The Malvern City Council met for its regular monthly meeting on Monday, May 10,
2021 at 6: 30 p.m. via Microsoft Teams and advertised as required by law, due to the Covid-
19 Pandemic of 2020. The meeting was available for viewing live on YouTube. Mayor
Weldon announced that the opportunities for attending the meeting had been advertised on
the City' s website (with link provided), the City' s Facebook page, and in the Malvern Daily
Record.
Mayor Brenda Weldon called the meeting to order. City Clerk/ Treasurer Dial led the
invocation and pledge of allegiance. Answering the roll call were Council members Mary
Fraction, William Wilson, Wayne Reynolds, Peggy Lusinger, Matthew Keenan, David Cross and
Larry Stiles with Lynn Davis absent. Also present were City Clerk/ Treasurer Phyllis Dial and
City Attorney Cecilia Ashcraft.
A motion was made by Council Member David Cross, seconded by Council Member
Wayne Reynolds to approve the minutes of the regular meeting held on April 12, 2021.
Voting for the motion were Council Members Fraction, Wilson, Reynolds, Lusinger, Keenan,
Cross and Stiles with Davis absent. All present voting for, motion carried, and the minutes of
the previous meeting were adopted.
Council Member Cross noted that the Fire/ Code Enforcement Reports were not
located on the OneDrive for the month of April. A motion was made by Council Member
Matthew Keenan, seconded by Council Member Mary Fraction, to accept the Departmental
Reports as posted, excepting the Fire/ Code Enforcement Report. Voting for the motion were
Council Members Fraction, Wilson, Reynolds, Lusinger, Keenan, Cross and Stiles with Davis
absent. All present voting for, and the reports were accepted. Mayor Weldon stated that the
Fire/ Code Enforcement Report will be posted Tuesday morning.
Under old business, Council Member Keenan introduced an ordinance governing
electrical service entrances in the City of Malvern for its third and final reading by title only.
The ordinance was read for its third reading by title only by the City Attorney. A motion was
made
by Council Member Lusinger, seconded by Keenan to adopt the ordinance. Voting for
the motion were Council Members Fraction, Wilson, Reynolds, Lusinger, Keenan, Cross and
Stiles with Davis absent. All present voting for, the motion carried and the ordinance was
declared adopted and assigned No. 2021- 05.
ORDINANCE NO. 2021-05
AN ORDINANCE AMENDING SCCTION 3 OF ORDINANCE NO. 944 OF 1984
REGULATING SERVICE ENTRANCES
Under new business, a motion was made by Cross, seconded by Fraction to approve
the 2020 Water Works Audit report. Voting for the motion were Council Members Fraction,
Wilson, Reynolds, Lusinger, Keenan, Cross and Stiles with Davis absent. All present voting
for, the motion carried.

Council Member Fraction introduced a resolution amending Resolution 1 1- 2020 and
the 2021 budget for the Malvern Water Works. City Attorney Ashcraft read the resolution.
A motion was made by Alderman Cross, seconded by Lusinger, to adopt the resolution.
Voting for the motion were Council Members Fraction, Wilson, Reynolds, Lusinger, Keenan,
Cross and Stiles with Davis absent. All present voting for, motion carried, and the resolution
was declared adopted and assigned No. 07- 2021.

A RESOL.UTION AMENDING RESOLUTION NO. 11- 2020 AND THE 2021 BUDGET FOR
THE MALVERN WATER AND SEWER DEPARTMENT
A motion was made by Council Member Lusinger, seconded by Keenan to accept the
low bid for the Malvern Water Works manhole rehab. Voting for the motion were Council
Members Fraction, Wilson, Reynolds, Lusinger, Keenan, Cross and Stiles with Davis absent.
All present voting for and the motion carried.
A motion was made by Alderman Cross, seconded by Fraction to accept the low bid
for the Malvern Water Works collection system rehab.
Voting for the motion were Council
Members Fraction, Wilson, Reynolds, Lusinger, Keenan, Cross and Stiles with Davis absent.
All present voting for, the motion carried.Larry Stiles asked if he heard correctly at the
finance/ agenda meeting that this would rehab about 1/ 3 of the total system and Water
Works Manager Coston, said that it would. Stiles asked where the money will come from to
rehab the remaining 2/ 3' s of the system. Coston said that some of the money will come
from a bond pay- off( which will free up $. 5 million a year) and the remainder through the
sewer depreciation account. Stiles asked if there was a plan in place, and Coston replied
that there was.
Mayor Weldon reported that there is a pre- bid conference for the renovation of the
new police facility to be held at 2 p. m. on Tuesday, May 1 1, 2021 at the site. She asked
that the committee for the new police facility, consisting of council members Cross, Fraction,
Davis, and Lusinger, plan to meet with the Chief of Police some time next week to discuss
the colors and exterior of the facility. Stiles asked if the remainder of the Council would have
a say in the choices, and Weldon stated that after the committee meets, she will call a special
Team Up meeting so that the remainder of the Council can be made aware of the choices
before the bids open on lune 1. She advised the Council that bids will be opened on June
1, 2021 at 2: 30 p. m. at the site of the new facility.
Mayor Weldon stated that she is working on specifications for the street projects and
ho P es to have some of them in the news P a p er b Y next week. She advised that we still have
not found an operator for the street sweeper, or a summer mower operator, and that the
Water Works has an opening.

The construction of the new fire station is moving along and they are also working on
drainage around the new facility. The final approval on the TAPS grant for the walkways at
the park has been received. The new playground equipment has been ordered and should
be delivered in four to six weeks.
A motion was made by Alderman Keenan, seconded by Council Member Lusinger, to
adjourn. With no further business to come before the Council, the meeting was declared
adjourned.

Dear Mr. Coston:
Bids for the above mentioned project were received on Apri129, 2021. The bids ranged from
a low of $1, 398, 000 to a high of $2, 038, 720. Kajacs Contractors, Inc. of Little Rock,
Arkansas was the apparent low bidder. The engineers estimate for the project was
1, 723, 000.
Kajacs Contractors, Inc. has an Arkansas contractors license ( 0049950322) and I have
worked with them on several projects. To my knowledge the Utility Owner' s were satisfied
with their work.
Upon your authorization, I will prepare the Notice ofAward and proceed with processing the
Official Contract Documents
