Maple Grove City Council Meeting Meeting Minutes May 4, 2020 Call to Order Pursuant to call and notice thereof, a Regular Meeting of the Maple Grove City Council was held at 7: 30 p.m. on May 4, 2020 at the Maple Grove Government Center/ Public Safety Facility, Hennepin County, Minnesota and online via WebEx. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Karen Jaeger, Phil Leith, and Kristy Barnett. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Peter Vickerman, Planning Manager; Brett Angell, Economic Development Manager; Ken Ashfeld, Public Works Director/ City Engineer; Fire Chief Tim Bush; Parks Director Chuck Stifter; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7: 30 p. m. and led the City in the Pledge of Allegiance. Consideration The following items were pulled from the Consent Agenda. of Items Regarding Item 3K ( Cedar Island Lake, Fish Lake and Rice Pulled from Lake Ski Slalom Courses), Councilmember Jaeger discussed the the Agenda ski slalom courses being requested and noted all permits were in place. She reported the Lake Quality Board reviewed these requests and supported the use. Motion by Councilmember Jaeger, seconded by Councilmember Leith, to approve the 2020 permits for the Cedar Island Lake Homeowners Association for a ski slalom course on Cedar Island Lake, the Fish Lake Ski Club for a ski slalom course on Fish Lake, and Maple Grove Waterski Club for a ski slalom course on Rice Lake. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Regarding Item 3T ( Proclamation to Declare May 15th as Peace Officers Memorial Day and May 10th through 16th, 2020 as Police Week), Councilmember Hanson reported May 15th was set aside as Peace Officers Memorial Day. She explained the Maple Grove Police Department was asking and encouraging the community to honor Minnesota' s fallen officers by turning their porch lights blue during National Police Week. Motion by Councilmember Hanson, by seconded Councilmember Leith, to approve May 15th as Peace Officers Memorial Day and May loth through 16th, 2020 as Police Week. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Special Business Open Forum Mayor Steffenson reported he received an email from Keith Wroolie, 11275 82nd Place N, asking why the Parks and Maple Grove City Council Minutes May 4, 2020 Page 8 Recreation staff had not be furloughed given the fact there was no park programming taking place at this time. Parks Director Stifter discussed the deep cleaning and deferred maintenance projects that are occurring at the Community Center and described how parks staff was being utilized for other projects or being reassigned as parks ambassadors. He commented his staff was on the verge of opening up a series of summer recreation programs that could be implemented using CDC guidelines regarding social distancing. He noted the public could register for these programs this coming Wednesday and programs would begin in June. He reported residents were still very interested in wellness, being engaged and having recreation opportunities. Staff commented further on the efforts of the park ambassadors and the park maintenance that would occur in the coming weeks. He noted trash was picked up and bathrooms within parks were being cleaned on an increased basis. Mayor Steffenson questioned how many seasonal employees the city would be hiring compared to previous years. Parks Director Stifter reported the city would be hiring 11 seasonal employees this year and has hired 18 to 20 in the past. Councilmember Hanson asked if some parks staff was working remotely. Parks Director Stifter stated this was the case noting eight of his employees were working remotely. Councilmember Leith inquired if any of the parks staff members had been furloughed. Parks Director Stifter explained four full time employees have been furloughed temporarily and two or three have reduced hours. Update on Fire Chief/Emergency Management Director Bush provided the COVID- 19 Council with an update on the city' s response to COVID- 19. Response He reported the governor extended the Stay at Home order l through May 17 . He reviewed the number of COVID- 19 cases that have occurred in Minnesota compared to other states. He reported those over the age of 60 are most impacted by COVID. He explained the pandemic has not increased the calls for police and fire. He indicated the city has been successful in taking care of its staff with PPE. He commented further on the phased approach that would be taken to reopen businesses by the State of Minnesota. He reported the recent farmer' s market was held outdoors very successfully. Maple Grove City Council Minutes May 4, 2020 Page 9 Mayor Steffenson thanked Fire Chief Bush for his thorough report and tremendous efforts on behalf of the City of Maple Grove. 7: 30 p. m. City Administrator Nelson stated Granite City Brewery was Public requesting an On- Sale Intoxicating Liquor/ Sunday Sale license and Brew Pub Off- Sale License. She reported in December of Hearing 2019 Granite City filed for Chapter 11 bankruptcy protection. On- Sale She indicated Famous Dave' s parent company subsequently purchased the company earlier this year. She explained the Intoxicating applicant had submitted all necessary paperwork. Staff reported Liquor/ the City Attorney reviewed the bankruptcy information and Sunday Sale everything had been found in good order. Staff commented License and further on the request and recommended approval of the new liquor license. Brew Pub Off-Sale Pete VonBank, General Manager of Granite City, stated his License for organization was staying afloat during these difficult times by Granite City, offering curb- side pick-up and to go service. He indicated this Inc. dba had dramatically impacted sales. He reported he has had to Granite City furlough the vast majority of his staff as sales were down by 75%. He was looking forward to getting guests back in the Food & building as soon as possible. Brewery Councilmember Jaeger stated the food at Granite City was excellent. She requested more information regarding the brunch boxes. Mr. VonBank discussed the brunch boxes noting they were available on Saturday and Sunday and came with mimosas. Motion by Councilmember Barnett, seconded by Councilmember Jaeger, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7: 56 p.m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Jaeger, seconded by Councilmember Barnett, to close the public hearing at 7: 57 p. m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Maple Grove City Council Minutes May 4, 2020 Page 10 Motion by Councilmember Barnett, seconded by Councilmember Jaeger, to approve the On- Sale Intoxicating Liquor/ Sunday Sale License and Brew Pub Off-Sale License for Granite City, Inc. dba Granite City Food & Brewery, 11909 Main Street, Maple Grove, Minnesota, subject to compliance with liquor licensing requirements in Chapter 4, Article I of the City Code, with said license to expire June 30, 2020. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Community Development Items The Village Planning Manager Vickerman explained the applicant seeks PUD Concept Stage Plan Amendment for a senior residential Arbor Lakes use at the Village Arbor Lakes development. This would be for 2020 PUD a five story, 198 unit senior housing development and slightly Concept Stage adjusting the commercial uses in the northwest corner of the Plan Village. The senior housing would provide a continuum of care Amendment— with independent, assisted and memory care units. He reviewed Senior the location of the parking for the senior building. The Housing Comprehensive Plan guides this site Regional Mixed Use, non- retail focus and high density housing was an allowed use. The proposal has a density of 59 units per acre. Staff commented on the job estimates for the senior housing noting 35 to 50 full time jobs would be created versus 170 if the site were to remain office. It was noted the site was previously proposed for office, but explained the proposed use would have a higher tax value. Staff commented further on the request noting the applicant has explained there was not a strong demand for office at this time. He reported the Planning Commission reviewed this item at their April 27,h meeting and recommended approval on a 6- 1 vote. Councilmember Hanson commented on the required building enhancements and asked if this would be addressed further during the Development Stage Phase of the project design. She indicated she would support the site having more amenities that were tailored for seniors. Planning Manager Vickerman stated this could be addressed further with the developer during the Maple Grove City Council Minutes May 4, 2020 Page 11 Development Stage Phase, along with the architectural and landscaping details. Councilmember Hanson believed there was a need in Maple Grove for this type of housing and stated she was less concerned about the density. Councilmember Jaeger questioned if there was a Plan B for this project if the economy took a sharp turn due to COVID- 19. Tony Kuechle, Doran Development, thanked staff for providing the Council with a detailed staff report. He explained he was proposing to construct 198 units within a five story building. He noted this would be a continuum of care facility. He reported the facility would have 117 units would be independent living units, 59 assisted living units and 22 memory care units. He discussed how the site would be programmed specifically for seniors. He described how the proposed five story building would add interest to this area of the Village at Arbor Lakes. He discussed the enhanced landscaping and architecture that would be used on the building. He indicated this building was developed based on a market study and explained there was an increased demand for independent living during these times, which meant there was no Plan B. Councilmember Jaeger questioned when construction would begin if the project were approved. Mr. Kuechle reported construction would begin in the spring of 2021 and noted the building would take 18 months to complete. Councilmember Jaeger encouraged the developer to consider outdoor seating or a firepit for the site. Mr. Kuechle indicated this was a Concept Stage Plan and these details would be included with the enhanced landscaping plan in the Development Stage Plan. Councilmember Hanson stated she understood the developer has been trying to market the site for office. Mr. Kuechle explained the site has been marketed for the past three years as office space and he anticipated there was more predominant office sites available within the Gravel Mining Area. He anticipated two smaller service offices may be located in the area. Councilmember Barnett inquired how old the market studies Maple Grove City Council Minutes May 4, 2020 Page 12 were for the senior housing project. Mr. Kuechle stated the study was originally completed in the spring of 2019 and this information was updated in November of 2019. Councilmember Barnett questioned if this building had the flexibility to be used for other housing should the market for senior housing change in the next two years. Mr. Kuechle reported this building would be programmed specifically for seniors. He explained the market study shows a strong demand for senior housing for the next 11 years. Councilmember Barnett indicated there may be a trend in the near future for seniors to not to want to congregate in assisted living facilities given what has happened during the COVID- 19 pandemic. Mr. Kuechle stated he has spoken to his operating partner, Ebenezer, to discuss this matter and noted there was an increased demand for being in a controlled environment where services are provided versus living on their own. Councilmember Leith stated he thought this would be a great site for a tall office building. However, this has not panned out and he anticipated the demand for office would go down. He did not want to see this site remain empty for years to come. He indicated there were other sites in the city that could support office. He noted the proposed density did not bother him and explained he would be supporting the proposed senior housing at this location. Motion by Mayor Steffenson, seconded by Councilmember Leith, to approve directing the City Attorney to draft a Planned Unit Development Agreement and a Resolution approving the PUD Concept Amendment for The Village Arbor Lakes, subject to: 1. The applicant addressing to the satisfaction of the City any remaining applicable comments contained in the memorandums from: a. The Community and Economic Development Department dated April 17, 2020 b. The Fire Department, dated April 20, 2020 c. The Water Resources Engineer, dated March 16, 2020 d. The Parks and Recreation Department, dated March 18, 2020 Maple Grove City Council Minutes May 4, 2020 Page 13 e. The Transportation Operations Engineer, dated March 18, 2020 The applicant shall acknowledge that Park Dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent Board Action. Board meetings are held on the third Thursday of each month. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Interim Community and Economic Development Director Hogeboom Ordinance to explained staff was bringing forward a proposed moratorium on Establish a new multi- family residential developments based on Council input. He reported the city was seeking to establish this Moratorium moratorium for one year. He discussed the numerous multi- on New Multi- family projects that have been completed in recent years and Family indicated staff wanted to greater understand this market and the Residential impacts it will have on the city' s infrastructure prior to Developments approving additional projects. He stated the city currently had 4, 000 apartment units, which was 15% of the total housing stock. He noted 2, 000 apartment units were in various states of Ordinance No. 20- 06 approval and could potentially be developed in the coming years. Staff commented further on the studies that would be completed over the coming year regarding apartment complexes and recommended approval of Ordinance 20- 06 establishing the twelve month moratorium. Councilmember Leith questioned if this would impact any developer that already had a Concept Stage approval. Planning Manager Vickerman reported any completed applications or projects that have received Concept Stage approval would not be impacted by the moratorium. Councilmember Leith stated he supported the proposed moratorium. Motion by Councilmember Leith, seconded by Councilmember Jaeger, to approve adopting Ordinance No. 20- 06 an Ordinance that would prohibit the development and construction of any new apartment project for up to one year. The moratorium, outlined within the interim ordinance, would not impact projects that have already Maple Grove City Council Minutes May 4, 2020 Page 14 received preliminary plat approval, or final development approval. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to approve directing the use of the publication Ordinance Summary for Ordinance 20- 06. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. ZOTA — Community and Economic Development Director Hogeboom Internal explained the city was proposing a Zoning Ordinance Text Appeal Amendment for the purpose of amending City Code regarding Limitations Internal Appeal Limitations. He explained this ordinance addressed the appeal time an aggrieved party would have to Ordinance No. appeal a zoning order from 90 days to 30 days. Staff commented 20- 03 further on the proposed City Code amendment and reported the Planning Commission recommended approval. Councilmember Jaeger stated she supported the proposed change to 30 days. Councilmember Hanson agreed stating 30 days would be consistent with neighboring communities. Motion by Councilmember Jaeger, seconded by Councilmember Hanson, to approve adopting Ordinance No 20- 03, amending city code section 36- 121 regarding Internal Appeal Limitations period and set a Limitations period for Judicial Appeals. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Hanson, seconded by Councilmember Jaeger, to approve directing the use of the publication Ordinance Summary for Ordinance No. 20- 03. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Shoppes Community and Economic Development Director Hogeboom Transit discussed the proposal to add signage for the Shoppes at Arbor Signage Lakes onto the freeway side of the Maple Grove Transit parking ramp. He explained shop management believes this signage would increase visibility for the Shoppes at Arbor Lakes. He Maple Grove City Council Minutes May 4, 2020 Page 15 explained staff has spent time reviewing various renditions of signs and came up with an approved final design. He indicated the next step would be to engage the City Attorney to develop an agreement between the city and the Shoppes at Arbor Lakes which would require the Shoppes to be responsible for all sign cost, engineering and maintenance. Staff requested feedback from the City Council on how to proceed with the Shoppes transit signage. Councilmember Jaeger asked if the proposed final sign design had been previously approved by the Council. Community and Economic Development Director Hogeboom stated this was the final design recommended by the Council. Councilmember Leith and Councilmember Barnett supported the proposed signage on the Maple Grove transit parking ramp. Councilmember Hanson supported the signage. The consensus of the Council was to direct this matter to the City Attorney. Report On Community and Economic Development Director Hogeboom Upcoming updated the Council regarding the following: Community The Planning Commission would meet next on May IIth and Economic and the group would discuss the apartments and villa homes Development at Territorial Green. Items The Planning Commission would meet on May 26`h to discuss T- Zone Ordinance updates along with a standalone coffee shop at the Village at Arbor Lakes. Staff reported the city collected over 5, 000 cloth masks at the Fire Department on April 27`h All retail businesses could be open again beginning May 41h for curb- side pickup. The Arbor Committee will be meeting again in June. Report on Director of Public Works/ City Engineer Ashfeld updated the Council regarding the following: Upcoming Engineering Staff provided the Council with an update on the I-94 project. He stated the rest area was closed except for truck Maple Grove City Council Minutes May 4, 2020 Page 16 Items traffic. I- 94 at Maple Grove Parkway/ Weaver Lake Road the speed limit would be reduced from 70 miles per hour to 60 miles per hour and the State Patrol would have high enforcement. The City-wide Clean Up Day would be held on Saturday, May 16th from 8: 00 a. m. to 12: 00 p.m. at the Public Works Facility. Staff was getting ready to submit a grant application with the Met Council for the Elm Creek Boulevard Project at 169. Heidi Nelson, Ms. Nelson explained that the Council has her Monday report if there are any questions. She reported she would continue to City Administrator monitor activity at the Legislature regarding reopening and the potential for a bonding bill. She indicated the session is scheduled to end on May 18th but there is some talk of a special session in June. Adjourn to Motion by Councilmember Hanson, seconded by Mayor EDA Meeting Steffenson, to convene the EDA meeting. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson adjourned the City Council meeting to the EDA Meeting at 8: 54 p. m. Reconvene to Motion by Councilmember Hanson, seconded by Regular Councilmember Barnett, to reconvene to the regular City Council meeting. Upon call of the motion by Mayor Meeting Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson reconvened the regular City Council meeting at 9: 08 p. m. Items Added Councilmember Jaeger reported there would be a fly over the to the Agenda Maple Grove Hospital from the 148th Fighter Wing in Duluth and the 133rd Aircraft Wing from Fort Snelling. She explained the fly over would be held on Wednesday, May 6th from 11: 20 to 11: 35 a. m. Councilmember Jaeger thanked Parks Department staff for their Maple Grove City Council Minutes May 4, 2020 Page 17 efforts at the recent farmer' s market. She reported the next farmer' s market would be held on Thursday, May 14th Councilmember Leith reported a virtual 5K/ lOK would be hosted by the Lions Club on Saturday, May 16th. He indicated participants can chose to walk or run for this event. He encouraged residents to consider participating in this great community fundraising event. He stated those that participate would have until Sunday, May 31 st to submit their times in order to receive a medal and a t- shirt. Councilmember Leith stated he attended the annual meeting for the Fish Lakes Area Residents Association ( FLARA). He explained he learned a great deal about projects this group was working He reported this group sends their thanks to the on. City Council for the city' s continued support of the LIP program.
