Eftaxiadis Presentation: stability of retaining wall east of former American Dry-Cleaning Building  Wall inspected by structural engineer  Final report to be shared with Planner  Current wall has been in place for many years  Behind the wall construction is 18” blocks with cement columns on a concrete base  Upon demo of structure, 2 sets of braces were installed and bolted into the wall and at ground base against the wall  Gateway plans being revised; new plans to be submitted to Planner in near future  Wall constantly being monitored  Future plans of wall are to amend current wall or replace it with a new wall  Plan in place for any sign of slight show of failure  Brownfield plan is to be in place before any work is to be done  Concrete columns and clay soil behind the wall greatly protects the structure directly behind the wall Chair Wittlieff stated Marc Miller will be present at the March meeting. PUBLIC HEARING Zoning Amendment—Duplex as Permitted Use in R-2 Public hearing opened at 7:32 pm Ms. Mehl: proposing duplex as a permitted use in R-2 district, no changes to current regulations, only permitting process to change, permitting process would eliminate going through the Planning Commission (PC) for approval- if adopted this would streamline the permitting process. Discussion: Commissioner Slawinski: reviewed the current permitting process and minimum requirements, should keep the current permitting process Commissioner Szymanski: vacation rental issue needs to be resolved, not in favor of vacation rentals taking away from single family homes being available for families to move, work and live City of Manstee Planning Commission Meeting Minutes of January 5, 2023 Page 3 here, public appears to support this, should have control and be able to manage vacation rentals to prevent over development of rentals Commissioner Weiner: PC worked on short-term rental issue with City Council not acting on it Commissioner McBride: duplexes seem to be a 1-unit apartment Commissioner Yoder: have concerns with eliminating the process, this should be further evaluated Chair Wittlieff: short-term rentals should be addressed; present process is in place and should remain in place Public hearing was closed at 8:13 pm. PUBLIC COMMENT ON AGENDA RELATED ITEMS Vincent Quaglia 433 Elm Street, Ruth Pratt 463 4th Street both commented on duplex permitting NEW BUSINESS Zoning Amendment—Duplex as Permitted Use in R-2 Motion by Commissioner Szymanski, seconded by Commissioner Slawinski to table until it can be addressed on the scope of duplexes and vacation rentals and take the vacation rentals back to City Council for management of them and examining the scope of R-2 district as it relates to allowing for development of duplexes. With a Roll Call vote this motion passed 6 to 0. Yes: Slawinski, Szymanski, Weiner, McBride, Yoder, and Wittlieff No: None Zoning Amendment—Accessory Buildings on Corner Lots Ms. Mehl: memo contents-- corner lots and accessory buildings on such a lot, some lots have 2 front setbacks and 2 side setbacks, other communities corner lot allowances/non-allowances, language can be changed, present exemptions. Staff has no recommendations. Commissioners’ comments: keep as is, define front of lot, can go to ZBA. MEMBERS DISCUSSION Commissioner Slawinski: Hampton Inn making good progress Commissioner Wittlieff: PC do another tour of Hampton Inn March/April, thanked Heather Pefley on staying for the zoning arrangement, 12th Street storage facility security lighting does not appear to be working, inquired on blight at old Ringel building on 1st Street PC: will not hold another public hearing for duplex amendment with the agenda item not moving forward; requested Tracy Davis, of Housing North, attend the next PC meeting. Ms. Mehl will request Chief Glass or another officer to attend the February meeting and give a blight progress report. This property requires special land use approval per section 408: Nonconforming Special Uses, of the City of Manistee Zoning Ordinance. Although there is no change in use to the property, due to the use being identified as a special land use under the current zoning ordinance, the special land use procedure must be followed with any change, expansion, or adjustment to the property. Mr. Whitman is proposing to demolish the existing detached garage on the property and construct a new detached garage. Given the grandfathered, substandard size of the parcel and limited area for this construction, a variance was granted on August 30th, 2022, for the proposed construction. A summary of the variance request is below: The parcel is located within the R-2 Medium Density Residential District (R-2) and the request is for the construction of a 14’x46’ or 644 square foot detached accessory building (garage). The nature of the variance request includes the following: • A variance from the required three (3) foot side setback to allow for a side setback of 1’ 11”. • A variance from the eighteen (18) foot height limitation for an accessory building, to allow for a finished height of 18’ 8”. • A variance from the 40% maximum lot coverage, to allow for lot coverage not exceeding 43%. • A variance from the ten (10) foot setback requirement between accessory buildings and the principal structure, to allow for the distance between the accessory building and the principal structure to be 4’ 6”. The variance granted allows for Mr. Whitman to encroach on one (1) side yard setback, maximum accessory building height, lot coverage, and the required setback between primary structures and accessory buildings. Sincerely, Katie Mehl Manistee County Planner City of Manistee Zoning Administrator Special Use Permit Requests Planning Commission A Step-By-Step Guide INTRODUCTORY MEETING WITH PLANNING STAFF - Staff will assist the applicant by explaining the 1 review process, review the zoning requirements for a special use permit, and provide site information, review the application and detailed site plan requirements, waive requirements if applicable. The applicant is encouraged to contact adjoining and nearby property owners and occupants to discuss their project prior to the public hearing. A copy of the mailing information for the 300’ notification can be obtained from Staff upon request. SUBMISSION OF APPLICATION - Applicant will submit application at least 30 days before the next 2 regularly scheduled Planning Commission meeting (first Thursday of the month) to the Zoning Administrator for review. The Zoning Administrator shall review the application and site plan. Staff will forward a copy of the request to the Site Plan Review Committee, consisting of the City Fire Department, City Police Department, DPW/Utility Director, and City Engineer for review/comments as needed. If need be, the Site Plan Review Committee can be expanded further to include other City entities. Fee must be received before any requests are processed. APPLICATION/SITE PLAN IS INCOMPLETE – Staff will prepare a notice of findings/corrections 2a that will be sent to the applicant. MEETING – The Planning Commission will begin their deliberation on the request. If the Commission 5 determines that no additional information is needed they will deliberate/take action on the request. The will adopt either a resolution to approve/approve with conditions or deny the request. If the Commission determines that additional information is needed they will postpone their determination until the next regularly scheduled meeting to allow the applicant time to provide the necessary information. [If applicable – requirements will be provided] Special Use Permit Application/Detailed Site Plan Page 3 of 3 Special Land Use Narrative(s) Summary, 313 & 311 Maple St, Parcel 51-574-726-02 Summary Timeline Of Events: On or about 05/11/2022 the Manistee Planning and Zoning Administrator (Katie Mehl, ZA) was contacted by the property owner (Chad Whitman) about starting the “Request For Appeal” process to permit the construction of a new garage at the subject parcel and removal of the existing garage for reasons stated in in the request for appeal package, herein referred to as “Attachment 1”. A public hearing was held for this request for appeal on 08/30/2022 and was unanimously passed by the Zoning Board Of Appeals (ZBA) as evidenced by “Attachment 2”, draft ZBA meeting minutes for 08/30/2022. Following passage of the request, a “land use permit” was not immediately filed by the property owner as other aspects of realizing the construction of approved appeal request were more pressing and, with an anticipated construction start of spring 2023, not assumed to be a critical path to the anticipated schedule with an estimated two-week approval time once submitted. On or about 11/22/2022 property owner was advised by the ZA that this project would require a “Special Land Use Permit” (SLUP) as a result of the property currently being used as a “duplex”, which is a listed special use under Article 9, Section 900 of the Manistee Zoning Ordinance. As per “Attachment 1” & “Attachment 2” the fact that the property is currently used as duplex had been communicated as such when the variance request was approved. Following discussions with the ZA, a SLUP was not immediately filed as an amendment was proposed in late 2022 to establish “duplex” as a permitted use, thereby potentially eliminating the need for a SLUP if approved for this garage project (Attachment 1). On or about 1/9/2023 was advised by the ZA that the amendment was unlikely to pass in a timeframe that would support the garage project. Therefore, a SLUP is being filed to allow the garage project (Attachment 1) to continue. Proposed Special Use Narrative: The current use of the property as a “Duplex” is permitted by Section 408 of the Manistee Zoning Ordinance as “Duplex” was previously a permitted use prior to 10/30/2010. Amendment Z10-01 changed duplex from “permitted” to “special” use. However, the proposed garage (Attachment 1) modifies the associated site so establishing the property for “duplex” use under the current zoning ordinance is being requested on the advice of the ZA. As a historical note, the property originally constructed as a “duplex” in 1900 with both addresses (313 & 311 Maple) typically being rented as established by census records (Attachment 3). Given this historical record of the property being used as a “duplex” for over a century, the location is appropriate for the requested special use. The proposed garage is anticipated to bolster this use as it provides for a significant increase in the useable rear-yard area and efficient fencing of the yard(s) that is not currently practical. Accessory buildings, with variances as approved, are uses permitted by right per R-2 zoning ordinance. Expected Impacts: There are no expected impacts for the special use as a “duplex” for emergency service, schools, storm water, sanitary sewer, traffic patterns or volumes given the property’s history. For the proposed garage impacts, those are only expected to improve the current site condition for primary storm water drainage & demarcation between property lines. The impermeable area of the property will be reduced by approximately 298 ft^2. The new garage will have gutters to direct this storm water flow, a detail the existing garage lacks. The new garage will also provide for demarcation between property lines allowing adjacent properties to efficiently fence their yards if so desired. The proposed garage has already been endorsed by the two adjacent property owners (Attachment 1) with the duplex use of the property known by both with no known objections. The number of members of the zoning board of appeals shall be specified in the zoning ordinance.” When there are more than five members acting during a meeting, it is a violation of the Zoning Enabling Act because the ZBA is now operating as a six-member board, and the City of Manistee Zoning Ordinance calls for a five-member board per section 2501 Membership, Terms of Office. All future meetings of the Zoning Board of Appeals should be conducted by no more than five members and should only be conducted with a majority of members present. It is also important to note that a passed majority vote for the ZBA is not a majority of the members present, but a majority of the five-member board. I have attached a copy of the Michigan Zoning Enabling Act with the sections relevant to this memo highlighted. Due to the information provided above, the January 12, 2022, meeting minutes that were approved via voice vote are not validly approved; the motion is not lawful having been given by the alternate member. Furthermore, the City Attorney noted that meeting minutes should never be approved via email, even if they are officially approved during the next meeting. Per section 3(2) of the Open Meetings Act, “All decisions of a public body must be made at a meeting open to the public”. The following can be followed completely, partially, or not at all. They are simply to help the ZBA members have a starting point for discussion. Option A: Deny the variance request. The variance request fails to pass the majority vote needed. The variance needed has been caused or somewhat caused by the parcel owner, and/or practical difficulty has not been shown to exist. Option B: Allow the variance as requested. The variance would allow for the construction of a 14’x46’ or 644 square foot detached accessory building (garage) as described in the application. Option C: The Zoning Board of Appeals may reverse or affirm, wholly or partly, or modify the order, requirement, decision, or determination and may issue or direct the issuance of a permit. Recommendation: The Planning Department request that if a variance is granted, that it be contingent on pulling of a land use permit, and issuing of all other local, state, and federal requirements prior to building. While this is usually covered under land use permitting, outright stating it within the variance recommendation, if passed, is always preferable. Also stating that this does not relieve the applicant from any other requirements of the City of Manistee Zoning Ordinance is desirable by staff.
