CALL MEETING TO ORDER At 3:00 PM, Mayor D'Errico called the meeting to order. B. PLEDGE TO THE FLAG Councilmember Howorth led the Pledge of Allegiance. C. ROLL CALL Present 5 - Tony D'Errico, David J. Lesser, Amy Howorth, Wayne Powell, and Mark Burton D. CERTIFICATION OF MEETING NOTICE AND AGENDA POSTING City Clerk Liza Tamura confirmed that the meeting was properly posted. E. PUBLIC COMMENTS (2 MINUTES PER PERSON PER ITEM, A MAXIMUM OF 5 MINUTES IF A SPEAKER WANTS TO COMMENT ON MORE THAN ONE ITEM) None. City of Manhattan Beach Page 1 City Council Adjourned Regular Meeting Minutes - Final May 16, 2016 Meeting F. ANNOUNCEMENT IN OPEN SESSION OF ITEMS TO BE DISCUSSED IN CLOSED SESSION At 3:02 PM, City Attorney Quinn Barrow announced the following Closed Session. The City Council had a discussion regarding the City Manager's contract and the details of a mid-year performance evaluation. Councilmember Howorth feels that the annual performance evaluation for the City Manager is enough and there should not be a Closed Session mid -year performance evaluation without first having a City Council discussion at a regular meeting in which the City Council gives direction that there needs to be a performance evaluation. Councilmember Burton believes that the review should be quarterly and not annually but if nothing else at least semi-annually where the City Council can manage the City Manager. Councilmember Powell realizes that there is no contractual obligation do a semi-annual performance evaluation, however with plenty of notice to the City Council and to the City Manager there is no problem with doing a semi -annual performance evaluation. Mayor Pro Tem Lesser stated that he did not recall the City Council directing a mid-year evaluation and, upon reviewing the contract, understands that reviews are permissible but requires the full City Council to direct a review. City Attorney Quinn Barrow and City Manager Mark Danaj responded to the City Council questions. A motion was made by Councilmember Burton, seconded by Councilmember Powell, to have a mid-year performance evaluation review for the City Manager and City Attorney in the next thirty days and for Facilitator Mary Egan to be present at the performance evaluation. Aye: 4- D'Errico, Lesser, Powell and Burton Nay: 1- Howorth The City Council, agreed that the date of the evaluations would depend on Ms . Egan's availability. MID-YEAR PERFORMANCE EVALUATION (Government Code Section 54957) Title: City Manager City Attorney A motion was made by Councilmember Burton, seconded by Councilmember Powell, that this item be approved. The motion carried by the following vote: G. RECESS INTO CLOSED SESSION At 3:15 PM, Mayor D'Errico announced that City Council would recess into Closed Session to discuss Agenda Item No. 1 - Conference with Labor Negotiator only. H. RECONVENE INTO OPEN SESSION At 5:15 PM, the City Council reconvened into Open Session. I. CLOSED SESSION ANNOUNCEMENT IN OPEN SESSION City Attorney Quinn Barrow announced that direction was given to the labor negotiators but no reportable action was taken. J. ADJOURNMENT At 5:16 PM Mayor D'Errico adjourned the meeting.
