Maple Grove City Council Meeting minutes October 7, 2024 Call to order Pursuant to call and notice thereof, a regular meeting of the Maple Grove City Council was held at 7:30 p.m. on October 7, 2024 at the Maple Grove Government Center/Public Safety Facility, Hennepin County, Minnesota. Members present were Acting Mayor Judy Hanson, Councilmembers Kristy Barnett, Kristy Janigo, and Rachelle Johnson. Absent was Mayor Mark Steffenson. Present also were Heidi Nelson, City Administrator; Joe Hogeboom, Community and Economic Development Director; - Chris LaBounty, Public Works and Engineering Director; and Justin Templin, City Attorney. Acting Mayor Hanson called the meeting to order at 7:30 p.m. and led the city in the Pledge of Allegiance. Additions or Acting Mayor Hanson asked if there were any additions and/or deletions to deletions to the consent agenda to which Heidi Nelson stated the following: the agenda Item amended to the agenda None Item amended to the consent agenda None Item added to the agenda None Item removed from the consent agenda for discussion 3W. Work session meeting – September 16, 2024 B. Regular meeting – September 16, 2024 HUMAN RESOURCES ITEMS C. Appointment of combination plans examiner building inspector Motion to approve the hiring of Jason Bredenberg for the combination plans examiner/building inspector position in the Community & Economic Development Department. Subject to the successful completion of all pre-employment requirements and a 12-month probationary period. D. Appointment of police sergeant Motion to approve the hiring of Samantha Valerius for the police sergeant position in the Police Department. All pre- employment requirements have been completed. Subject to a 12- month probationary period. E. Approval of HealthPartners agreement and 2025 employer insurance contributions Motion to approve the multiyear health plan agreement with HealthPartners for group health insurance for 2025 and 2026 and approve the proposed employer contribution amounts. F. Recruitment approval for fire chief Motion to rescind September 5, 2024 Council action separating the Fire Chief, Tim Bush, and authorizing staff to enter into a Separation Agreement and Release of All Claims with both actions effective upon the expiration of the recission periods noted in the document without action by Mr. Bush in addition to authorizing staff to begin recruitment for the position of fire Maple Grove City Council Minutes October 7, 2024 Page 3 chief. COMMUNITY & ECONOMIC DEVELOPMENT ITEMS G. Minnesota Rural Electric Association freeway frontage development stage plan - Resolution No. 24-124 H. Norheim Maple Grove planned unit development concept stage plan amendment, development stage plan, preliminary and final plat Motion to adopt Resolution No. 24-124 approving the Minnesota Rural Electric Association freeway frontage development stage plan subject to: 1. Planned unit development agreement final review and approval of the city attorney and the director of community and economic development. I. Project Loon resolution of support - Resolution No. 24-133 Motion to approve Resolution 24-133 supporting the Minnesota Forward Fund application in connection with Project Loon. J. Rush Hollow Fifth Addition final plat - Resolution No. 24- 125 Motion to adopt Resolution No. 24-125 approving the Rush Hollow Fifth Addition final plat subject to: 1. The applicant addressing to the satisfaction of the city any remaining applicable comments contained in the memorandums from: a. The Parks & Recreation Department dated September 26, 2024 The applicant shall acknowledge that park dedication requirements are based on staff review and recommendation to the Park and Recreation Board and their subsequent board action. L. Agreement amendment to acquire additional easements for Territorial Road realignment Motion to approve amendment between the City of Maple Grove and Allen I. Dehn subject to final review and approval of the public works and engineering director and city attorney. M. Bridge conveyance to Three Rivers Park District Motion to approve agreement with the Three Rivers Park District for the conveyance of and cost participation for replacement of Bridge No 1934 – Ped Walk (Territorial), subject to final review and approval by the city attorney and public works/engineering director. N. Fire Station 3 Remodel Project No. 24-20 Establish project, order and approve plans, and authorize ad for bid Resolution No. 24-132 Motion to adopt Resolution No. 24-132 establishing the Fire Station 3 Project No. 24-20, ordering plans, approving plans, and authorizing advertisement for bids. O. Fuel dispensing system replacement Motion to approve proposal from Pump and Metro to furnish and install replacement fuel dispensing system. P. Main Street and Lakeview Drive Street Reconstruction Project No. 25-06 Resolution No. 24-126 Maple Grove City Council Minutes October 7, 2024 Page 5 Motion to adopt Resolution No. 24-126 establishing Main Street and Lakeview Drive Area Street Reconstruction Project No. 25-06 and ordering plans and specifications. Q. Parnassus School Zachary lot agreement amendment 2 Motion to authorize the mayor and city administrator to execute amendment 2 to the 2022 license agreement for the Zachary Park and Ride lot between the City of Maple Grove and Parnassus Preparatory School that extends the term to June 30, 2026. R. Rush Creek Stream Restoration Project No. 23-06 accept bids and award contract Resolution No. 24-128 Motion to adopt Resolution No. 24-128 accepting bids for Rush Creek Stream Restoration Project No. 23-06 and awarding the contract to Minnesota Native Landscapes of Otsego, Minnesota in the amount of $311,940.00. S. Senior citizen - permanently disabled assessment deferral annual renewal Resolution No. 24-123 Motion to adopt Resolution No. 24-123 approving the senior citizen/permanently disabled assessment deferral on 17 deferred properties for the 2025 tax year. T. Sureties - 10-07-24 Motion to approve the surety actions. ADMINISTRATIVE ITEMS U. Acting city administrator October 17-20 2024 Motion to approve Community and Economic Development Director Joe Hogeboom as acting city administrator effective Thursday, October 17, through Sunday, October 20, 2024. V. Joint powers agreement between Hennepin County and City of Maple Grove for social worker services Maple Grove City Council Minutes October 7, 2024 Page 6 Motion to approve and authorize the mayor, city administrator, and chief of police to execute the joint powers agreement between Hennepin County and City of Maple Grove for senior social worker services for the period of January 1, 2025, through December 31, 2026. W. Proclamation declaring October 2024 as Domestic Violence Awareness Month and recognition of community awareness events This item was removed by Acting Mayor Hanson for discussion. X. Proclamation Fire Prevention Week 2024 This item was removed by Councilmember Barnett for discussion. Y. Rice Lake emergency boat launch lease Motion to authorize a 10-year non-exclusive emergency boat launch lease with Richard and Joyce Drangeid for the period of October 1, 2024 to September 30, 2034 for a fee of $10.00. Motion to authorize City Administrator Heidi Nelson to sign the lease agreement on behalf of the City of Maple Grove. Z. Approve claims Motion to approve claims totaling $ 8,269,648.10. Motion by Councilmember Johnson, seconded by Councilmember Barnett, to approve the consent items as amended, removing items 3W (Proclamation declaring October 2024 as Domestic Violence Awareness Month and recognition of community awareness events) and 3X (Proclamation Fire Prevention Week 2024). Upon call of the motion by Acting Mayor Hanson, there were four ayes and no nays. Motion carried. Consideration The following items were pulled from the consent agenda. of items pulled Maple Grove City Council Minutes October 7, 2024 Page 7 from the Regarding Item 3W (Proclamation declaring October 2024 as agenda Domestic Violence Awareness Month and recognition of community awareness events), Acting Mayor Hanson stated October will be recognized as Domestic Violence Awareness Month in the City of Maple Grove. She reported this proclamation recognizes Maria’s Voice and their fifth annual community tribute as well as Maple Grove Police Department’s third annual domestic violence patch initiative. She discussed how the City of Maple Grove has pursued a purple lights initiative since 2017, which raises awareness to the issue of domestic violence. She explained domestic violence is a crime where a family member or an intimate partner engages in abusive behavior against a family member in order to gain or maintain power and control in the relationship. She indicated the repercussions of domestic violence can be felt throughout a community. She noted Maria’s Voice would be hosting its 5th Annual community tribute at Maple Grove Central Park on Thursday, October 10 from 5:30 to 7:30 p.m. She indicated the Police Department would also be showing its support through the third annual purple patch initiative. She reported members of the community can show their support by purchasing a purple patch or mug noting all proceeds would benefit Maria’s Voice. She commented further on the great work Maria’s Voice and DVAA were doing on behalf of the community to address domestic violence. She explained throughout the month of October there would be purple lights lit at Town Green and at the Maple Grove Police Department. Motion by Acting Mayor Hanson, seconded by Councilmember Janigo, to approve October 2024 as Domestic Violence Awareness Month in Maple Grove and recognize Maria’s Voice fifth annual Community Tribute to Domestic Violence Awareness Month at, the Maple Grove Police Department’s third annual Purple Patch Initiative, and Domestic Violence Awareness and Action’s work to prevent domestic violence since 2004; and their partnership with the City of Maple Grove in the Purple Lights Initiative since 2017, which raises awareness to the issue of domestic violence. Councilmember Janigo reported since Bill and Lissa’s daughter Maria Pew was killed by her husband in Maple Grove in 2020, Maria’s family took up the responsibility of educating the Maple Grove City Council Minutes October 7, 2024 Page 8 public on the signs of domestic violence through Maria’s Voice. She commented further on how valuable the partnership was the city had with Maria’s Voice and encouraged the public to consider attending the community tribute on Thursday, October 10 at 5:30 p.m. Upon call of the motion by Acting Mayor Hanson, there were four ayes and no nays. Motion carried. Regarding Item 3X (Proclamation Fire Prevention Week 2024), Councilmember Barnett reviewed the Proclamation to declare this week Fire Prevention Week in the City of Maple Grove. She reported Maple Grove was committed to ensuring safety and security for all of those living and visiting the community. She stated fire was a serious public health concern both locally and nationally, and homes are at greatest risk for fire. She explained home fires killed more than 2,700 people in the United States in 2022 and fire departments respond to more than 360,000 home fires each year. She stated roughly three of five fire deaths occur in homes with either no smoke detectors. She reported working smoke alarms cut the risk of dying in a fire almost in half. She encouraged residents to check their fire extinguishers and smoke detectors, noting smoke detectors only last ten years. Motion by Councilmember Barnett, seconded by Councilmember Johnson, to motion for Acting Mayor Hanson to proclaim October 6 – 12, 2024, as Fire Prevention Week throughout the City of Maple Grove. Upon call of the motion by Acting Mayor Hanson, there were four ayes and no nays. Motion carried. Special business Open forum Pastor Sarah Bunge, 7499 Walnut Grove LN N, explained she visited with the Council this summer to discuss the acreage she has in Maple Grove. She indicated there was interest in using this land for cannabis because this land was zoned Residential/Agriculture. Adam Bunge reported the acreage has out buildings, noting the land has been used for farming. He explained he was Maple Grove City Council Minutes October 7, 2024 Page 9 interested in bringing cannabis to this land in one or two of the out buildings. He requested city staff get back to him on whether or not this matter was still open for discussion. Community and Economic Development Director Hogeboom reported the Council passed a cannabis ordinance this summer that did not include provisions for producing cannabis in agricultural areas. Mr. Bunge questioned if the Council would consider an amendment to this ordinance to allow the farming of cannabis. Community and Economic Development Director Hogeboom stated he would speak with staff and would get back to Mr. Bunge on this matter. Police officer Police Chief Werner introduced Police Officer Nkua-Zoua or oath of office Nana Pa to the City Council noting she began her career with the Maple Grove Police Department as a community service officer in December of 2022 and was promoted to police officer in April of 2024. He reported Officer Pa has successfully completed her field training program and was assigned to solo patrol. Acting Mayor Hanson administered the oath of office to Police Officer Pa and welcomed her to the Maple Grove Police Department. Officer Pa’s badge was pinned on by her father and a round of applause was offered by all in attendance. Community and economic development items Report on Community and Economic Development Director Hogeboom upcoming updated the Council regarding the following: community  The Planning Commission will meet next on Monday, and economic October 14. development items  He explained Mama’s Happy would open on October 10, the Rally House would open on October 17, and Grackle would be opening on October 18. Maple Grove City Council Minutes October 7, 2024 Page 10 Engineering- public works items Report on Public Works and Engineering Director LaBounty updated the Council regarding the following: upcoming engineering  Damage occurred to the Elm Creek Boulevard/Brooklyn Boulevard bridge and MNDOT has decided to close this items overpass bridge for an investigation. It was noted the ramps would remain open. Administration items Report on City Administrator Nelson explained that the Council has her upcoming Monday report if there are any questions. She explained a City Council candidate forum would be held at the Government administration Center on Tuesday, October 8 at 6:30 p.m. She reported the items Park Board Tour was scheduled for Thursday, October 17 at 5 p.m. Items added to None the agenda Adjournment Motion by Councilmember Barnett, seconded by Councilmember Johnson, to adjourn to the regular City Council meeting on October 21, 2024 at 7:30 p.m. Upon call of the motion by Acting Mayor Hanson, there were four ayes and no nays.
