MINUTES PLANNING BOARD OF THE BOROUGH OF MADISON REGULAR MEETING AUGUST 6, 2019 A regular meeting of the Planning Board of the Borough of Madison was held on the 6th day of August 2019 at 7:30 P.M., in the Court Room, Hartley Dodge Memorial, 50 Kings Road, Madison, NJ. The meeting was called to order by Planning Board Chairman, Mr. Steve Tombalakian. Mr. Tombalakian requested the reading of the Public Meeting Notice. Ms. Boardman read the following statement in accordance with the Open Public Meetings Act. “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the reorganization meeting of the Board held on January 15, 2019, the Board by Resolution adopted a schedule of meetings. On January 16, 2019, a copy of the schedule of meetings will be posted at the bulletin board at the entrance to the Hartley Dodge Memorial, sent to the Madison Eagle and the Daily Record, and filed with the Borough Clerk all in accordance with the “Open Public Meetings Act”. The following roll call was recorded: Present: Astri Baillie, Ann Huber, John Forte, Tom Lewis Rachel Ehrlich, Steve Tombalakian and Peter Flemming Excused: George Limbach, and Mayor Conley Absent: None Also Present: Frank Russo, Assistant Borough Engineer Vince Loughlin, Planning Board Attorney Susan Blickstein, Board Planner Frances Boardman, Board Secretary Approval of Minutes: Copies of the minutes of the July 16, 2019 regular meeting were distributed to all Board members for their review prior to this meeting. A motion to approve the regular minutes as presented was made by Mr. Flemming, seconded by Ms. Baillie. A voice vote of “Aye” was heard by all eligible voting members and recorded. Comments by the Public: Mr. Tombalakian opened the floor to the public for anyone that wished to be heard on any matter not on this evening’s agenda. Seeing none that portion of the meeting was closed. RESOLUTIONS FOR MEMORIALIZATION – CASE NO. P 19-004 Resolution granting the Preliminary and Final Site Plan with Variances to 7 Giralda Realty, LLC on property located at 7 Giralda Farms commonly known on the Borough of Madison Tax Map as Block: 3202, Lot: 7 for adoption. The draft resolution was sent to the applicant’s Attorney, Mr. Ryan Benson, Esq. as well as the Planning Board members and it’s Professionals for review prior to this evening’s meeting. Several changes to the draft resolution were finalized after discussion with Mr. Ryan Benson and the Board Professionals. 1 Planning Board August 6, 2019 Mr. Tombalakian asked the Board if they had any further comments or questions concerning the resolution. Mr. Tombalakian asked for a motion to approve the resolution this evening, a motion was made by Ms. Ehrlich, seconded by Ms. Baillie; the following roll call was recorded: “Ayes” – Ms. Ehrlich, Mr. Flemming, and Ms. Baillie “Nays” – None “Abstain” – Mr. Forte, Ms. Huber, Mr. Lewis and Mr. Tombalakian “Excused” – Mayor Conley and Mr. Limbach NEW BUSINESS – CASE NO. P 19-006 Minor Subdivision 173 Kings Road, LLC 173 Kings Road Block: 3901, Lot: 4 Mr. Steve Schaffer Esq. began by giving a brief summary of the application before the Board. The applicant proposes to subdivide the existing property at 173 Kings Road that contains a single-family residence on an L-shaped lot. Parts of the lot that extend behind Lots 6 and 7 are proposed to be added to those lots. No physical improvements are proposed in tandem with this minor subdivision. The subject properties are on the south side of Kings Road in the R-3 Single- Family Residential Zone. No new variances are created as a result of the proposed subdivision. Mr. Schaffer stated that he had one witnesses this evening, Andrew Clarke, PLS, PE. He then proceeded to distribute the following to each Board member and Professional: Exhibit A-1: Handout, dated August 6, 2019 Mr. Andrew Clarke, 466 Southern Boulevard, Chatham, NJ was sworn in and accepted as an expert witness. Mr. Clarke began his testimony by stating to the board that the proposed minor subdivision would subdivide the existing property at 173 Kings Road that contains a single-family residence on an inverted L shaped lot on the top of the property running east to west through the rear yards. This application will annex 3,655 square feet of the inverted L to the adjacent Lot 6 owner and 7,882 square feet to the owner of Lot 7. No new variances will be created with this minor subdivision. No new development is proposed for any of the lots in this application. Mr. Tombalakian asked the Board if they had any questions for Mr. Clarke. Ms. Huber asked why the applicant was proposing this subdivision. Mr. Clarke responded that while doing surveying work discussion began with the owner and the other owners of the properties. Mr. Frank Russo’s July 2, 2019 memorandum was discussed and Mr. Clarke responded that he had no issues consenting with the memorandum requirements. Mr. Lewis stated that he was concerned with the nearby railroad tracks and if there were any safety issues. Mr. Clarke stated that no safety issues exist to date and this subdivision will normalize the use of the properties that is there. 2 Planning Board August 6, 2019 Dr. Blickstein’s memorandum dated June 25, 2019 was discussed and Mr. Schaffer advised the Board that during a title search there were no existing right-of way or easements that would effect any of the lots that may have existed for the nearby railroad. Mr. Tombalakian then opened the floor for questions from the public for Mr. Clarke. Seeing none that portion of the hearing was closed. Mr. Schaffer gave his closing summary to the Board. The Board began its deliberation. Mr. Vince Loughlin, Board Attorney, provided a summary of conditions for the resolution. A motion to approve the application with the conditions provided by Mr. Loughlin was made by Mr. Forte, seconded by Mr. Lewis and the following roll call was recorded: “Ayes” – Ms. Baillie, Mr. Flemming, Ms. Ehrlich, Mr. Forte, Mr. Lewis, Mr. Tombalakian, and Ms. Huber “Nays” – None “Excused” – Mayor Conley, and Mr. Limbach OLD BUSINESS – None PLANNING DISCUSSION – Solar Ordinance – Dr. Blickstein stated that she would like to meet with the Master plan subcommittee to discuss a proposed solar ordinance. The subcommittee will meet on Tuesday, September 3, 2019 at 7:30pm to discuss. Ms. Boardman will circulate a draft to the subcommittee members when it is received from Dr. Blickstein. The August 20, 2019 and September 3, 2019 Planning Board meetings were cancelled. CORRESPONDENCE – None Since there was no further business to come before the Board, Mr. Tombalakian asked for a motion to adjourn the Regular meeting at 7:58 pm.; seconded by Mr. Forte.
