PLANNING BOARD OF THE BOROUGH OF MADISON
SPECIAL MEETING NOVEMBER 14, 2016
A special meeting of the Planning Board of the Borough of Madison was held on the 14th day of November 2016 at
7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison, NJ.
The meeting was called to order by Planning Board Chairman, Steve Tombalakian
Mr. Tombalakian requested the reading of the Public Meeting Notice.
Ms. Boardman read the following statement in accordance with the Open Public Meetings Act.
“Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the
reorganization meeting of the Board held on January 5, 2016, the Board by Resolution adopted a schedule of meetings.
On January 6, 2016, a copy of the schedule of meetings was posted at the bulletin board at the entrance to the Hartley
Dodge Memorial, was sent to the Madison Eagle and the Daily Record, and filed with the Borough Clerk all in
accordance with the “Open Public Meetings Act”.
The following roll call was recorded:
Present: Steve Tombalakian, John Forte arrived at 7:58pm, Jeff Gertler, Astri Baillie, Peter Flemming, and Tom Lewis
Excused: Mayor Robert Conley, George Limbach, and Michael Kopas
Frank Russo, Assistant Borough Engineer
Susan Blickstein, Board Planner
Absent: None
Also Present: Keith Loughlin, Substitute Planning Board Attorney
Frances Boardman, Board Secretary
Approval of Minutes:
Copies of the minutes of the November 1, 2016 regular meeting were distributed to all Board members for their review
prior to this meeting. A motion to approve the minutes was made by Mr. Flemming, seconded by Mr. Tombalakian.
A voice vote of “Aye” was heard by all eligible voting members.
Comments by the Public:
Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter not on this evening’s
agenda. Seeing no one he closed that portion of the meeting.
RESOLUTIONS FOR MEMORIALIZATION –

The draft resolution was sent to the applicant’s Attorney, Mr. Nicholas Racioppi, Jr, Esq. as well as the Planning Board
members and it’s Professionals for review prior to this evening’s meeting.
Mr. Tombalakian asked the Board if they had any further comments or questions concerning the resolution. Seeing
none he asked for a motion to approve the resolution, a motion was made by Mr. Lewis, seconded by Mr. Flemming;
the following roll call was recorded:
“Ayes” – Ms. Baillie, Mr. Flemming, Mr. Lewis and Mr. Tombalakian

The draft resolution was sent to the applicant’s Attorney, Mr. Martin Newmark, Esq. as well as the Planning Board
members and it’s Professionals for review prior to this evening’s meeting.
Mr. Tombalakian asked the Board if they had any further comments or questions concerning the resolution. Seeing
none he asked for a motion to approve the resolution, a motion was made by Mr. Lewis, seconded by Mr. Flemming;
the following roll call was recorded:

Amended Site Plan with Variances

Mr. Steven Schaffer, Esq. provided a summary to the Board on the application before them. Mr. Schaffer marked into
evidence:

Mr. Schaffer indicated to the Board that Dr. Adams is seeking relief from Condition # 3 of the 2011 resolution approval
to allow medical use on the second floor.
Dr. Allison Adams, 1 Kings Road, Madison was sworn in. Marked into evidence at this time was

Dr. Adams began by testifying that the photos before the board depict the premises and advised the board that no
exterior changes or site improvements are being proposed. Dr. Adams told the board that she is seeking relief from
Condition # 3 in the resolution from 2011 that would allow her to use 785 square feet of the second floor for a
myofunctional therapy practice. Dr. Adams went on to give the board a history of her practice. She testified that the
parking variance being sought is due to the fact that a part-time associate dentist has joined her practice since the
Board’s resolution in 2011. The site has 16 onsite parking spaces where 21 are required by Ordinance. Dr. Adams
confirmed to the board that she has acquired five parking tags in the municipal lot for her employees but has yet to use
them. Dr. Adams continued to provide testimony to the board that she has sufficient parking on site for the needs of
her patients and staff but is willing to continue to purchase municipal parking tags.

The Board discussed the number of patient visits during the week to determine if municipal parking tags were
necessary, after some discussion it was noted that there was no need for municipal spaces to be purchased by Dr.
Adams. The Board noted that there was sufficient on-street parking available on Kings Road as well.

Mr. Tombalakian asked the Board or Professionals if the had any further questions for Dr. Adams. Seeing none he
closed that portion of the hearing. He opened the floor to the public for questions, seeing none he closed that portion of
the hearing. He then opened the floor to the public for comments, seeing none that portion of the hearing was closed.
The Board began their deliberation; Mr. Flemming made a motion to approve the request for the Amended Site Plan
with Variances for Adams Dental, LLC, 1Kings Road, seconded by Mr. Lewis; the following roll call was recorded:
“Ayes” – Ms. Baillie, Mr. Flemming, Mr. Forte, Mr. Gertler, Mr. Lewis and Mr. Tombalakian
“Nays” – None
“Abstain” – None
“Recused” – Mr. Limbach
“Excused” – Mr. Kopas, and Mayor Conley

Since there was no further business to come before the Board, Mr. Tombalakian made a motion to adjourn the regular
meeting at 8:30P.M.; seconded by Mr. Lewis. A voice vote of “aye” was heard by all members present and carried.
