MINUTES OF THE REGULAR BOARD OF ALDERMEN MEETING OF MONDAY, OCTOBER 16, 2023 AT 200 HIGHLANDS BOULEVARD DRIVE CALL TO ORDER Mayor Clement called the Regular Board of Aldermen Meeting to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Dodge, Alderman Ottenad, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. Alderman Nolte was absent. A quorum was present. APPROVAL OF THE MINUTES October 2, 2023 Public Hearing –Special Use Permit for 14441 Manchester Road Alderman Ottenad made the motion to approve the minutes of the Monday, October 2, 2023, Public Hearing for a Special Use Permit for 14441 Manchester Road. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. October 2, 2023 Public Hearing –Text Amendment for Marijuana Land Uses Alderman Ottenad made the motion to approve the minutes of the Monday, October 2, 2023, Public Hearing for a Text Amendment for Marijuana Land Uses. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. October 2, 2023 Regular Board of Aldermen Meeting Alderman Ottenad made the motion to approve the minutes of the Monday, October 2, 2023, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Mayor Clement asked Alderman Toben to read Bill No 23-2514 in Alderman Nolte’s absence. Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as amended. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. CONSIDERATION OF PETITIONS Comments from the Public City Clerk Melugin read a public comment submitted by Dan Pinkard to the City. The comment was disapproving of the City’s promotion of the Guns ‘N Hoses fundraiser and Merchandise. Regular Board of Aldermen Meeting 10/16/2023 Page 1 Mayor Clement responded to the comment thanking anyone who comes forward with public comments and explained that the Guns ‘N Hoses event is the primary fundraiser for BackStoppers. REPORTS FROM THE MAYOR Mayoral Proclamations- Mike Pate’s 30 Years of Service Mayor Clement read a proclamation recognizing Mike Pate and thanking him for his hard work and dedication over the past 30 years working in the City. Mike Pate thanked the Mayor and Board for recognizing his time in Manchester. Mayoral Proclamations- Terry Black Retirement Mayor Clement read a proclamation thanking Terry Black for his 43 years with the City and wishing him well in retirement. Mayoral Reports Mayor Clement reported that there had been two annexation open houses the previous week at Love Park. He explained that there are continued efforts to educate people on annexation. He continued that the election would be on November 7th. Mayor Clement acknowledged the American Legion fundraiser and Police Department’s support for Sgt Absolon. REPORTS FROM THE CITY ADMINISTRATOR City Administrator Klocke echoed the success of the American Legion fundraiser for Sgt. Absolon. City Administrator Klocke acknowledged the public comment from earlier in the meeting and explained that Guns ’N Hoses is a long-standing St. Louis tradition held on the day before Thanksgiving and supporting the organization BackStoppers. He continued that the donations to BackStoppers are important and in the 36 years of the event, they have raised over 11 million dollars to help the family of fallen and injured first responders. He continued that he hoped knowing this would show residents the importance of the event to Manchester Police Officers and why information was shared about the event. List of Paid Bills (Warrant dates of 10-02-2023 to 10-15-2023) There were no questions. Reports from the Committees Planning and Zoning Commission Mayor Clement reported that the Planning and Zoning Commission gave a positive recommendation for a dedication for Baxter Commons Dr that would be read later in the Board meeting. Veterans Commission Alderman Huether reported that the Veterans Commission had a lot going on. She reminded the Board that the City’s Veterans Day events would be observed on Friday, November 10th, since the holiday fell on that Saturday. The events include a Veterans breakfast, Flags of Valor, and a ceremony celebrating Hometown Heroes. She reported that the Veterans Commission’s next meeting would be on Thursday, November 9th at 5pm. Regular Board of Aldermen Meeting 10/16/2023 Page 2 Audit and Finance Committee Alderman Baumann stated that the Audit and Finance Committee discussed the upcoming budget that would presented to the Board in the fall. Tree Advisory Board Alderman Dodge stated that there was no report for the Tree Advisory Board. Homecoming Committee Alderman Ottenad reported that Homecoming Committee did not meet. The wrap-up meeting would be on October 18th at 6:30pm at the Park’s office. Annexation Update Alderman Dodge told the Board that there would be a mailer sent to residents in Manchester and in the annexation area that would notify them of the four polling locations for the November 7th election. ACTION ON OLD BILLS BILL NO. 23-2514 Text Amendment to Medical and Recreational Marijuana Land Uses Alderman Toben read for the second time Bill No. 23-2514 entitled: “AN ORDINANCE AMENDING MULTIPLE SECTIONS OF THE MANCHESTER ZONING CODE RELATING TO REGULATIONS FOR MEDICAL AND RECREATIONAL MARIJUANA LAND USES IN COMPLIANCE WITH THE MISSOURI CONSTITUTION,” by title only. Alderman Toben made the motion that Bill No. 23-2514, become Ordinance No. 23-2398. The motion was seconded by Alderman Ottenad. A poll of the Board showed: Alderman Dodge – aye Alderman Ottenad – aye Alderman Huether – aye Alderman Baumann – aye Alderman Toben – aye Alderman Nolte – absent Mayor Clement announced that the motion passed 5 to 0, with no objections from any members of the Board of Aldermen. INTRODUCTION OF NEW LEGISLATION Resolution No. 23-0950 Extension for Special Use Permit for 4 Topwood Drive Alderman Dodge read Proposed Resolution No. 23-0950, entitled: “A RESOLUTION AUTHORIZING A 2ND EXTENSION OF TIME TO THE EXPIRATION OF A SPECIAL USE PERMIT FOR 4 TOPWOOD DRIVE,” by title only. Alderman Ottenad expressed concern on the lack of movement in the project from the last Regular Board of Aldermen Meeting 10/16/2023 Page 3 special use permit extension that had been granted. Mr. Holohan, owner of the property, explained that work had been done on finalizing plans and that the projected completion of the first structure was 2025. Alderman Huether noted that the property is in the same state that it was prior to Mr. Holohan’s purchase and that it didn’t seem to be an issue with neighbors. Director Riganti explained that Planning and Zoning was looking on adjusting the language regarding the expiration of special use permits and their extension periods to address the issues the Board had with the requirement of Mr. Holohan coming back for extensions so frequently. Alderman Dodge made the motion for approval of Resolution No. 23-0950. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board of Aldermen. BILL NO. 23-2515 Street Dedication Accepting Baxter Commons Drive Alderman Baumann read Proposed Bill No. 23-2515 entitled: “AN ORDINANCE ACCEPTING THE DEDICATION AND CONVEYANCE OF CERTAIN RIGHT-OF-WAY AND EASEMENTS AND ACCEPTING BAXTER COMMONS DRIVE FOR MAINTENANCE AS A PUBLIC STREET OF THE CITY OF MANCHESTER,” by title only. Alderman Baumann and Mayor Clement thanked Don Carpenter, Director Riganti, and Public Works on their efforts in coordinating and making this dedication happen. No further action at this time. MISCELLANEOUS Comments from the Public Robert Lopez, owner of 1302 Mautenne Dr, asked for updates on the La Bonne Project. Mayor Clement explained that bids would be accepted later in the week and that the project had taken a lengthier amount of time due to issues with residents dedicating temporary easements for the project. ADJOURNMENT There being no further business, Alderman Toben made the motion to adjourn. The motion was seconded by Alderman Ottenad and carried unanimously.
