PLANNING BOARD OF THE BOROUGH OF MADISON
REGULAR MEETING MAY 19, 2015
A regular meeting of the Planning Board of the Borough of Madison was held on the 19th day of
May 2015 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison,
NJ.
The meeting was called to order by Planning Board Chairman, Steve Tombalakian
Mr. Tombalakian requested the reading of the Public Meeting Notice.
Ms. Boardman read the following statement in accordance with the Open Public Meetings Act.
“Let the minutes reflect that adequate notice of this meeting has been provided in the following
manner: At the reorganization meeting of the Board held on January 6, 2015, the Board by
Resolution adopted a schedule of meetings.
On January 7, 2015, a copy of the schedule of meetings was posted at the bulletin board
at the entrance to the Hartley Dodge Memorial, was sent to the Madison Eagle and the Daily
Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”.
The following roll call was recorded:
Present: Steve Tombalakian, Michael Kopas, Tom Johnson, Jeff Gertler arriving at 7:55pm, Astri
Baillie,
Peter Flemming arriving at 7:35pm, Mayor Robert Conley, and Tom Lewis
Excused: John Forte
Absent: None
Also Present: Susan Blickstein, Board Planner
Vince Loughlin, Planning Board Attorney
Frank Russo, Board Engineer
Frances Boardman, Board Secretary
Approval of Minutes:
Copies of the April 21, 2015 regular meeting minutes were distributed to all Board members for
their review prior to this meeting. A motion to approve the minutes was made by Ms. Baillie,
seconded by Mr. Flemming. A voice vote of “aye” was heard by all eligible voting members and
recorded.
Comments by the Public:
Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter
not on this evening’s agenda. Seeing no one he closed that portion of the meeting.
RESOLUTIONS FOR MEMORIALIZATION –
CASE NO. P 14-003
Amended Site Plan with Variances
B.I.G. Management
Block: 1502, Lot: 10
6 Main Street
Resolution granting the Amended Site Plan with Variances to B. I. G. Management for the
Amended Site Plan with Variances on property located at 6 Main Street, Madison commonly
known on the Borough of Madison Tax Map as Block 1502, Lot 10.

The draft resolution was sent to the applicant’s Attorney, Ms. Rose Mary Stone-Doughtery, Esq.
As well as the Planning Board members and its Professionals for review prior to this evening’s
meeting.
Mr. Tombalakian asked the Board and its Professionals if they had any further comments or
questions concerning the resolution. Mr. Tombalakian asked for a motion to approve the
resolution as drafted, a motion was made by Ms. Baillie, seconded by Mr. Kopas; the following
roll call was recorded:
“Ayes” – Ms. Baillie, Mr. Flemming, Mr. Tombalakian, Mr. Johnson, and Mr. Kopas
“Nays” – None
“Abstain” – Mayor Conley, Mr. Forte, and Mr. Lewis
REVIEW AND RECOMMENDATION ITEMS -
On referral from the Governing Body: Resolution R 156-2015 RESOLUTION OF THE
BOROUGH OF MADISON REFERRING THE CIVIC CENTER REDEVELOPMENT PLAN
FOR PROPERTY AT 28 WALNUT STREET, MADISON, NEW JERSEY (BLOCK: 1602,
LOT: 42)PREVIOUSLY DESIGNATED AS AN AREA IN NEED OF REHABILITATION IN
ACCORDANCE WITH N.J.S.A. 40A:12A-14
A motion was made by Mr. Flemming, seconded by Mr. Kopas to recommend that the Mayor and
Council adopt the proposed Resolution R 156-2015 of the Borough of Madison Referring The
Civic Center Redevelopment Plan for Property at 28 Walnut Street, Madison NJ Block: 1602,
Lot: 42 Previously Designated as an area in Need of Rehabilitation in Accordance with N.J.S.A.
40A:12A-14. The Planning Board found that the proposed Resolution is consistent with the
Master Plan of the Borough of Madison. A roll call was requested and recorded as follows:
“Ayes” – Mayor Conley, Ms. Baillie, Mr. Flemming, Mr. Gertler, Mr. Johnson, Mr. Kopas, Mr.
Lewis and Mr. Tombalakian
“Nays” – None
“Absent” –Mr. Forte.
On referral from the Governing Body: ORDINANCE OF THE BOROUGH OF MADISON
AMENDING AND SUPPLEMENTING CERTAIN AFFORDABLE HOUSING PROVISIONS
OF CHAPTER 195 OF THE BOROUGH CODE ENTITLED “LAND DEVELOPMENT
ORDINANCE”
A brief discussion took place to explain in more detail this ordinance. Mr. Tombalakian opened
the floor to the public for comment, seeing none he closed that portion of the hearing. A motion
was made by Ms. Baillie, seconded by Mr. Lewis to recommend that the Mayor and Council
adopt proposed Ordinance 35-2015. The Planning Board found that the proposed Ordinance
recommendation is consistent with the Master Plan of the Borough of Madison. A roll call was
requested and recorded as follows:

adopt proposed Ordinance 38-2015. The Planning Board found that the proposed Ordinance
recommendation is consistent with the Master Plan of the Borough of Madison. A roll call was
requested and recorded as follows:

PLANNING DISCUSSION –
A letter was received on April 20, 2015 from Mr. Steve Schaffer, Esq. with respect to the
Resolution that was approved for Case No. P 15-003, John & Lori Westerhold, Block: 4201, Lot:
4, 29 Crescent Road. Mr. Schaffer wanted clarification with respect to the standard tree
protection language in the resolution.

Giralda Farms
Mr. Thomas Melman, Esq began with a brief summary of the application. The Board was
advised that the applicant was seeking approval to construct a new 8 foot high fence on property
that is jointly located in Madison and in Chatham Township.
Mr. Mark Yeager, 65 Lenox Road, Summit, New Jersey, Applicant and Mr. Joe Fleming,
Professional Engineer from PS&S, 67A Mountain Boulevard, Warren, New Jersey, were sworn
in.

A review of the details of this project was provided by Mr. Yeager. He stated during testimony
that the fence at a height of 8 feet was a requirement of the Giralda Farms Open Space
Management Association.
The following exhibits were marked into evidence:
A-1: Arial View of Giralda Farms taken off Google Map
A-2: Site Plan with Fence Highlighted
Mr. Fleming explained the construction of the fence including a gate and access points to allow
for public access. Maintenance of the fence will be handled by the applicant.
A ribbon cutting and dedication ceremony is scheduled for Saturday, June 6, 2015.
Mr. Tombalakian asked the Board and its Professionals if they had any further questions of Mr.
Fleming or Mr. Yeager, seeing none he closed that portion of the hearing. The floor was then
opened to the public for questions and or comments’, seeing none that portion of the hearing was
closed.
Motion to approve this application was made by Mr. Kopas, seconded by Mr. Lewis. A roll call
was requested and recorded as follows:
“Ayes” – Mayor Conley , Ms. Baillie, Mr. Flemming, Mr. Gertler, Mr. Johnson, Mr. Kopas, Mr.
Lewis and Mr. Tombalakian

Due to insufficient noticing this case was carried to the June 2, 2015 Planning Board meeting.
CORRESPONDENCE – None
Since there was no further business to come before the Board, Mr. Tombalakian made a motion to
adjourn the regular meeting at 8:30 P.M; seconded by Mr. Johnson. A voice vote of “aye” was
heard by all members present and carried.
