Old Business Arbor Committee Meeting Minutes December 10, 2020 Page 2 Forest Preservation Chairperson Parenteau mentioned that several residents Area Conservation had been writing letters in support of the easement to, Easement staff will provide the letters to the City Council. Kristine Maurer had suggested postponing the discussion since she has not yet received the title search information. Mary requested to staff that the City Council work shop be postponed until April and has not heard back. Staff Liaison Corrow mentioned that he will keep the committee updated on any scheduling changes. Resident letters will continue to be received if a later work shop date determined. New Business 2021 Tree Sale Grove Nursery reported that the inventory of available trees is currently down due to an unusually high demand of trees in 2021. Trees will be replenished in the summer months and it was suggested that the tree sale is postponed until mid/late September. The Arbor Committee agreed that the sale should be postponed to provide a greater selection of trees and that fall is an excellent time to plant trees. Committee Member Arnlund suggested that a notice should be published in the spring newsletter informing residents of the change. Rice Lake Elementary Staff Liaison Corrow introduced the project and noted Addition – Landscape that 14 trees will be removed and the landscape plan Plan proposes only 13 new trees. • A full site tree inventory is necessary to determine the 20% tree diversity requirement. • If it is determined that certain tree species exceed the 20% maximum, no additional trees of that species may be added to the site. • It does not appear there are enough trees on site to meet the Landscape Ordinance requirements. The proposed landscape plans should be revised to include the minimum number of trees. Boston Scientific Staff Liaison Corrow introduced the project and noted Parking Lot – that 117 trees are proposed to be removed from the Landscape Plan parking lot area and replaced with 148 overstory trees Arbor Committee Meeting Minutes December 10, 2020 Page 3 and 76 ornamental trees. The Arbor Committee provided the following comments: • The applicant must include a tree schedule and indicate tree species of all new trees on the landscape plan. • The Landscape plan should specifically indicate the number of removed trees and the number of new overstory and new understory trees proposed. • The landscape ordinance requires that not more than 20 percent of the total number of overstory trees shall be composed of one genus. • Since the property is located in a T-Zone and a tree inventory of the entire site has not been provided, an accurate assessment of tree diversity cannot be made. The Arbor Committee would like to remind the applicant that a full site tree inventory will be necessary as part of any future building expansion projects. Area Reports Committee Member Piket shared that the YourGov app has been replaced with SeeClickFix as an interface to report issues throughout the City. Staff Liaison Corrow plans to demonstrate how to access and use the service at the next meeting. Respectfully submitted, Jesse Corrow, Staff Representative City of Maple Grove Arbor Committee  REQUEST FOR COMMITTEE ACTION Item Number: 3 Meeting Date: February 11, 2021 Agenda Heading: New Business Agenda Item: Conservation Easement Update Recommended Committee Action: None Discussion: The Conservation Easement was introduced and briefly discussed at the City Council work shop on February 1st. The plan going forward is to invite Kristine Maurer to the April 8th Arbor Committee meeting, along with Joe Hogeboom and the City Attorney to discuss the Forest Preservation Area in detail. A more comprehensive proposal will be presented to the City Council following this meeting. Also, Peter Vickerman will attend the March 11th Arbor Committee meeting to review some additional revisions to the T-Zone ordinance before the final draft is provided to the City Council. Committee Comments:  REQUEST FOR COMMITTEE ACTION Item Number: 4A Meeting Date: February 11, 2021 Agenda Heading: New Business T.H. 94/Maple Grove Parkway Agenda Item: Landscape Agreement Recommended Committee Action: Staff is requesting the following motion from the Arbor Committee: A Motion to recommend the City Council direct city staff to negotiate a landscaping agreement with the Minnesota Department of Transportation regarding T.H. 94 and Maple Grove Parkway. Discussion: Staff is planning Phase 2 of the landscape plan at the T.H.94/Maple Grove Parkway Interchange. The attached plan is a preliminary document that shows the location of Phase 2 (SW Quadrant). A more detailed landscape plan will be shared with the Arbor Committee later this spring. A motion from the Arbor Committee and direction from City Council will allow staff to continue moving forward on the project. Committee Comments:  REQUEST FOR COMMITTEE ACTION Item Number: 4B Meeting Date: February 11, 2021 Agenda Heading: New Business Agenda Item: Ash Tree Treatment Contract Recommended Committee Action: None Discussion: The City Council approved proposals from Rainbow Treecare for treatment of ash trees and YTS Companies for removal of trees at their meeting on February 1st. Staff plans to start aggressively treating ash trees that are considered healthy and good candidates for treatment while also removing ones that are unhealthy or hazardous. Details are still being worked out but Public Works staff wanted to inform the Arbor Committee on the direction they are going with EAB treatments. Attached is the Council Action Form regarding the treatment program. Attachment A is a contract that outlines the process for Right-Of-Way trees and trees that are on private property. The contract with Rainbow Treecare includes a 2-warranty for treated trees that are determined to be in good condition. Attachment B is contract with YTS Companies regarding public tree and stump removal. Matzke Accepting Proposals for Treatment Right of Way Technician and Removal of Ash Trees PREVIOUS ACTIONS: None. RECOMMENDED COUNCIL ACTION: Motion to accept proposal from Rainbow Treecare to treat public ash trees. Motion to accept proposal from YTS Companies, LLC. to remove public ash trees and stumps. COMMENTS: In 2016, Emerald Ash Borer (EAB) was discovered in the Rice Lake Development north of County Road 30 and west of Fernbrook Lane. The condition of the ash trees in the area have continued to decline over the years to a point at which city staff decided that action needed to be taken to minimize the impact EAB has on the community. After reviewing the current situation and speaking with experts in the tree industry, it is recommended that the city aggressively treat as many trees as possible throughout the city to slow down the ash mortality rate and maintain the urban forest. Treatment is recommended every two years until pest pressure is reduced. Trees that are unhealthy or not considered good candidates for treatment will be removed over time. It is anticipated that the number of trees to be removed during the first couple of years will be elevated because the infestation rate in neighborhoods where EAB was originally discovered is high. Work completed by these contractors will be in addition to and supplement the work of the Public Works Department staff. The acceptance of these proposals is subject to adequate liability insurance from both tree firms that will be reviewed and approved by the City Attorney. It is recommended that City Council accept proposals from Rainbow Treecare for treatment of trees and YTS Companies, LLC. for tree removal, stump grinding, and restoration. Tree Removal Proposal  Attachment A Ash Tree Treatment Quote to The City of Maple Grove Submitted by: Rainbow Treecare 12/02/2020 Project Understanding The Emerald Ash Borer (EAB) threatens the lives of the thousands of ash trees located in the City of Maple Grove (City). Fortunately, the City is continuing to prepare for this devastating infestation by electing to protect public ash trees with Emamectin benzoate. The City has invited Rainbow Treecare to submit a proposal to provide tree injection services (Project) for ash trees within two separate areas: right-of-way (ROW) and private property. Project Goals • Protect ash trees from emerald ash borer infestation on public and private property. • Provide a bulk discount through a formal city program to encourage residents to inject their ash trees on private property in order to preserve the city’s tree canopy and the accompanying economic and environmental benefits. • Educate city residents about the benefits of tree injection treatments for high value ash trees as part of an overall EAB plan. • Collect and update GPS points for injected ash trees. The information will be used to ensure communication occurs before condemning potentially protected trees, and to gauge the participation and success of the program over time. Project Areas Area 1- Right-of-Way  There are thousands of ash trees growing on public right-of-ways which may be suitable for preservation. o The City reserves the right to increase or decrease quantities.  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove o All ash injections must be completed between June 1st and September 30th of each year, or before fall leaf color, whichever occurs sooner—any variances in dates must be approved by the City.  The contractor must collect tree inventory data using a mobile device  All invoices will be remitted to the city of Maple Grove and itemized by address listing and unique number assigned to each tree Area 2 – Private Property  The private property owner will contact the contractor directly to initiate an inspection, receive a quote and provide permission. The City will not be a party to any contract between the private owner and the proposer. Any agreement with the private owner and the proposer shall be subject to the following terms: o The contractor will inspect the ash trees on private property and determine whether they are appropriate for treatment o All ash tree injections must be completed between June 1st and September 30th of each year or before fall leaf color, whichever occurs sooner o Any variances in dates must be approved by the City Tree Inspector o All invoices will be remitted to the homeowner Terms of Service Contract Period and Project Completion Dates The contract will commence on date of contract award and terminate September 30, 2022 unless terminated sooner in accordance with the provisions contained in this contract. The City reserves the option under the terms of the agreement with Rainbow Treecare, to extend the contract for one additional two (2) year period. A cost-of-living adjustment may be included in the contract extension. Both the City and the Rainbow Treecare must agree to such terms in writing. The tree injection period will run from approximately June 1st—September 30th of each year. Injections will occur on trees that have fully expanded leaves and have not reached fall senescence (fall leaf color). The City reserves the right to extend or limit the time period based on seasonal conditions. Prior to beginning work under this contract, Rainbow Treecare will arrange for a meeting with city staff at which time specifications will be reviewed and the scheduling and progression of work will be discussed. Rainbow Treecare will be represented by the superintendent and the individual(s) arborist(s) who will be representing Rainbow Treecare during the progress of this Rainbow Treecare  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove contract and will make applicators available to provide an on-site demonstration prior to the start of the project if requested by the City. The entire project must be completed by September 30th of each year unless the City approves an extension or alternate proposed timeline. Subcontractor No subcontracts will be used to complete any aspect of this project. Rainbow Treecare is fully capable of completing all tree injection, GPS, and marketing work as specified herein. Superintendence by Contractor Rainbow Treecare shall have a competent superintendent who is an ISA certified arborist supervising all application crews. Rainbow Treecare shall also provide an adequate and qualified staff certified by the Minnesota Department of Agriculture for the proper coordination and expediting of work under this agreement. Basis of Payment Payment for injections on city property will be made within 30 days of acceptance of the work. Rainbow Treecare shall be responsible for invoicing the private property owner for right-of-way and private property tree injections and collecting those payments. The City has no responsibility for the private property tree injections. Tree Injection Specifications General It is the intent of these specifications to describe the tree injection program requirements for each area. Rainbow Treecare  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove Equipment and Treatment Specifications Upon request, Rainbow Treecare will demonstrate proficiency with the injection equipment and knowledge of the products used to prevent EAB. Assigned applicators may be required to provide an on-site demonstration prior to the start of the Project. Safety Standards Rainbow Treecare will use work methods, safety procedures and personal protective equipment conforming to all ANSI and OSHA standards in performing the work under this contract and will supply any Material Safety Data Sheets (MSDS) to the City upon request. Formulation Rates It is the responsibility of Rainbow Treecare to follow all insecticide label instructions. Any alterations in the formulations or equipment must be approved in advance by the city forester. In order to remain responsive to emerging research, the City reserves the right to request a change in formulation rates or application methods for the duration of the contract. Any such change and additional costs incurred would be agreed to in written correspondence between the Rainbow Treecare and the City. Ash Tree Injection 1) All injections of ash trees shall be injected with a liquid formulation of 4% Emamectin benzoate every two years. The City may give preference to formulations that pose the lowest health risks to applicators as determined by the US EPA signal word listed on the product label. No substitutions of the formulations shall be allowed. 2) All Right-Of-Way Trees (Area 1) are to be treated every two years unless otherwise specified by the City. The City reserves the right to change this interval at any time in response to the latest research. Private Trees (Area 2) are proposed to be treated every two years. 3) Determination of dosage shall be on the diameter at breast height (DBH) within specific diameter classes. Rainbow Treecare shall inject Emamectin benzoate at the following rates: a. Trees less than 22 inches diameter shall be injected at a variable rate from 2.5 ml. /DBH inch up to 5 ml. /DBH inch. b. Trees 22 inches diameter and larger shall be injected at a 5 ml./DBH inch. Rainbow Treecare  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove 4) Injections shall be made at the soil line to ensure the best distribution of the insecticide throughout the tree. Equipment Rainbow Treecare will provide all necessary equipment to complete the contract under these specifications: 1) Equipment will remain in proper operating condition throughout the term of the contract and RTC is responsible for cleaning and providing upkeep to the injection system on a daily basis. Any maintenance issues or repairs are the sole responsibility of Rainbow Treecare. 2) Treatment technicians will use a high-helix drill bit and shall replace the drill bits after every 100 DBH inches to maintain high efficiency. Drilled holes must be the size recommended by the injection equipment manufacturer. Injection holes on ash must be drilled to a depth of approximately 1 inch below the bark to maximize delivery of Emamectin benzoate into ash trees. 3) Emamectin benzoate will be injected into ash trees using current industry standard injection systems that have efficacy data that supports their use. 4) All injected trees must be tagged with the year of injection clearly indicated on the tag. Rainbow Treecare shall provide tags for trees growing on right-of-way and private properties. The tags must be of a design and type that can persist on the tree for at least 3 years. Guarantee and Warranty Rainbow Treecare guarantees public and private ash trees in good condition that are treated by our technicians with a 4% liquid formulation of Emamectin Benzoate will not die from an emerald ash borer infestation for two years after the treatment date. If a healthy injected tree dies of EAB within the guarantee period, Rainbow Treecare shall uphold the agreement with the property owner as written within the proposal. Rainbow Treecare reserves the right to treat ash trees in poor condition without the warranty. Tree Feature Class Attributes As part of this proposal, Rainbow Treecare includes a commitment to record tree location and tree attributes in a GIS application. Because Maple Grove’s tree inventory program is in progress, tree point features may need to be collected while performing tree activities. In the event a tree point does not exist for the Rainbow Treecare  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove active tree, Rainbow Treecare shall collect x-y coordinates within 1 meter of accuracy and verify location data by aerial photography to ensure the accuracy of location data relative to the tree. This is in addition to the data fields to be filled out in entirety from the field while performing tree activities. Rainbow Treecare shall supply mobile devices such as tablet or phone equipped cellular service to their staff to collect tree data in real-time from the field. Property Access and Notification Rainbow Treecare shall not enter private property without having previously obtained permission from the property owner. If Rainbow Treecare personnel desire to enter private property to access trees on a city owned property, it is their responsibility to notify the underlying property owner by knocking on the door at the time of the site visit or making a phone call ahead of time. The City Tree Inspector shall be notified of the Rainbow Treecare’s intent on accessing a site through private property. If access is denied, the contractor shall notify the City. Contract Supervision and Form of Order to Proceed City staff shall assign trees growing on city property when the program commences. The City will continuously refer residents interested in ROW and private property tree injections throughout the treatment period of June-September of each year in a format mutually agreed upon prior to the start of the program. Rainbow Treecare shall send the City completed work orders and provide GPS data on a monthly basis. The City will reserve the right to request locations planned for treatment during the week and conduct spot checks. Right-of-Way and Private Property Tree Inspections Prior to recommending treatment on private property, all proposed ash trees shall be inspected by a qualified Rainbow Treecare employee. There may be instances when a tree is not in suitable health or condition to recommend treatment and Rainbow Treecare shall have an individual experienced in communicating tree information to the general public to explain such decisions. The person assigned to inspect private property trees shall be, at the very minimum, a Certified Minnesota Tree Inspector, or have a degree in forestry, or be an ISA Certified Arborist. The individual shall be qualified to diagnose emerald ash borer and have experience evaluating tree condition. Additionally, the individual shall be able to explain the benefits and Rainbow Treecare  Rainbow Treecare Tree Injection Service Proposal to the City of Maple Grove risks of all ash protection options, with regard to pollinators, water quality, human health, and tree health and condition. Area Maps and Strategic Planning During each year of this agreement, Rainbow Treecare shall make staff time and technology available to collect ash tree inventory data from proposed public treatment areas. This tree inventory data shall be collected and shared with the City in an effort to determine the numbers and locations of trees and appropriate management strategies. Hours of Operations and Uniform The City reserves the right to set limits on hours of operation on Saturdays, Sundays and holidays. All weekend or holiday work shall be approved by the City in advance. Certified applicators and GPS staff shall wear company uniform and/or a high visibility/safety vest at all times during field operations. Every vehicle associated with the Project shall display a company logo or name. Capacity Rainbow Treecare annually protects over 25,000 ash trees and can inject over 900 trees per day at peak summer capacity. Committee Comments: January 12, 2021 Jesse Corrow Arbor Committee Liaison City of Maple Grove 12800 Arbor Lakes Parkway Maple Grove, MN 55311 Dear Jesse: I am sending you this note because I wanted to alert the City concerning two plant species at the Maple Grove Arboretum that are considered to be invasive by a number of states and agencies. The species of concern are Amur Corktree and Winged Burning Bush. To introduce myself, I have been a Maple Grove resident for 23 years and I am a volunteer with Three Rivers Park District working with the invasive species programs; Adopt a Woodlot and "Rapid Response Early Detection" (R2ED). I started this work in 2012. I have done similar work with the National Park Service, Mississippi National River and Recreation Area. My educational background is in Biology and Soil Science and I am retired from a career in natural resources management. The R2ED group surveys the parks and sometimes surrounding land for invasive plant species that are on our watch list. The watch list includes species identified in adjoining states, other parts of Minnesota or invasive species that are starting to show up in our area. When found on Three Rivers Parks lands prompt steps are taken to control the infestation. In recent years, Amur Corktree and Winged Burning Bush were added to our watch list. Recently, one of our volunteers observed a mature female Amur Corktree with abundant fruit at the Maple Grove Arboretum. This tree was labeled with a sign as being planted in 1990 for Arbor Day. A winged burning bush was also seen at the Arboretum and it is also labeled. Currently Amur Corktree is not on Minnesota Department of Agriculture's prohibited noxious weed list. However, the Wisconsin DNR lists it as "prohibited". Their website indicates that it suppresses regeneration of native trees and displaces the shrub and herbaceous layers. It is also prohibited in Indiana, New York and Massachusetts. Missy Anderson, former Invasive Species Coordinator at Three Rivers Park District, has petitioned MDA to place Amur Cork on the prohibited species list but to date no action has been taken. It is significant that the University of Minnesota Landscape Arboretum had historically included Amur Corktrees in their collection but found that it was invading the natural landscapes at their site. They removed all the female individuals and only allow non-fruit producing Amur Corktrees to remain. Our group has found many Amur Corktrees invading nearby Carver Park. The University of Minnesota Landscape Arboretum strongly recommends that all fruit producing Amur Corktrees be removed. Our current Invasive Species Coordinator, Emily Dunlap, related that the City of St. Paul removed female Amur Corktrees they had planted in boulevards after finding nearby infestations. For reference, I have attached a publication from the University of Minnesota Landscape Arboretum concerning their experience with the invasive tendencies of Amur Corktree and their recommendations. Concerning Winged Burning Bush, the Minnesota Department of Agriculture has assigned the species a Specially Regulated status. It will be moved to "Restricted" status January 1, 2023. It will then no longer be permitted to be sold in the nursery trade. The invasive effect is that it forms a dense layer in the understory and reduces native plant diversity in the understory. We have found Winged Burning Bush plants at Elm Creek Park. Seeds are distributed by wildlife that eat the fruit. Winged Burning Bush is monoecious so one individual can produce a colony of plants. I think it is well known that our historical experience with Invasive plants such as common buckthorn clearly shows that it is important to take action early once a species is shown to be invasive to natural environments. I would encourage the Arbor Committee to consider recommending removal of both of the above species from the Arboretum and other park lands where they are found to the extent practical.
