MINUTES OF THE PUBLIC HEARING HELD ON MONDAY, APRIL 16, 2018 AT 200 HIGHLANDS BOULEVARD DRIVE REGARDING A PROPOSED TEXT AMENDMENT PERTAINING TO USES SPECIFICALLY PROHIBITED IN THE R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT Mayor David L. Willson called the Public Hearing of the Board of Aldermen to order at 7:00 p.m. Roll call showed those present were Alderman Clement, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, April 16, 2018 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #18-TXT-001 Fontbonne University proposes a Zoning Text Amendment to Article V or Chapter 405 of the Code of Ordinances pertaining to uses specifically prohibited in the R-1 Single Family Residential District.” Mayor Willson advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. Planning, Zoning, and Economic Development Director Melanie Rippetoe spoke as a proponent. She stated that the text amendment is proposed by Fontbonne University and it is eliminating colleges and universities from the prohibited uses from the R-1 Single Family Residential zoning district. They are allowed in the section prior as a Special Use; however, there is a bit of confusion with the language with being specifically prohibited in the next section. This is being proposed to eliminate that text. City Attorney Gunn read a provision in the permitted uses which states: “Public schools kindergarten, elementary, secondary, and collegiate and other not-for-profit educational institutions having a curriculum the same as ordinarily given in such public schools, provided such satisfies all requirements of the BOCA Code, the other Ordinances of the City of Manchester and the requirements of the West County EMS and Fire Protection District, or its equivalent, as such may, Public Hearing: Text amendment regarding permitted uses in the R-1 District - 04/16/2018 Page 1 from time to time, be in effect.”, so that is a recognized specially permitted use in the R-1 Zoning District, but under specially prohibited it says colleges or universities. Colleges and Universities in his opinion are specially permitted under the provision that he just read. He would think it is about other colleges or universities that didn’t have a curriculum. That is where the confusion is and staff felt it should be clarified as a part of the application by Fontbonne University, so that is why this text amendment is being proposed. There were no opponents, no comments from the public, and no comments from the Board of Aldermen. Alderman Clement stated that the Planning and Zoning Commission recommended this text amendment to the Board of Aldermen. Willson called the Public Hearing of the Board of Aldermen to order at 7:04 p.m. Roll call showed those present were Alderman Clement, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, April 16, 2018 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #18-TXT-002 – Zoning Text Amendment – Article VII of Chapter 405 of the Code of Ordinances of the City of Manchester regarding Section 405.320.R. pertaining to Construction Requirements of Scoreboards.” Mayor Willson advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. Director of Planning, Zoning, and Economic Development Melanie Rippetoe spoke as a proponent. She stated that this is an additional text amendment requested by Fontbonne University. She stated that Manchester’s regulations currently allow scoreboards, but they are only allowed for high schools. This text amendment will change the allowance for colleges and universities, in addition to high schools. It also changes the number of scoreboards, there is a maximum of three scoreboards allowed, one per field. Additionally, staff included the requirement that all sign permits associated with scoreboards shall require approval by the Planning and Zoning Commission. There were no opponents and no comments from the public. Alderman Ottenad asked about the buffering within 100 feet, whether that is something being added or whether that is something included before. Public Hearing: Text amendment regarding construction requirements of scoreboards - 04/16/2018 Page 1  Director Rippetoe answered it has been in the Code and had not been changed. Alderman Ottenad wondered how many properties are by Fontbonne that would be within 100 feet. Director Rippetoe answered she is not sure because nothing is definite. They will have to come back to the Planning and Zoning Commission for review when they are ready to install the scoreboards. Alderman Hamill wanted to clarify if the scoreboards faced the building and not the residents. Director Rippetoe agreed with Alderman Hamill. Alderman Clement stated that the Planning and Zoning Commission recommended this text amendment to the Board of Aldermen. Mr. Mike Pressimone, President of the University, said he sees this as an important secondary West County facility for the University; it does not replace their home in Clayton. In Clayton there are no playing fields, so this would give them an opportunity to have a place for home sports, and also to create some vibrant educational programs that serve more of the West County marketplace. Through their strategic planning process, and working with the Planning and Zoning Commission, they believe they have developed a good plan to create a very vibrant educational enterprise and an athletic home for Griffin sports here in Manchester. There were no opponents, no comments from the public, and no comments from the members of the Board of Aldermen. Alderman Clement stated that the Planning and Zoning Commission forwarded these requests to the Board of Aldermen with their recommendation. The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, April 16, 2018 at 7:00 p.m. at the Manchester Police Facility, 200 Highlands Boulevard Drive, to consider the following: CASE #18-SUP-003 – Montana Hilti, on behalf of Nico Properties II LLC, owner, is seeking approval of a microbrewery to be located at 14336 Manchester Road, in the PBD Planned Business Development District.” Mayor Willson advised that first the proponents would speak, then the opponents, and comments from the public, followed by questions from the members of the Board of Aldermen or the City staff. Speaking as the proponent, Mr. Montana Hilti said he lives in Ballwin. He has a passionate drive to see where this endeavor can go. He thinks bringing a microbrewery to the Manchester area will bring people in from around the St. Louis area and abroad, and he hopes to talk with other businesses in the area as well. It will be a family-friendly business, open seven days a week. Right now there are about 65 breweries in the St. Louis area, including a new one in Ellisville, a new one in Town and Country, and another coming to Valley Park. Public Hearing: Special Use Permit Request for a microbrewery 04/16/2018 Page 1  Mr. Gerald Arbini, owner and operator of Sallies Cake and Candies, is located adjacent with the property of the proposed microbrewery. He said he is not concerned about the microbrewery, but he is concerned about the parking. He said there are 8100 square feet, which would call for 81 parking places, right now there are 42 spaces, four of which are on a designated alley. He mentioned that recently the bridal store next door had 11 cars on their parking lot, and he is concerned about what will happen during peak hours, especially on Saturday, when the bridal shop also has their busiest time. Mr. Frank Yokum, commercial real estate broker, addressed the 40 parking spots which were previously approved by the City. He said that most of the time there is hardly anyone at the bridal shop next door, but they are busy on Saturday. He stated that the other neighbors next door are parking illegally on their lot; the car repair place next door has consistently been parking cars on their property. In regard to the 40 spots previously approved by the City, he thinks the City is in compliance with that. Alderman Clement asked if staff has been aware of the parking concern. Director Rippetoe said this is the first she has heard of this, and this meets parking regulations; she added that often there is not anyone parking at the bridal shop. She stated she will look into this, but she was unaware there was a problem. Alderman Clement asked that the parking situation be discussed City Attorney Patrick R. Gunn read the special conditions which are part of the Ordinance: “1. Holder’s hours of operation shall be limited to 9:00 a.m. to 1:00 a.m. Monday through Friday; 7:00 a.m. to 1:00 a.m. Saturday; and 7:00 a.m. to 12:00 midnight Sunday. 2. Holder’s strict compliance with all applicable Federal, State and City of Manchester statutes and ordinances. 3. Holder permitting access to the Site by the City of Manchester at all times requested so as to confirm compliance under Paragraphs 1 and 2 of this Section Five.” Mr. Hilti said the conditions were acceptable; however, they would not be open to the public until noon; they would have employees at the microbrewery at 7:00 a.m. for the purpose of brewing beer. There was discussion about parking spaces, and Attorney Gunn stated that parking is an Ordinance requirement. Alderman Ottenad said she understands there will be three to five full-time employees, part- time employees, and customers, and she is concerned about the parking. She asked how many customers Mr. Hillti would expect at a time. Mr. Hilti said that as a rough estimate, but in the beginning, he would guess 50. Mr. Hilti said the full-time employees would likely be there early in the morning doing the brewing. He stated his proposed hours are to be open at noon Monday through Friday, but they would be there at 7:00 a.m. to brew. CALL TO ORDER Mayor David L. Willson called the Regular Board of Aldermen meeting to order at 7:28 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Clement, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Diehl, Mayor Willson and Attorney Gunn. A quorum was present. 3. APPROVAL OF THE MINUTES a. Alderman Clement made the motion to approve the Minutes of the April 2, 2018 Regular Board of Aldermen meeting. The motion was seconded by Alderman Hamill and carried unanimously, without objection. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Clement made the motion to approve the Order of Items on the Agenda as submitted. The motion was seconded by Alderman Ottenad and carried unanimously, without objection. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Approval of new liquor license for El Toluco Taqueria and Grocery Alderman Hamill made the motion to approve the new liquor license for El Toluco Taqueria and Grocery. The motion was seconded by Alderman Clement and carried unanimously, without objection. b. Comments from the Public Regular Board of Aldermen 04/16/2018 Page 1  Ms. Nancy Venezia, 1721 Blakefield Terrace, thanked the elected officials for their service. She said she has lived in City for 22 years now. Ms. Venezia invited everyone to the National Day of Prayer event on May 3 at noon at the Police Facility. Ms. Venezia stated that in 1952 Congress established National Day of Prayer, and in 1988, the law was amended and the National Day of Prayer was established as an annual observance held on the first Thursday of May. She advised that more than 48,000 events are held at City Halls and other locations throughout the nation. 6. REPORTS FROM THE MAYOR a. Proclamation Presentation honoring National Park Week Mayor David L. Willson presented a Proclamation to Director of Parks, Recreation, and Arts Eileen Collins recognizing National Park Week, April 21 – 29, 2018, as observed and celebrated by the National Parks Foundation.. b. Commendation for Police Officer Tim Chapman Chief Timothy Walsh read a Commendation for Police Officer Tim Chapman in regard to his excellent life-saving assistance given during a service call for a sick case on Tuesday, March 20, 2018. Upon arriving on the scene, Officer Chapman found the victim lying on the floor. At that time, the victim was not breathing and did not have a pulse. Officer Chapman administered CPR and within minutes, the victim developed a pulse and began shallow breathing, and has since fully recovered. c. Commendation for Police Officer Meredith Absolon Chief Timothy Walsh read a Commendation for Police Officer Meredith Absolon in regard to her recent exceptional professional performance and investigative skills during a routine traffic stop, followed by an in-depth inquiry, initiated the arrest of two identity theft suspects. It is evident that Officer Absolon’s quick thinking and immediate investigative response has stopped further crimes from occurring and provided evidence to pursue prosecution against the suspects. She effectively organized and presented the evidence of her case very well, as evidenced by the United States Secret Service’s decision to join the investigation and present the case for federal prosecution. d. Mayoral Report Mayor Willson reported that on April 7, at St. Joseph’s Church, he presented Kevin Patrick Harter with an Eagle Scout Proclamation. Eagle Scout Harter had earned 46 merit badges, and he plans to go into the Marines after school. Mayor Willson asked Director of Parks, Recreation, and Arts Eileen Collins to discuss the Cute Kids and Cute Pets competition for Homecoming this year, and Director Collins stated that proceeds will go to the Veterans’ Honor Flight for Manchester residents to help pay for that flight. Mayor Willson stated the guardians who go on these flights have to pay their own way, and that perhaps this will help somewhat. 7. REPORTS FROM THE CITY ADMINISTRATOR a. List of Paid Bills (Warrant dates of April 1 – April 14, 2018) Regular Board of Aldermen 04/16/2018 Page 2  There were no questions. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Clement stated there was no meeting last week, but there will be a Planning and Zoning meeting next week. b. Homecoming Committee Alderman Ottenad reported that there will be a meeting May 9 at 6:30 at Legion Hall, and everyone is invited. 9. ACTION ON OLD BILLS a. There were none. 10. INTRODUCTION OF NEW BILLS a. Answering an inquiry, Director of Public Works Bob Ruck stated that this is the annual replacement project typically done. He said this will compliment the work which will be done as a result of the recently-passed bond issue. He advised that he is unsure as to the exact time this replacement will begin in the City, because contractors are behind because of weather conditions. Comments from the Public Mr. Chris Winters, 510 Cardinal Lane, expressed his appreciation for the opportunity to thank Mayor David L. Willson for his service. He said that in his opinion, Mayor Willson has proven himself as being a pillar in the community by the endless hours he has dedicated himself to all the community and local events he has attended over the past many years.
