee, made the following comments: Mr. Haralampoudis noted an ordinance regrading water rates for introduction this evening. The proposed ordinance will encourage conservation of water. Mr. Burnet will have a presentation. The Water Department repaired an underground water line on November 15th. Community Affairs Ms. Honohan, Chair of the Committee, made the following comments: Ms. Honohan reminded residents that this Friday will be the annual Christmas parade and tree lighting ceremony. The Borough once again thanks the Toto Family for the decoration at the Train Station and The Madison Farm & Artisan Market is open for business every Saturday through December 14th in the Prospect Street Parking Lot from 9:00 am until 2:00 pm. Health Mr. Forte, Chair of the Committee, made the following comments: The Madison Health Department will host a rabies clinic on Saturday, December 7, 2024, from 10:00 am to noon, at the Madison Volunteer Ambulance Corp building on Prospect Street. Information is available on the Borough website. COMMUNICATIONS AND PETITIONS – None PAGE 3 OF 17 Regular Meeting Minutes – November 25, 2024 INVITATION FOR COMMENT (1 of 2) Mayor Conley opened the meeting to the public for their opportunity to ask questions and make comments on those items listed on the Agenda only. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Judy Kroll; Laurel Way, representing the Friends of the Drew Forest, noted her support for a resolution to include Madison in the federal Highlands boundary and stated ten things the Friends are thankful for including support and funding to purchase the forest. Since no other member of the public wished to be heard, the invitation for discussion was closed. AGENDA DISCUSSIONS 11/25/2024-1 CLIMATE ACTION RECOMMENDATIONS Ms. Ehrlich presented the 2025 Climate Action Recommendations and Initiatives noting that the 2024 Climate Action Annual Report described progress towards Madison’s climate goals to cut carbon pollution and increase our resiliency to the changing climate and new or adjusted climate actions developed in response. Recommendations include engaging a consultant to implement electrical grid analysis plan, perform accommodation analysis for potential solar generation at MPS sites, expedite solar installations at Community pool parking lot and DPW complex and engage an HVAC engineer to create electrification plans for municipal buildings. Following the presentation there was agreement to list a resolution adopting 2025 Climate Action Recommendations on the Consent Agenda. Resolution 324-2024 is listed on the Consent Agenda. 11/25/2024-2 WATER RATE AMENDMENT ORDINANCE Mr. Burnet provided information regarding the water utility noting source and capacity, noting the Borough billed for 73,657,255 cu ft. of water in 2023. On the hottest days of the year, the Borough is pumping 3.2 million gallons a day. At times, water consumption at 4am exceeds water consumption at 7am. Mr. Burnet recommends a higher rate for consumption over 10,000 that would generate an additional $75-85k in revenue if usage continues at the same level. But the goal is not to increase revenue, it’s to reduce the consumption of water and strain on our system. This change would impact about 420 bills (2%) out of the 19,000 residential bills we send annually. Following the presentation there was agreement to list an ordinance for introduction. Ordinance 37-2024 is listed for Introduction. 11/25/2024-3 FIVE-YEAR CAPITAL PLAN Mr. Burnet noted the 5 year capital plan, which contains purchases and projects compiled by Administration and Department Heads. Council will hear presentations from Department Heads in the first few meetings of 2025, outlining capital projects and the proposed road program. PAGE 4 OF 17 Regular Meeting Minutes – November 25, 2024 ADVERTISED HEARINGS Ordinances introduced on November 13, 2024 will have a hearing date of December 2, 2024 and December 9, 2024 INVITATION FOR COMMENT (2 of 2) Mayor opened the meeting to the public for their opportunity to ask questions and make comments on any subject. Mayor asked that, upon recognition by the Meeting Moderator, each person give his/her name and address in an audible tone of voice, for the record. He/she shall limit his/her statement to three (3) minutes or less. Jim Burnet; Main Street, provided information regarding vandalism at the First Presbyterian Church Cemetery noting multiple headstones have been damaged. Mr. Burnet encouraged anyone with information to contact the Madison Police Department. Kathi Caccavale; Central Avenue, encourage funding in the next year’s budget for pedestrian safety and for green infrastructure. Ms. Caccavale also thanked the Mayor and Council and Administration for their support with climate action change. And congratulated the Borough for again receiving recognition from the State with the highest points for a midsize municipality. Alix Jennings; Edgewood Road, offered her support for the Immigration Trust Act legislation and encouraged the Council to pass a new resolution of support. Tricia Coyle; Stafford Drive, noted a welcoming resolution pass by the Council and offered support for several reasons, including the importance of feeling safe in our community. Lisa Jordan; Loantaka Way, noted the success of the Climate Action Committee and encouraged the Council to support the Immigration Trust Act legislation. Peter Fried; Morris Place, noted his parents escaped from Germany and offered support for the Immigration Trust Act legislation. Paul Daly; Longview Avenue, member of the Complete Streets Committee, suggested a broader view of safety and noted a lot more work that could be done. Since no other member of the public wished to be heard, the invitation for discussion was closed. INTRODUCTION OF ORDINANCES The Clerk made the following statement: Ordinances scheduled for introduction and first reading tonight will have a hearing during the meeting of December 9, 2024 in the 2nd Floor Council Chamber of the Hartley Dodge Memorial Building, Kings Road, in the Borough of Madison at 8 p.m., or as soon thereafter as practical, for further consideration and final adoption. Said ordinances will be published in the Morris County Daily Record, be posted at the main entrance to the Borough offices and be made available to members of the public requesting same, as required by law. PAGE 5 OF 17 Regular Meeting Minutes – November 25, 2024 Mayor Conley called up Ordinances for first reading and asked the Clerk to read said ordinance by title: ORDINANCE 36-2024 ORDINANCE OF THE BOROUGH OF MADISON REVISING ORDINANCE 30-2022, SETTING THE SALARY RANGES FOR NON- UNION FULL-TIME EMPLOYEES Ms. Ehrlich moved that Ordinance 36-2024, which the Borough Clerk read by title, be adopted. Mr. Range seconded the motion. There was no Council discussion, and the motion passed with the following roll call vote recorded: WHEREAS, the Borough Council has determined to revise an ordinance setting salary ranges for non-union full-time employees; and WHEREAS, these salary ranges are for guidance purposes only when setting and reviewing employee salaries. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, County of Morris, State of New Jersey, as follows: Section 1.Ordinance 30-2022 setting the salary ranges for non-union full- time employees is hereby revised as follows: Section 2. (2) Single family residences shall be charged $0.0700 per cubic foot of water over 10,000 in any quarter. WHEREAS, Borough Chief Financial Officer has further recommended the follow changes to Section 190-32 and 190-33 of the Borough Code: § 190-32 Water rates for metered service. C. Borough-owned residential water meters. Any residential water customer with a one-inch water service shall be levied the minimum charge for a 3/4 inch service. Any residential water customer with two-inch water service whose average quarterly usage is less than the minimum usage specified in § 190-32B (Article XIII) of the Borough Code by at least 25% in a calendar year would have their water bill set for the following year at the minimum charge for the next smaller meter size or actual water usage, whichever is greater. D. The Chief Financial Officer shall increase all rates in § 190-32A and B by 10% effective on January 1, 2023. Beginning on January 1, 2024, and annually thereafter, the The Chief Financial Officer shall adjust all rates in § 190-32A and B not to exceed the cost of living adjustment. The cost of living adjustment shall be the higher of 2.0% or the Cost of Living Cap Adjustment annually promulgated by the NJ Director of Local Government Services based on the Implicit Price Deflator for State and Local Governments for New Jersey as published by the U.S. Department of Commerce, Bureau of Economic Analysis. § 190-33 Temporary permits. Paragraph/Section E. Temporary services are provided for in § 190-14 herein: up to $250 $500 per quarter per residential unit and up to $200 $400 per quarter per 1,000 square feet of commercial space. Labor, excavation and material shall be provided for by the applicant. If consumption warrants it, PAGE 7 OF 17 Regular Meeting Minutes – November 25, 2024 the Chief Financial Officer may determine that the customer shall provide the Borough with a deposit of $250 $750 for a temporary water meter which shall be installed by the Borough and read quarterly with the customer being billed based on the then current rates. The water meter deposit shall be promptly refunded when the undamaged temporary meter is returned to the Borough. WHEREAS, Borough Council, after due consideration has determined to proceed with said recommendation. NOW, THEREFORE, BE IT ORDAINED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: SECTION 1: Section 190-32 and Section 190-33 of the Borough Code entitled “Water Rates for Metered Service” is hereby amended to revise the water utility rates as set forth herein. SECTION 2: All other rates and terms remain the same, except those changed herein. SECTION 3: This Ordinance shall take effect on January 1, 2025. Mr. Haralampoudis moved that Ordinance 37-2024, which the Borough Clerk read by title, be adopted. Mr. Landrigan seconded the motion. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey, that Kristopher MacDougall is hereby appointed to the position of Confidential Assistant in the Public Works Department, effective immediately, to be compensated at the annual salary of $143,000.00. R 323-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING RYAN BAGLEY TO THE POSITION OF APPRENTICE LINEMAN WHEREAS, the Electric Utility Superintendent and Personnel Director have recommended hiring Ryan Bagley to the position of Apprentice Lineman in the Electric Utility Department; and WHEREAS, the Borough Council agrees with this recommendation. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, that Ryan Bagley is hereby appointed to the position of Apprentice Lineman in the Electric Utility Department, effective immediately, to be compensated in accordance with the current Collective Bargaining Agreement for Electric Utility Department Employees at an annual salary of $65,784.00. R 324-2024 RESOLUTION OF THE BOROUGH OF MADISON ADOPTING THE 2025 CLIMATE ACTION RECOMMENDATIONS WHEREAS, the Madison governing body adopted long-term climate goals through Resolution 63-2023, aligning Madison with New Jersey state goals for greenhouse gas reduction and resiliency through climate adaptation; and PAGE 9 OF 17 Regular Meeting Minutes – November 25, 2024 WHEREAS, Resolution 63-2023 initiated a recurring Climate Action Process to measure progress, develop recommendations to meet Madison’s climate goals, and present proposed actions to the governing body for adoption; and WHEREAS, the Climate Action Ad Hoc Committee (the “Committee”) presented recommendations for 2025 to the governing body on November 25, 2024, identifying four climate actions to pursue in the coming year to support Madison’s objectives to accelerate renewable energy and reduce building emissions through electrification; and WHEREAS, these recommendations were prepared by the Committee in partnership with Borough Administration and its consulting professionals, department heads and staff, and members of other boards and commissions to gauge the feasibility and impact of potential climate actions; and WHEREAS, the 2025 recommendations build on past years’ actions, grant awards, and successful initiatives and will continue to support Madison in reducing demand for fossil fuels, strengthening our community against the impacts of climate change, and acting locally to engage in New Jersey’s clean energy transition. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: (1). The following 2025 Climate Action Recommendations are adopted to demonstrate an ongoing commitment to climate action and help Madison continue the path to achieving its energy goals: a) Engage an electric utility consultant to implement Phase 1 of the electrical grid analysis plan entitled “GIS Implementation and Benefits” by Asplundh Engineering. b) Perform grid accommodation analysis for potential solar generation at Madison public school sites. c) Begin outreach, planning, and design for two additional municipal solar installations to be bid-ready once the MRCC solar project is operating. d) Engage an HVAC engineer to analyze needs and develop electrification plans for the Public Safety Complex, Hartley Dodge Memorial, the James Building (METC), the Library, and the DPW garage. (2). The Committee shall undertake the next steps for each Climate Action PAGE 10 OF 17 Regular Meeting Minutes – November 25, 2024 Recommendation, partnering with the departments and professionals involved to pursue the initiative and report on progress. R 325-2024 RESOLUTION OF THE BOROUGH OF MADISON AWARDING CONTRACT TO RAPID PUMP & METER SERVICE CO., INC. FOR MATERIALS AND LABOR TO REPLACE VALVES AT THE WEST END PUMP STATION WHEREAS, the Director of Public Works has recommended that the Borough Council award a contract to Rapid Pump & Meter Service Co., Inc. of Paterson, New Jersey, in the amount of $94,890.00, for materials and labor to replace valves at the West End Pump Station; and WHEREAS, the Chief Financial Officer has attested that funds will be available for this purpose in Ordinance 27-2024. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1. A contract for materials and labor to replace valves at the West End Pump Station is hereby awarded to Rapid Pump & Meter Service Co., Inc. of Paterson, New Jersey based upon its base bid in the amount of $94,890.00. 2. The Mayor and Borough Clerk are hereby authorized and directed on behalf of the Borough to enter into the contract with Rapid Pump & Meter Service Co., Inc. in a form acceptable to the Borough Attorney. R 326-2024 RESOLUTION OF THE BOROUGH OF MADISON APPOINTING PATRICIA FINELLI TO THE POSITION OF SUBSTITUTE CROSSING GUARD WHEREAS, the Personnel Director has recommended appointing Patricia Finelli to the position of Substitute Crossing Guard; and WHEREAS, the Chief Financial Officer has attested that funds are available for this purpose in the 2024 Police Department Budget # 240, Operating Account for Part-time Help #130. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, County of Morris, State of New Jersey that upon satisfactory completion of a background check, Patricia Finelli is appointed to the position of Substitute Crossing Guard for the Borough of Madison for the 2024-2025 school year. BE IT FURTHER RESOLVED, that Patricia Finelli be compensated at the current rate of pay of $21.45/hour. WHEREAS, a climate-ready community seeks to understand current and projected climate hazards affecting health, safety, infrastructure, property, and businesses so that appropriate actions may be implemented before hazard events occur to cause harm; and WHEREAS, a climate-ready community seeks to optimize sustainability through improving quality of life for its residents by ensuring that its environmental, economic, and social objectives are balanced and mutually supportive; and WHEREAS, the Borough of Madison Master Plan is aimed at guiding the use of lands within the municipality in a manner which protects public health and safety and promotes the general welfare; and WHEREAS, Borough of Madison strives to save tax dollars, assure clean land, air, and water, and improve working and living environments; and WHEREAS, a Climate Change-Related Hazard Vulnerability Assessment is required by NJ law (N.J.S.A. 40:55D28) to be included in the Borough of Madison Master Plan Land Use Plan Element; and WHEREAS, one of the purposes of the Sustainable Jersey Program is to provide resources to municipalities to make progress on sustainability issues, and, recognizing municipalities are interested in guidance on climate resilience, created a Guide to Local Climate Change Adaptation Planning; and WHEREAS, Sustainable Jersey provides a Climate Vulnerability Assessment Technical Assistance Program for municipalities to use the Guide to Local Climate Change Adaptation Planning to complete a Climate Change Related Hazard Vulnerability Assessment consistent with the NJ law; THEREFORE, the Governing Body of Borough of Madison has determined that Borough of Madison should apply for the aforementioned Climate Vulnerability Assessment Technical Assistance Program. THEREFORE, Borough of Madison will commit to providing staff support for the duration of the Climate Vulnerability Assessment Technical Assistance project, including providing planning documents and relevant assessment data and supporting public events and opportunities to share and receive comment on the project. THEREFORE, Borough of Madison will commit to providing a professional planner to review the draft and final version of the Climate Change-Related Vulnerability Assessment for potential adoption into the municipal Master Plan Land Use Plan Element. THEREFORE, BE IT RESOLVED, that the Governing Body of the Borough of Madison, State of New Jersey, authorize the submission of the aforementioned application to Sustainable Jersey for Climate Vulnerability Assessment Technical Assistance. R 328-2024 RESOLUTION OF THE BOROUGH OF MADISON AUTHORIZING A CHANGE ORDER REQUEST FROM DAJON ASSOCIATES, INC. IN THE AMOUNT OF $62,750.00 FOR THE DEPARTMENT OF PUBLIC WORKS GARAGE RESTORATION PROJECT PAGE 12 OF 17 Regular Meeting Minutes – November 25, 2024 WHEREAS, a contract for restoration at the Department of Public Works Garage roof was awarded to Dajon Associates, Inc. of Hackensack, New Jersey, in the amount of $140,000.00., by Resolution 316-2024; and WHEREAS, the Director of Public Works has recommended approval of a change order to the contract for changes that were encountered during truss repairs at the DPW Garage, bringing the contract total to $202,750.00; and WHEREAS, the Borough Engineer has advised that the project has been substantially completed and has recommended approval of final payment including the change order to Dajon Associates, Inc. in an amount not to exceed $62,750.00; and WHEREAS, the Chief Financial Officer has attested to the availability of funds in an amount sufficient for this purpose, which funds were appropriated by Ordinance 32-2024. NOW, THEREFORE, BE IT RESOLVED, by the Council of the Borough of Madison, in the County of Morris and State of New Jersey that a change order request from Dajon Associates, Inc. of Hackensack, New Jersey, in the total amount not to exceed $62,750.00 for the DPW Garage restoration project is authorized. R 329-2024 RESOLUTION OF THE BOROUGH OF MADISON AWARDING CONTRACT TO RAPID PUMP & METER SERVICE CO., INC. TO SUPPLY AND INSTALL TASKMASTER GRINDER AT THE CANDLEWOOD PUMP STATION WHEREAS, the Director of Public Works has recommended that the Borough Council award a contract to Rapid Pump & Meter Service Co., Inc. of Paterson, New Jersey, in the amount of $50,675.00, to supply and install Taskmaster Grinder at the Candlewood Pump Station; and WHEREAS, the Chief Financial Officer has attested that funds will be available for this purpose in Ordinance 4-2024. NOW, THEREFORE, BE IT RESOLVED by the Council of the Borough of Madison, in the County of Morris and State of New Jersey, as follows: 1.
