MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, APRIL 19, 2021 BY VIDEO CONFERENCING ON ZOOM AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Mike Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Hamill, Alderman Huether, Alderman Nolte, Alderman Ottenad, Alderman Baumann, Alderman Toben, and Mayor Clement. A quorum was present. APPROVAL OF THE MINUTES Alderman Ottenad made the motion to approve the minutes of the Monday, April 5, 2021 Regular Board of Aldermen Meeting. The motion was seconded by Alderman Hamill and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as submitted. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS AND COMMENTS FROM THE PUBLIC New Liquor License Consideration Alderman Nolte made the motion to approve the new liquor license for El Jarocho. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. Comments from the Public There were none. REPORTS FROM THE MAYOR Social Service Fund vs. Non-Profit Social Service Discussion Mayor Clement and the Board of Aldermen discussed the creation of a 501(C) corporation or city social service program to use funds for various improvement projects in the City. Mayor Clement said that several residents in the City expressed interest in donating funds for such projects and with the anticipated receipt of American Rescue Plan Act funds, the City should consider establishing a fund or non-profit that would facilitate and administer a program that Regular Board of Aldermen Meeting 04-19-2021 Page 1 would deliver relief of some sort to residents. Board members discussed the pros and cons of 501(c) corporations and City established programs. A consensus was agreed upon that City staff and elected officials should continue to research the creation of a fund or non-profit and discuss the purpose of these programs further. Mayoral Proclamations Mayor Clement read the Proclamations for 2021 Arbor Day; Parks, Recreation, and Arts Professionals Week and Municipal Administrative Professionals Day. Recognition of Mr. Michael Ludwig’s Eagle Scout Project Mayor Clement recognized Michael Ludwig and his Eagle Scout Project. Mr. Ludwig made a Flag retirement receptacle that was placed at the Manchester Justice Center. Mayor Clement expressed the City’s gratitude for his contribution to the City. Tree Advisory Board Appointment Alderman Ottenad made the motion to approve the Appointment of Karen Zelle and Kevin Olsen to the Tree Advisory Board. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. 2021 Arbor Day Report Mayor Clement shared details for the upcoming Arbor Day events. D’Vontay Friga Mayor Clement stated D’Vontay Friga came to the City of Manchester and gave a talk about sports and supporting young men and women to work hard and get ahead on Tuesday, April 13 in Schroeder Park. REPORTS FROM THE CITY ADMINISTRATOR Missouri Police Chief’s Command College Graduation Recognition – Lt. Brian Yount Capitan Craig Smith recognized Lieutenant Brian Yount for his graduation from Missouri Police Chief’s Command College. Fiscal Year 2021 Three Month Financial Report – Director Yucuis Director of Finance Don Yucuis distributed the Financial Report to the Board of Aldermen and Audit and Finance Committee. Director Yucuis reported that there are no surprises, and the revenues and expenses are at the 25 percent mark or better. City Administrator Larry Perney stated that the Board is undertaking the second reading of the Bill for the financing on the new City Hall building. On April 27, the city will be closing on the property, pending Board approval. He said that if the Board approves the Bill, he would like to schedule, in early May, an open house for the Board and staff to see what the building looks like and the vision for the future. List of Paid Bills (Warrant dates of 04-05-2021 to 04-18-21) There were no questions. Regular Board of Aldermen Meeting 04-19-2021 Page 2 REPORTS FROM COMMITTEES Planning and Zoning Commission Alderman Hamill stated that there were numerous items on the Agenda this last meeting; a special use permit for a martial arts building at the old Office Depot building that was approved, three site plan approvals, and a sign approval for the Arbors of Hanna. Veterans Commission Alderman Huether stated the Veterans Commission will be meeting April 21. Alderman Huether updated the Board on the upcoming Flags of Valor project. They currently have 25 people volunteering to help put the dog tags with pictures on the Flags that will fly on Art Hill. They are still looking for more volunteers. Homecoming Committee Alderman Ottenad said they met on April 14 at the Parks Building. It was a signup meeting for the members to state what Homecoming committees they would like to be a part of. Alderman Ottenad stated the next meeting will be on May 19 at 6:30 p.m. at the Parks Building. Audit and Finance Committee Alderman Toben said that we are currently 15 percent through the year and the City is on track to have a good budget overall. Tree Advisory Board Director of Public Works Dave Pracht spoke about the tree grants that the City has been working on. ACTION ON OLD BILLS BILL NO 21-2430 – 14317 MANCHESTER ROAD PROPERTY FINANICING AUTHORIZATION Alderman Hamill read for the second time Bill No 21-2430, entitled: “AN ORDINANCE AUTHORIZING THE CITY OF MANCHESTER, MISSOURI TO ENTER INTO A LEASE TRANSACTION WITH CLAYTON HOLDINGS, LLC, AS LESSOR, WITH RESPECT TO THE ACQUISITION OF CERTAIN REAL PROPERTY AND IMPROVEMENTS THEREON TO BE USED AS A NEW CITY HALL; AND AUTHORIZING CERTAIN OTHER DOCUMENTS AND ACTIONS IN CONNECTION THEREWITH”, by title only. Alderman Hamill made the motion that Bill #21-2430 become Ordinance #21-2315. The motion was seconded by Alderman Toben. BILL NO 21-2431 – CONVEYANCE OF EASEMENT – 301 SPRING MEADOWS DRIVE (BAXTER ACRES PARK) Alderman Toben read for the second time Bill No 21-2431, entitled:” AN ORDINANCE AUTHORIZING THE GRANT TO ST. LOUIS COUNTY OF A PERMANENT ROADWAY IMPROVEMENT MAINTENANCE UTILITY SEWER AND SIDEWALK EASEMENT AND A TEMPORARY SLOPE AND CONSTRUCTION LICENSE OVER PROPERTY LOCATED AT 301 SPRING MEADOWS DRIVE AS PART OF THE COUNTY’S BAXTER ROAD (SOUTH) ARS RESURFACING PROJECT AND AUTHORIZING THE CITY ADMINISTRATOR TO EXECUTE THE EASEMENT DOCUMENT ON BEHALF OF THE CITY”, by title only. Alderman Toben made the motion that Bill #21-2431 become Ordinance #21-2316. The motion was seconded by Alderman Ottenad. ACTION ON NEW LEGISLATION BILL NO 21-2432 – MANCHESTER ROAD PEDESTRIAN IMPROVEMENTS PROJECT AGREEMENT Alderman Ottenad read Proposed Bill No #21-2432, entitled: “AN ORDINANCE AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO AN AGREEMENT WITH THE MISSOURI HIGHWAYS AND TRANSPORTATION COMMISSION IN CONNECTION WITH A FEDERAL AID PROJECT RELATING TO THE MANCHESTER ROAD PEDESTRIAN IMPROVEMENTS IN THE CITY OF MANCHESTER”, by title only. No further action at this time. Alderman Nolte made the motion for approval of Resolution #21-0803. The motion was seconded by Alderman Huether and carried unanimously, without any objections from any members of the Board of Aldermen. RESOLUTION NO #21-0804 – SPECIAL USE EXTENSION AUTHORIZATION – 14401 MANCHESTER ROAD (SUNUP EXPRESS) Alderman Hamill read Proposed Resolution No. #21-0804, entitled: “A RESOLUTION AUTHORIZING AN EIGHTH EXTENSION OF TIME FOR THE EXPIRATION OF A SPECIAL USE PERMIT FOR 14401 MANCHESTER ROAD,” by title only. There was a discussion of reasons why they needed another extension on the Special Use Permit. Sun Up Express hopes to open up around May 1, 2021. Alderman Hamill made the motion for approval of Resolution #21-0804. The motion was seconded by Alderman Toben and carried unanimously, without any objections from any members of the Board of Aldermen. RESOLUTION NO #21-0805 – OPPOSITION TO HOUSE BILL NO 920 OF THE 101ST GENERAL ASSEMBLY Alderman Huether read Proposed Resolution NO #21-0805, entitled: “A RESOLUTION EXPRESSING THE CITY OF MANCHESTER BOARD OF ALDERMEN’S OPPOSITION TO HOUSE BILL NO. 920 OF THE 101ST GENERAL ASSEMBLY”, by title only. Alderman Huether made the motion for approval of Resolution #21-0805. The motion was seconded by Alderman Nolte and carried unanimously, without any objections from any members of the Board of Aldermen. MISCELLANEOUS Comments from the Public There were no comments from the Public. ADJOURNMENT There being no further business, Alderman Hamill made a motion to adjourn.
