(2) ROLL CALL Present: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan Also Present David Tolces, Attorney, Weiss, Serota, Hoffman, Cole & Bierman Mohamed Dabees, Vice President & Senior Coastal Modeler, Humiston & Moore Engineers Michael Poff, President, Coastal Engineering Consultants, Inc. Tim Hall, Senior Ecologist/ Principal, Turrell Hall & Associates, Inc. City Staff: Timothy Pinter, Director of Public Works Martin Luna, Video/Broadcast Technician Tracey Barnett, Administrative Assistant for Public Works (3) PLEDGE OF ALLEGIANCE Led by Chair Delawder. (4) APPROVAL OF THE AGENDA MOTION by Vice-Chair Barto, seconded by Member Fernstrum that the Agenda be Approved. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (5) APPROVAL OF THE MINUTES ID 22-2058 Approval of the Minutes Member Ryan asked that the last line on item 11b. be changed from "Member Ryan" to "Member Fernstrum" reported. MOTION by Vice-Chair Barto, seconded by Member Ryan that the Minutes be Approved as Amended. MOTION CARRIED BY THE FOLLOWING VOICE VOTE: Yes: 5- Vice-Chair Barto, Chair Delawder, Member Fernstrum, Member Ryan and Member Zinkan (6) STAFF COMMUNICATIONS a. Near Shore Borrow Area Expansion Monitoring Survey Proposal (Poff) ID 22-2147 Near Shore Borrow Area Expansion Monitoring Survey Proposal Mr. Michael Poff, advised the Board that the State had issued the DEP permit. He was still waiting on the U.S. Corps of Engineers permit, but since it secondary to the permit for Tigertail Lagoon Project, he is not pushing the Corps of Engineers to complete it. Member Ryan brought up the possibility of adding more City of Marco Island Florida Page 1 Hideaway Beach Tax District Board Meeting Minutes - Final March 7, 2022 sand by the 6000 building. Mr. Poff indicated it would be very expensive to truck in sand, so he recommended that it be included as an option in the bid package item during the construction. He also suggested stock piling sand and moving it where needed. There was no update on the Collier Creek Project by the County. Mr. Pinter advised the Board that a Motion and Vote were needed for the third year fiscal monitoring survey scope of work in the amount of $49,950. MOTION by Member Zinkan, seconded by Vice-Chair Barto that third year fiscal monitoring survey scope of work for $49,950 be Approved. Tigertail Lagoon/ Sand Dollar Island Budget Review/Timeline (Dabees) ID 22-2148 Timeline and Budget Costs Mr. Mohamed Dabees advised the Board that the final state DEP permit was received on 2/11/22. He noted that we are still waiting for the U.S. Army Corps of Engineers permit. Humiston & Moore received communication from the Florida Wildlife Service (FWS) that the biological opinion is finalized and is pending a final signature, which is expected this week. The State DEP permit and the FWS biological opinion are what is needed for the processing of the Army Corps permit. We are on track to get permits in time for construction to begin on November 1st. One condition for the state DEP permit was noted. Before construction can begin, an incidental take permit from Florida Fish & Wildlife Conservation Commission (FWC) is required for state listed species that are not covered in the FWS biological opinion. Mr. Dabees mentioned that the incidental take permit application was received by FWC but subsequently there was a request for additional information (RAI). Mr.Tim Hall, from Turrell Hall & Associates explained that the original submittal was based on the latest conditions, and the request was for a five year average estimate of the potential impact of changing the acreage by the proposed plan. Mr. Hall noted that, once the information is submitted and there are no more questions forthcoming, the permit is deemed "a complete file" and the permit will be issued within 90 days, if approved. Mr. Dabees shared an updated version of his budget with more consolidated descriptions and an expected contingency of 15%. Some of the expenditures are completed, such as tasks for the permitting and pre-construction services. Some are estimates which are subject to a bidding process that can exhibit a wide range of uncertainty. The budget estimated for the initial project has adequate stability and is designed to hold for a number of years. If the bids are within the budget that H & M currently has, then it would be advantageous to build more resiliency into the design. But if the bids are higher than the budget, then H & M will have to scale back the project to adhere to the available budget. c. Pre-Construction Environmental Services Proposal (Dabees) ID 22-2151 Environmental Services Proposal Mr. Pinter explained that there was a discrepancy in Humiston and Moore's proposals based on work from Turrell Hall & Associates. causing an error in the total. After corrections, the total should be $42,165. MOTION by Member Zinkan, seconded by Member Ryan that the Pre Construction Environmental Services Proposal from Humistan & Moore for $42,165. be Approved. Resolution Discussion (Pinter) ID 22-2153 Resolution Discussion Mr. Pinter communicated that the City Council approved the resolution on 2/22/22 to allow the Board and the District to request up to 2.6 mils. He also advised that the Referendum will be going before the HIdeaway Beach electorate on 8/23/22. Subsequent to that, there will be an inter-local agreement between the Board and the City that will need to be executed. Member Ryan shared her proposed communications plan and a draft script for the video to the Hideaway Beach members. She asked the Board members for their recommended suggestions and changes. Also discussed were dates of completion and when to conduct presentations with each condo association board and member body as to inform all residents of Hideaway Beach. Each Board Member accepted the task of attending at least one meeting to share the presentation. (7) PUBLIC COMMENT None. (8) PRESENTATIONS None. (9) OLD BUSINESS a. Financials (Fernstrum) ID 22-2154 Financial Report Member Fernstrum shared the financials with the Board and expressed concern that there may not be enough money to complete the project. The Board had considered requesting a loan of $700,000 from the City but never pursued it. It is now, past the deadline set by the Marco Island City Council. The Board discuss the possibility of going back to the City Council to request the loan, this will be discussed further at the next meeting. (10) NEW BUSINESS a. Board Vacancies (Barto) ID 22-2155 Board Vacancies Vice-Chair Barto reminded the Board that there are staggered terms for Board Members. This year, Member Zinkan and Member Fernstrum's terms are up. Reappointments need to be communicated back to the Board at Hideaway, so that it can consider re-nominations to the marco Island City Council. Member Fernstrum and Member Zinkan acknowledged that they would be interested in being considered for reappointment to the Hideaway Beach Tax District Board. (11) COMMITTEE COMMUNICATIONS City of Marco Island Florida Page 3 Hideaway Beach Tax District Board Meeting Minutes - Final March 7, 2022 a. Confirmation of Board Members Availability for the next Meeting April 1, 2022 at 1:30 P.M. The Board decided to next convene on April 4, 2022 @ 1:30 P.M. Also, a tentative meeting was placed on the Calendar for May 13, 2022 @ 1:30 P.M. b. Sharing of Thoughts on Topics of Board Interest (All Members) Member Ryan updated the Board on meetings and interviews going on in support of the project. She also shared the video produced by Denny Shields, and she commented on the changes and conditions of the lagoon, and the status of the permitting.
