MAHTOMEDI CITY COUNCIL MINUTES AUGUST 3, 2015 Mayor Jud Marshall convened the regular City Council meeting at 7:00 p.m. with Council members Timothy Deans, Richard Brainerd, Lael Ramaley, and Joel Schilling in attendance. City Administrator Scott Neilson, City Attorney Jay Karlovich, City Planner Erin Perdu, Finance Director Scott Schaefer, Fire Chief Terry Fischer and Account Clerk Jerene Rogers were also in attendance. CONSIDER APPROVAL OF AGENDA Council member Brainerd moved and Council member Deans seconded the motion to approve the agenda as presented. The motion was unanimously approved. CONSIDER APPROVAL OF THE JULY 21, 2015 CITY COUNCIL MEETING MINUTES AND THE JULY 21, 2015 CITY COUNCIL WORKSHOP MEETING MINUTES Council member Schilling moved and Council member Brainerd seconded the motion to approve the July 21, 2015 City Council and City Council Workshop minutes as presented. The motion was unanimously approved. 4. PRESENTATIONS 4a. 10 Year Service Award – Tim Albrecht 10 Year Service Award – Tony Byerly 15 Year Service Award – Chris Dettinger Mayor Jud Marshall presented Tim Albrecht, Tony Byerly and Chris Dettinger with their 10 and 15 year service awards and thanked them for their years of service to the City. 5. DISCUSSION FROM THE AUDIENCE None 6. CONSENT AGENDA Council member Brainerd moved and Council member Ramaley seconded the motion to approve the Consent Agenda as presented. The motion was unanimously approved. a. APPROVAL-Hiring of Firefighters Fire Chief Fischer requested and received permission to hire two new probationary paid on call firefighter/EMT’s. CONSENT AGENDA-Continued. hiring is contingent upon successful completion of a criminal background check, psychological assessment and physical exam. b. APPROVAL-2015 -2016 Safety Management Program Contract City Staff requested and received permission to enter into a services agreement between Minnesota Municipal Utilities Association and the City for the 2015-2016 Safety Management Program. c. APPROVAL-Acknowledge Completion of Probationary Period for Maintenance Operator Kevin Bartholomew. Public Works Maintenance Operator Kevin Bartholomew completed his first six months of employment with the City. Under the personnel policy, the Public Works Director has reviewed the performance in consideration of the responsibilities in the position job description and recommended Mr. Bartholomew be retained as a regular employee. d. APPROVAL-Construction Pay Voucher No. 1 and Final in the amount of $40,846.00 for Phase 1 Historic District Landscaping for Collyard Landscaping. Construction Pay Voucher No. 1 and Final in the amount of $40,846.00 for Phase 1 Historic District Landscaping for Collyard Landscaping was approved. 7. PUBLIC HEARINGS 7a. CONSIDER APPROVAL – Ordinance Amending Mahtomedi City Code, Chapter 3, Sections 3.01 and 3.02 and Adding Section 3.11 Relating to the Keeping of Bees, and Amending the Fee Schedule to Include a Beekeeping Permit Fee. City Administrator Scott Neilson said at the July 7, 2015 City Council meeting the Council discussed a proposed ordinance recommended by the Environmental Commission amending Chapter 3 to allow for the keeping of bees. City Planner Erin Perdu reviewed several minor changes to the proposed ordinance based on questions the Council had and legal review before adoption of the ordinance. She said definitions for apiary and beekeeper were removed because those terms were not used in the ordinance. She said it was clarified under conditions that adjacent to a lake or pond does not suffice as a water source for the bees. She also stated that conditions were added to include management of hives to prevent swarming and aggressive behavior. CITY COUNCIL MEETING MINUTES -3- AUGUST 3, 2015 7. PUBLIC HEARINGS-Continued She noted the neighborhood notifications will be sent out to neighbors within a 350’ radius. City Planner Perdu explained the Beekeeping Permit Issuance and Revocation Policy. She said if a written objection is filed with the City Administrator, the Administrator or their designee, will conduct a hearing with the applicant and the person who objects to the issuance of the beekeeping permit. The purpose of the policy is to identify general principals and criteria which will guide the City Administrator or their designee when determining whether or not to issue or revoke a beekeeping permit. Council member Brainerd stated the Environmental Commission did a good job creating this ordinance. Mayor Marshall opened the public hearing at 7:20 p.m. Virginia Green, 1011 Lincolntown Avenue, said she is in favor of supporting the raising of bees. She and her husband plan to raise bees. She asked the Council to look at the neighbor notification process. She feels the distance should be calculated from where the hives will be located on the property, not necessarily the property boundaries. Hearing no further public comment, Mayor Marshall closed the public hearing at 7:28 p.m. Council member Ramaley said she appreciates all the work City Planner Erin Perdu and the Environmental Commission did to create this ordinance. Council member Brainerd moved and Council member Ramaley seconded the motion to adopt an Ordinance Amending Mahtomedi City Code, Chapter 3, Sections 3.01 and 3.02 and Adding Section 3.11 Relating to the Keeping of Bees, and Amending the Fee Schedule to Include a Beekeeping Permit Fee. The motion was approved. 8. STAFF REPORTS 8a. CONSIDER APPROVAL – Bill List Council member Ramaley moved and Council member Deans seconded the motion to approve the bills as presented. The motion was unanimously approved. CITY COUNCIL MEETING MINUTES -4- AUGUST 3, 2015 9. REPORT FROM THE CITY ADMINISTRATOR Administrator Neilson said the Washington County HRA would like a council member to be on the committee to decide what colors, etc. the Piccadilly Square building should be. Council member Ramaley volunteered to be on the committee. Administrator Neilson reminded everyone about the open house for the council and advisory commissions on August 6th at Katherine Abbott from 4:00 p.m. to 6:00 p.m. 10. COMMENTS FROM THE CITY COUNCIL Mayor Marshall reminded everybody that tomorrow night, is National Night Out. He stated that we have 6 locations in the City that are celebrating. Council member Brainerd stated he would like an update on the street projects that are under construction. Council member Deans asked if there are any positions available on Advisory Boards. City Administrator Neilson said there are two open positions on the Finance Commission. 11. CLOSED SESSION – None Scheduled 12.
