The parcels meet Zoning requirements, and the City Assessor has confirmed that the split is legal and allowable. The City of Manistee Planning Commission must give their recommendation to City Council for the parcel split request to continue. There was some confusion on the survey at the August 5, 2021, meeting leading to the tabling of this agenda item. Staff has reached out to Pat Bentley, the surveyor in question, on this matter for clarification. Mr. Bentley provided staff with the following explanation: There is nothing wrong, incorrect, or inconsistent with the set of drawings provided. No edits are needed. I will explain. • Sheet 1 shows three parcels of land. The original Fricano Parcel, Enhancement parcel A and Enhancement parcel B. • Enhancement parcel B is a parcel of land that would be deeded from the City of Manistee to Fricano and Enhancement parcel A is a parcel of land that would be deeded from the Elks to Fricano. • All three parcels are clearly labeled. • On the southerly line of Enhancement parcel B, a dimension is shown of 12.65 feet. This distance is from the SW corner of the Fricano boundary along the southerly line of Enhancement parcel B. • This dimension is between 2 survey points that I monumented during the survey to signify boundary corners of parcels. • Sheet 3 Shows the new Fricano Parcel – combination of the original Fricano parcel along with the addition of both Enhancement parcels = Combined parcel. • This is clearly labeled. • The other interior boundary lines between the original Fricano parcel and the Enhancement parcels have been removed. • Our client, Mr. Fricano, asked us to show the existing restaurant building located at 440 River Street along with the deck, enclosed porch and other porches. These are all shown and designated with labels and different hatching. • Our client also asked that we dimension the building located at 440 River St to the new Combined parcel boundary lines. We did this. • The 18.0-foot dimension near the SW corner is not a dimension between the original Fricano Boundary and the Enhancement parcel B boundary. It is dimension from the existing building to the new combined parcel boundary line. • You will note that there are two arrows on the line measuring from the building wall to the boundary line. • As you look around the building and deck you will also note several other dimensions that are doing the same thing – showing how far a particular point is from the boundary line. • The south line of the combined parcel is shown on sheet 3 to be 84.07 feet long from the overall SW corner to the SE corner of lot three (71.42 + 12.65 = 84.07’ where the 71.42’ dimension and the 12.65’ dimension come from sheet one) • There are exterior boundary dimensions with dimension arrows on them to aid in this.
