Dear Planning Commission Members,
I would like to address any confusion there might be about the legality of having a Marihuana
Grow Operation in the Marihuana Sales Overlay District.
The Marihuana Overlay District calls for any underlying uses to be allowed. The underlying Zoning
District for the property at 74 Arthur Street is C-1 Regional Commercial. The C-1 District allows for
Marihuana Grower, Marihuana Processer, Marihuana Safety Compliance Facility, and Marihuana Secure
Transporter uses. Because of this, a Marihuana Grow facility would be an allowable use at 74 Arthur St.
The City Attorney, George Saylor, said that “When this issue came up a couple of months ago, I
reviewed the zoning ordinance and saw that grow is allowed in C-1. That had not been my understanding,
so I went back and checked the ordinance adoption and saw that we had adopted a zoning ordinance that
allowed for grow within the C-1.” George went on to say that “When the overlay district was adopted
grow was not included in that action, but it was already part of what was authorized in C-1 (as a special
use).”

that the Edgewater Condo Project can square off their parcel to the river. The parcels meet Zoning
requirements, and the City Assessor has confirmed that the split is legal and allowable. The City of
Manistee Planning Commission must give their recommendation to City Council for the parcel split
request to continue.

Dear Planning Commission Members,
The Site Plan Review Committee is currently reviewing the resubmission of plans for the PUD at 101
Lakeshore Drive. After the April 1st meeting, the applicant resubmitted an application with enough
changes to the project to require another meeting of the Site Plan Review Committee. The Planning
Department is recommending the Planning Commission table the project until the Site Plan Review
Committee has given their full review and recommendations.
