MINUTES BOROUGH OF MADISON ZONING BOARD OF ADJUSTMENT Regular Meeting, November 10, 2016 at 7:30 P.M., Hartley Dodge Memorial, 50 Kings Road, Madison, New Jersey. 1. CALL TO ORDER BY CHAIRPERSON 2. ANNOUNCEMENT OF NOTICE (STATEMENT OF COMPLIANCE): A regular meeting of the Borough of Madison Zoning Board of Adjustment was held on Thursday, November 10, 2016 at 7:30 pm in Room #140 of the Hartley Dodge Memorial Building, located at Kings Road, Madison, N.J. Joseph Santoro, Chairperson opened the meeting and requested the reading of the public notice as follows: “Let the minutes reflect that adequate notice of this meeting has been provided in the following manner: At the Reorganization meeting of the Board, held on January 14, 2016, the Board, by resolution adopted a schedule of meetings. On January 15, 2016, a copy of the schedule of meetings was posted at the bulletin board at the main entrance of the Hartley Dodge Memorial, was sent to the Madison Eagle and the Daily Record and filed with the Borough Clerk all in accordance with the Open Public Meetings Act.” 3. ROLL CALL Present: Joseph Santoro, Toni DeRosa, Diane Driscoll, Dr. Paetzell, Helen Kaar and Mary Sue Salko Excused: Mr. Blair, Mrs. Elias, Mrs. Lawless Also Present: Keith Loughlin, Esq., Substitute Attorney for Gary Hall 4. PLEDGE OF ALLEGIANCE 5. MINUTES FOR APPROVAL - Regular meeting of October 13, 2016 The minutes were distributed to all Board members prior to this meeting for their review. There were a few corrections that were made to the minutes. A voice vote of aye was heard from all eligible voting Board members in approval of the minutes as corrected. 6. RESOLUTIONS FOR MEMORIALIZATION – The Resolution was distributed to all Board members prior to this meeting for their review. There were no corrections made to the Resolutions. A voice vote of aye was heard from all Board members in approval of the Resolution. CASE NO. Z 16-034 Paul & Dana Patella Block: 3803, Lot: 44 56 Prospect Street Resolution granting variance application to Paul & Dana Patella, Block: 3803, Lot: 44, 56 Prospect Street to construct a 2 ½ Story Addition, 1 Story Garage Addition, Drywell, Expansion of Existing Driveway, and Removal of Existing Shed in an R-2 (Single-Family Residential) Zone requiring relief from Minimum Front Yard Setback (Belmont Avenue), Minimum Side Yard Setback, Maximum Principal Building Coverage and Maximum Impervious Lot Coverage ZBA Regular Meeting 11-10-16 Page 1 7. SCHEDULING AND PROCEDURAL MATTERS – 8. OLD BUSINESS – 9. NEW BUSINESS – CASE NO. Z 16-023 Arthur Tutela Block: 4402, Lot: 34 164 Green Avenue Applicant is seeking permission to remove portion of Existing Asphalt Driveway, Reinstallation of Removed Portion of Asphalt Driveway, and the Installation of (2) Driveway Entrance Piers in an R-1 (Single-Family Residential) Zone requiring relief from Maximum Impervious Lot Coverage. At the request of the Applicant’s Attorney this application is to be carried to the December 8, 2016 Zoning Board of Adjustment meeting. Attorney was advised that he would need to re-notice for the December meeting. CASE NO. Z. 14-006 Jayneil Shah Block: 1203, Lot: 23 7 Elm Street Applicant is seeking Two Year Extension of Approval for Variances Approval granted by Resolution which was adopted on December 11, 2014 to authorize construction of a Replacement Two-Family residence requiring variance of Minimum Front Yard Setback, Minimum Side Yard setback (Left), Minimum Side Yard setback (Right), Rear Yard setback, Maximum Building Stories, Maximum Principal Building Coverage, Maximum F.A.R., Driveway Setback, Maximum Impervious Lot Coverage and Principal Permitted use of 2‐Family in an R‐5 Zone. This Resolution was approved November, 2014. A letter was received from the applicant asking for an extension due to his waiting for funding for the project. Mr. Santoro stated he does not see a reason for not granting a two year extension. A motion to grant the extension of the Resoluton was made by Ms. Kaar and seconded by Ms. Salko. A roll call vote was requested and recorded as follows: Aye: Mrs. DeRosa, Mrs. Driscoll, Dr. Paetzell, Ms. Kaar, Mr. Santoro and Ms. Salko CASE NO. Z 16-035 John & Mary Wilson Block: 905, Lot: 3 27 Sherwood Avenue Applicants are seeking permission to construct a 2 Story Addition, Detached 2 Car Garage, Paver Patio, Driveway, Sidewalk, Drywell, (2) Air Conditioning Units, and the Removal of Existing Driveway & Front Walk, Shed and Patio, Side Concrete Pad, Stoop and Roof in an R-3 (Single-Family Residential) Zone requiring relief from Maximum Principal Building Coverage and Maximum Impervious Lot Coverage. John and Mary Wilson were sworn in and the following exhibits were marked: B – 1 Letter of Denial from the Borough of Madison Deputy Zoning Officer, Dan Buckelew , dated 8/15/16 A – 1 Survey dated 8/9/16 ZBA Regular Meeting 11-10-16 Page 2 A – 2 Plans dated 8/9/16 A – 3 Survey with several changes Mrs. Wilson began by stating that the 3 bedroom home is very small and since they purchased the home their family has grown. The principal building will house a living room and kitchen, and the second floor will have an additional bedroom. The garage is now attached to the home, and the applicant would like to build a detached garage in the rear. The applicants plan to utilize Hardiplank on the exterior of the entire home. Ms. Wilson continued by describing the layout of the home, enlarging the kitchen with an eat-in-area. A mudroom and family room is also planned. An entrance will be constructed to enter the living room and into the study. The ½ bath on the first floor will be moved. The front of the home will remain the same. A closet in the master bedroom will be added. Three bedrooms will be available for the three children on the second floor. The front of the home will have an overhang over the front door to cover the steps. The garage that is now attached will be converted into living space. French doors will be installed on the existing garage. The air conditioning units will be located in the rear. The new detached garage will be located in the rear. The existing paver patio, concrete pad, shed and existing driveway will be removed. The deck will be 15” above the grade constructed of wood. The impervious coverage will be reduced with the removal of the present driveway and a new driveway installed with pavers. Drywells will be installed in the front and rear. All of the roof areas will be directed into the drywell, especially in the front where there is a drainage issue. There being no further testimony from the applicant and no questions from the Board, the public was given the opportunity to ask questions or make comments as follows: Rob Pratt, 25 Sherwood Avenue, was concerned with the water problems when there are heavy rains. He explained that sump pumps have been installed in his home. Mrs. DeRosa asked if the applicant has considered installing drywells. Mr. Pratt stated that they have considered drywells. Mr. Santoro stated that the applicant is providing more than what is required. Eileen Fee, 26 Knollwood Avenue questioned how far the rear property line is from the garage. She feels it is very imposing. She was also concerned with water issues. There being no further questions from the Board or the public, the Board began their deliberation. The consensus of the Board was to approve the application with the following conditions: meet with the Borough Engineer to discuss the storm-water and drywells, catch drains near the garage and have him evaluate the situation. A motion to approve the application with the conditions was made by Mrs. DeRosa, and seconded by Mrs. Driscoll. Z 16-036 Matthew & Laura Collins Block: 4804, Lot: 5 56 Barnsdale Road ZBA Regular Meeting 11-10-16 Page 3 Applicants are seeking permission to construct a 1-1/2 Story Addition, Front Portico Roof over Existing Stoop, and to remove an Existing Rear Walk in an R-2 (Single-Family Residential) Zone requiring relief from Minimum Side Yard Setback and Minimum Rear Yard Setback. Laura and Matthew Collins, applicants and Steven Majewski, Majewski Architects were sworn in and Mr. Majewski gave his credentials and was qualified. B – 1 Letter of Denial from the Borough of Madison Deputy Zoning Officer, Dan Buckelew dated 10/2616 A – 1 Site Plan dated 10/14/16 A – 2 Survey, dated 9/26/16 A – 3 Board with Site Plan, dated 10/14/16 A – 4 Photo board taken October and a few months prior A – 5 Photo board taken the first week of November Mr. Collins stated that the house was constructed in 1956 and is outdated. He plans to open the first floor up and construct an addition. A new roof and siding is planned. A portico in the front will be added as an architectural feature. Mr. Majewski began by describing the application. He stated the lot is irregularly shaped which is wider than what is required. He proposes to square off the house allowing more useful space in the interior. The architecture that is planned is compliant. He then began by utilizing A – 3 and reviewed the front and rear views of the home. The portico which is planned will give the home some architectural value. The addition will enhance the living space on the first floor. An entrance vestibule will be added in the front and the dining room and kitchen will be joined and the family room will be adjacent to the dining/kitchen space. The adjacent home has a similar addition as to what is being proposed. Mr. Majewski continued by utilizing A – 4 and described the photos contained on this Board. A – 5 was reviewed which contains the neighboring homes in the area. Mr. Majewski reviewed the different types of homes which surrounds the applicant’s home. He described the height, and the setbacks and explained the deficiency existing which is diminimus. A crawl space will be under the addition which is one story in height. There being no further testimony from the architect, the public was given the opportunity to question him or make comments. There being none, the Board began their deliberation. A motion to approve the application was made by Mrs. Driscoll , and seconded by Mrs. DeRosa. Z 16-037 Katherine Gargiulo Block: 4402, Lot: 16 3 Colonial Way Applicant is seeking permission to construct a Bluestone Patio, Stoop and Walkway and Grill with Counter Top, applicant will also remove an Existing Deck and Steps in an R-1 (Single-Family Residential) Zone requiring relief from Maximum Impervious Lot Coverage. Katherin Gargiulo and Barry Caul, Caul Design Group, Allamuchy, NJ were sworn in and the following exhibits were marked. ZBA Regular Meeting 11-10-16 Page 4 B – 1 Letter of Denial from the Borough of Madison Deputy Zoning Officer, Dan Buckelew dated 9/12/16 A – 1 Site Plan dated 9/12/16 A – 2 Colored rendering dated 9/12/16 Ms. Gargiulo began by giving the reasons for the deck and the surrounding area. She stated the present deck is aging and needs updating. The deck will be removed which presently has moist soil underneath, and will be removed. A bluestone patio will be installed in place of the deck with a small barbecue area to the left of the patio. The impervious coverage will increase by approximately 4.06%. He stated the well-being and aesthetics will be improved. Three sliding glass doors exist and it is plan to install one step down leading to the backyard area and a level lawn area. The patio is 925 sf, the existing deck is 621 sf. Mr. Santoro asked if the roof leaders are being captured. Ms. Gargiulo stated the gutters enter into the ground. Mr. Caul explained how the water can be collected off of the proposed patio. A drywell will be installed on the right side of the property to do so. The issue that exists is that there is no hardship for this type of patio. Mr. Caul stated that to work with the Board the lower barbecue area can be removed, 100 sf, and the grill can be placed on the main patio area. The Board gave their input and stated that the applicant’s request is large and suggested to downsize their request. Mr. Santoro suggested that the applicant return with a more modest application. Several Board members had a few questions for Mr. Santoro and a brief discussion took place. 10. OTHER BUSINESS- No Other Business 11.
