BOROUGH OF MADISON ZONING BOARD OF ADJUSTMENT
Regular Meeting, Thursday, February 9, 2012 at 7:30 P.M.,
Hartley Dodge Memorial, 50 Kings Road, Madison, New Jersey.
1. CALL TO ORDER BY THE CHAIRPERSON
2. ANNOUNCEMENT OF NOTICE (STATEMENT OF COMPLIANCE)
A regular meeting of the Borough of Madison Zoning Board of Adjustment was
held on Thursday, February 9, 2012 at 7:30 pm in Room #140 of the Hartley Dodge
Memorial Building, located at Kings Road, Madison, N.J. Joseph Santoro, Chairperson
opened the meeting and requested the reading of the public notice as follows:
“Let the minutes reflect that adequate notice of this meeting has been provided in
the following manner:
At the reorganization meeting of the Board, held on January 12, 2012,
the Board, by resolution adopted a schedule of meetings.
On January 13, 2012, a copy of the schedule of meetings was posted at the
bulletin board at the main entrance of the Hartley Dodge Memorial, was sent to the
Madison Eagle and the Daily Record and filed with the Borough Clerk, all in accordance
with the Open Public Meetings Act.
3. ROLL CALL:
PRESENT : John Ciulla, Daniel Cochran, Joseph Santoro, Ronald Poeter, Diane
Driscoll and Timothy Blair
ALSO PRESENT: Gary Hall, Board attorney
5. MINUTES FOR APPROVAL- Re-Organization and Regular meeting of 1/12/2012 for
adoption.
6. RESOLUTIONS FOR MEMORIALIZATION -
The following Resolutions were distributed to all Board members for their review prior to
this meeting.
CASE NO. Z 11-037 - Resolution granting variance application to Steven & Maria
Aloupis, Block: 3404, Lot: 1, 72 Glenwild Road to construct a 2 Story Addition, 1 Story
Addition (Garage), Paved Driveway, Realignment of Existing Gravel Driveway, and
Rear Walkway in an R-1 (Single-Family Residential) Zone requiring relief from Minimum
Side Yard Setback (Left), Maximum Principal Building Coverage, Maximum Impervious
Lot Coverage and Minimum Driveway Setback
CASE NO. Z 11-038 - Resolution granting variance application to Tom & Paula Murcott,
Block: 4230, Lot: 2, 334 Woodland Road to construct a 2nd Story Addition, In-Ground
Pool, Wood Deck with Arbor, Paver Patio, Removal of Existing Driveway replaced with
Paver Driveway and Fence in an R-1 (Single-Family Residential) Zone requiring relief
from Maximum Impervious Lot Coverage.
There were no corrections or additions to either Resolution. There being none, a voice
vote of aye was heard from all eligible voting Board members in approval of the motions

It was announced that LVJJ Investments will be carried to the March 8, 2012Regular
meeting.
Joseph Glade was present to accept an award Certificate for his outstanding years of
service on the Board of Adjustment as Board member for the ZBA for three years and
also Vice Chair and Chairperson. Joseph Santoro, Chairman read the contents of the
Certificate. A round of applause was heard from all Board members in recognition of
Joe’s service.
A motion to approve the presentation of the Certificate was made by Mrs. DeRosa and
seconded by Mrs. Driscoll.
7. UNFINISHED BUSINESS -
CASE NO. Z10-017
LVJJ Investments
Block: 1302, Lots: 5 & 6
4 & 6 Elm Street
Applicant is requesting permission for Preliminary and Final Site Plan approval with
necessary variances (C) and (D) to construct a nine-unit townhouse development in the
R5 (Multi Family Residential) Zone requiring relief from Maximum Allowable Density,
Minimum Front Yard Setback, Minimum Rear Yard Setback, Minimum Side Yard
Setback, Maximum Building Coverage, Maximum Impervious Lot Coverage, and
Maximum Building Height. This application was started at the November 10, 2011
meeting and carried without further notice. This application was carried at the January
12, 2012 meeting and carried with out further notice. This application will be carried
to the March 8, 2012 regular meeting.

Applicants are requesting permission to construct a 1 Story Addition, (2) 2nd Story
Additions and an Open Porch in an R-2 (Single Family Residential) Zone requiring relief
from Minimum Side Yard Setback (Right), Minimum Side Yard Setback (Left), and
Maximum Impervious Coverage.
Stephen and Karen Blout were sworn in along with the Architect, Mr. John Booth. The
following exhibits were marked:
B – 1 Zoning Denial Letter from the Construction Official, dated 1/9/12.
A – 1 Plans prepared by Mr. John Booth, Architect, 3 sheets, dated 1/4/12
Mr. Blout began by explaining the layout of his home and the additions which are
planned which will allow for more space for a growing family.

Mr. John Booth, Architect began by describing the home and that is was impossible to
avoid variances in adding space to the home. The second floor bedroom and bathroom
space will be expanded. He utilized the front elevation exhibit which depicts where the
existing home lies on Woodland Road. The front elevation also depicts the front
additions on both sides of the home. He stated his development is constrained by the
existing setbacks. The Lot coverage is only slightly exceeded. The first floor addition is
also seeking a lot coverage variance. The one-story addition in the front of the home is
the only location where the lot will be disturbed. Different scenarios were considered for
the location of the addition. Mr. Ciulla questioned the impervious coverage and asked if
Mr. Booth has attempted to lower the impervious coverage.
Mr. Booth stated that under the Ordinance the applicant is not subject to a drywell
requirement. Mr. Santoro asked where the drain pipe leads that is located in the rear.
Mrs. Blout stated that it leads to nowhere. Mr. Blout stated that it most likely leads to
the rear of the property which slopes downhill. A discussion regarding the runoff from
the home’s drains took place.
The walkways were considered to reduce the impervious coverage, however, Ms. De
Rosa stated a drywell might be considered. Mr. Blout stated he would have no problem
in adding a drywell. Mr. Santoro asked if there was any other means to reduce the
impervious coverage. It was suggested that runoff in the front of the home be captured
and brought to the proposed drywell. Mr. Booth stated he would work with the Borough
Engineering Department to remedy any water runoff.
The application was opened to the public. There being no further questions from the
Board or the public, the Board began their deliberation. The consensus of the Board
was to approve the application with the condition that the applicant work with the
Borough Engineer with his approval to take all leaders from the house and lead them
into a drywell. A motion to approve the application with the condition as discussed was
made by Mr. Poeter and seconded by Mrs. De Rosa.
9. OTHER BUSINESS - There was no Other Business on the Agenda this evening.
10. ADJOURNMENT – The meeting was adjourned at 8:30 pm with a motion made by
Mr. Poeter and seconded bY Mrs. De Rosa.
