Discussion and Action Items - Old Business 18-1051 Cleveland Avenue and Maritime Drive speed deterrent. Attachments: CLEVELAND AVE - MARITIME DR 2015-2018 Cleveland Ave - Maritime Drive suggestions Cleveland Ave Speed Data Police Chief Nick Reimer informed the committee the Police Department placed a stealth stat speed display in the area and data showed less than one percent of vehicles traveling in the area were driving ten miles over the posted speed limit, which is an average stat for these deployments. Neighboring citizens, Barry Bast, Charles Sontag, James Iverson, and Greg Kraynek were present to discuss their concerns about the rate of speed vehicles are traveling. At this time the accident data and the stealth stat data provided doesn't suggest there is an issue in this area. Adler Czekala made a motion to place on file. Discussion and Action Items - New Business 19-0539 Citizen request for flashing stop signs to be installed at the intersections of South 8th Street and Columbus Street and South 9th Street and Columbus Street. Attachments: S 41ST ST - ROCK ST 2019-2016 Police Chief Nick Reimer feels the increase traffic in the area is due to the Rapids Road construction project. Accident data was provided, but doesn't warrant a change to the intersection at this time. Moved by Czekala, seconded by Lotz, that this Request be placed on file. Roll Call Present: 5- Howe, Lotz, Czekala, Williams and Jacobs 19-0541 Summer school crossing guard support at Jackson Elementary School. Attachments: Crossing Guard Request - 2019 Jackson Elementary Summer School Crossing Guard (2019) Principal of Jackson Elementary School Duane Simmons was present to request summer school crossing guard support for the 2019 summer school session. The Public Safety Committee suggested Chief Reimer add it to his budget for future years. Adler Lotz made a motion to approve the request pending finance approval. Moved by Lotz, seconded by Williams, that this Request be approved and referred to the Finance Committee. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs 19-0552 Manitowoc Sex Offender Residency Board Appeal for Michael Szente. A motion was made to table this item until next month to allow the City Attorney's Office to determine if an agreement can be drafted setting conditions the offender must follow. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs City of Manitowoc Page 4 Public Safety Committee Meeting Minutes May 13, 2019 19-0543 Ordinance to amend section 19.020 of the Manitowoc Municipal Code regulating construction of ordinances - rules for holidays. Attachments: Ord to Amend 19.020 Construction of Ordinances (define _holiday_) Assistant City Attorney Liz Majerus informed the committee the statutes have two different definitions of holiday depending on their purpose. For civil process both definitions are accepted. Our current municipal code does not define holiday, but our employee policy manual does. Last month a memo was presented to the committee asking for direction and the committee ask Assistant City Attorney Majerus to draft an ordinance. A motion was made to add clarifying language to Good Friday and to add Christmas Eve to the list of holidays. Moved by Lotz, seconded by Czekala, that this Ordinance be amended and referred to council. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs 19-0544 Ordinance to amend section 14.270 of the Manitowoc Municipal Code regulating smoking and tobacco products. Attachments: Ord to Amend 14.270 Regulating Vaping Within Buildings Assistant City Attorney Liz Majerus explained this ordinance prohibits electronic smoking devices from being used anywhere within a building where smoking is prohibited. Moved by Lotz, seconded by Williams, that this Ordinance be approved and referred to council. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs 19-0545 Ordinance to amend section 14.290 of the Manitowoc Municipal Code regulating restrictions on sale or gift of cigarettes or tobacco products to children. Attachments: Ord to Amend 14.290 Sale of Tobacco to Children Assistant City Attorney Liz Majerus explained this ordinance restricts the ability to sell electronic smoking devices to minors. This also applies to electronic smoking devices that don't contain nicotine within the cartridge. The vendor must display notice that the sale of electronic smoking devices is prohibited to minors under municipal code. Moved by Lotz, seconded by Jacobs, that this Ordinance be approved and referred to council. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs City of Manitowoc Page 5 Public Safety Committee Meeting Minutes May 13, 2019 19-0546 Ordinance to amend section 14.160 of the Manitowoc Municipal Code regulating unlawful use of telephone, cell phone, computerized communication system. Attachments: ord to amend 14.160 unlawful use of phone Assistant City Attorney Liz Majerus explained this ordinance simply say you can not pocket dial 911 or purposefully prank call 911. The ordinance was expanded to meet some requirements in order to convict at municipal court trials. Annoyance was also added as a purpose, because individuals do make prank calls to annoy, threaten, harass or intimidate. Sub section six amendment covers when a parent gives their phone to their child and their child calls 911. Moved by Lotz, seconded by Czekala, that this Ordinance be approved and referred to council. The motion carried by the following vote: Aye: 5- Howe, Lotz, Czekala, Williams and Jacobs 19-0551 Ordinance to amend chapter 18 of the Manitowoc Municipal Code (Electrical Code). Attachments: Ord to Amend Ch. 18 Electrical Code Assistant City Attorney Liz Majerus explained Electrical Inspector Bill Nichols attended a conference this year where he learned about some deficiencies in our ordinance that haven't been address in a long time. Electrical Inspector Bill Nichols took the time to review the ordinance and compare it to Wisconsin Administrative Code and the State Statutes that apply to electrical work and made the majority of the changes to conform with current state law. If we do not adopt the changes by the end of the year, we will loss our ability to conduct electrical inspections.
