PROCEEDINGS OF THE MANISTEE CITY COUNCIL –JANUARY 2, 2019 A regular meeting of the Manistee City Council was called to order by his honor, Mayor Roger Zielinski on Wednesday, January 2, 2019 at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: Dale Cooper, Roger Zielinski, Robert Goodspeed, Michael Szymanski, James Grabowski, and Erin Pontiac. CONSENT AGENDA.  Minutes - December 18, 2018 - Regular Meeting  Financial Reports - Cash Balances November 2018 - Revenue & Expense November 2018  Notification Regarding Next Work Session – January 8, 2019 A discussion will be conducted on special events, deer cull, and provisioning centers; and such business as may come before Council. MOTION by Szymanski, second by Cooper to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Cooper, Zielinski, Goodspeed, Szymanski, Grabowski, and Pontiac NAYS: None CONSIDERATION OF CHANGES TO COUNCIL POLICY 28 CIVIL INFRACTIONS Council Policy 28 is a resolution authorizing certain City Officials to issue Civil Infraction Notices and Citations. CP-28 is outdated with various restructuring of City Departments that has occurred. The City Attorney has drafted proposed revisions to CP-28. AYES: Cooper, Zielinski, Goodspeed, Szymanski, Grabowski, and Pontiac NAYS: None CONSIDERATION OF ADOPTION OF CHAPTER 867 RECREATIONAL MARIHUANA Initiated Law 1 of 2018 was approved by voters at the November 6, 2018 general election. Unlike the Medical Marihuana Facilities Licensing Act, for a city to prohibit marihuana facilities within its boundaries, it must affirmatively “opt out” of the law. Until Council reviews its options regarding Recreational Marihuana, City Staff is recommending that the City adopt an ordinance opting-out of the provisions of the Michigan Regulation and Taxation of Marihuana Act with the ordinance containing a sunset provision that provides for the ordinance to cease from and after April 1, 2019, unless modified by Council before that date. The City Attorney has prepared Ordinance 19-01, Chapter 867 Recreational Marihuana. As an ordinance two separate readings are required. If this ordinance is introduced this evening, it could be adopted at the next regular meeting. MOTION by Cooper, second by Grabowski to introduce Ordinance 19-01, Chapter 867 Recreational Marihuana. With a roll call vote this motion passed, 5-1. AYES: Cooper, Zielinski, Goodspeed, Grabowski, and Pontiac NAYS: Szymanski CONSIDERATION OF APPLICATIONS TO BOARDS AND COMMISSIONS The City Clerk has taken action to advertise vacancies on Board of Review, PEG Commission, and the Zoning Board of Appeals. Mayoral appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives majority support. The following applications have been received: *Incumbent BOARD OF REVIEW. Two vacancies, one term ending 12/31/19 and one term ending 12/31/21. Applicants must be City taxpayers and registered to vote in the City. Council appointment. Five vacancies, one term ending 12/31/19, four terms ending 12/31/21. Applicants must be Manistee County residents. Council appointment. Barry Lind, 532 Fourth Street* Goodspeed nominated Barry Lind, to the PEG Commission with a term ending 12/31/21. With a roll call vote this nomination passed unanimously. AYES: Cooper, Zielinski, Goodspeed, Szymanski, Grabowski, and Pontiac NAYS: None RESOLUTION OF THANKS AND APPRECIATION Councilmember Szymanski read and councilmembers presented a Resolution of Thanks and Appreciation for Doug Dominick, City of Manistee Firefighter, who will be retiring on January 4, 2019. A REPORT FROM MANISTEE BLACKER AIRPORT Mr. Barry Lind reported on the activities of the Manistee Blacker Airport and responded to any questions the Council had regarding their activities. CITIZEN COMMENT None. OFFICIALS AND STAFF Mikula reminded citizens of the importance of adhering to the alternate parking ordinance for snow removal. | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL –JANUARY 2, 2019 Kozal reminded citizens that it is illegal to drive their vehicles while they are covered in snow and ice, and stressed the importance of clearing snow and ice from their vehicles. Kozal invited Councilmembers and residents to attend the Retirement Open House at the Fire Department for Doug Dominick on January 3, 2019. COUNCILMEMBERS Councilmembers offered their congratulations to retiring firefighter Doug Dominick and wished him well. ADJOURN MOTION to adjourn was made by Goodspeed.
