PLANNING BOARD OF THE BOROUGH OF MADISON
REGULAR MEETING May 7, 2019
A regular meeting of the Planning Board of the Borough of Madison was held on the 7th day of
May 2019 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison,
NJ.
The meeting was called to order by Planning Board Chairman, Steve Tombalakian.
Mr. Tombalakian requested the reading of the Public Meeting Notice.
Ms. Boardman read the following statement in accordance with the Open Public Meetings Act.
“Let the minutes reflect that adequate notice of this meeting has been provided in the following
manner: At the reorganization meeting of the Board held on January 15, 2019, the Board by
Resolution adopted a schedule of meetings.
On January 16, 2019, a copy of the schedule of meetings will be posted at the bulletin
board at the entrance to the Hartley Dodge Memorial, sent to the Madison Eagle and the Daily
Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”.
The following roll call was recorded:
Present: Astri Baillie, George Limbach, John Forte, Tom Lewis, Steve Tombalakian,
Ann Huber, Mayor Conley, Rachel Ehrlich, and Peter Flemming who arrived at 7:35pm
Excused: Frank Russo, Assistant Borough Engineer
Absent: None
Also Present: Vince Loughlin, Planning Board Attorney
Susan Blickstein, Board Planner
Frances Boardman, Board Secretary
Approval of Minutes:
Copies of the minutes of the April 16, 2019 regular meeting were distributed to all Board
members for their review prior to this meeting. A motion to approve the regular minutes as
presented was made by Mr. Lewis, seconded by Ms. Huber. A voice vote of “Aye” was heard by
all eligible voting members and recorded.
Comments by the Public:
Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter
not on this evening’s agenda. Seeing none that portion of the meeting was closed.
RESOLUTIONS FOR MEMORIALIZATION –
CASE NO. P 18-003 A Resolution granting the Preliminary and Final Site Plan with Variance to
Fairleigh Dickinson University on property located at 285 Madison Avenue commonly known on
the Borough of Madison Tax Map as Block: 101, Lot: 6 for adoption.
The draft resolution was sent to the applicant’s Attorney, Mr. Jason Tuvel, Esq. as well as the
Planning Board members and its Professionals for review prior to this evening’s meeting. After
review, several items were revised and a redline version of the resolution was redistributed.

This evening Mr. Loughlin also clarified another item that he had spoken with Mr. Tuvel about in
the resolution.
Mr. Tombalakian asked the Board if they had any further comments or questions concerning the
resolution. Mr. Tombalakian asked for a motion to approve the resolution this evening with the
modification as explained by Mr. Loughlin this evening, a motion was made by Ms. Ehrlich,
seconded by Ms. Baillie; the following roll call was recorded:
“Ayes” – Ms. Erhlich, Ms. Huber, Mr. Flemming, Mr. Limbach, Mr. Lewis, Mr. Tombalakian,
Mr. Forte, Mayor Conley and Ms. Baillie
“Nays” – None
“Abstain” – None
“Excused” – None
CASE NO. P 18-009 Resolution granting the Minor Subdivision to The Trademark Company,
LLC on Property located at 36 Lathrop Avenue commonly known on the Borough of Madison
Tax Map as Block: 4309, Lot: 2 for adoption.
The draft resolution was sent to the applicant’s Attorney, Mr. Sam DeAngelis, Esq. as well as the
Planning Board members and its Professionals for review prior to this evening’s meeting.
Mr. Tombalakian asked the Board if they had any further comments or questions concerning the
resolution. Mr. Tombalakian asked for a motion to approve the resolution this evening a motion
was made by Mayor Conley, seconded by Mr. Forte; the following roll call was recorded:
“Ayes” – Ms. Erhlich, Ms. Huber, Mr. Flemming, Mr. Limbach, Mr. Lewis, Mr. Tombalakian,
Mr. Forte, and Mayor Conley
“Nays” – None
“Abstain” – Ms. Baillie
“Excused” – None
EXECUTIVE SESSION
RESOLUTION TO PERMIT EXECUTIVE DISCUSSION OF SUBJECTS IN
CLOSED SESSION:
Chairperson moved:
BE IT RESOLVED, by the Planning Board of the Borough of Madison, County of
Morris, State of New Jersey, as follows:
That pursuant to Sections 7 and 8 of the “Open Public Meetings Act”, NJSA 10:4-12
and 4-13, the following subject are discussed in closed session.
Litigation Matter
BE IT FURTHER RESOLVED, that those portions of the discussion not subject to
attorney-client privilege may be disclosed to the public upon completion.

RECONVENE WITH (ALL) MEMBERS PRESENT
Let the record reflect that the meeting is reconvened with (all) members present at
8:07pm.
NEW BUSINESS – None
OLD BUSINESS – None
PLANNING DISCUSSION –
Mr. Tombalakian discussed with the Board the appeal of the Zoning Officer, Danny Buckelew’s
decision regarding a fence. He inquired if the Board and its Professionals felt that the Borough’s
fence Ordinance should be looked at more closely regarding posts. It was the opinion of the
Board and Professionals to not make any changes to the Ordinance at this time.
Mr. Tombalakian asked the Board Secretary to extend an invitation to the Zoning Board
Chairman and Attorney to discuss the 2018 Zoning Board Annual Report and any other Zoning
issues they may be dealing with.
Ms. Baillie stated that after some discussion with the Zoning Officer, Danny Buckelew it may be
a good idea to have Dr. Blickstein re-examine the Ordinance regarding front facing garages in the
R-1 and R-2 (Single-Family Residential) Zones on corner lots.
It was determined that the regular meeting of the Planning Board scheduled for May 21, 2019
would be cancelled. Also discussed was cancelling the July 2, 2019 Planning Board meeting due
to not having a quorum. Ms. Boardman also asked what members were available for the June 4,
2019 Planning Board meeting since three members will not be able to attend.
CORRESPONDENCE – None
Since there was no further business to come before the Board, Mr. Tombalakian asked for a
motion to adjourn the Regular meeting at 8:30pm.; seconded by Mayor Conley. A voice vote of
“aye” was heard by all members present and carried.
