Roll Call Present: 6- Councilor Blonna, Vice-Chair Brechnitz, Councilor Folley, Councilor Palumbo, Councilor Rola and Chair Grifoni Not Present: 1- Councilor Irwin (Note: Councilor Irwin joined the Workshop beginning at 2:02 P.M.) Also Present Michael McNees, City Manager Casey Lucius, Assistant City Manager Joan Taylor, City Clerk David Tolces, City Attorney Tracy Frazzano, Police Chief (arrived at 2:04 P.M.) Business ID 24-3523 Municipal Code Audit Update - Jeff Katims, Complete Cities Chair Grifoni outlined the purpose of the Workshop, and he invited City-hired consultant, Mr. Jeff Katims, to review his proposed changes to the City of Marco Island Municipal Code in follow-up to his Municipal Code Audit that was initially reviewed in a City Council Workshop on April 24, 2023. Mr. Katims briefly reviewed the objective of the initiative, and he presented his recommendations to streamline, organize, and more effectively align the City's Code of Ordinances with existing State statutes and regulations. Through the course of the Workshop, Mr. Katims responded to a number of questions from members of the Council. The following summarizes the Council's direction to Mr. Katims and the City Staff: 1) Proceed with removing current provisions in the Code related to fees and fines; bring those before Council as Resolutions for annual Council review and approval; 2) Remove restatements of State regulatory and statute provisions currently included in the City's Municipal Code, and replace them with referencing citations to ensure ongoing, up-to-date alignment with those State regulations and statutes; 3) Retain sections related to the City's: a) investment policy; b) procurement policies and procedures; c) travel policies and procedures; d) provisions related to the administrative processing of development and redevelopment applications; and, e) post disaster redevelopment plan, Chapter 6, Article VI, within the City of Marco Island Florida Page 1 City Council Meeting Minutes - Final May 6, 2024 existing Municipal Code of Ordinances; 4) Proceed to include all proposed edits and additions as drafted in Sections 1 - 14, 18 - 26, and 32 - 54 of the Municipal Code of Ordinances with the exception of the following: a) Section 2-121 (6) : add "...member of the Board of Trustees of the Marco Island Community Parks Foundation ..." as a duty of the City Clerk; b) Section 4-10 (a) & (b) : remove the adjective "anatomically"; revert to using original language references for female, male, his, her; c) Section 18-211 : add "swale" to the definition of "watercourse"; d) Section 18-145 (3a), (3b), (4a) & (11c) : consult with the subject matter expert, such as FWC or Audubon contractor to determine if a more uniform protection zone around named, protected animal species is practical and can be specified in the Code e) Section 18-104(b)(2)(3): review timing aligned with decibel vs. audible reading within General Noise Prohibitions. 6) Proceed to engage with City Staff in preparing a proposal to audit and recommend modifications to Sections of the Municipal Code that were identified as "out of scope" in the initial Audit: Chapter 4, Alcoholic Beverages and Chapter 18, Article II, Environment . The Council also directed Mr. Katims and Staff to work towards completing all additions and modifications within six weeks from the date of this Workshop so that: 1) the Council may be provided at least 30 days to review the final recommended City of Marco Island Municipal Code and; 2) a First Reading of the updated Municipal Code of Ordinances is provided at the July 22 City Council Meeting. 4. Public Comment No members of the public came forward to offer comment. 5. Marco Island City Council Rules of Decorum The City of Marco Island is committed to the First Amendment principal of free speech and to full and open discussion of the City’s business in open forum. It also recognizes that in order to ensure meetings of the City Council are conducted in a manner that allows the business of the City to be effectively conducted, and ensures that members of the public can be heard in a fair, impartial and respectful manner, that reasonable rules based on time, place, and manner of that speech are in order. The members of the Marco Island City Council, employees of the City of Marco Island, and citizen participants are expected to reflect proper decorum and treat each other with courtesy and respect as follows: • The City Council Chair is in control of the meeting at all times. The Chair is granted wide discretion to interpret and enforce these rules of decorum and other City Council Policies and Procedures. • When recognized by the Chair, citizen participants will address all comments to the Chair, speaking from the designated podium. No individual shall make slanderous, disparaging or unduly repetitive remarks. • Only those persons who have signed for a particular item of business will be given the opportunity to speak. Exceptions may be granted at the sole discretion of the Chair. • Demonstrations in the form of clapping, applauding, heckling or other verbal outbursts in support or in opposition to a speaker during his or her remarks are not permitted. Such demonstrations between speakers may be further limited by the Chair should they serve to disrupt the orderly conduct of the meeting. • For the safety of all in the chambers, signs, placards, or anything blocking sightlines, entrances, exits or aisles in the City Council Chambers are not permitted. • No more than one person may stand in the aisles or at the dais. Individuals waiting to be recognized shall wait in an area designated by the City. Persons exiting the council chambers shall do so quietly. • Anyone who violates these Rules of Decorum may forfeit their right to speak and may be asked to leave or cease their public comment at the discretion of the Chair. Citizen Comment on Consent Agenda Items • Items listed under Consent Agenda are viewed to be routine and the recommendation will be enacted by one motion. If discussion is desired by the Council, the item(s) will be removed from the Consent Agenda and will be considered separately.
