A meeting of the Manistee City Planning Commission was held on Thursday, May 7, 2015 at 7
pm in the Council Chambers, City Hall, 70 Maple Street, Manistee, Michigan.
Meeting was called to order at 7:00 pm by Chair Yoder
Roll Call:

Motion by Ray Fortier, seconded by Judd Brown that the agenda be approved as prepared.

PZ15-04 – Correction
Zoning Amendment Z15-04 was approved by the Planning Commission at their meeting on April
9, 2015. An error was found in the document. The correct language should be as follows:

Permitted by Right and Special Land Use Permit add as a use by right WHOLESALE FACILITY (not

Staff noticed a public hearing to correct Zoning Amendment PZ15-04.
Chair Yoder opened the Public Hearing at 7:03 pm.
Denise Blakeslee, Planning & Zoning Administrator – Ms. Blakeslee reviewed the correction and
answered questions.
Chair Yoder opened the hearing for public comments - No public in attendance
Chair Yoder asked if any correspondence had been received in response to the request - None
received.
There were no more additional comments; the Public Hearing was closed at 7:04 pm.

A public hearing was noticed for a correction to Zoning Amendment Z15-04 which was
approved by the Planning Commission at their meeting on April 9, 2015. The correct language

STAFF/SUB-COMMITTEE REPORTS
Denise Blakeslee, Planning & Zoning Administrator – Ms. Blakeslee gave the Commissioners an
invitation to a public input session for a redevelopment plan for the building at 400 River Street,
a copy of the Healthy Manistee Events on May 15 th & 17th and discussed the Ride of Silence on
May 20th.
Ms. Blakeslee discussed the May worksession and asked if the PC wanted to have a bus tour,
cancel the worksession and schedule a tour at a later date since members will be attending an
input session on May 13th.
MOTION by Mark Wittlieff, seconded by Marlene McBride that the May 21, 2015 worksession
be cancelled.

The next regular meeting of the Planning Commission will be held on Thursday, June 4, 2015

RE: Draft Zoning Ordinance Amendment
Commissioners, an Ad Hoc Domestic Animals Committee first met in July of 2013 and drafted an
amendment to Section 606 Animals of the General Law Ordinances. City Council introduced the
Ordinance at the September 2, 2014 meeting. Changes in the Michigan Right to Farm Act and changes
in Generally Accepted Agricultural and Management Practice (GAAMP) resulted in the ordinance being
placed on hold.
At the January Planning Commission worksession the Commission discussed the changes GAAMP
resulted in the need to specify in the Zoning Ordinance if Chickens or Ducks would be permitted. The
discussion by the Commission was that chickens or ducks should be allowed in the R-1, R-2 and R-3
Zoning Districts. The regulation and enforcement would be under Section 606 Animals of the General
Law Ordinances of the City of Manistee.
Staff drafted language to Section 606 Animals that has been reviewed by the City Attorney and the Ad
Hoc Domestic Animals Committee that is being forwarded to the Council Ordinance Committee for their
consideration. A component of the Ordinance is the need to provide language in the Zoning Ordinance
that specifies the zoning districts where Chickens or Ducks would be permitted.
The language that is proposed is as follows:
535 KEEPING OF CHICKENS OR DUCKS
The keeping of Chickens or Ducks is permitted in the R-1, R-2, and R-3 Districts if conforming to Section
606 Animals of the General Law Ordinances of the City of Manistee.
A draft zoning amendment has been prepared for your review. If there are no issues with the proposed
amendment, staff would like to schedule a Public Hearing at our July meeting.

AN ORDINANCE TO AMEND IN PART
AN ORDINANCE ENTITLED “MANISTEE CITY ZONING ORDINANCE”
WHICH WAS ADOPTED FEBRUARY 21, 2006,
To Amend the Manistee City Zoning Ordinance
Article 5: General Provisions
ADD Section 535 Keeping of Chickens or Ducks

THE CITY OF MANISTEE, MANISTEE COUNTY, MICHIGAN, ORDAINS:
1. That Article 5: General Provisions, ADD Section 535 Keeping of Chickens or Ducks as
follows:
535 KEEPING OF CHICKENS OR DUCKS
The keeping of Chickens or Ducks is permitted in the R-1, R-2, and R-3 Districts if conforming to
Section 606 Animals of the General Law Ordinances of the City of Manistee.
2. CONFLICTING ORDINANCES: that any and all ordinances of City of Manistee which may
conflict with the provisions of this ordinance be and are hereby rescinded.
3. EFFECTIVE DATE: This Ordinance shall take effect seven days after publication in the
Manistee News Advocate.
