PROCEEDINGS OF THE MANISTEE CITY COUNCIL – ORGANIZATIONAL MEETING
NOVEMBER 14, 2023
The Organizational Meeting of the Manistee City Council was called to order by City Clerk Heather Pefley
on Tuesday, November 14, 2023, at 7:30 p.m. in the City Hall Council Chambers, 70 Maple Street, followed
by the Pledge of Allegiance.
ORGANIZATIONAL MEETING OF THE CITY COUNCIL.
In accordance with Section 2‐13 of the Charter of the City of Manistee, "the City Council shall meet at
7:30 p.m. on the Tuesday night following the completion of the official canvass at which time the
members shall be sworn and assume the duties of their office. "
At the regular election of Tuesday, November 8, 2022, Councilmembers were elected to seats on the
Manistee City Council. Members include:
DISTRICT COUNCILMEMBER TERM
Second District Wesley Smith Two Years
Fourth District Jermaine Sullivan Two Years
Sixth District James Grabowski Two Years
Pefley administered the oath to Wesley Smith, Jermaine Sullivan, and James Grabowski as members of
the Manistee City Council.
PRESENT: David Bachman, Wesley Smith, Cindy Lundberg, Jermaine Sullivan, Seth Pratt, James
Grabowski, and Erin Martin Pontiac.
ALSO PRESENT: City Manager – Bill Gambill, City Attorney – Tim Figura, City Clerk – Heather Pefley,
Community Development Director – Theresa Waldo, Police Chief – Josh Glass and City
Engineer – Shawn Middleton.
CITIZEN COMMENTS ON AGENDA RELATED ITEMS.
None received.
ELECTION OF THE MAYOR FOR THE CITY OF MANISTEE.
At the Organizational Meeting of the City Council held on this date the Council elects from its membership
a Mayor and a Mayor Pro-Tem. The Mayor and Mayor Pro-Tem are elected for a one-year term. Under
Section 2-4 of the Charter "the Council shall elect a Mayor by a majority vote of its members." This
provision of the Charter requires four affirmative votes to elect the Mayor, a majority of the Council,
regardless attendance at the Organizational Meeting. Sections 2-4 and 2-13 of the Charter require that
the Mayor be elected at the Organizational Meeting. The voting procedures should continue until a
candidate receives four affirmative votes.
Pefley asked for nominations to elect a Mayor for the City of Manistee. Grabowski nominated Sullivan
and Pratt nominated Grabowski. No other nominations were received.

A roll call vote was taken as follows:
SULLIVAN: Bachman, Smith, Lundberg, Sullivan, Grabowski, and Martin Pontiac
GRABOWSKI: Pratt
Councilmember Sullivan was elected Mayor. Mayor Sullivan assumed the Chair at this time.
ELECTION OF A MAYOR PRO‐TEM FOR THE CITY OF MANISTEE.
The same provisions identified in the Charter for the Mayor apply for the Mayor Pro‐Tem. The Mayor
Pro‐Tem serves as the Mayor in the Mayor's absence.
Mayor Sullivan opened the floor for nominations to elect a Mayor Pro‐Tem for the City of Manistee.
Sullivan nominated Grabowski. No other nominations were received.
A roll call vote was taken as follows:
GRABOWSKI: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac
OTHER: None
Councilmember Grabowski was elected Mayor Pro‐Tem.
REVIEW OF CITY COUNCIL GUIDELINES.
Under the adopted City Council Guidelines, the Guidelines are reviewed at the Organizational Meeting of
the City Council. While the Guidelines may be amended at any time during the year, the Organizational
Meeting is the traditional opportunity to review the operating procedures of the Council.
MOTION by Bachman, second by Grabowski to accept the City Council Guidelines as written.
With a roll call vote this motion passed unanimously.
AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, Grabowski, and Martin Pontiac
NAYS: None
CONSIDERATION OF ESTABLISHING REGULAR MEETINGS FOR 2024.
In accordance with Section 2-13 of the Charter, the City Council “shall meet in public session at least twice
each month at such times as may be prescribed by the rules....” The City Council Guidelines reviewed
during the previous agenda item indicate that regular meetings shall be held on the first and third
Tuesdays of each month beginning at 7:00 p.m. with study sessions conducted on the second Tuesday of
each month beginning at 7:00 p.m. This results in the attached schedule for regular meetings and study
sessions throughout the year 2024, with exceptions made for known election dates and holidays.
MOTION by Pratt, second by Martin Pontiac to adopt the attached schedule for regular meetings and
study sessions for the year 2024.

ORDINANCE COMMITTEE MEETING
MINUTES OF OCTOBER 16, 2023
A meeting of the Manistee City Council Ordinance Committee was held on Monday, October 16,
2023, at 10:00 a.m. in the Second Floor Conference Room, City Hall, 70 Maple Street, Manistee
MI 49660.
MEMBERS PRESENT: Jermaine Sullivan, James Grabowski, David Bachman
OTHERS PRESENT: City Manager William Gambill
Discussion on Chapter 430 Parking Generally:
• Attachment – Ordinance to Amend – approved of change.
• Add Parklet Language – would like to see specific language for parklets. Requests should
continue to run through the DDA for Administrative Approval – language should be included
in the ordinance.
• Publish fees in the next budget.
Discussion on Chapter 606 Animals:
• Attachment – Ordinance to Amend – would like to see language added to prohibit all open
feeding of animals (water bowls okay). Otherwise looks good and should continue to move
forward.
• Dogs in the Downtown – no need to address.
Discussion on Chapter 650 Anti-Blight:
• Language is already in the ordinance to put on tax roll. Would like to see it put on the tax
rolls, if possible. Review with City Attorney.
• Combine Blight and Nuisance Abetment ordinances.
Discussion on Chapter 692 Weeds:
• Change notice time from 7 days to 4 days.
• Need more enforcement.
• Check the operational procedure with the DPW.
Discussion on Chapter 850 Business Registration:
• Attachment – Ordinance to Amend – remove the word permanent.
Discussion on Chapter 1024 Sidewalks and Riverwalk, Chapter 674 Safety, Sanitation and
Health: Still in progress. Add to November study session.
• Remove from Snow Removal from business district/private property from Chapter 674 and
only include in Chapter 1024. Combine these chapters where appropriate.
• Require residents to remove snow from sidewalks – enforcement will be complaint based.
• Add depth of snow requirement – 4 inches. City would declare a snow event after 4 inches.
• Sidewalk replacement 50/50 split.
• Add sidewalk inspections, performed by the City engineer, before sale of property and
necessary replacement costs come out of sale proceeds. Review City of Ludington language.

Discussion on Chapter 1028 River Street Traffic Flow, Parking, Amenities:
• Would like DDA to make a recommendation.
Discussion on Chapter 1040 Utilities:
• Attachment – Ordinance to Amend – approved as presented.
Discussion on Chapter 1482 or new ordinance to address Short-Term Rentals:
• Would like Housing North and the Assessor to make specific recommendations for a short-
term rental ordinance.
• Grandfather in all registered in City rental program – until sold.
• Need an amount allowed in the City – 30 suggested (condos and central business district
would be excluded).
Would like the attorney to take a look at Chapter 674 – can these be combined in other
chapters. Lots of redundancies with blight and nuisance chapters.
• Removal coal.
• Remove firewood in ROW.
• Remove all obsolete language.
