PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 5, 2022 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Lynda Beaton on Tuesday, April 5, 2022, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. John McCrackin, Walker, MI / spoke on blight in the community and his desire to help find ways to help residents with blight; asked Council to consider his application for appointment to the Neighborhood Restoration and Beautification Commission. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 5, 2022 CONSIDERATION OF AWARDING A CONTRACT FOR THE DEMOLITION AND REMOVAL OF THE SECONDARY STORAGE TANK COVER AT THE WASTEWATER TREATMENT PLANT. Damage occurred to the Secondary Digester storage cover this winter during sludge removal. The cover is damaged beyond repair and requires replacement. The removal and replacement costs are covered by insurance. Bids for the cover removal were publicly advertised with one bid being received. Zupin Industrial. LLC $63,075.00 Engineer’s Estimate $65,000.00 The agreement has been reviewed and approved by the City Attorney. MOTION by Szymanski, second by Grabowski to award a contract to Zupin Industrial, LLC in the amount of $63,075.00 and authorize the Mayor and City Clerk to execute the documents. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF A MICHIGAN DEPARTMENT OF TRANSPORTATION, 2023 CATEGORY B GRANT APPLICATION. The Michigan Department of Transportation administers a grant program to assist with paving local streets for communities with populations of less than 10,000. The maximum grant amount is $250,000.00 with a 50/50 match. The City has identified the First Street Beach loop (Lakeshore Drive) as an eligible street segment with proposed utility work. This project is already planned in the proposed Transportation Improvement Program for 2023 construction and will utilize the project as match money. The grant application amount is $199,500.00. MOTION by Bachman, second by Martin Pontiac to adopt a resolution to establish a request for funds, provide the required grant match, designate Jeffrey W. Mikula as the designated agent and agree to future maintenance on the project. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF ACCEPTING A GRANT AWARD TO SUPPORT THE CONSTRUCTION OF A DISC GOLF COURSE AT FIRST STREET BEACH. The City successfully applied for a Minger Foundation grant from the Manistee County Community Foundation. The grant amount is $22,500.00 and will be spent to acquire equipment and materials to support the new public amenity. AYES: Bachman, Beaton, Lundberg, Sullivan, Szymanski, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF APPROVING THE SMOKE ON THE WATER SPECIAL EVENT. Salt City Rock & Blues, LLC is requesting to host a Smoke on the Water special event at Douglas Park, Saturday, July 16, 2022. The event will include a Deep Purple tribute band and several local bands. Marihuana consumption will be available within a cordoned off and well-defined area, not accessible to persons under 21 years of age. Alcoholic beverages will also be available for purchase. Proceeds of the event will be used to continue efforts to build an amphitheater at First Street Beach. MOTION by Sullivan, second by Martin Pontiac to approve the July 16, 2022, Smoke on the Water special event, and authorize the consumption of marihuana on public property in a controlled area in accordance with MCL 333.2795 1 (e.) and City Ordinance 867.14. Discussion included: • First Aid area at event • Entire event for those 21 years of age and older only • Concerns with edibles • Dial A Ride • Food trucks at event • Ticket sales / estimated attendance Councilmember Szymanski stated he would be abstaining from the vote since he is a member of the Salt City Rock & Blues Board. With a roll call vote this motion passed, 4-2. AYES: Beaton, Lundberg, Sullivan, and Martin Pontiac NAYS: Bachman and Grabowski ABSTAIN: Szymanski CONSIDERATION OF COMMISSION APPOINTMENT. Chapter 275 Neighborhood Restoration and Beautification Commission of the City of Manistee Codified Ordinances was established by the adoption of Ordinance No 22-01 at the March 1, 2022, Council meeting. Section 275.02 Membership states, “…One (1) member shall be a City Council member appointed by the Mayor and confirmed by City Council.” Mayor Beaton appointed Jermaine Sullivan to the Neighborhood Restoration and Beautification Commission. | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 5, 2022 MOTION by Martin Pontiac, second by Grabowski to support the Mayor’s appointment of Jermaine Sullivan to the Neighborhood Restoration and Beautification Commission. The City Clerk has taken action to advertise vacancies on the Compensation Commission, Harbor Commission, Neighborhood Restoration and Beautification Commission, PEG Commission, and Tree Commission. Mayoral and Manager appointments require a motion, second and Council voted support. Nominations for Council appointments do not require a second. After all nominations are made, Council votes on the nominees until one nominee receives majority support. Mr. Clinton McKinven-Copus reported on the activities of the City of Manistee Housing Commission and responded to any questions the Council had regarding their activities. INTRODUCTION OF THE FISCAL YEAR 2022-2023 BUDGET. Administration has prepared the proposed 2022-2023 Fiscal Year Budget. Finance Director Ed Bradford provided a brief summary of the budget highlights. A public hearing to review the budget and receive public input has been scheduled for Tuesday, April 19, 2022, at 7:00 p.m. A study session is scheduled for Tuesday, April 12, 2022, and an optional study session could be held on Tuesday, April 26, 2022, if needed. The budget adoption will be on the May 3, 2022, Council meeting agenda. CITIZEN COMMENT Ruth Pratt, 463 Fourth Street / commented on a recent issue at her residence that left her without water for several days; would like to see City purchase camera needed to assist with sewer maintenance. Libby Zilke, 706 Hopkins Street / spoke on signage issue at store, 3 Peas in a Pod, located behind Wahr Hardware and asked Council for guidance. OFFICIALS AND STAFF Gambill provided an update on the Maple Street Bridge. Middleton stated the 12th Street project is going out for bids and the Drinking Water Asset Management (DWAM) Grant bid opening took place today. COUNCILMEMBERS Bachman thanked Ms. Pratt for her comments and apologized for the situation. Lundberg offered appreciation to Ms. Pratt for her comments and apologized for the inconvenience; asked Bradford if he could share his budget Power Point presentation with Council. Grabowski inquired if the City could look into purchasing a camera to help with sewer issues in the future; commented on tree limbs down at Mack Park and miscellaneous blight issues; would like to see more members added to the Neighborhood Restoration and Beautification Commission in the future. Szymanski offered a reminder that the extension given on compliance with the dumpster ordinance expires in May and all dumpsters must be enclosed according to the ordinance; asked if sidewalks were included in the budget. Beaton offered her apologies to Ms. Pratt and is glad the situation was resolved. She also spoke on her decision for first the round of appointments to the Neighborhood Restoration and Beautification | Page 6  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 5, 2022 Commission and stated if the commission decides they need more members after they begin meeting, they can ask for an amendment to the bylaws. CONSIDERATION OF A CLOSED SESSION, UNION CONTRACT NEGOTIATIONS. City Manager William Gambill has requested a Closed Session this evening as permitted by the Michigan Open Meetings Act, Section 8 (c) to discuss contract negotiations with the International Association of Firefighters. MOTION by Szymanski, second by Bachman to proceed to Closed Session under Section 8 (c) of the Michigan Open Meetings Act. TIME: 8:54p.m. With a roll call vote this motion passed unanimously.
