(2) ROLL CALL Present: 4- Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan Absent: 1- Vice-Chair Barto Also Present City Council Chairman Erik Brechnitz David Tolces, Attorney, Weiss, Serota, Helfman, Cole & Bierman Mohamed Dabees, Vice President & Senior Coastal Modeler, Humiston & Moore Engineers Michael Poff, President, Coastal Engineering Consultants, Inc. City Staff: Timothy Pinter, Director of Public Works Lina Upham, Purchasing & Risk Manager Martin Luna, Video/Broadcast Technician Tracey Barnett, Administrative Assistant, Public Works (3) PLEDGE OF ALLEGIANCE Led by Chair Delawder. (4) APPROVAL OF THE AGENDA Approved with the following change move Old Business c. to after g. to accommodate Mr. Poff who had a prior commitment and would be arriving late to the meeting. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 4- Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (5) APPROVAL OF THE MINUTES ID 21-1879 Approval of the Minutes from HBTDB meeting on 10/14/21 MOTION by Member Ryan, seconded by Member Fernstrum, that the Meeting Minutes of October 14, 2021 be Approved. City of Marco Island Florida Page 1 Hideaway Beach Tax District Board Meeting Minutes - Final November 10, 2021 (8) PRESENTATIONS None. (9) OLD BUSINESS a. Erosion of Beach 6000 Building - Member Fernstrum ID 21-1966 Erosion of Beach 6000 Building The Board discussed the erosion of the beach at the 6000 building, and that it seems to be diminishing rapidly. Perhaps a renourishment plan would help, but the expertise of Mr. Dabees or Mr. Poff may be required identify the best solution. An estimate is needed for a plan, but nothing is in the budget at this time. b. Inland Over Wash During Last Storm - Member Ryan ID 21-1967 Inland Over Wash During Last Storm A video taken on October 30th during the last storm, and shared by Member Ryan, showed Sand Dollar Island being completely covered by water and washing sand into the lagoon. The seagrass is mostly gone in the channel and the Manatees are not able to feed. At low tide, the Manatees are starting to get stranded on the beach. c. Report Upcoming Permits- Michael Poff ID 21-1968 Report Upcoming Permits Mr. Michael Poff, updated the Board that he has the draft permit in hand from the Department of Environmental Protection with some new permit conditions that are required. He also noted that the erosion at the 6000 Building had recovered in the past and, perhaps in time, it will recover naturally. With the permits now in hand, the Board can move sand from an accretional area to an erosional area, truck in sand, or pump sand from the bar area in the same construction area and then truck it to the 6000 location. Mr. Poff's suggestion was to wait at least until the next meeting to see if there are any changes, better or worse, and make a determination at that time. d. Report Upcoming Permits- Mohamed Dabees ID 21-1969 Report Upcoming Permits Mr. Dabees reported that Humiston & Moore is monitoring the over wash at Sand Dollar Island. An update on the permit status is complete, but still awaiting approval. More requirements and questions have been raised by the State and the Fish and Wildlife Commission, which H & M is continuing to address. The work preferably needs to be done around the bird and turtle nesting seasons, pushing the project to possibly next November to accommodate this. e. View Video of Chair Delawder and Member Ryan Pertaining to Renourishment of Beach City of Marco Island Florida Page 2 Hideaway Beach Tax District Board Meeting Minutes - Final November 10, 2021 ID 21-1970 New Video Pertaining to Renourishment of Beach The Board viewed the proposed internal communications video to the residents of Hideaway Beach on the project. With the approval from the Board of the Hideaway Beach Association, the video will be released immediately after that meeting. Additional external communication will be distributed after the FDEP approval to City Management, The City Council, and then posted to Facebook. An informational update will also be sent to State Senators and Representatives as well. f. City of Marco Beach Renourishment Update ID 21-1971 City of Marco Island Beach Renourishment Update None. g. ID 21-1965 Approval of Weiss Serota Helfman Cole & Bierman, P.L as Hideaway Beach Tax District's Attorney Mr. David Tolces shared his qualifications as a partner with the Weiss Serota Firm. The Board discussed changing it's meeting day to Fridays to accommodate Mr. Tolces since he is also is the attorney for the City's Planning Board. A motion to approve Mr.Tolces as the new HIdeaway Beach Tax District Attorney was put foward. MOTION by Member Ryan, seconded by Member Zinkan, to Approve Weiss, Serota, Helfman, Cole & Bierman as the Hideaway Beach Tax Districts attorney. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 4- Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan MOTION by Member Zinkan, seconded by Member Fernstrum, authorizing Mr. Timothy Pinter to spend up to $15,000 per calendar year for legal services. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 4- Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (10) NEW BUSINESS None. (11) COMMITTEE COMMUNICATIONS a. Confirmation of Board Members Availability for the Next Meeting. The Board decided after discussion that the next meeting will be on Wednesday December 15th at 1:30 P.M. Beginning in January, the Board will meet on the first Fridays of the month for the 2022 Calendar Year. As a result, the first Board Meeting of the new year will be on Friday January 7th, 2022 at 2:00 P.M. b. Sharing of Thoughts on Topics of Board Interest (All Members) None. (12) ADJOURNMENT There being no further business before the Board, Chair Delawder adjourned the meeting at 3:41 P.M.
