MINUTES OF THE MALVERN CITY COUNCIL Monday, March 8, 2021 STREAMED FROM THE MALVERN WATER WORKS OFFICE 6: 30 P. M. The Malvern City Council met for its regular monthly meeting on Monday, March 8, 2021 at 6: 30 p. m. via Microsoft Teams and advertised as required by law, due to the Covid- 19 Pandemic of 2020. The meeting was available for viewing live on YouTube. Mayor Weldon announced that the opportunities for attending the meeting had been advertised on the Ciry' s website ( with link provided), the City' s Facebook page, and in the Malvern Daily Record. Mayor Brenda Weldon called the meeting to order and led the invocation and pledge of allegiance. Answering the roll call were Council members Mary Fraction, William Wilson, Wayne Reynolds, Lynn Davis, Peggy Lusinger, Matthew Keenan, David Cross and Larry Stiles. Also present were City Clerk/ Treasurer Phyllis Dial and Ciry Attorney Cecilia Ashcraft. A motion was made by Council Member Matthew Keenan, seconded by Council Member Mary Fraction to approve the minutes of the regular meeting held on February 8, 202L Voting for the motion were Council members Mary Fraction, William Wilson, Wayne Reynolds, Lynn Davis, Peggy Lusinger, Matthew Keenan, David Cross and Larry Stiles. All voting for, motion camed, and the minutes of the previous meeting were adopted. A motion was made by Council Member Lynn Davis, seconded by Council Member Peggy Lusinger, to accept the Departmental Reports as posted, including January reports from Community Service, Street Department and Police Department. Voting for the motion were Council members Mary Fraction, William Wilson, Wayne Reynolds, Lynn Davis, Peggy Lusinger, Matthew Keenan, David Cross and Larry Stiles. All voting for, motion camed. Under old business, Council Member Fraction introduced an ordinance abolishing the Malvern/ Hot Spring Counry Planning Commission and the Malvern Board of Zoning Adjustment for its second reading by title only. The Mayor read the ordinance for its second reading by title only. The ordinance will be heard for its third and final reading at the April 2021 City Council meeting. Alderman Keenan introduced an ordinance reestablishing the Malvern Counry Planning Cominission for its second reading by title only. The Mayor read the ordinance for its second reading by title only. The ordinance will be heard for its third and final reading at the April 2021 City Council meeting. Under new business, a motion was made by Alderman Cross, seconded by Council Member Lusinger to accept the low bid, including the add- on alternate for the city park walkways from Tri- State Truck in the amount of$ 97, 000. 00 plus the alternate add- on of$22, 075. 00. Voting for the motion were Council members Mary Fraction, William Wilson, Wayne Reynolds, Lynn Davis, Peggy Lusinger, Matthew Keenan, David Cross and Larry Stiles. All voting for, motion carried. A motion was made by Council Member Fraction, seconded by Council Member Davis to accept the low bid from Doggett Freightliner in the amount of$ 87, 780. 00 for the purchase of a new 2022 dump truck for use by the Malvern Street Department. A motion was made by Alderman Cross, seconded by Council Member Lusinger to approve the purchase of a Crack- Sealer for the Street Department from Southern Star Manufacturing in the amount of$ 52, 886. 77 through the State purchasing contract. Voting for the motion were Council members Mary Fraction, William Wilson, Wayne Reynolds, Lynn Davis, Peggy Lusinger, Matthew Keenan, David Cross and Larry Stiles. All voting for, motion camed. Council Member Davis introduced an ordinance governing electrical service entrances in the Ciry of Malvern. The Mayor read the ordinance for its first reading. The ordinance will be heard for its second reading at the April 2021 meeting. Mayor Weldon told the Council that the old fire station was demolished today, in preparation for construction of the new station. She informed the Council that she was meeting with an engineer on Thursday to discuss insurance, bonding, and specifications on the upcoming street projecu. Mayor Weldon advised that the Governor had opened vaccines up to category 1- B today. Council Member Fraction asked for the status on the demolition project for abandoned structures. Chris Brewster, Code Enforcement Of icer, advised that certified letters have been sent to the owners and some have responded. His office hopes to present a list next month for condemnation, and after that they will begin title searches. He hopes to be able to go to bid within the next two months. A motion was made by Alderman Stiles, seconded by Alderman Cross to adjourn. With no further business to come before the Council, the meeting was declared adjourned. 1 '•. Weldon, Mayo 2  BID SUMMARY Malvern City Park Walking Trail The City of Malvern held a bid opening on Tuesday, February 23, 2021 at 2:30 p.m. in the Malvern Water Works conference room for the construction of the Malvern City Park Walking Trail. Present for the opening were Mayor Brenda Weldon, Architect Greg Pumphrey, City Clerk Dial, Water Works Manager David Coston and Bill Almond representing Tri-State Track. Attending via teams were Kim Sanders of ARDOT and representatives from Cate Construction, Pioneer Civil Construction, and Township Builders. The bid opening was available for viewing on Teams, with the connection information provided in the bid packet. Architect Pumphrey announced that all four bidders appeared to provide necessary bid documents, and that the bids will be reviewed prior to presentation to the City Council for the awarding of the contract.
