PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 18, 2023 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, April 18, 2023, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. PRESENT: David Bachman, Lynda Beaton, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James Grabowski, and Erin Martin Pontiac ABSENT: None ALSO PRESENT: City Manager – Bill Gambill, City Attorney – George Saylor, City Clerk – Heather Pefley, DPW Director – Jeff Mikula, Finance Director – Edward Bradford, Planning & Zoning Administrator – Katie Mehl, Police Chief – Josh Glass, Fire Chief – Mark Cameron, and City Engineer – Shawn Middleton PUBLIC HEARING ON THE 2023-2024 BUDGET AND CAPITAL IMPROVEMENT PLAN The City fiscal year runs from July 1 through June 30. Under Section 7-4 of the Charter, a public hearing is required on the budget which must be adopted not later than May 15 of each year. A study session was held on Tuesday, April 11, and a budget discussion is on the agenda for later this evening. An optional budget study session is scheduled for April 25. The Budget Calendar anticipates adoption of the budget at the Wednesday, May 3, 2023, meeting. The public had an opportunity to comment on the 2023-2024 Budget and Capital Improvement Plan. No comments received. The Manistee Lions Club will hold their Annual Fish Boil event at the Lions Pavilion at First Street Beach on Friday, June 30, 2023, with set up on Thursday, June 29 and tear down on the morning of Saturday, July 1. The Lions Club will provide all necessary equipment. Serving time will be on Friday, June 30 from 4:00 – 7:00 p.m. Anticipated attendance is 800-1000 people, including volunteers. They will obtain a food service permit from District Health Department #10. • Consideration of Trinity Lutheran School First Annual 5k Color Run, May 27, 2023. The Trinity Lutheran School First Annual 5K Color Run will be held on Saturday, May 27, 2023. The race will start and end at Trinity Lutheran Church/School at 420 Oak Street and is a fundraiser for the school. • Consideration of a temporary activity permit for a fireworks stand in front of 115 Cypress Street. The Wizards Fireworks hopes to open a 20’x40’ fireworks stand temporary business in front of 115 Cypress Street on or about May 27, 2023, and remove it on or about July 14, 2023. MOTION by Pratt, second by Grabowski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF RECOGNIZING MUSIC SPARKS MEANING OF MANISTEE AS A NONPROFIT ORGANIZATION Music Sparks Meaning of Manistee has requested the City of Manistee adopt a resolution to recognize their organization as a nonprofit for the purpose of applying for a Charitable Gaming License through the State of Michigan. They plan to hold a raffle at each concert during their summer concert series to help pay for the bands as well as potential fall/winter programming. Council approved the summer concert series at their December 20, 2022, regular meeting. MOTION by Pratt, second by Martin Pontiac to adopt a resolution recognizing Music Sparks Meaning of Manistee as a nonprofit organization for the purpose of applying for a Charitable Gaming License through the State of Michigan. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 18, 2023 CONSIDERATION OF ORDINANCE Z23-01 TEXT AMENDMENTS TO ZONING ORDINANCE Ordinance Z23-01 includes language to amend the Zoning Ordinance to allow for the use of Feather Flags for up to sixty (60) consecutive days with the opening of a new business. Currently, Feather Flags are not identified as an allowable type of signage in the Zoning Ordinance and are therefore not allowed. The Planning Commission voted to recommend approval of this amendment. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Grabowski, second by Martin Pontiac to introduce Ordinance Z23-01. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF 2023 MANISTEE PROUD PROJECTS Manistee Proud has coordinated several large projects within the City parks over the past two years. This year they have submitted a list of projects they wish to complete with the City’s help. MOTION by Pratt, second by Bachman to approve projects proposed by Manistee Proud. Mikula reviewed the list of proposed projects. MOTION by Pratt, second by Bachman to AMEND the original motion to exclude items 3, 4, & 5 of the projects proposed. With a roll call vote this motion to AMEND the original motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A roll call vote was then taken on the original motion as amended. The motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None CONSIDERATION OF PARKS COMMISSION BY-LAW REVISIONS Each year the Parks Commission reviews and approves or recommends revisions to its by-laws; | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – APRIL 18, 2023 this year the Commission recommended several changes. The City Attorney has reviewed and completed the requested revisions. MOTION by Beaton, second by Lundberg to move this item to the May 9th Study Session. With a roll call vote this motion passed unanimously. AYES: Bachman, Beaton, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac NAYS: None A REPORT FROM THE ALTERNATIVES FOR AREA YOUTH Ms. Shelia Kaminski reported on the activities of Alternatives for Area Youth and responded to questions the Council had regarding their activities. DISCUSSION OF THE FISCAL YEAR 2023-2024 BUDGET Administration has prepared the proposed 2023-2024 Fiscal Year Budget. It was introduced to Council and the community at the April 4, 2023, Council meeting by the Finance Director. A public hearing to review these budget recommendations and receive public input on them took place earlier in this meeting. In addition to tonight’s discussion, a budget study session took place on April 11 and an optional study session on Tuesday, April 25 is scheduled. The Budget Calendar anticipates adoption of the budget at the Wednesday, May 3, 2023, meeting. Discussion included: • DDA maintenance agreement • Community Development/Planning & Zoning administrator position • Building and Rental Inspection services • Part-time facility assistant eliminated / increase collaboration with Parks & DPW • Motor Pool • Sewer Camera purchase • Attorney services • AAY appropriations • Ramsdell appropriations, rental fees, pillar repairs • Water services - DWAM • Sidewalks With no further comments from Council, Mayor Sullivan concluded the discussion. COUNCILMEMBERS Mayor Sullivan read a Resolution of Thanks and Appreciation for Fire Chief Mark Cameron who will be retiring on April 25, 2023.
