PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JANUARY 16, 2024 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan on Tuesday, January 16, 2024, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. NOMI Racing is requesting to hold the Run the Pier Run/Walk on Saturday, July 27, 2024, 11:00 a.m. – 9:00 p.m. This year along with a 5k, there will be a 10k, ½ marathon and a full marathon. As part of the event a kids adventure fun run will take place onsite at Duffy Park. • Consideration of the 2024 Smoke on the Water event. Salt City Rock and Blues in conjunction with Authentic 231 proposes to hold a day long music festival with onsite alcohol and cannabis consumption on Saturday, July 27, 2024. Music would start at 5:00 p.m. and end no later than 12:00 a.m. This is a 21+ event; IDs will be checked at both the main gate and the entrance to the cannabis sales and consumption areas. Salt City Rock and Blues proposes to hold a day long music festival on Saturday, August 31, 2024, 9:00 a.m. – 11:00 p.m. This event includes onsite alcohol consumption; the event also includes a classic car show, mini-Labor Day parade, tethered hot air balloon rides, free afternoon music and a paid music event in the evening. This year’s event will take place in Douglas Park, the Lions Pavilion, and the City parking lot adjacent to the Armory Youth Project. • Consideration of Music Sparks Meaning hosting the Roots on the River Concert Series. Music Sparks Meaning is requesting to host the Roots on the River concert series on July 11, 18, 25 and August 1, and 8, 2024. This is a free concert series held at the Veterans Memorial Park/North Riverwalk gazebo. The aim of the series is to support regional and local artists while also providing a free and memorable experience to our community. • Consideration of Music Sparks Meaning hosting the Summer Sun Sets Concert Series. Music Sparks Meaning is requesting to host the Summer Sun Set concert series on June 1, 15, 29 and July 6, and 21, 2024. This is a free concert series held at the First Street Beach gazebo providing listeners with ‘easily approachable’ music in a variety of genres. MOTION by Pratt, second by Grabowski to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF A RESOLUTION OF THANKS AND APPRECIATION, SERGEANT STEVE SCHMELING. Mayor Sullivan read a resolution of Thanks and Appreciation to Sergeant Steve Schmeling for his upcoming retirement. CONSIDERATION OF A RESOLUTION OF THANKS AND APPRECIATION, RANDY HUNT. Mayor Sullivan read a resolution of Thanks and Appreciation for Randy Hunt for his upcoming retirement. CONSIDERATION OF APPROVING THE PURCHASE OF TWO DPW PICKUP TRUCKS. Two pickup trucks have been scheduled for replacement in the current fiscal year budget at $53,000.00 each. The City received a MiDEAL quote from Gorno Ford in the amount of $52,471.00 each. The trucks would replace two existing trucks that are 15 and 16 years old respectively. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF APPROVING AN AMENDED EASEMENT WITH DTE GAS COMPANY. DTE Gas Company owns and operates a Gas Station at Seventh and Robinson Streets. The current station is located partially on Manistee Area Public School property and partially within Sands Park. The amendment would allow DTE to construct cathodic protection for the gas mains. The amendment approval has been recommended by the Sands Park Control Board and will require City Council and Manistee Area Public School approval. MOTION by Lundberg, second by Bachman to approve the amended easement with DTE and authorize the Mayor and City Clerk to execute the agreement. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF MUSIC SPARKS MEANING – 4TH OF JULY ROOTS ON THE RIVER KICKOFF EVENT. Music Sparks Meaning is requesting to host a day of fun and music at the Veterans Memorial Park, including part of the parking lot and gazebo on July 4, 2024 as a kickoff to the Roots on the River concert series. This event will include food trucks, alcohol sales, lawn games, a raffle and an evening concert. MOTION by Pratt, second by Grabowski to support and approve the request from Music Sparks Meaning to hold the Roots on the River concert series kickoff event, July 4, 2024; subject to appropriate departmental approvals. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF AUTHORIZING RESOLUTION OF SUPPORT AND MOU TO SPONSOR THE OLD KIRKE MUSEUM 2024 STATE HISTORIC PRESERVATION OFFICE (SHPO) CERTIFIED LOCAL GOVERNMENT (CLG) PROGRAM GRANT APPLICATION. Only local units of government certified as part of the CLG Program are eligible to apply for the SHPO CGL grant. CGL’s may sponsor eligible projects for non-profit organizations within its boundaries; the City of Manistee is eligible to sponsor the Old Kirke Museum project. Through the sponsorship the City is committing to facilitate the administration of the grant agreement; this includes, but not limited to, preparing and submitting quarterly progress reports to SHPO and executing the bidding | Page 3  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JANUARY 16, 2024 process. The final form of these documents is contingent on attorney approval. MOTION by Grabowski, second by Lundberg to authorize the resolution of support and the MOU to sponsor the Old Kirke Museum 2024 SHPO CLG program grant application; authorizing the Clerk and Mayor to execute the documents. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF ORDINANCE 24-01 TO AMEND CHAPTER 430 PARKING GENERALLY, OF THE CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. Ordinance 24-01 would amend Chapter 430 by adding 2-hour parking exemptions to include approved parklets and construction parking. Also, it removes imprisonment language. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Lundberg, second by Bachman to introduce Ordinance 24-01 amending Chapter 430 Parking Generally. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None CONSIDERATION OF ORDINANCE 24-02 TO AMEND CHAPTER 850 BUSINESS REGISTRATION, OF THE CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. Ordinance 24-02 would amend Chapter 850 to only require business registrations for businesses that have a permanent physical location in the City. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Bachman, second by Grabowski to introduce Ordinance 24-02 amending Chapter 850 Business Registration. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None | Page 4  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JANUARY 16, 2024 CONSIDERATION OF ORDINANCE 24-03 TO AMEND CHAPTER 606 ANIMALS, OF THE CITY OF MANISTEE, MICHIGAN CODIFIED ORDINANCES. Ordinance 24-03 would amend Chapter 606 Animals, changing the word “mammals’ to the more inclusive term “animals.” Also addressing issues with bird feeders in the Downtown District. As an ordinance two separate readings are required. If this ordinance is introduced at this time, it could be adopted at the next regular meeting. MOTION by Lundberg, second by Grabowski to introduce Ordinance 24-03 amending Chapter 606 Animals. With a roll call vote this motion passed unanimously. AYES: Bachman, Smith, Lundberg, Sullivan, Pratt, and Grabowski NAYS: None TRANSPORTATION IMPROVEMENT PLAN PRESENTATION. Shawn Middleton, Ed Bradford, Jeff Mikula and Lucas Richardson provided a presentation on the Transportation Improvement Plan (TIP) and responded to questions from Council. Discussion included: • Asset Management • Consideration for selecting streets • Street grant funding • Street project funding • PASER Ratings • 2023 PASER Cost Breakdown • Treatment methods – Reconstruction, Heavy Rehab, Light Rehab, Preventative/Normal Maintenance • Private Street Issues – 14th Street and North Water Street • Other Infrastructure – Sidewalks, Maple Street Bridge, Alleys, Parking Lots • 3-year TIP as of today – current plan summary & community impact • Spruce Street - Not in TIP, could be addressed in the spring • Duffy Street • Overlay option FIRE DEPARTMENT CAPITAL IMPROVEMENT PLAN DISCUSSION. Fire Chief Tom Hernden gave a presentation on apparatus replacement ideas for the fire department.
