MINUTES OF THE PUBLIC HEARING OF MONDAY, JULY 6, 2015 AT 200 HIGHLANDS BOULEVARD DRIVE REGARDING A SPECIAL USE PERMIT REQUEST TO OPERATE A RESTAURANT WITH LIQUOR BY THE DRINK AT 471 LAFAYETTE CENTER Mayor David L. Willson called the Public Hearing of the Board of Aldermen to order at 7:00 p.m. Roll call showed those present were Alderman Clement, Alderman Stevens, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, July 6, 2015 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #15-SUP-008 - A request for a Special Use Permit has been made by Jie Bin Chen of Sushi Ai dba Sushi Japan to operate a restaurant with sales of liquor by the drink for consumption on the premises at 471 Lafayette Center. The property is zoned C-1 Commercial District.” Mayor Willson advised that Mr. Chen was unable to attend this evening, so this public hearing would be continued to July 20, 2015. Willson called the Public Hearing of the Board of Aldermen to order at 7:02 p.m. Roll call showed those present were Alderman Clement, Alderman Stevens, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, July 6, 2015 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #15-SUP-009 - A request for a Special Use Permit has been made by Andrew Shaw of Little Tokyo Restaurant to operate a restaurant with liquor sales for consumption on the premises at 61 Nationalway Shopping Center. The property is zoned PBD Planned Business Development District.” Mayor Willson advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. Mr. Andrew Shaw stated that he is from O’Fallon, Missouri, and he would like to open up the Japanese steak house. He said it would basically be the same operation that was there previously. There were no opponents and no comments from the public. Alderman Diehl asked if a liquor license would be involved too. Mr. Shaw answered that was correct. Alderman Clement asked about updating or remodeling. Public Hearing 07/06/2015- Special Use Permit Request-Restaurant at 61 Nationalway Center Page 1  Mr. Shaw answered he would do some remodeling, as in adding all new carpeting, do a lot of cleaning, and get brand new refrigeration and new hoods if required. Attorney Gunn reviewed the conditions included in the Bill: 1. Holder’s strict compliance with all applicable Federal, State and City of Manchester statutes and ordinances. 2. Holder’s strict compliance with all applicable State, County, and City of Manchester statutes and ordinances pertaining to the liquor license managing officer’s requirements and responsibilities, and evidential confirmation that the said managing officer is appropriately qualified. 3. Holder’s strict compliance with the City’s Planning and Zoning Ordinances in regard to signage. 4. Holder permitting access to the Property by the City of Manchester at all times requested so as to confirm compliance under Paragraphs 1, 2 and 3 of this Section Five. Mr. Shaw stated that he agreed with the four conditions. Alderman Clement stated that the Planning and Zoning Commission gave a unanimous endorsement. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, July 6, 2015 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #15-SUP-010 - A request for a Special Use Permit has been made by Jacob Eldridge of Manchester 17, LLC to operate a restaurant with liquor sales for consumption on the premises at 17 Nationalway Shopping Center. The property is zoned PBD Planned Business Development District.” Mayor Willson advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. Mr. Jacob Eldridge stated that they plan to open a sports bar. He said it is 6,000 square feet, and a lot of the kitchen was already updated by the previous owners. He advised that he was able to inherit all the tables and chairs, plates, etc. He said he wants to provide a little night life and entertainment as well. He hopes to have a successful and good business. Alderman Diehl asked if there is going to be dancing. Mr. Eldridge answered he would like to have some live music in the evening. He said it will depend on what people respond to. Alderman Stevens asked the hours of operation. Mr. Eldridge answered that they would like to be open Tuesday through Sunday 11:00 a.m. to 1:30 a.m. They have been tossing around the idea of not being open on Monday. It could just be for lunch on Monday, again it will depend on the people. Attorney Gunn reviewed the conditions included in the Bill: 1. CALL TO ORDER Mayor David L. Willson called the Regular Board of Aldermen meeting to order at 7:11 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Clement, Alderman Stevens, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the June 15, 2015 Public Hearing regarding Community Development Block Grant Funds Alderman Clement made the motion to approve the Minutes of the June 15, 2015 Public Hearing regarding Community Development Block Grant Funds. The motion was seconded by Alderman Hamill and carried unanimously, without objection. b. Minutes of the June 15, 2015 Regular Board of Aldermen meeting Alderman Hamill made the motion to approve the Minutes of the June 15, 2015 Regular Board of Aldermen meeting. The motion was seconded by Alderman Clement and carried unanimously, without objection. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Diehl advised that item 10 (a) needs to be removed. Mayor Willson stated he would be introducing some boy scouts. Alderman Clement made the motion to approve the Order of Items on the Agenda as amended. The motion was seconded by Alderman Hamill and carried unanimously, without objection. Regular Board of Aldermen 07/06/2015 Page 1 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Introduction of Boy Scouts Mayor Willson introduced boy scouts David William Henske, Troop #387 sponsored by St. John United Church of Christ, and Christopher Hruz and Sean Hruz, Troop #751, sponsored by St. Joseph’s Catholic Church. The scouts are all working on their “Communications” merit badges. b. Presentation of check to Missouri Special Olympics Chief of Police Timothy Walsh stated that in May the Police Department holds a night at Tucker’s Place West Restaurant where the Police Officers volunteer their time as bus boys to raise money for Special Olympics. Chief Walsh expressed thanks to Mr. Tom Struharik who continues to welcome Manchester Police’s fundraising program at his restaurant and who continues to serve as the number one benefactor and supporter. He said the total for the year is $14,009 in donations. Chief Walsh acknowledged Mr. Neil Struharik, representing Tucker’s Place West Restaurant, and Chief expressed thanks for the support and donations. At the meeting to accept the check for the donations was Ms. Finley Hurth, Special Olympics Missouri Development Manager. c. Comments from the Public There were none. 6. REPORTS FROM THE MAYOR a. Reappointment of Alderman Mike Clement and Doug Whitaker as members of the Manchester Arts Council Alderman Hamill made the motion for Alderman Mike Clement and Doug Whitaker to continue to be on the Manchester Arts Council. The motion was seconded by Alderman Stevens. Alderman Clement abstained. The motion carried by a vote of 5 - 0. b. Proclamation Presentation – Parks and Recreation Month Mayor Willson recognized the Parks and Recreation Department for their year-around maintenance of the parks and all the special events and activities that are hosted by the Parks and Recreation Department. Mayor Willson presented a Proclamation to Director of Parks and Recreation Eileen Collins in honor of National Parks and Recreation Month. c. Mayoral Report Mayor Willson announced that on June 28, he presented an Eagle Scout Proclamation for Ryan Fogarty; on July 4 he attended the 4th of July Celebration at the Park. There was great attendance and great fireworks. Regular Board of Aldermen 07/06/2015 Page 2  Mayor Willson stated that Mr. Franklin stated he counted 1,100 bursts for the fireworks finale. He said that Director Collins stated that there were 1,400. He said it was amazing how many people were there who were not Manchester residents. He said there were people from Wildwood, Eureka, Pacific, and Bourbon, Missouri and even the state of Michigan. 7. REPORTS FROM THE CITY ADMINISTRATOR a. Announcement of Budget Preparation Schedule City Administrator Hixson stated he has released the dates for the budget schedule in the Agenda packet. b. List of Paid Bills (Warrant dates of June 12 – July 3, 2015) There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Clement stated that the Planning and Zoning Commission did meet on June 22, and they had two cases in front of them. One case was a Special Use Permit for a massage therapist and that was recommended to come to the Board. The other case was a Special Use Permit for ATA Martial Arts which is already a business in the City, and they are planning a move to Boardwalk Plaza. That case has also been recommended to the Board. b. HOMECOMING COMMITTEE Alderman Ottenad advised that the Homecoming Committee did not meet, but they will meet Wednesday, July 8 at 6:30 p.m. at the Legion Hall. She invited everyone to attend. c. MANCHESTER ARTS Alderman Stevens reviewed the upcoming events; there will be a concert on July 12 “Heroes and Villains”. 9. ACTION ON OLD BILLS a. There were none. 10. INTRODUCTION OF NEW BILLS a. BILL APPROVING A SPECIAL USE PERMIT REQUEST FOR A RESTAURANT WITH LIQUOR BY THE DRINK AT 471 LAFAYETTE CENTER This item was postponed. Regular Board of Aldermen 07/06/2015 Page 3  b.
