PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JUNE 17, 2025 A regular meeting of the Manistee City Council was called to order by her honor, Mayor Jermaine Sullivan, on Tuesday, June 17, 2025, at 7:00 p.m. in the City Hall Council Chambers, 70 Maple Street, followed by the Pledge of Allegiance. City staff and the City Attorney reviewed Chapter 1040 Combined Water Supply and Sewage Disposal System and suggested some needed changes. The Council Ordinance Committee met on May 21, 2025, reviewed and recommends the changes. As an ordinance two separate readings are required. This ordinance was introduced at the June 3, 2025, meeting and could be adopted at this time. • Consideration of Ordinance 25-05 to amend Chapter 1420 Stille-Derossett-Hale Single State Construction Code, of City of Manistee, Michigan Codified Ordinances. In May of 2021, the City identified the “City of Manistee Engineer” as the enforcing agent of Appendix G (Flood Resistant Construction) of the Michigan Building Code. Since that time the City hired Jerry Bleau as the City’s full-time Building Official. The Building Official reviews and approves building permits; as part of the building permit review process he could check the floodplain map to ensure these regulations are enforced. The City participates in the | Page 1  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JUNE 17, 2025 National Flood Insurance Program (NFIP), which makes flood insurance available in communities that agree to manage their floodplains. One of the requirements of the NFIP program is to identify an enforcement agent. This amending ordinance appoints the Building Official as the person enforcing the Michigan Building Code and thus the Floodplain Administrator. Once these changes are made, EGLE and FEMA will be notified. As an ordinance two separate readings are required. This ordinance was introduced at the June 3, 2025, meeting and could be adopted at this time. • Consideration of Ordinance 25-06 to amend Chapter 1060 Garbage and Rubbish Collection and Disposal, of City of Manistee, Michigan Codified Ordinances. As part of the recently approved contract with Republic Services, the City agreed to designate them as the sole waste hauler in the City of Manistee. This amending ordinance would bring Chapter 1060 in line with the contract. The Council Ordinance Committee met on May 21, 2025, reviewed and recommends the changes. As an ordinance two separate readings are required. This ordinance was introduced at the June 3, 2025, meeting and could be adopted at this time. • Consideration of T.J.’S Block Party and Concert. T.J.’s would like to hold a concert and block party on Saturday, September 13, 2025. The request includes closing River Street from Poplar to Maple for 3 hours, from 7-10 p.m. T.J.’s will sponsor the event and provide a small stage. The event is free and open to the public. Approval of this event, including the street closure, is recommended by the DDA. • Consideration of a request from Taco ‘Bout It to hold a series of bike night karaoke fundraisers throughout the summer season. Taco ‘Bout It is requesting to hold Bike Night Karaoke Fundraisers in collaboration with the Combat Veterans Motorcycle Association, every other Thursday evening, June 26 through September 25, 2025, 7-9 p.m., in the outdoor seating area in front of Taco ‘Bout It. The purpose of this series is to raise awareness and funds for local combat veterans. Approval of this event is recommended by the DDA. MOTION by Keck, second by Smith to approve the Consent Agenda as presented. With a roll call vote this motion passed unanimously. AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF A PROCLAIMING AND ACKNOWLEDGING 99 PINE STREET AS A REGISTERED HISTORIC SITE, HONORING THE LEGACY AND MEMORY OF ANNIE MAE AND RAYMOND A. SMITH. MOTION by Rozga, second by Laskey to proclaim and acknowledge 99 Pine Street as a registered historic site and authorize the Mayor and Clerk to sign the proclamation. With a roll call vote this motion passed unanimously. | Page 2  PROCEEDINGS OF THE MANISTEE CITY COUNCIL – JUNE 17, 2025 AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF ENTERING INTO A FIVE-YEAR AGREEMENT TO LEASE TWO SLIPS AT THE CITY MARINA TO THE UNITED STATES COAST GUARD. The City has a current agreement to lease marina slips to the United States Coast Guard. This agreement expires at the end of August 2025. A new five-year lease has been prepared at current slip rental rates in the amount of $11,280 for the first year, with an annual escalator of 3%. The City Attorney has reviewed the agreement. MOTION by Grabowski, second by Keck to approve a five-year agreement with the United States Department of Homeland Security to lease two marina slips for use by the Coast Guard. With a roll call vote this motion passed unanimously. AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF THE MANISTEE CITY POLICE DEPARTMENT PURCHASING AND/OR UPGRADING SURVEILLANCE CAMERAS. The Manistee City Police Department was awarded $27,677 by the Local Revenue Sharing Board to purchase surveillance cameras systems for the First Street beach house, Fifth Avenue beach house, Riverwalk, Maple Street bridge, City Marina, and outside the downtown bathrooms. The City of Manistee has budgeted $15,000 for this project. The combined funds available for the project are $42,677, which will cover the cost of the equipment, installation, and one year of service and maintenance. MOTION by Smith, second by Grabowski to approve the Manistee City Police Department request for approval to spend $42,677 on the surveillance camera project through ESP Security. With a roll call vote this motion passed unanimously. AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF LOCAL GOVERNMENTAL APPROVAL FOR A SOCIAL DISTRICT PERMIT FOR LOVE WINES, LLC. The Manistee Downtown Development Authority (DDA) would like to request support and approval for Love Wines, LLC to receive Local Government Approval for a Social District permit. This will allow Love Wines to sell alcoholic beverages that can be consumed in the identified social district area. The Manistee Downtown Development Authority (DDA) would like to request support and approval for Don Tequila Mexican Restaurant, LLC to receive Local Government Approval for a Social District permit. This will allow Don Tequila Mexican Restaurant to sell alcoholic beverages that can be consumed in the identified social district area. MOTION by Keck, second by Grabowski to approve the resolution supporting the request from Don Tequila Mexican Restaurant, LLC to join the existing City of Manistee Social District. With a roll call vote this motion passed unanimously. AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None CONSIDERATION OF APPROVING A TEMPORARY ACTIVITY PERMIT. ECHO His Love is requesting a temporary activity permit to allow for the sheltering of the homeless population located in the City of Manistee in one location throughout the winter. This would allow people experiencing homelessness to be sheltered for five months from November 1, 2025 until April 30, 2026, at ECHO His Love main campus, located at 525 Michael Street in Manistee, Michigan. Temporary activity permits are allowable via the zoning ordinance Section 522 and Section 507. MOTION by Grabowski, second by Rozga to approve the temporary activity permit requested by ECHO His Love to allow for the sheltering of the homeless population in the City of Manistee at one location throughout the winter. With a roll call vote this motion passed unanimously. AYES: Smith, Laskey, Sullivan, Keck, Grabowski, and Rozga NAYS: None A REPORT FROM THE UTILITIES DEPARTMENT. Bruce Banks and James Riley reported on the activities of City of Manistee Utilities Department and responded to any questions the Council had regarding their activities.
