(7) PUBLIC COMMENT (TIME CERTAIN 10:00 A.M.) Greg Foley, resident inquired about regulations for fishing on beaches which detracts value of beach, and is not well controlled. Chair McCann stated fishing is allowed on beaches statewide. Gopher Tortoise - Rachel King Conservation Biologist (FWCC) Ms. Rachel King, Regional FWCC biologist gave presentation on Gopher Tortoise: Only land turtles slow growing to 50 yrs. of age Lay eggs all year round, females can lay eggs until die. Sometimes live in yards, burrows (350 species live in burrows), sometimes co-habitat with burrowing owls Like dry soil, eat vegetation Threatened in FL due to roadway moralities in Panhandle, they ate turtles. If develop land and tortoise on land, need permit for building for land owner, need site plan, land use map, soil, reservation letter and parcel identification. Will relocate tortoise and clear land. Inspect sites. Agent on island protecting tortoises. Member McChesney inquired when tortoise is relocated, does it go to reserve, not island. Markings from research project with permit, not being done. Member Eastman inquired if program to relocate is allowed on private property. There is option for on-site property, make sure relocation is safely protected. Vice Chair Lamb - Poaching in homes, turtle population decreasing, what can be done to protect? If see illegal happenings, call hotline to investigate. Site to bring tortoise is in Glades County with thousands of acres. Designate island property for tortoises is possible, minimum 40 acres. Can get waiver for a few acres, place to take tortoises to give them a home. Burrows are protected by state law, it's illegal. If seen, contact law enforcement. Most tortoises are on private land. Owls similar to tortoises, need to adopt program to protect them, some universities John Herman professor, Audubon, East City of Naples might be interested. Conservancy of SW Florida has research group with hospital. MI has Ordinance to protect species needing update. Reach out to Ms. King to incorporate information into new version ordinance. Val Simon, Coastal Breeze reported there are fines for disturbing burrows. Construction is misdemeanor, killing them is felony - 2nd degree misdemeanor. Need witness to come forward with video or photo. b. Migratory Bird Regulations - Wayne Fiyalko LCEC Risk Management Mr. Fiyalko, LCEC presented the following: Not limited to Eagles, relates to all species in territory Provide deterrence and Avian protection plan Corporate policy - plan to develop where concentrate efforts Nest Management Procedures - 3 eagle nests in MI with eggs do not remove, nest can be removed before completion. Bad nests - can cause outrages, danger to birds, Construction Design Standards - keep birds in protection (from lighting on pole) City of Marco Island Florida Page 2 Beach and Coastal Resources Meeting Minutes - Final March 21, 2018 Advisory Committee Bob Atkins, LCEC: Different species - 3 known eagles nests - Jamaica Court, ShadowRidge (electrocuted), 1 Tigertail - 2 issues electric and collision, Eagle wing span hits conductor, insulated wire structure with black covers on pole. Osprys nesting platforms moved off lines on poles. Two issues: nesting remove platforms (from nest) have higher mortality rate. Platforms put up in different locations were affected by Irma. Goodland has wood poles - woodpecker problems, nest same location year after year, replace with concrete poles. Poles are treated with chemicals to motivate woodpeckers move to another natural location. Mr. Fiyalko - Has program to build platform on private property. Can only allow decoy in easements to not interrupt power lines. Problematic if want to sell property. Call his office or search on-line for information. Sandra Palombo, Palm Court, resident - Add decoy to poles to deter nesting resulting in less electrical issues. (9) OLD BUSINESS Beach Steward Program - Training was in January 2017. John Nafgiger (beach steward volunteer) completed 120 hrs. on beach. Police Dept. and Environmentalist on beaches wearing labeled orange t-shirts trying to help educate public. Beach Steward Program: Chair McCann received list of names of possible beach stewards at last beach cleanup, add to City website, and help from Police Dept. Member McChesney - Fishing is allowed anywhere, fishermen need to be aware of beach goers, and use common sense for walkers. Outreach volunteer classes, City can send email blast to advertise. Vice Chair Lamb - add to Officer Clayton's observation for beach etiquette list. Public Comment: Nick Wagner, Marriott - Started Paradise Preserve Campaign by handing out biodegradable straws used at Marriott and flyers distributed to associates and restaurants. Marriott can partner with restaurants to receive information and purchase straws. Chair McCann - Ordinance approved by City Council March 19, 2018 to ban plastic straws on beachfronts. Hand out beach clean-up schedule to condo managers, add to City calendar, advertise on TV station. Beach clean up shirts were ordered from Gear Promotions. Next beach clean up date @ Tigertail - April 14th at 8:00 am. Committee clean up 8:00 a.m. at South Beach on May 5, 2018. Member McChesney - Received budget email, response due by April 30th to qualify for approval by City Council for $5000. Before next meeting need additional wish list for budget. Chair McCann - City Council needs breakdown - Sea Turtle, Owls, Tortoise wildlife updating species list. Member Eastman requested reveiwing previous history of expenditures for FY18 budget. She will request updated FY18 budget from Director Smith. Chair McCann - Burrowing Owl Program - donating $1,000 towards program for banding owls, budget is $5,000, spent $436. A MOTION was made by Member Ray McChesney, seconded by Vice-Chair Lamb,to donate $1,000 toward the burrowing owl program, that this be approved. Collier County Parks & Recreation only at Tigertail and South Beach. Vice Chair Lamb will check with Collier County Parks & Recreation (Barry Williams) on what is allowed and locations needing benches. MOTION by Vice-Chair Lamb, to support to update 01-34 Ordinance for wildlife protection from BchCRAC Mission Statement, seconded by Member Novak, that this be approved. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 6- Chair McCann, Vice-Chair Lamb, Member McChesney, Member Novak, Member ODonnell and Member Eastman Not Present: 1- Member Curiale MOTION by Vice Chair Lamb to support elimination of the mission to ban carry out plastic bags and other single use plastic to support elimination of the mission to ban, to get City wide, is on our goals, seconded by Member McChesney, that this be approved.
