CITY OF MANCHESTER BOARD OF ADJUSTMENT MINUTES September 13, 2018 ATTENDANCE Chairman Kent Goddard – Present Member J. D. Bond Lauren Goodman Planning and Zoning Director Melanie Rippetoe ATTENDEES Brett Prior Jayne Prior CALL TO ORDER Chairman Goddard called the meeting to order at 6:30 p.m. and asked Director Rippetoe to call the roll. The record of attendance is shown above. APPROVAL OF MINUTES A motion to approve the July 12, 2018 minutes as submitted was made by Member Nissenbaum and seconded by Member Ward. The minutes were approved 5-0. OLD BUSINESS None NEW BUSINESS CASE #18-V-007 Director Rippetoe gave the details of the variance case: Brett and Jayne Prior, owners, are seeking a variance required for approval of a deck for an existing single-family home located at 813 Dunraven Drive, in R-3 Single Family Residential Zoning District. The proposed deck is shown to be 16 feet long and 18 feet wide. It extends from a concrete patio on the rear of the home. The existing home is shown to be 6 feet from the property line, which encroaches 2 feet into the side yard setback. This property was developed under St. Louis County’s Regulations prior to annexation, and therefore is a legal non-conforming building pursuant to Section 405.160. The deck is shown to be in line with the existing home and will therefore need a 2-foot variance from the 8-foot side yard setback requirement. Page 1 of 2 Section 405.200.E.2. of the R-3 Residential Zoning Regulations states that there shall be a side yard on each side of a building having a width of not less than eight (8) feet. The deck is shown to be in line with the existing home and will therefore need a 2-foot variance from the 8-foot side yard setback requirement. Testimony #1 – Brett Prior summarized the project and the reason for the requesting the variance and answered questions of the City Attorney and Board members. Testimony #2 – Jayne Prior stated that added that in addition to the hardships, it would be aesthetically appealing. With all the questions satisfactorily answered, Member Pohlman made a motion and seconded by Member Nissenbaum to approve the variance. The resulting vote was 5-0 in favor of the variance.
