I. Call to Order. Chairman Charles Ioven called the meeting to order at 7:00 pm.
Ioven announced that under the provisions of the Open Meeting Law, attendees are informed that this
meeting is being recorded by Urban Media Arts, formerly known as Malden Access Television, and that
he has not been notified that any other video or audio recording of this meeting will occur.

The proposal is to demolish the existing building, most recently used as a three-family dwelling, and

Decision: The Planning Board granted a special permit, subject to the following six (6) conditions:
1. All development shall be as per plans, except as modified by these conditions.
2. The maximum number of bedrooms in the two-family dwelling is six.
3. The front porch and rear porches/decks may not be enclosed.
4. Basement may be used for storage and utilities, and no residential living use by the two-family
dwelling is allowed.
5. Install and maintain yard areas and open space with landscaping, which may not include overly
compacted materials, except walkways. Paving shall be limited to driveway and parking area
shown on the plan.
6. Windows on the southern side of the dwelling may be eliminated. On the front façade, windows
may be relocated and windows may be added.

The proposal is to renovate and reconfigure the entire third floor of the building, containing 6,868
square feet, and comprised of four condominium units, Units 301, 302, 303 and 304, and for
petitioner to occupy the entire third floor for its mental health clinic.

any other medical center use shall require seeking an amendment of this special permit.

PROCEDURAL HISTORY (Case #25-05):

2. The petitioner is the property owner, Janick Company LLC, 10 Vernon Street, Stoneham, MA.
3. At the public hearing, the petitioner was represented by Paul Mochi, Vision Design & Construction, 14 Western
Avenue, Wakefield, MA, and John Mancini, 39 Emerald Street, Medford, MA.
4. The petition in permit application number RES 070208-2025 seeks a special permit under Title 12.28.010.D of
the Code of the City of Malden (the “Ordinance”) to allow residential conversion of preexisting nonconforming
property in the Residence A zoning district, namely, to demolish the existing three-family dwelling and to
construct a two-family dwelling.
5. The following plans and information were submitted in support of the petition: set of plans, “Two Family
Dwelling, 27 Sheridan Street, Malden, MA 02148,” dated February 21, 2025, revised January 19, 2025 (?),

6. Petitioner obtained the Determination of the Malden Historical Commission under the Demolition and Alteration
Delay Ordinance, Title 4.24 of the Code of the City of Malden, namely, the Commission’s approval of the
proposed demolition of the building at the subject property, as per decision dated April 24, 2025.
7. The public hearing complied with the notice requirements of §12.32.020(K) of the Ordinance and Massachusetts
General Laws, Chapter 40A, §11.
FINDINGS of FACT (Case #25-05):
The City of Malden Planning Board finds the following facts:
1. The property is the site of a vacant two-story building, most recently used as a three-family dwelling with six
bedrooms and 1,568 square feet on each of the first floor, the second floor, and basement.
2. Petitioner found the building to be structurally unsound and structurally damaged, as discovered following
interior demolition and “total gut” in preparation for renovations, pursuant to permit number RES-068936-2024.
3. The proposal is to demolish the existing building, concrete front porch, rear porch, and side stairs and landing;
and to construct a two-family dwelling on the same foundation and with a two-story addition at the rear.
4. As proposed, the two-family dwelling will have a total of six bedrooms, configured as one unit on the first floor,
containing 2,009 square feet, three bedrooms, a rear deck with 160 square feet, and home office with 110 square
feet; one unit on the second floor, containing 2,037 square feet, three bedrooms, a rear deck with 160 square feet
and home office with 110 square feet; and a basement containing 1,500 square feet, configured as unfinished
storage for one unit with 420 square feet, unfinished storage for the other unit with 500 square feet, and a
common area for storage of property maintenance equipment with 600 square feet.
5. The property is classified as part of the Residence A zoning district.
6. The most recent three-family dwelling use is prohibited in this zoning district, predates the current Ordinance
and is considered preexisting nonconforming, per §§12.12.300 and 12.28.010 of the Ordinance.

7. The proposed two-family residential use is prohibited in this zoning district and may be allowed by special
permit as a conversion from a nonconforming use to a residential use, per §12.28.010.D of the Ordinance.
8. The direct abutters to the north are a single-family dwelling and two-family dwellings; to the west, a two-family
dwelling; to the south, single-family dwellings and a two-family dwelling; and to the east, on the other side of
Sheridan Street, a City park, O’Connell Park.
9. Surrounding land uses are residential, mostly single and two-family dwellings, and a few three-family dwellings.
10. The existing building on the property grossly violates current dimensional controls for lot area, frontage, both
side yard setbacks, and density; predates the current Ordinance; and is considered preexisting nonconforming,
per §§12.16.010 and 12.28.010.A of the Ordinance.
11. The proposal decreases the existing violations of lot area, frontage, both side setbacks and density, and creates
no new nonconformities, per §§12.12.180 and 12.16 of the Ordinance.
12. Petitioner intends to landscape the rear yard with a grass yard and plant shrubbery around the property, and the
proposal would comply with the current Usable Open Space Requirements for All Districts, per §12.16.080 of
the Ordinance, and also the proposed amendments of this regulation pending in City Council Paper 186-2025.
13. The proposed two-family dwelling complies with current parking requirements to provide six parking spaces on-
site, namely, one space per bedroom, per §12.20.010 of the Ordinance.
14. The existing property does not comply with current regulations regarding landscaping and not paving more than
50% of the front yard; the existing paved driveway area comprises the entire front yard, predates the Ordinance
and is considered preexisting nonconforming, per §§12.20.020.I.12 and 12.28.010.A of the Ordinance.
15. Under the proposal, the existing driveway area, at the eastern side of the dwelling, with access via a curb-cut off
Sheridan Street, will be used to provide parking for six in a nonconforming layout of two sets of triple tandem.
16. The proposal maintains the existing violations of parking requirements regarding layout and landscaping.
17. Petitioner intends to demolish the existing building using hand tools, not heavy equipment, and will replace and
repair sections of the foundation as necessary, pursuant to review by its structural engineer.
18. Petitioner does not intend to allow use of the home office as a fourth bedroom and will rent each unit as a three-
bedroom unit; and according to the Building Commissioner, the certificate of occupancy will specify the number
of bedrooms in each unit.
19. Currently there are two construction dumpsters and various debris, including furniture, on site.
20. Petitioner intends to clean the site of debris currently located in the yard areas.
21. There is no public support of the proposal.
22. There is no public opposition to the proposal.
23. As modified by the proposed conditions of the special permit, the proposal will not be more detrimental to the
neighborhood.
DECISION (Case #25-05):
On June 11, 2025, pursuant to the foregoing Findings of Fact, the Planning Board granted a special permit, subject to
the following six (6) conditions:
1. All development shall be as per plans, except as modified by these conditions.
2. The maximum number of bedrooms in the two-family dwelling is six.

FINDINGS of FACT (Case #25-04): The City of Malden Planning Board finds the following facts:
1. The property is the site of a four-story building with a total of 27,930 square feet, comprised of sixteen units,
separately assessed as office condominium units and managed by a commercial condominium association.
2. The subject of the petition is the entire third floor of the building, containing 6,868 square feet, and comprised of
four condominium units, Units 301, 302, 303 and 304.
3. The proposal is for petitioner to occupy the entire third floor for its mental health clinic.
4. Under the proposal, petitioner will renovate the third floor and reconfigure the existing layout to sixteen offices
for therapy; nine offices and an open area for administration; a conference room; a reception area; and
amenities/utilities, including storage closets, data room, kitchen, restrooms and mechanical room.
5. The third floor is currently vacant and was most recently used by the current owner for light manufacturing by its
biotechnology company, per the special permit granted in Case #13-26, amended in Case #14-18.
6. The proposal does not involve changes to the other units, other floors or exterior of the building.
7. The property is classified as part of the Central Business zoning district.
8. The proposed mental health clinic is classified as part of the use known as medical center and may be allowed by
special permit in this zoning district, per §12.12.030 of the Ordinance.

9. Other units in the building are occupied for general offices, which are allowed by right in this district, and dental
offices, which are preexisting nonconforming uses, per §§12.12.030 and 12.28.010 of the Ordinance.
10. The direct abutter to the north is a vacant former bank and public parking lot; to the east, a private/non-profit
school, the Cheverus Catholic School; and to the south, two restaurants, a beauty salon; to the west, on the other
side of Main Street, are a daycare, restaurant and general offices.
11. Surrounding land uses are business, residential and the multimodal recreational trail, Bike to the Sea
Path/Northern Strand Community Trail.
12. The proposed medical center use is not in conflict with surrounding land uses.
13. The building on the property complies with dimensional controls for allowed uses of property in the Central
Business zoning district, per §§12.16.010 and 12.16.030 of the Ordinance.
14. The proposal creates no violations or nonconformities of dimensional controls.
15. No parking is required for the current uses or proposed medical center use of the building, as allowed non-
residential uses in the Central Business zoning district, per §12.20.020.H of the Ordinance.
16. The proposal creates no violations of parking requirements.
17. There are thirteen parking spaces located onsite in paved areas at the northern side and rear of the building and
along City Hall Avenue, a private way that runs off Main Street, between the subject property and abutting
property, 399 Main Street; access to the parking areas is gated and restricted by card-key; and parking spaces are
lined and most have faded, illegible numbers.
18. Currently, some vehicles park in various areas not designated for parking, including fire lanes, access aisles, and
the portion of the subject property, 142 feet in length, ten feet in width, that begins at City Hall Avenue and ends
at Ferry Street, that is subject to a right-of-way easement for “foot traffic only,” per deed records.
19. Currently, two unscreened dumpsters are located in areas striped to prohibit parking/use.
20. According to the current owner, the building condominium association is aware of on-going parking issues.
21. Four parking spaces are assigned to the current owner of the third floor and will be assigned to the new owner.
22. Petitioner intends to use assigned onsite parking for staff and expects other staff and clients to use the nearby
public garage and public transportation.
23. The traffic and traffic patterns generated by the proposed use will not adversely impact any of the surrounding
streets or create a traffic or safety hazard.
24. Petitioner’s proposed mental health clinic will be an outpatient clinic, licensed by the state, that provides services
in the form of “talk therapy,” to children and adults, individuals and families, by appointment only, 60% via
telehealth, and in-home and in-school.
25. Petitioner currently operates its business in Peabody, MA and Orlando, FL; the proposed Malden location will
replace the Peabody location.
26. The proposed use is in the interest of the common good.
27. One abutter, who is a long-standing business occupant of the building, is in favor of the proposal.
28. There is no public opposition to the proposal.
29. As modified by the proposed conditions of the special permit, the proposal will not be more detrimental to the
neighborhood.
DECISION (Case #25-04): On June 11, 2025, pursuant to the foregoing Findings of Fact, the Planning Board
granted a special permit, subject to the following three (3) conditions:
1. All development shall be as per plans, except as modified by these conditions; minor modifications of floor plan
are allowed.
2. This special permit allows use of the third floor only for a mental health clinic/service provider; any other medical
center use shall require seeking an amendment of this special permit.
3. Parking is only allowed in marked spaces and is prohibited in fire lanes, unmarked areas and the right-of-way
from City Hall Avenue to Ferry Street.
RECORD of VOTES (Case #25-04): The vote on June 11, 2025, on the motion by Chuha, seconded by Henry, to
grant a special permit subject to three conditions, was nine in favor, none opposed, and the motion passed (9-0):
