PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 7, 2023 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, February 7, 2023, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Finance Director – Edward Bradford, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton CITIZEN COMMENTS ON AGENDA RELATED ITEMS None received. CONSENT AGENDA • Minutes January 17, 2023 Regular Meeting • Financial Reports Cash Balances December 2022 Revenue & Expenses December 2022 Quarterly Financial Update Quarterly Investment Update • Notification Regarding Next Study Session – Tuesday, February 14, 2023, at 7:00 p.m. A Council study session has been scheduled for Tuesday, February 14, 2023, at 7:00 p.m. A discussion will be conducted on RRCA update, sidewalk ordinance, Neighborhood Enterprise Zone, downtown parking, Utility Rate Sufficiency Study update; and such business as may come before Council. • Consideration of Run The Pier 5k Run/Walk to be held on Saturday, August 12, 2023, From 4:00- 9:00 p.m. The Run the Pier 5k run/walk will be held on Saturday, August 12, 2023, starting at Ford Street south and continuing to Lakeshore to the 5th Avenue Pier and back. Pre-race activities will be held at Duffy Park and will begin at 4:00 p.m. for participant packet pick-up. Site prep/set-up will begin as early as 8:00 a.m. The race will begin at 7:30 p.m. and finish at approximately 8:45 p.m. A beer tent provided by Stomp Out Cancer will be set up in the baseball diamond and will be open from 4:00- 9:00 p.m. MOTION by Grabowski, second by Pratt, to approve the Consent Agenda as presented. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 7, 2023 PRESENTATION OF 91-99 ARTHUR STREET DEVELOPMENT Jason Tilmann and James Brodi gave a presentation on the plans for the Lakeside Social Development planned for 91-99 Arthur Street and answered questions from Council regarding their plans. They will be requesting an OPRA for this property. CONSIDERATION OF BUDGET AMENDMENT 2023-1 FOR FISCAL YEAR END JUNE 30, 2023 The City of Manistee is required by State law to ensure that actual expenditures do not exceed budgeted amounts. Over the course of the current fiscal year, unanticipated and unbudgeted events and/or Council approved expenditures have occurred. The proposed budget amendment addresses expenditures associated with those events to ensure compliance with State statutes regarding appropriations. MOTION by Beaton, second by Grabowski to adopt budget amendment 2023-1 for fiscal year ending June 30, 2023. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF COLLECTIVE BARGAINING AGREEMENT WITH THE INTERNATIONAL ASSOCIATION OF FIRE FIGHTERS LOCAL 645 MOTION by Pratt, second by Bachman to approve a three-year collective bargaining agreement with the International Association of Fire Fighters Local 645; and authorize the Mayor and City Manager to execute the agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE NEIGHBORHOOD RESTORATION AND BEAUTIFICATION COMMISSION Mr. Lucas Richardson reported on the activities of the NRBC and responded to questions the Council had regarding their activities. CITIZEN COMMENT None received. OFFICIALS AND STAFF Gambill offered his appreciation to Council for the approval of the IAFF collective bargaining agreement and stated the DPW director is working with the Visitors Bureau on additional signage for the upcoming detour. | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – FEBRUARY 7, 2023 COUNCILMEMBERS Bachman asked for an update on the blighted building on River Street and if they have brought the building into compliance. Lundberg inquired about the See Click Fix app and how it works. Pratt thanked the Parks Commission and the Museum for their recent presentation and thanked the Planning Commission for listening to citizens’ concerns at their recent meeting. He also asked for an update on the River Street clock repairs and wondered if the agenda packets could be received earlier so there is more time for review before the meeting. Martin Pontiac inquired about the run water notice. CONSIDERATION OF A CLOSED SESSION, ATTORNEY-CLIENT PRIVILEGED COMMUNICATION Request to convene a closed session pursuant to the Open Meetings Act, PA 267 of 1976, pursuant to MCL 15.268(1)(h) to discuss attorney-client privileged communications in an email from legal counsel dated January 31, 2023. MOTION by Pratt, second by Beaton to proceed to Closed Session. Time 7:48 p.m. With a roll call vote this motion passed unanimously.
