ID 23-2749 Employee Service Awards:
Sergio Gomez - 20 Years
City Manager Mike McNees recognized and called forward City Employee Sergio Gomez to receive his
appreciation of service recognition certificate and pin as presented by City Council Chair Greg Folley. All
present offered a warm round of applause in recognition of Mr. Gomez's 20 years of service to the citizens
of Marco Island.
9. Citizens' Comments on Agenda Items Not Scheduled for Public Hearing and Items
Other Than Those Appearing on the Agenda
Ms. Janet Green (Manor Terrace) shared her family's discovery of a Marco Island burrowing owl that had
died from ingesting rat poison, and she requested that the Council help raise the community's awareness
to the dangers of using rat poison bait boxes to control the presence of palm rats around their homes.
Mr. Niels Jorgenson (N. Collier Blvd.) shared his experience and honor in assisting with the transport of
centenarian World War II veterans during the recent National Veterans Conference in Washington D.C.,
and he urged all of Marco Island's residents and guests to remember the courage and sacrifice of all of
America's veterans as the Veterans' Day Holiday approaches (November 11, 2023).
Mr. Martin Winter (Perrine Ct.) expressed his belief that the remuneration of Marco Island's City Councilors
is inadequate in relation to the service that they perform and the comparative compensation levels of other
nearby elected officials, and he offered a suggestion as to how this item might be proposed to the citizens
of Marco Island.
Motion To Allow for Remote Participation by Councilor Palumbo

Palumbo to participate in all matters coming before the Council at this meeting,

City Attorney Alan Gabriel swore in all parties who indicated an intention to provide witness or testimony,
and each Council member conveyed a verbal ex parte disclosure related to the Applicant's Appeal.

Community Affairs Director Daniel Smith briefly presented an overview of the proposed garage addition,
and he and Mr. H. Matthew Barhoum, Principal of Coastal Build LLC, addressed questions raised by

Public Comment
Mr. Tim H. Sykes (Abaco Ct.) raised concern with the character of the home and the size of the garage in
relation to the other homes in the immediate vicinity of it, and he requested that the Council consider his
observations and concerns in ruling on the Applicant's Appeal.

the City Council.
City Manager Mike McNees outlined the key elements of the proposed purchase, and he
briefly highlighted the process undertaken by the City to assess the value and the condition
of the utility's assets.
Councilor Joe Rola shared a presentation with the Council outlining a number of questions
and concerns, and his presentation precipitated substantial discussion between members of
the Council and with members with the City Staff.

City Finance Director Guillermo Polanco noted that Florida state statutes require that adjustments and
revisions to the previous fiscal year's budget be combined into a re-appropriation resolution for ratification
by the City Council as the final amended past fiscal year budget. He then read Resolution 23-58 into the
record by title only.

b. ID 23-3216 Close Out Report for the Vacation Rental Registration Program, Casey
Lucius, Ph.D., Assistant City Manager
Assistant City Manager Casey Lucius briefly summarized the history of the vacation rental registration
program, and she enumerated and summarized the various costs incurred by the City between the
Summer of 2020 and October, 2023. Various members of the Council offered their observations and
"lessons learned" from the experience.

Mr. Martin Winter (Perrine Ct.) shared his observations and disappointments relative to the enactment and

eventual voiding of Marco Island Ordinance 22-08, and he expressed his hopes and expectations for the
future.
c. ID 23-3228 Approval of an FY24 Budget Appropriation to Address an Increase in
Volume of Permitting, Fire Plan Review, and Fire Inspections Due to State
Statute Mandates and Identified Issues within the City’s Permitting
Process. Approval will Repurpose One Fire Inspector to Assume These
Duties. - Chris Byrne, Fire Chief, Fire-Rescue Department
Fire Chief Chris Byrne, in recognition of, and in response to, recent state mandates and revised permitting
review procedures resulting in approximately 500 more required fire inspections annually, requested that
the Council approve the re-purposing of one already employed, trained, and equipped fire inspector to the
Fire Rescue Department Fire Prevention Division to address the increased departmental workload.
Public Comment
Mr. Niels Jorgensen (N. Collier Blvd.) cited his experience as a New York City firefighter and Fire Rescue
Team leader in urging the Council to support Chief Byrnes' request.

Construction of Same at 1170 San Marco Road, in the Amount of
$134,046.71, Using the City Public Infrastructure Construction Services

Public Works Director Justin Martin outlined the unusable condition of the existing canal interconnect pipe
under San Marco Road, and he presented a drainage easement plan and proposed agreement with San
Marco Senior Living, LLC that could allow for the timely installation of a modern, up-to-date, canal
interconnect pipe that would not impede that property owner's on-going facility construction.

Water & Sewer General Manager Jeff Poteet reminded the Council of its approval of a permanent storage
facility for the City's sixty (60) emergency generators in the Water & Sewer Department's FY 2023 Capital
Improvement budget, and he was pleased to notify the Council of the State's 50% matching contribution
grant providing up to $600,000.00 toward the completion of the $1.2 million storage facility.

Councilor Brechnitz requested that the agenda item regarding the City Manager's FY 2023-24 Goals be
removed from the Consent Agenda so that he could propose a re-weighting of the City Manager's goal
regarding the FY 2024-25 City Budget from 20% to 25%, with a corresponding reduction in the weighting of
the Land Use and Permitting goal from 25% to 20%.

Councilor Rola requested that this item be removed from the Consent Agenda so that Water & Sewer
General Manager Jeff Poteet could explain and respond to his (Councilor Rola's) questions regarding the
City's process for identifying, replacing and auctioning off vehicles that have come to the end of their
useful service life. General Manager Poteet responded to Councilor Rola's questions.

14. Council Communications & Future Agenda
Councilor Irwin expressed appreciation to the citizen who raised the concern regarding the application of
rat poison bait boxes and their potential effects on protected species on the Island. Community Affairs
Director Daniel Smith confirmed that the City's Beach & Coastal Resources Advisory Committee is
reviewing and crafting recommendations on how the City can best address this issue.
Councilor Irwin also noted Marco island's recent recognition as the #1 safest city in Florida and, in addition
to thanking Police Chief Tracy Frazzano and her team, thanked Marco Island's visitors and guests for
contributing to the Island's recognition by respecting its laws and one another. She noted the statistics
reported in the Marco Island Police Department report showing that, though visitations to the Island are up,
civil and criminal incidents are down. Chair Folley supported and amplified upon Councilor Irwin's
observations.
Councilor Brechnitz requested an update from City Attorney Alan Gabriel on the status of the four lawsuits
that were brought forward in opposition to the recently voided short-term rental registration ordinance
(Ordinance 22-08). He also requested that the City Manager explain why the recently-issued notice
regarding re-zoning of the South Water Treatment Plant was not pursued as Conditional Use Exception
within an RSF (Residential Single-Family) Zoning District. City Attorney Gabriel and City Manager McNees
responded to Councilor Brechnitz's questions.
Vice-Chair Grifoni commended the City's Parks & Recreation Staff for the execution of its Halloween
Spooktacular event, and he recognized the Marco Island Police Department and the many volunteers who
contributed to a safe and fun environment for all of the trick-or-treaters around Tommie Barfield
Elementary School on Halloween evening.
Chair Folley echoed praise on all members of the City Staff who assisted in ensuring a safe Halloween
evening, and he asked Police Chief Tracy Frazzano to comment on the November "Lunch With The
Chief" event which featured members of the Regional INTERCEPT (Inter-Agency Child Exploitation and
Persons Trafficking) Task Force speaking on their work to identify and apprehend child predators and
traffickers in Southwest Florida. Chief Frazzano provided a brief verbal report.
Chair Folley also commended City Manager McNees on the well-attended "Roundtable Discussion" on
November 2nd with the Island's builders, contractors, and hospitality industry leaders regarding the City's
processes and procedures for supporting construction and property improvement activities on the Island.
City Manager McNees recognized and thanked several organizational leaders who assisted in making the
event a success.
Chair Folley concluded by requesting confirmation that the Council's requested review of the City's Code of
Ordinances was on the Council's Future Agenda. Assistant City Manager Casey Lucius confirmed that a
March 2024 date is planned for this review.
Councilor Palumbo reinforced the importance of the Council working together on matters affecting
residents, business owners, and visitors to Marco Island, and he recognized the great work that Councilor
Blonna and others successfully undertook to secure Conservation Collier's purchases of key property
parcels on Marco Island. [Editorial Note: see Agenda Item 15a]

15. Council Reports
a. ID 23-3226 Presentation - Conservation Collier Parcels - Councilor Rich Blonna
Councilor Blonna shared the presentation visuals that he reviewed with the Collier County Board of
Commissioners in support of Conservation Collier's proposed property parcel purchases on Marco Island,
and he highlighted unique elements of each property that contributed to its attractiveness to the leadership
of Conservation Collier. In all, parcels totaling three acres were purchased by Conservation Collier on
Marco Island in this most recent evaluation/purchase cycle.
Councilor Blonna thanked the many supporters who helped to secure Conservation Collier's recent action.

dedication in representing Marco Island's interests throughout the entire process.

b. ID 23-3229 City of Marco Island Support for the Healthcare Legislation Bill of Rights
and the Constitutional Sanctuary Bill of Rights - Chairman Greg Folley
Chair Folley shared his rationale for proposing a Health Freedom Resolution and associated Bill of Rights
Ordinance, and he invited his colleague Councilors to share their perspective on potentially bringing
forward a resolution and ordinance that closely mirrors similar declarations by the Collier County Board of
Commissioners.
Public Comment
Dr. Richard Shroeder (Naples) shared data from his practice and expertise as a medical doctor in support
of the proposed resolution.
Mr. Scott Kiley (Cutler Ct.) explained the tenets of the Health Freedom Resolution, and he expressed his
support for the protection of the rights and freedoms of all Americans.
Following the Council's discussion of the proposed Resolution and Ordinance, Chair Folley obtained
Council consensus to direct the City Attorney to draft an applicable Resolution and Ordinance that closely
aligns with the content and spirit of the Collier County decrees.
16. City Manager's Report
City Manager Mike McNees thanked the Council for allowing him the benefit of enjoying some recent paid
time off to rest, relax, and recharge before returning to his duties as City Manager.

City Attorney Alan Gabriel advised the Council of his outreach to Attorney Robert Pritt to ascertain Mr.
Pritt's interest in considering an employment agreement with the City to act as an additional Code

After some discussion among the Councilors, City Council Chair Folley obtained Council consensus to
direct the City Attorney to offer Mr. Pritt an employment agreement to supplement the City's roster of
Special Magistrates to preside over monthly Code Enforcement Hearings.
City Attorney Gabriel concluded by reminding the Council of an opportunity for Council members to fulfill
their State-mandated, annual Ethics Training requirement by participating in a Zoom teleconference
session with attorneys from Weiss Serota Helfman Cole + Bierman on Friday, December 8, 2023 from
9:00 AM - 1:00 PM.

Councilor Blonna pointed out the reference to the City's recently-acquired street sweeper and operator in
the Public Works Monthly Department Report, and he inquired about the status of hiring a full-time Storm
Water Engineer as well as the conditions when re-use water might be routed into the City's existing deep
injection wells. Public Works Director Justin Martin and Water & Sewer General Manager Jeff Poteet
responded to Councilor Blonna's questions.

Marco Island City Council Rules of Decorum
The City of Marco Island is committed to the First Amendment principal of free speech and to full
and open discussion of the City’s business in open forum. It also recognizes that in order to
ensure meetings of the City Council are conducted in a manner that allows the business of the
City to be effectively conducted, and ensures that members of the public can be heard in a fair,
impartial and respectful manner, that reasonable rules based on time, place, and manner of that
speech are in order. The members of the Marco Island City Council, employees of the City of
Marco Island, and citizen participants are expected to reflect proper decorum and treat each other
with courtesy and respect as follows:
• The City Council Chair is in control of the meeting at all times. The Chair is granted wide
discretion to interpret and enforce these rules of decorum and other City Council Policies and
Procedures.
• When recognized by the Chair, citizen participants will address all comments to the
Chair, speaking from the designated podium. No individual shall make slanderous, disparaging or
unduly repetitive remarks.
• Only those persons who have signed for a particular item of business will be given the
opportunity to speak. Exceptions may be granted at the sole discretion of the Chair.
• Demonstrations in the form of clapping, applauding, heckling or other verbal outbursts in
support or in opposition to a speaker during his or her remarks are not permitted. Such
demonstrations between speakers may be further limited by the Chair should they serve to disrupt
the orderly conduct of the meeting.
• For the safety of all in the chambers, signs, placards, or anything blocking sightlines,
