MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, AUGUST 3, 2020 BY VIDEO CONFERENCING ON ZOOM AND ALSO OPEN FOR THE PUBLIC AT 200 HIGHLANDS BOULEVARD DRIVE 1. CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen meeting to order at 7:00 p.m. 2. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Huether, Alderman Nolte, Alderman Hamill, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. A quorum was present. 3. APPROVAL OF THE MINUTES a. Minutes of the Monday, July 20, 2020 Public Hearing Alderman Ottenad made the motion to approve the Minutes of the Monday, July 20, 2020 Public Hearing. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. b. Minutes of the Monday, July 20, 2020 Board of Aldermen Regular Meeting Alderman Ottenad made the motion to approve the Minutes of the Monday, July 20, 2020 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Huether and carried unanimously, with no objections from members of the Board of Aldermen. 4. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad made the motion to approve the Order of Items on the Agenda, Regular Board of Aldermen Meeting 08-03-2020 Page 1 as submitted. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. 5. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC a. Comments from the Public City Clerk Justin Klocke read the emails he received. Dear Mike, there has been considerable discussion re: raising chickens in one’s back yard in Manchester on the Next door website. People are suggesting that we contact our Mayor and Alderman to encourage legalization. My brother lives in St. Charles city and his neighbor raises chickens and they have to put up with the odor from time to time and request that the neighbors coop be cleaned. So I am contacting you to notify that we do not want raising chickens legalized in Manchester. It’s inevitable that some residents will not always practice “best habits” when raising chickens. Sincerely, Leonard and Debbie Riley Big Bend Woods 314-202-1570 He also read: Good Morning Mr. Klocke, I'm emailing in the hope my voice will be heard at the Board of Alderman meeting. I'm in favor of lifting the ban on backyard chickens in Manchester. The city already does so much to cohabitate with Mother Nature with the Arbour tree giveaway and composting program, that it seems counterintuitive to prevent people from having the opportunity of backyard chickens. I would like to own chickens to get fresh eggs from my backyard and to teach my growing family about raising and caring for chickens. This would be a great learning experience, especially given the current global pandemic and starting the school year at home. Thank you all for everything that you do for our city. My family loves living in this area already and owning and caring for backyard chickens would be an added benefit! Thank you for your time and consideration. Sincerely, Regular Board of Aldermen Meeting 08-03-2020 Page 2 Shannon Schloessman Mr. Wayne Hartman, 415 Cardiff Lane, stated on Saturday night, August 1, a vehicle came up his street going north, parked their vehicle and he could see individuals being suspicious. When he spoke to the police they stated that the police would come by and the police never showed up. Ms. Trish Gunby, State Representative in the 99 District, stated there are a lot of things going on and wanted to remind everyone to get out and vote tomorrow. She also wanted everyone to be aware October 3 is shop local and support local businesses. 6. REPORTS FROM THE MAYOR a. Veteran Commission Nomination – Staff Sergeant Westley Moore Mayor Mike Clement nominated Staff Sergeant Westley Moore to the Veterans Committee. Alderman Toben made the motion to approve the nomination of Staff Sergeant Westley Moore to the Veterans Commission. The motion was seconded by Alderman Huether and carried unanimously, with no objections from members of the Board of Aldermen. b. Mayoral Reports Mayor Clement wanted to thank City Clerk Justin Klocke and Deputy Clerk Michelle Melugin for their drive through notarization drive on Saturday July 25. They had 24 notaries and multiple questions. They are two more drives in October for the November election. Mayor Clement wanted to let everyone know the Chat with the Chief is going to be held on Tuesday, August 4 at 6:30 p.m. at the Justice Center. This is a great event to have more relaxed conversation with the Chief. Mayor Clement wanted to let everyone know that Manchester is holding another blood drive on August 27 from 1 – 7 p.m. at the Parks Building. Due to Covid, you will have to have appointment. 7. REPORTS FROM THE CITY ADMINISTRATOR a. I5 Annexation Analysis Presentation – Mr. Stephen Ibendahl, Ms. Jackie Wellington and Ms. Beth Noonan Mr. Ibendahl went through his presentation on the Annexation Analysis. They did an analysis evaluated the potential advantages and disadvantages of annexation. Regular Board of Aldermen Meeting 08-03-2020 Page 3  Mr. Ibendahl stated there are two areas they are looking at, two locations. One location is the Northeast Annexation area which almost goes to Queeny Park on the east to Barrett Station Road and down to the south to Dougherty Ferry. The second one is called the Southwest Annexation area. This area is north of Big Bend and then the area over to the City limits of Ballwin. Mr. Ibendahl stated that the population increase for the northeast would be 6,425 and for the southwest would be 3,282. Mr. Ibendahl stated that the City currently has 63.0 street miles per length. If they were to annex the NE, they would be adding 19.0 miles and then 9.9 in the Southwest annexation area. Ms. Beth Noonan stated that the estimated total revenues would succeed the estimated total costs for the northeast annexation area. In the southwest area the costs are slightly higher than the revenues. She said the primary drive for that is the absence of the commercial area. Mayor Clement asked at this point what is the next step for the City or is there still work that needs to be done by i5? Mr. Ibendahl answered that they are finished with their scope of compiling the data. He said the next steps will be to give the City their official findings. He said the City will have to decide if they are to move ahead in both locations. Alderman Baumann asked when i5 was calculating the miles per street, did they calculate both ways or only one way. Mr. Ibendahl answered it is only one way, but it is street mile not land mile. Alderman Baumann inquired as to the Park maintenance extra cost. Ms. Noonan answered they anticipated that the parks department intended to add new Recs specialist to their team along with extra maintenance workers. They do not anticipate for non-personal costs associated with the southwest area. Mr. Ibendahl stated the next cycle begins January 2024 so the deadline to the boundary commission would be July 2022. There are a couple years in terms of a deadline to submit any proposals to the Boundary Commissions. b. Parks, Recreation, & Arts Department Update – Director Schien Director of Parks, Recreation & Arts Kat Schien stated she was asked to give a quick update on the Park’s programs. She said the majority of their programming in the Parks program guide was designed to be able to scalable but still be able to offer programming based on what the County is allowing. There potentially could be a few that could be cancelled. Regular Board of Aldermen Meeting 08-03-2020 Page 4  Director Schien stated next week they will be having a Homecoming Committee meeting and they will be going over the car show that will be taking place during the Homecoming weekend. With St. Louis County’s regulations of no more than 50 people in a gathering they will be following the developments as to whether they are allowed to have the car show. Director Schien stated the Parks Department is putting together a plan for St. Louis County to open the Paul Schroeder Park playground. A couple other playgrounds around St. Louis County have opened based on putting in a certain level of signage, markers about how many people would be permitted. She said she would like to put some hand sanitizer there. They will be making that a priority to get it open. They will be making Schroeder Park the first park so they can really take care of it since they are in the Park and see how things go. If everything goes well, they will slowly try opening the pocket parks. She said many residents have asked about opening the parks. Director Schien stated she wanted to give an update on some development plans on Stoecker Park and Schroeder Park. The Schroeder Park playground park project was worked on with a committee to select landscape architect, PDS, which is a very reputable and fantastic landscape architecture firm in St. Louis. They will help develop a master plan with the hopes of pushing the project back at least a year to go after some municipal grant funding in August of 2021. They hope to implement in 2022. Director Schien stated that with Stoecker Park, they are looking at transforming the front area where they acquired some additional land. They will be working with SWT, another fantastic landscape architecture firm here in St. Louis. They plan to start a master plan process for the development. Alderman Huether stated there is a lot of interest between the Veterans planning group and the Veterans Commission. She and Bonnie Krueger were at the Veterans Memorial looking at how they can remember our Manchester Veterans that have been killed in action or killed from their wounds, PTSD and or suicide. She said it is of real interest so if Manchester can make sure the communication between the Veteran’s efforts are closely tied. c. Body-Worn Cameras Report – Chief Scott Will City Administrator Larry Perney stated that after all the things that have happened in Minneapolis and other areas with the upheaval and defunding police, he along with the Mayor and Chief Will, have been discussing how Manchester can be better. One of the ideas was to get body worn cameras. He did not know the feasibility with that because of pricing. He asked Chief Will to investigate it. Chief of Police Scott Will stated they looked, but essentially what they found to outfit just the road officers (20 officers), and to use the company that we are currently Regular Board of Aldermen Meeting 08-03-2020 Page 5 using (Vista which is our car cameras) would be a little over $41,000 with some annual costs after that. Chief Will stated before he came to Manchester, he had the duty of looking into car and body cameras for Maryland Heights. He did a ton of research. When he did his research most police officers were against them and after they had them for about a year, they loved them. It got them out of trouble, and it helped them become better police officers. He stated that this day and age, to become more transparent and more open than we already are, he thinks it is a good idea. Alderman Hamill asked if the cost is coming from Asset Forfeiture Money. Chief Will answered yes, it would come from Asset Forfeiture. He said they currently have a little bit more than the $41,000 in the Asset Forfeiture. Alderman Nolte asked what the ongoing viability of Asset Forfeiture is. He said he knows there have been some cases that have limited the police departments ability to receive money from it. Chief Will stated it is not something that we should count on as a continuing revenue stream. It is hit or miss and it not a money-making project. The consensus from the Board is to look into this more. d. List of Paid Bills (Warrant dates of 07-15-2020 to 08-03-2020) There were none. 8. REPORTS FROM COMMITTEES a. Planning and Zoning Commission Alderman Hamill stated they did meet and had three items on the agenda. Two of them were site plans that were approved. He said the other item was a text amendment that received a favorable recommendation for the Board of Aldermen regarding tobacco products. b. Veterans Commission Alderman Huether stated they did meet on July 23; they confirmed their leadership teams. They are delighted to let everyone know that Kay Bell is chairman and Bonnie Krueger is secretary. They are delighted to welcome Staff Sergeant Westley Moore. Alderman Huether stated it was officially decided that the September 18, POW/MIA Remembrance Day will be held via Facebook live versus in-person given Covid restrictions. c. Homecoming Committee Alderman Ottenad stated the next meeting will be August 12 at 6:30 p.m., pavilion 1 at Paul Schroeder Park. She said hopefully all the Aldermen have received the email from Director Schien Regular Board of Aldermen Meeting 08-03-2020 Page 6 with all the significant changes with the Homecoming parade. Alderman Ottenad stated that she is hoping that all the Aldermen can make the evening homecoming parade to show Ruth Baker how much we appreciated her time and talents with the City since she is the Grand Marshal this year. She hopes they will also show our resident, friend and reporter Bonnie Krueger who will be the citizen of the year appreciation. d. Budget and Audit Committee No Report. 9. ACTION ON OLD BILLS a. BILL NO. 20-2411 – CHAPTER 205 ANIMAL REGULATIONS AMENDMENT Alderman Baumann read the second reading of Bill #20-2411, entitled: “AN ORDINANCE AMENDING CHAPTER 205 OF THE CODE OF ORDINANCES OF THE CITY OF MANCHESTER BY AMENDING SECTION 205.070 AND ADDING ARTICLE VI RELATING TO THE REGULATION AND POLICY FOR THE USE OF BEES WITHIN THE CITY”, by title only. Alderman Baumann wanted to thank Karen Markowski again for all the help that she provided the City with this Ordinance. Alderman Baumann made the motion that Bill #20-2411 become Ordinance #20- 2297. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Baumann – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Nolte – aye Alderman Hamill – aye Alderman Toben – aye Mayor Clement announced that the motion passed 6 – 0, with no objections from any members of the Board of Aldermen. 10. ACTION ON NEW LEGISLATION a. BILL NO. 20-2413 – REPEAL OF CHAPTER 380 HEADGEAR – WHEN REQUIRED – MOTORCYCLES OR MOTORTRICYCLES Alderman Nolte read Proposed Bill #20-2413, entitled: "AN ORDINANCE AMENDING CHAPTER 380 OF THE CODE OF ORDINANCES OF THE CITY OF MANCHESTER BY REPEALING SECTION 380.190 RELATING TO THE USE OF PROTECTIVE HEADGEAR BY Regular Board of Aldermen Meeting 08-03-2020 Page 7 DRIVERS AND PASSENGERS OF MOTORCYCLES OR MOTORTRICYCLES WITHIN THE CITY", by title only. No further action at this time. b. RESOLUTION NO 20-0764 – AUTHORIZATION OF A CONTRACT WITH E. MEIER CONTRACTING, INC. FOR THE 2020 PROPOSITION “S” ASPHALT IMPROVEMENTS PROJECT Alderman Ottenad read Proposed Resolution #20-0764, entitled: " A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH E. MEIER CONTRACTING, INC. IN AN AMOUNT NOT TO EXCEED TWO HUNDRED FIFTY-FOUR THOUSAND, THREE HUNDRED FOUR DOLLARS AND TWENTY- TWO CENTS ($254,304.22). WHICH INCLUDES A FIVE PERCENT (5%) CHANGE ORDER IN THE AMOUNT OF TWELVE THOUSAND ONE HUNDRED NINE DOLLARS AND SEVENTY- TWO CENTS ($12,109.72) TO BE USED FOR UNFORESEEN WORK CONDITIONS, FOR CONSTRUCTION OF THE 2020 PROPOSITION “S” ASPHALT IMPROVEMENTS PROJECT", by title only. Alderman Ottenad made the motion for approval of Resolution #20-0764. The motion was seconded by Alderman Nolte and carried unanimously, without any objections from any members of the Board of Aldermen. c. RESOLUTION NO 20-0765 – AUTHORIZATION OF A CONTRACT WITH HORNER & SHIFRIN, INC. TO PROVIDE PROJECT MANAGEMENT SERVICES FOR THE 2020 PROPOSITION “S” ASPHALT IMPROVEMENTS PROJECT Alderman Huether read Proposed Resolution #20-0765, entitled: " A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH HORNER & SHIFRIN, INC. IN AN AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND EIGHT HUNDRED SIXTY DOLLARS ($25,860.00) TO PROVIDE THE CITY WITH PROJECT MANAGEMENT SERVICES FOR THE 2020 PROPOSITION “S” ASPHALT IMPROVEMENTS PROJECT IN THE CITY OF MANCHESTER", by title only. Alderman Ottenad stated that she does not know if Ward One or Ward Three has had any of the problems or complaints with the Prop “S” street repairs, but Ward Two has had plenty. She has driven on Mautenne and Country Stone from LaBonne Parkway to Big Bend with many cars in back of her and three cars coming towards her. Cars were going over sidewalks and grass to escape the congestion with no one facilitating traffic. She said residents have complained of drivers of contractor trucks, H&A trucks, and even city trucks sitting together and talking amongst themselves with no one directing cars or paying attention to traffic. Someone needs to start paying attention to the residents and what is going on with them. People will remember next time we ask them to vote for a bond issue Regular Board of Aldermen Meeting 08-03-2020 Page 8 on streets. If Horner & Shifrin cannot oversea these projects maybe perhaps it is time to find another company that can. Alderman Nolte stated he disagrees, and he thinks this project is going well. He said he knows there is a little inconvenience going on and driving on one side of the street, but that is how you fix a street. Alderman Huether stated that she has also experienced what Alderman Ottenad mentioned. She would like to hear from Director Ruck and Assistant Director Pracht on how that was addressed and how we can avoid it in the future. Assistant Director of Public Works Pracht stated that he has been with the City a little over a year now and he has not really heard too many complaints up until the last three weeks. He believes most of the complaints have been on Country Stone. He said that Country Stone is one of the busier streets. They have spoken with Horner & Shrifrin about that area and have directed them to work in phases, opposed to having long stretches of road construction. He said they hope this helps with the complaints. Alderman Ottenad stated that until this year they have not had complaints. Alderman Huether made the motion for approval of Resolution #20-0765. The motion was seconded by Alderman Hamill and carried unanimously, without any objections from any members of the Board of Aldermen. 11. MISCELLANEOUS a. Comments from the Public There were none. 12. EXECUTIVE SESSION a. Closed Session: Pursuant to Section 610.021 (1) of the Revised Statutes of the State of Missouri pertaining to legal actions, causes of action of litigation involving a public governmental body and any confidential or privileged communications between a public governmental body or its representatives and its attorneys.
