Maple Grove City Council Meeting minutes November 6, 2023 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on November 6, 2023 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Mayor Mark Steffenson and Councilmembers Judy Hanson, Kristy Barnett, Kristy Janigo, and Rachelle Johnson. Absent was none. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; Vince Vander Top, Interim Public Works Director/City Engineer; Jupe Hale, Assistant Public Works Director/Assistant City Engineer; and Justin Templin, City Attorney. Mayor Steffenson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Recruitment approval for crime analyst Motion to authorize staff to begin the recruitment process for the crime analyst position in the Police Department due to the resignation of DeAnna Acker, which was accepted with an effective date of November 10, 2023. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS E. Chipotle Maple Grove planned unit development stage plan, preliminary plat, and final plat - Resolution No. 23-163 Motion to adopt Resolution No. 23-163 approving Chipotle Maple Grove planned unit development stage plan, preliminary plat, and final plat subject to: 1. Planned unit development agreement final review and approval of the city attorney and the director of community and economic development. F. Support for the acquisition of 15406 Territorial Road in the City of Maple Grove by Three Rivers Park District - Resolution No. 23-170 Motion to adopt Resolution No. 23-170 approving support for the acquisition of 15406 Territorial Road in the City of Maple Grove by Three Rivers Park District. ENGINEERING ITEMS G. Assessment cancellation Territorial Road interim improvements - Resolution No. 23-168 Maple Grove City Council Minutes November 6, 2023 Page 3 Motion to approve Resolution No. 23-168, cancelling three of the four properties identified as 04-119- 22-12-0003, 04-119- 22-14-0004, and 04-119-22-42-0009, based on the developer’s agreement for the Rush Hollow development. H. Deerwood Homes and Eagle Lake Area Street Rehab. Project No. 22-02 final acceptance Motion to approve the final acceptance of the Deerwood Homes & Eagle Lake Area Street Rehab Project No. 22-02 completed by Park Construction Company subject to the warranty provisions of the contract and statutory law. I. Edgewater on Cook Lake Project No. 18-23 Change Order No. 3 Motion to approve Change Order No. 3 to the Edgewater on Cook Lake Project No. 18-23 in the amount of $73,120.34. J. Elm Road Area Street and Utility Project No. 20-08 final acceptance Motion to approve the final acceptance of the Elm Road Area Street and Utility Project No. 20-08 completed by Northern Lines Contracting, Inc. subject to the warranty provisions of the contract and statutory law. K. Highway 610 Ext. Project No. 19-24 Coop. Construction Agreement No. 1053663 - Resolution No. 23-167 Motion to adopt Resolution No. 23-167 approving MnDOT Cooperative Construction Agreement No. 1053663 and authorizing its execution. L. MXD assessment cancellations - Resolution No. 23-169 Motion to adopt Resolution No. 23-169 cancelling special assessments that have been previously deferred and are now under contract or agreement and no longer are MXD deferred. M. Purchase of replacement park and rec. garbage packer truck Maple Grove City Council Minutes November 6, 2023 Page 4 Motion to approve the purchase of a 2024 TOMCAT eight-yard packer mounted on an ISUZU chassis. This is on Sourcewell contract # 091219-CRB. The contract price is $157,653.00. N. Water Quality Pond Maintenance Project Nos. 23-19, 23- 20, and 23-21 - Resolution No. 23-165 Motion to adopt Resolution No. 23-165 receiving the feasibility report, ordering Project No. 23-19 Maple Grove Addition Water Quality Pond Maintenance, Project No. 23-20 Meadowview Estates Water Quality Pond Maintenance, and Project No. 23-21 Sharp 2nd/Brown’s Duck Pond Water Quality Pond Maintenance, approving plans and specifications, and authorizing the advertisement for bids. O. Sureties - 11-06-23 Motion to approve surety actions. ADMINISTRATIVE ITEMS P. Amendment to consultant services agreement - architecture Community Center expansion and renovation project Amend the consultant services agreement with JLG Architects dated April 17, 2023 splitting the project into phases and modifying the compensation to reflect the phased delivery per AIA Document G802-2017, and to authorize execution by the parks and recreation director contingent on final review by the city attorney and parks and recreation director. Q. Lower potency cannabinoid products license for Total Wine and More Motion to approve a lower potency cannabinoid products license for Minnesota Fine Wines and Spirits LLC, dba Total Wine and More, 12795 Elm Creek Blvd N., Maple Grove, Minnesota for the period of 18 months or until retailers selling lower potency cannabinoid products are required to obtain a license from the State of Minnesota, whichever occurs first. Maple Grove City Council Minutes November 6, 2023 Page 5 The establishment is subject to compliance with all licensing requirements as outlined in section 10-37 of the Maple Grove City Code R. North Ambulance staging at Maple Grove Fire Stations Motion to authorize a 2-year lease agreement with North Memorial Health Care for the period December 1, 2023 through November 30, 2025 for a monthly fee of $400.00. Motion to authorize City Mayor Mark Steffenson and City Clerk Amy Dietl to sign lease agreement on behalf of the City of Maple Grove. S. Parkway Station 2023 license agreement with Three Rivers Park District Motion authorizing the mayor and city administrator to execute the 2023 license agreement between the City of Maple Grove and Three Rivers Park District for use of the Parkway Station on December 9, 2023. T. Purchase of replacement police special use vehicle for traffic unit Motion to approve the purchase of a 2023 Dodge Charger Pursuit V6 from Guardian Fleet Safety for the amount of $41,012.00. U. Approve claims Motion to approve claims totaling $ 8,505,952.76. Motion by Councilmember Barnett, seconded by Councilmember Janigo, to approve the consent items as presented. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Consideration of None. items pulled from the agenda Maple Grove City Council Minutes November 6, 2023 Page 6 Special business Open forum There were no open forum issues brought before the Council at this meeting. Public hearings Public hearing Assistant City Engineer Hale explained that Council previously received the feasibility report for Norsq Maple Grove Project Norsq Maple No. 23-22. Since that time, the feasibility report has been Grove Project No. revised to reflect a correction to the trunk assessments to 23-22 reflect grading and dedication of a portion of Garland Lane right-of-way, as well as a reallocation of benefit amongst the Resolution No. three parcels. The revised feasibility report is attached. The 23-162 cost of the improvements benefitting this development is estimated to be $2,839,812. Those costs, together with area trunk assessments of $346,349 result in a proposed total assessment of $3,186,161 for the Norsq Maple Grove, which equates to $7,057 per townhome unit, $7,359 per apartment unit, and $620,412 for the commercial parcel. Staff commented further on the proposed improvements, noting the project costs and recommended approval of the project. Motion by Councilmember Barnett, seconded by Councilmember Johnson, to open the public hearing. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Mayor Steffenson opened the public hearing at 7:32 p.m. and asked if anyone would like to address this issue. No public testimony was offered. Motion by Councilmember Janigo, seconded by Councilmember Barnett, to close the public hearing at 7:33 p.m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Motion by Councilmember Barnett, seconded by Councilmember Hanson, to adopt Resolution No. 23-162 ordering Norsq Maple Grove Project No. 23-22, ordering plans Maple Grove City Council Minutes November 6, 2023 Page 7 and specifications, and approving developer’s agreement, subject to final review by the city attorney and director of public works. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays. Motion carried. Community and economic development items Report on Community and Economic Development Director Hogeboom upcoming updated the Council regarding the following: community and economic  The Planning Commission will meet next on Monday, development November 13 where three items will be addressed. items  The Planning Commission will also meet on Monday, November 27 where the Bella Woods development will be considered.  Boston Scientific held a groundbreaking ceremony last week.  Staff welcomed Uffda Donuts and Pancheros to the City of Maple Grove. Engineering- public works items Report on Interim Public Works Director Vander Top updated the Council upcoming regarding the following: engineering  Staff commented on the cooperative agreement for TH610 items the Council approved noting the bid opening would be held on Thursday and work would begin with MNDOT in early March of 2024.  Staff was seeking utility disconnects and environmental permits before the Old Village Hall could be demolished.  Fall street sweeping would be completed in the next two weeks. She reported the administration Government Center would be closed on Friday, November 10 items in observance of Veteran’s Day. She invited the public to attend the Beyond the Yellow Ribbon Veteran’s Day event at Central Park on Saturday, November 11 at 11 a.m. Items added to None. the agenda Adjournment Motion by Councilmember Hanson, seconded by Councilmember Barnett, to adjourn to the regular City Council meeting on November 20, 2023 at 7:30 p.m. Upon call of the motion by Mayor Steffenson, there were five ayes and no nays.
