(2) ROLL CALL Present: 4- Member Delawder, Chair Freeman, Vice-Chair Barto and Member Zinkan Absent: 1- Member Fernstrum (3) APPROVAL OF AGENDA (It is is noted for the record, the first item was business was the Candidate Interviews after the approval of the agenda.) Vice-Chair Barto suggested adding a discussion topic on organizational structure under Committee Communications and the Members concurred. Chair Freeman suggested Mr. Gene Siegel speak under Item 5-c (Discussion regarding water discharge issues) and the Members concurred. MOTION by Vice-Chair Barto, seconded by Member Zinkan, to approve the Agenda as amended. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 4- Member Delawder, Chair Freeman, Vice-Chair Barto and Member Zinkan Not Present: 1- Member Fernstrum (4) APPROVAL OF MINUTES ID 18-045 Hideaway Beach Tax District Meeting Minutes of January 18, 2018 Mr. Michael Poff commented on the following corrections regarding his report: First, on page 4, 4th paragraph: we are not attempting to locate the permits for the Master Plan; my suggestion was Hideaway attempt to locate them and Dick has been working on this. The minutes now read: "Mr. Poff asked if this outfall was grandfathered in and it would be helpful in locating the permits for the Master Plan for Hideaway Beach." Second, on page 4, 6th paragraph, the dimensions should be 300 ft x 100 ft x 12 inches (or 1 ft) and the volume should be approximately 1,100 cubic yards (vs 11,000 cubic yards) and this has been corrected. MOTION by Member Zinkan, seconded by Member Delawder, to approve the January 18, 2018 Hideaway Beach Tax District Meeting Minutes as amended. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 4- Member Delawder, Chair Freeman, Vice-Chair Barto and Member Zinkan Not Present: 1- Member Fernstrum City of Marco Island Florida Page 1 Hideaway Beach Tax District Board Meeting Minutes - Final February 28, 2018 (5) COMMUNICATIONS a. Discussion with Attorney Candidates Vice-Chair Barto provided background information and advised there were three (3) attorneys invited to participate in today's interviews; Mr. Clay Brooker, Mr. Craig Woodward and Mr. Richard Yovanovich. In attendance were Mr. Clay Brooker and Mr. Craig Woodward. Interviews were conducted and each candidate provided their experience and answered the Board Members questions and concerns. Following the interviews, the Board Members engaged in discussions and voted unanimously (Board Member Fernstrum was absent) to appoint Mr. Craig Woodward to represent Hideaway Beach Tax District. (It is noted for the record, during the interview Mr. Craig Woodward remarked on his fee structure. He would send a detailed bill out monthly at a rate of $300.00 an hour for himself and Mr. Tony Pires and a rate of $250.00 an hour for Ms. Lenore Brakefield.) Vice-Chair Barto questioned who would notify the candidates with the results and Public Works Director Tim Pinter advised him, he would send out letters to each of the two (2) attorney candidates on behalf of the Board Members. Mr. Pinter clarified the organizational structure between the City and the committee. He advised the Board Members that he acts as the liaison between them and City and City Council. The City provides staff support to take minutes but the Board Members are responsible for what they do within their Board. If the Board submits a draft document to forward to the City, then the City will transfer that document to the City's letterhead for the City Manager's signature, e.g, applications, permits. MOTION by Vice-Chair Barto, seconded by Member Delawder, to accept Mr. Craig Woodward's Law Firm to represent the Hideaway Beach Tax District. MOTION CARRIED BY THE FOLLOWING VOTE: Yes: 4- Member Delawder, Chair Freeman, Vice-Chair Barto and Member Zinkan Not Present: 1- Member Fernstrum b. Discussion with Collier Creek Contractor Chair Freeman disclosed the Collier Creek Contractor did contact him and offered to give them the sand which is being removed from Collier Creek to assist in the lower areas of Hideaway Beach, particularly in front of the clubhouse. The parties agreed upon delivery of the sand by not utilizing trucks and without fee; however the sand is not screened and not of beach quality; therefore for those reasons, Hideaway declined using the sand. The sand will now be taken to a landfill. c. Discussion regarding Water discharge issues Mr. Gene Siegel, President of Hideaway Beach Board of Directors held a discussion on the discharge of water across the beach and wanted to go on record to to advise the City of Marco Island and Hideaway Beach Tax District that there is a Master Drainage Plan that has been in place since 1979 with the approval and support of the Southwest Florida Water Management District (SWFWMD). He introduced Mr. Lou Rana, Vice-President of Hideaway Beach Board of Directors and Mr. Tom Ryan, Grounds Maintenance Executive Keeper of Hideaway Beach to continue the discussion. City of Marco Island Florida Page 2 Hideaway Beach Tax District Board Meeting Minutes - Final February 28, 2018 Mr. Lou Rana thanked Hideaway Beach Tax District for doing an excellent job and provided background information. He advised his purpose for attending today's meeting is to request that for all future plans that include beach changes or nourishment, that Hideaway Beach Tax District incorporate documentation that is in their present permit with the SWFWMD. He is asking the engineering group (Coastal Engineering) to go over the specifications in the documents and incorporate the modifications of the beach that allow for stormwater flow as outlined in the permits. Mr. Pinter advised per an edict received from the Environmental Protection Agency (EPA), there is no discharge allowed into the Gulf of Mexico from the boundaries within the city limits of Marco Island. Research needs to be conducted on the current permit issued by SWFWMD because it may be trumped by Florida Department of Environmental Protection (DEP) or Army Corp of Engineers (USACE). Mr. Michael Poff commented notification should be made to DEP to advise them of what the plan is for the outfall and the beach plan and secondly, the recommendation from Coastal Engineering to raise berm on Hideaway Beach up to six (6) inches to accommodate that sand that's in the spit. Member Delawder commented on his experience in working with the EPA. He said the two (2) methods they use are settlement ponds and marshlands. It is he opinion that the lakes on Hideaway Beach are considered to be settlement ponds. He went on record to say Hideaway Beach has these already set up. Following discussion, it was determined for all parties to work together to find a solution that will show the plans for the beach that do not impede on the drainage system of Hideaway and the parties will share documents that they have with each other. Hideaway Beach will make their engineer (Mr. Martin Pinckney) available for discussions after the permits are reviewed. (THE MEETING WENT INTO RECESS AT 3:37 P.M. IT IS NOTED FOR THE RECORD THE SAME BOARD MEMBERS WERE PRESENT WHEN THE MEETING RECONVENED AT 3:47 P.M.) (6) REPORTS a. Financials - Member Delawder ID 18-094 Revenue and Expense Report Member Delawder commented there has not been a big change since last month in the financials. Mr. Pinter advised them they have 1.8 million available cash on hand. MOTION by Vice-Chair Barto, seconded by Member Delawder, to approve the financials. Bird Monitoring - Ms. Nancy Richie ID 18-114 Shorebird Report Island Environmental and Marine Specialist Nancy Richie provided the Board Members an update on the shorebirds. She advised them that last month was very quiet. The tip is growing in two (2) directions; north and towards Hideaway's beach. She reminded the Members the 2016 permit expires on May 15, 2018. Mr. Poff noted bird monitoring services will be required for the modification permit. (7) PRESENTATIONS a. Coastal Engineering - Mr. Michael Poff President at Coastal Engineering Consultants Michael Poff engaged in earlier discussions and answered the Board Member's questions and concerns. b. Humiston and Moore Engineering - Mr. Brett Moore Mr. Mohamed Dabees provided an updated presentation and answered the Board Member's questions and concerns. He commented that Turrell, Hall and Associates has finished their ecological report and also collected water level in the lagoon which he would like to add that data to their analysis before finalizing it. The executive summary will be ready for the Board Members to review at the March meeting. (8) PUBLIC COMMENT Mr. Ben Farnsworth, 1208 Edington Place, President of Villa De Marco West Condominiums, commented on Collier Creek and the flow of sand. It suggested moving the jetty so that it is adjacent to Hideaway's property. Ms. Debbie Roddy, Vice-Chair of Collier County Coastal Advisory Committee, advised the study is underway and the results should be in this summer. (9) NEXT MEETING DATE The next meeting date is scheduled for March 22, 2018 at 2:00 P.M. The tentative April meeting date is April 11, 2018 at 2:00 P.M.
