PROCEEDINGS OF THE ZONING BOARD OF APPEALS – April 27, 2026 A regular meeting of the City of Manistee Zoning Board of Appeals was called to order by Chair Marty Spaulding on Monday, April 27, 2026, at 4:00 pm in the City Hall Council Chambers, 70 Maple Street followed by the Pledge of Allegiance. PRESENT: Denis Johnson, Dan Dilworth, Paul Du Fresne, Marty Spaulding ABSENT: Shelly Memberto ALSO PRESENT: City Attorney- Blake Conklin, Planning and Zoning Administrator- Madeline Kazmierski, and Administrative Assistant – Jaclyn Van Allen ELECTION OF OFFICERS Chair: Marty Spaulding turned the meeting over to Jaclyn Van Allen during the election of the 2026 Chair. Board Member Du Fresne nominated Board Member Spaulding for Chair. Board Member Spaulding accepted the nomination. MOTION by Du Fresne, second by Johnson to elect Board Member Spaulding for Chair. With a roll call vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None Vice Chair: Jaclyn Van Allen turned the meeting over to Chair Spaulding to continue with the Election of Officers: Board Member Johnson nominated Board Member Du Fresne for Vice Chair. Board Member Du Fresne accepted the nomination. MOTION by Johnson, second by Spaulding to elect Board Member Du Fresne for Vice Chair. With a roll call vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None Secretary: Board Member Dilworth nominated Board Member Johnson for Secretary. Board Member Johnson accepted the nomination. MOTION by Dilworth, second by Spaulding to elect Board Member Johnson for Secretary. With a roll call vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None Recording Secretary: Board Member Spaulding nominated Jaclyn Van Allen for Recording Secretary. Jaclyn Van Allen accepted the nomination. MOTION by Chair Spaulding, second by Vice Chair Du Fresne to elect Jaclyn Van Allen for Recording Secretary. With a roll call vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None APROVAL OF AGENDA MOTION by Board Member Johnson, second by Vice Chair Du Fresne to approve the April 27, 2026, Zoning Board of Appeals Agenda. PROCEEDINGS OF THE ZONING BOARD OF APPEALS – April 27, 2026 With a voice vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None CONFLICTS OF INTEREST None APPROVAL OF MINUTES MOTION by Johnson, second by Du Fresne to approve the April 7, 2025, Zoning Board of Appeals meeting minutes. With a voice vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None SITE INSPECTION Site Inspection was waived by the Board. PUBLIC HEARING Parcel # 51-101-275-12, 91 Arthur Street • Section 1814: Billboards, Subsection C.4: “No billboard shall be located within six hundred sixty (660) feet of another billboard abutting either side of the same highway.” The Wander In presented a request for variance from billboard spacing requirements. Public hearing opened at 4:06pm. Public comment was received from Wander In Owner, Bridgett VanDerHoff regarding relocation of existing billboard to accommodate future restaurant expansion. Public hearing closed at 4:15pm. • Section 1814: Billboards, Subsection C.5: “No billboard shall be located closer than the required front yard setback from the street City of Manistee Zoning Ordinance Page 16 Article Eighteen Standards and Requirements for Special Uses right-of-way or a side yard setback from any interior boundary lines of the premises on which the billboard is located.” The Wander In presented a request for variance from billboard setback requirements. Public hearing opened at 4:16pm During discussion, the applicant withdrew the setback variance request from consideration. Public hearing closed at 4:23pm. BUSINESS SESSION Consideration of variance from Section 1814C.4- Discussion among the Board Members occurred and included: • Existing nonconforming billboard status • Relocation of billboards onto combined parcels • Applicability of nonconforming use provisions • Ordinance intent PROCEEDINGS OF THE ZONING BOARD OF APPEALS – April 27, 2026 • The Board agreed that there was a need for additional administrative review to determine the existing Use status and a proposed new location by the Zoning Administrator, Madeline Kazmierski. MOTION by Vice Chair Du Fresne, second by Chair Spaulding to table the variance application to a May 18, 2026, Zoning Board of Appeals meeting to allow for further review by the Zoning Administrator to determine existing Use and to propose a new location. With a voice vote this motion passed unanimously. AYES: Johnon, Dilworth, Du Fresne, Spaulding NAYES: None PUBLIC COMMENTS AND COMMUNICATIONS None STAFF/BOARD REPORTS Madeline Kazmierski introduced members of the Community Development Department to the ZBA Board Members. Adjournment NOTICE OF PUBLIC HEARING CITY OF MANISTEE ZONING BOARD OF APPEALS On Monday, April 27, 2026, beginning at 4:00PM a public hearing will be held by the City of Manistee Zoning Board of Appeals in the Council Chambers at City Hall, 70 Maple Street, Manistee MI 49660. The meeting will be held to consider a proposed variance request for the property addressed as 51-101-275-12, commonly known as 91 Arthur Street, Manistee, MI 49660. The applicant is seeking a variance from the City of Manistee Zoning Ordinance for the following: Section 1814: Billboards, Subsection C.4: “No billboard shall be located within six hundred sixty (660) feet of another billboard abutting either side of the same highway.” Section 1814: Billboards, Subsection C.5: “No billboard shall be located closer than the required front yard setback from the street City of Manistee Zoning Ordinance Page 16 Article Eighteen Standards and Requirements for Special Uses right-of-way or a side yard setback from any interior boundary lines of the premises on which the billboard is located.” The variance request and application as well as copies of the Zoning Ordinance can be found on the City of Manistee website at https://www.manisteemi.gov/ and can be reviewed or purchased by visiting the City of Manistee Community Development Department at City Hall.
