Zamagni Greg Lucey, Clerk Saturday, October 29, 2022 2:00 PM City Hall Front Lobby Call to Order Also in attendance acting City Solicitor John McNaught, Assistant City Clerk Carol Ann Desiderio. Chair Voltaire called the meeting to order at 2:09 P.M. Roll Call Present 3- Board Member Andrew D. Zamagni, Chairperson Jean T. Voltaire, and Gregory Lucey Absent 1- Board Member Kathleen A. Young New Business 426-22 The Board of Registrars of Voters will meet to discuss the complaint filed on October 25, 2022 by Patrick Sherman of 36 Central Avenue, Malden pursuant to M.G.L. chapter 51, sections 48-49 alleging that certain persons, as named by him, may be illegally or incorrectly registered to vote in the City of Malden. Attachments: Patrick Sherman 36 Central Ave Malden - CLAIM Voter Registration Challenges PPT Chair Voltaire read the item on the docket and the reason the Board is meeting to address the complaint filed by Patrick Sherman on October 25, 2022 alleging illegal or incorrectly registered voters in the City of Malden. Chair Voltaire turned the meeting over to Acting City Solicitor John McNaught to speak on the complaint. Attorney McNaught stated what we have for evidence is what the complainant submitted for paperwork. Attorney McNaught has reviewed the Affidavit, the complainant's letter dated October 24th and the list. Mr. Sherman is a registered voter at 36 Central Avenue in Malden. Attorney McNaught referenced the slide presentation that he presented to the Board of Registrars that was given by Attorney Lauren F. Goldberg on the topic on June 13, 2019 and told the Board that he along with Asst. City Clerk Carol Ann Desiderio attended two Zoom meetings held with the State Elections Divisions and as many as 60 city clerks and election officials regarding the compliant filed. City of Malden Page 1 Board of Registrars of Voters Meeting Minutes - Final October 29, 2022 Attorney McNaught continued that he also had a CD that the complainant provided containing the list of voters on the spread sheet that he did not share and will not plug into the voter data base for fear of potentially corrupting the data base. Attorney McNaught stated the Affidavit filed by Mr. Stewart only states that he looked at change of mailing address cards, Attorney McNaught said that doesn't mean their domicile had changed and gave the example of someone going into a nursing home or joining the military and changing your mailing address, it doesn't mean your domicile has changed. Attorney McNaught went back to Attorney Goldberg's slide presentation saying it was spot on with what we are talking about today. There are 2,378 voters being questioned on the complaint. Attorney McNaught continued that the Board of Registrars need to determine if the complaint's information filed gives sufficient grounds to halt the election. It is of his opinion that the information provided is inadequate and insufficient grounds to take up the complaint. Board member Zamagni asked what is the process for checks and balances with voters moving in an out of the city, Assistant City Clerk Desiderio spoke to the Census street listing sent out every year, a second mailing done for those that didn't respond to the first, a voter becoming inactive after not completing the census, not voting, not signing a nomination paper, showing no activity whatsoever, they would need to show proof where they live if they showed up to vote. Mr. Zamagni asked about voters that pass away, Ms. Desiderio answered that the clerk's office monthly goes through the death certificates and purge the voters list. Board Member Lucey made a motion to dismiss the complaint because of insufficient grounds to go forward with the complaint with the documentation provided by the complainant, the motion was seconded by Board member Zamigni.It was so voted: Lucey (y), Voltaire (y), Zamagni (y).
