MINUTES OF THE PUBLIC HEARING OF MONDAY, APRIL 15, 2024 BOUNDARY ADJUSTMENT FOR 822 BIG BEND WOODS DRIVE AND 825 HANNA ROAD CALL TO ORDER Mayor Mike Clement called the Public Hearing of the Board of Aldermen to order at 7:00 p.m. ROLL CALL AND STATEMENT OF QUORUM Roll call showed those present were Alderman Dodge, Alderman Ottenad, Alderman Huether, Alderman Toben, Alderman Baumann, and Mayor Clement. A quorum was present. PUBLIC HEARING The following notice of the public hearing was then read: “The City of Manchester Board of Aldermen shall hold a public hearing on Monday, April 15, 2024, at 7:00 p.m. at the Manchester Justice Center, 200 Highlands Boulevard Drive, to consider the following: CASE NUMBER - PC-24-SUB-001, a Boundary Adjustment Plat to adjust the property line between 822 Big Bend Woods Drive and 825 Hanna Road in the R-3 Residential Zoning District.” Speaking as a proponent, Dan File, owner of 825 Hanna Road, explained that he, his wife, and the owner of 822 Big Bend Woods Drive were present for the meeting. Mr. File explained he wanted to expand his driveway due to the size of vehicles increasing and that was what began the boundary adjustment discussion with his neighbors. He explained that the presented adjustment would allow for the widening of their driveway and that the square footage would be an even exchange between the two properties. COMMENTS FROM OPPONENTS, QUESTIONS OR COMMENTS FROM THE PUBLIC There were no opponents. Mayor Clement stated that the Planning and Zoning Commission gave a favorable recommendation for the project to the Board of Aldermen. A quorum was present. APPROVAL OF THE MINUTES April 1, 2024 Regular Board of Aldermen Meeting Alderman Ottenad made the motion to approve the minutes of the Monday, April 1, 2024, Regular Board of Aldermen Meeting. The motion was seconded by Alderman Huether and carried unanimously, with no objections from any members of the Board of Aldermen. ESTABLISHMENT OF ORDER OF ITEMS ON THE AGENDA Alderman Ottenad made the motion to approve the Order of Items on the Agenda, as presented. CONSIDERATION OF PETITIONS Resident Advocating for Chickens in Manchester – Jenessa Solomon (Shearer) Jenessa Shearer, resident of 1116 Dauphine Lane, stated she had sent a letter to the Board of Aldermen expressing her family’s interest in raising chickens. She continued that the letter contained the positives of raising chickens and addressed concerns. She elaborated that her family had looked into moving out of Manchester to be able to raise chickens. He furthered that they wanted their children to learn responsibility and to be self-sufficient through raising chickens and that would like to do that in the Manchester community. Mayor Clement explained that the City Administrator would review the request she had made in her letter and seek a consensus from the Board of Aldermen on different approaches to the allowance of chickens on smaller lots than are currently allowed. Liquor Picnic License for St. Louis Scottish Games Festival City Clerk Melugin explained that St. Louis Scottish Games had an upcoming festival in Schroeder Park and were applying for a liquor picnic license to sell alcohol at the event. There were two licenses being presented, one for St. Louis Scottish Games and one for On the Rocks, who would sell at a separate tent during the event. She continued that all items had been submitted and approved for the license. Regular Board of Aldermen Meeting 04/15/2024 Page 1 Alderman Ottenad made the motion to approve the Liquor Picnic Licenses for the St. Louis Scottish Games Festival and for On the Rocks. The motion was seconded by Alderman Baumann and carried unanimously, with no objections from any members of the Board of Aldermen. Comments from the Public Melissa Copeland, resident of 610 Wren Ave, talked about the ECC. She questioned how the location had been determined as a positive choice for the Manchester community. She stated that some people were looking to move out of Manchester due to this addition and that it would cripple the local daycare centers. She continued that there is already an abundance of childcare in the area and that the ECC would be the fall of Manchester and devastating to the community. REPORTS FROM THE MAYOR Mayoral Proclamation – National Day of Prayer Mayor Clement read the proclamation to acknowledge and celebrate the National Day of Prayer on May 2nd. Nancy Venezia, resident of 1721 Blakefield Ter, thanked the Board for their service and invited everyone in attendance to participate in the 73rd annual National Day of Prayer on May 2nd. Mayoral Reports Mayor Clement reported on events that had taken place in Manchester including the listening event regarding the safety concerns around Wren Avenue, the City’s first Civic Saturday, the Lafayette Area Mayors Organization luncheon, and the Eid Carnival at Shroeder Park. Mayor Clement notified the Board and members of the public of upcoming events including Parkway South’s Day of Service on April 18th, the Arbor Day Celebration on April 20th, Civic Saturday on May 4th at 10am, St. Louis Scottish Games on May 11th, and Beer Fest on May 18th. REPORTS FROM THE CITY ADMINISTRATOR Introduction to Public Works Maintenance Director Tate introduced four new Public Works Maintenance staff members Zach Koenig, Chase Goins, Evan Riganti, and Justin Collins. Award Presentation for Police Personnel – Detective Jeff Lang Chief Will presented Detective Jeff Lang with a Letter of Commendation for his work on arresting an online sexual predator and pedophile in a joint effort with the Child Advocacy Center and with collaboration of federal partners. Chief Will introduced Detective Lang’s family who came to the meeting to celebrate Detective Lang’s Commendation and excellence in assisting in this case. Award Presentation for Police Personnel Chief Will introduced the families of the officers being presented awards. Chief Will presented Letters of Commendation to Police Officers Josh Cockrell and Jim Logan. Chief Will stated that Officer Coty West received a Letter of Commendation, as well, but was not present at the Regular Board of Aldermen Meeting 04/15/2024 Page 2 meeting. Chief Will explained that Sgt Priest and Officers Cockrell, Logan, and West responded to a suicide call and collectively deescalated the potentially deadly encounter. He thanked the Officers for the outstanding service. Chief Will presented the Meritorious Service Award to Sergeant Nikki Priest. He explained that this prestigious award was presented for her exceptional performance in the field of public service and demonstrated personal bravery while saving the life of another. Sgt Priest successfully supervised the suicide call response and was instrumental in the positive interaction with the individual. Sgt Priest’s empathy and compassion in the interaction with this individual deescalated the situation and led to a safe conclusion for her and the officers. Ward Boundary Analysis Discussion Director Riganti presented a boundary adjustment analysis the City had performed to assure compliance with federal legislation on equal representation. She explained that the evaluation completed by i5 determined that City would need to redistrict to more evenly distribute the population and she explained the set standards to follow during redistricting. Director Riganti proposed three scenarios for redistricting and that City staff recommended Option C that was presented. She requested guidance from the Board of Aldermen prior to presenting an ordinance at a future meeting. Southwest Middle School Student Letter Mayor Clement read a letter sent to him by Southwest Middle School Student Ceana Sturgeon explaining that they had created a petition and had it signed by the students at Southwest Middle to hopefully help them keep the field that the Early Childhood Center was proposed on. Mayor Clement reported that about seventy to seventy-five students had signed it. List of Paid Bills (Warrant dates of 04-01-2024 to 04-14-2024) There were no questions. REPORTS FROM THE COMMITTEES Planning and Zoning Commission Alderman Baumann reported that the Planning and Zoning Commission approved a new home near Parkway South High School and that the next meeting would be Monday, April 22nd. Veterans Commission Alderman Huether stated that there was no Veterans Commission report. Audit and Finance Committee Alderman Toben stated that the Audit and Finance Committee would meet on Wednesday, April 17th via Zoom. Tree Advisory Board Alderman Dodge reported that Arbor Day was the upcoming Saturday and that all were invited. Homecoming Committee Regular Board of Aldermen Meeting 04/15/2024 Page 3 Alderman Ottenad stated that the first Homecoming Committee meeting was scheduled for April 17th at 6:30pm at the Parks office. Mayor Clement stated that the Homecoming Committee would be looking for nomination for the Homecoming honors for Grand Marshal, Business of the Year, and Serving our Students. OLD LEGISLATION None NEW LEGISLATION Resolution No. 24-0969 Concrete Street Improvement Project Alderman Dodge read Proposed Resolution No. 24-0969, entitled: “A RESOLUTION AUTHORZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A CONTRACT WITH AMCON MUNICIPAL CONCRETE, LLC IN AN AMOUNT NOT TO EXCEED NINE HUNDRED FIFTY-SIX THOUSAND FOUR HUNDRED FIFTY-EIGHT DOLLARS AND FORTY-TWO CENTS ($956,458.42) INCLUDING A FIVE PERCENT (5%) CHANGE ORDER FOR UNFORESEEN WORK CONDITIONS FOR THE 2024 CONCRETE STREET IMPROVEMENT PROJECT TO BE UNDERTAKEN IN VARIOUS LOCATIONS THROUGHOUT THE CITY OF MANCHESTER,” by title only. Alderman Dodge made the motion for approval of Resolution No. 24-0969. The motion was seconded by Alderman Ottenad and carried unanimously, with no objections from any members of the Board of Aldermen. Resolution No. 24-0970 Parkway School District School Resource Officer Agreement Alderman Huether read Proposed Resolution No. 24-0970, entitled: “A RESOLUTION AUTHORIZING THE CITY ADMINISTRATOR OF THE CITY OF MANCHESTER TO ENTER INTO A THREE-YEAR AGREEMENT WITH THE PARKWAY SCHOOL DISTRICT RELATING TO THE SCHOOL RESOURCE OFFICER PROGRAM,” by title only. Alderman Huether made the motion for approval of Resolution No. 24-0970. The motion was seconded by Alderman Ottenad and carried unanimously, with no objections from any members of the Board of Aldermen. Bill No. 24-2531 City Traffic Engineer Amendment Alderman Ottenad read Proposed Bill No. 24-2531 entitled: “AN ORDINANCE AMENDING SECTION 305.060 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER DESIGNATING THE CITY TRAFFIC ENGINEER,” by title only. Alderman Ottenad stated Emergency Legislation had been requested. Alderman Ottenad made the motion for approval of emergency legislation. The motion was seconded by Alderman Toben and carried unanimously, with no objections from any members of the Board Regular Board of Aldermen Meeting 04/15/2024 Page 4 of Aldermen. Alderman Ottenad read for the second time Bill No. 24-2531, entitled: “AN ORDINANCE AMENDING SECTION 305.060 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER DESIGNATING THE CITY TRAFFIC ENGINEER,” by title only. Alderman Ottenad made the motion that Bill No. 24-2531, become Ordinance No. 24-2414. The motion was seconded by Alderman Baumann. A poll of the Board showed: Alderman Dodge – aye Alderman Baumann – aye Alderman Toben – aye Alderman Huether – aye Alderman Ottenad – aye Mayor Clement announced that the motion passed 5 to 0, with no objections from any members of the Board of Aldermen. Bill No. 24-2532 Boundary Adjustment for 822 Big Bend Woods and 825 Hanna Road Alderman Baumann read Proposed Bill No. 24-2532 entitled: “AN ORDINANCE APPROVING A BOUNDARY ADJUSTMENT PLAT FOR 822 BIG BEND WOODS DRIVE BEING LOT 88 OF BIG BEND WOODS PLAT 5 AND 825 HANNA ROAD BEING LOT 89 OF BIG BEND WOODS PLAT 5 IN THE CITY OF MANCHESTER, MISSOURI, SUBJECT TO CERTAIN CONDITIONS,” by title only. No further action at this time. Bill No. 24-2533 School Area Zone Ordinance (Wren Avenue Area) Alderman Toben read Proposed Bill No. 24-2533 entitled: “AN ORDINANCE AMENDING CHAPTER 320 OF THE MUNICIPAL CODE OF THE CITY OF MANCHESTER TO CREATE “SCHOOL ZONES” AND ESTABLISH THEM AS “INCREASED SAFETY AREAS,” by title only. City Administrator Klocke answered Alderman Ottenad’s question explaining that the school zone would be in effect 24/7, not just during school hours, and the speed limit would be twenty miles an hour on the roadway. City Administrator Klocke explained that this ordinance would make the speed limit in any school zone twenty miles per hour, as recommended by the Missouri Congress of Parents and Teachers. He continued that this is very similar to the City’s increased safety areas including double fines for certain traffic violations; however, he explained that in school zones these double fines were not capped at a $225.00 fine. He continued that there was not a cap in double fines in school zones. He explained that there were options for the Board to alter the double fines or time frame of application as they saw fit. Regular Board of Aldermen Meeting 04/15/2024 Page 5 Director Tate answered Alderman Huether’s question regarding the area of the school zone explaining that according to state statute a school zone can be up to a mile radius of any school from the front door. The Board discussed potential implications of the school zone designation and options they could proceed with. No further action at this time. MISCELLANEOUS Comments from the Public Robert Lopez, resident of 1302 Mautenne Dr, thanked the City for the limb chipping and electronic recycling events. He inquired about the City offering a hazardous chemical pickup once or twice a year and suggested empty buildings in the City that could be used as a drop off. Mayor Clement and Assistant Director Pracht explained that the City had looked into it, but it had been discouraged by St. Louis County Household Hazardous Waste because there are dangers in hosting such a collection in our Park. Assistant Director Pracht continued that the City is advocating for a collection center in West county, through the St. Louis County program. Don Conine, resident of 835 Heron Woods Dr, thanked the Board for the traffic meeting the City hosted. He continued that he completed his own traffic study and had counted over 410 cars passing through the intersection of Big Bend Woods Dr and Canary Dr from 7 to 10 and similar number of cars in between 2 to 5. He stated roughly a quarter of the cars rolled through the stop signs. He continued that the speed limit change to 20 miles per hour would be a great change and he did not care about the hours it was applied. Mayor Clement asked Mr. Conine to send the numbers he collected to the Board. Alderman Dodge informed the Board that he did his own informal survey at Mallard Woods Dr and Big Bend Woods Dr. He stated that there were few complete stops at the intersection. Kathy Wilbret, resident of 827 Heron Woods Dr, stated she was opposed to the ECC. She expressed concern for the speeding on Canary Dr and that students who walked to school do not have a sidewalk and are therefore walking on the street with the speeding vehicles. She continued that if the ECC is put in, more cars would cut through Canary Dr. ADJOURNMENT There being no further business, Alderman Toben made the motion to adjourn.
